Within the United States there is a long history of immigration and citizenship law and policy being shaped by the idea that certain immigrant populations are a threat to American society. Such ideas justified the Alien and Sedition Acts, the Chinese Exclusion Act, the enactment of new deportation grounds in 1917, and the adoption of national origin quotas in 1924. The repeal or revision of these laws has required discrediting the immigrant threat narratives justifying them. Immigrants have done this by demonstrating their respectability—their commitment and adherence to mainstream American values, norms, and practices. Scholars in the humanities and the …

The "Blurred Lines" Of Copyright Law: Setting A New Standard For Copyright Infringement In Music, Joseph M. Santiago

In 2014, rock legends Led Zeppelin were sued by a relatively obscure band, named Spirit, for copyright infringement over the use of their iconic 1971 song “Stairway to Heaven.” Just a year before, musicians Robin Thicke and Pharrell Williams found themselves in the same position over their hit song “Blurred Lines.” Both cases, tried in the Ninth Circuit through the same signature “extrinsic/intrinsic” infringement analysis, had different outcomes—Led Zeppelin was victorious, while Thicke and Williams lost. These differing outcomes help to accentuate the problem with applying the typical copyright infringement tests—ones used for any type of artistic medium—to music. Music …

The music industry appears to be thriving with constant record breaking sales and more ways to listen to music than ever before. But behind the scenes, government regulation has struggled to adapt to changes in the industry, leaving industry players uncertain of the bounds of copyright. Decades ago, the two most prevalent Performing Rights Organizations—entities that collect royalties for songwriters and publishers based on public performances of their musical compositions—in the United States, ASCAP and BMI, entered into consent decrees to assuage antitrust concerns. With foreign economic espionage and national security concerns thrust to the forefront of the discussion, Congress nearly unanimously passed the Defend Trade Secrets Act after a concerted effort by the executive branch, federal law enforcement, and intellectual property scholars. While this landmark legislation provides the long sought-after grounds of original federal jurisdiction for trade secret misappropriation claims, the statute also offers litigants a powerful remedy—the ex parte seizure provision. A militia right or an individual right? In District of Columbia v. Heller, the Supreme Court of the United States declared that the Second Amendment protects an individual’s right to a firearm outside the context of a militia. While pronouncing the individual right to a gun as fundamental, the Court declined to define an appropriate standard of review to assess firearm regulations. Thus, the Heller decision opened the floodgates for legal challenges to firearm regulations across the nation. Digital sampling of sound recordings itself has become an art—an art that has given rise to hit songs that have out-charted the songs they sampled. Yet there is a debate within the music industry and legal field over whether there is a de minimis exception for the unauthorized use of sound recordings. In the summer of 2016, in VMG Salsoul, LLC v. Ciccone, the Ninth Circuit departed from the Sixth Circuit’s unpopular 2006 decision in Bridgeport Music, Inc. v. Dimension Films by holding that the Copyright Act allows for a de minimis exception for the unauthorized use of sound recordings. …

Data Snapshot: 2.1 Million More Childless U.S. Women Than Anticipated, Kenneth Johnson

In 2016, there were 2.1 million more childless women of prime child-bearing age than anticipated. The 19.5 million women age 20–39 in 2016 who had never given birth was 12 percent more than demographers would have expected given child-bearing patterns just before the Great Recession. In 2016, there were 7 percent more women 20–39 than ten years earlier, but 22 percent more who had never had a child.

The mental health needs of college students have risen dramatically. According to Kitzrow (2003), an estimated 84% of students who walked into a school counseling centers show significant causes for concern. These students were at high risks because of a variety of psychological distress. The current study sought to understand the multidimensional impact of mental health concerns on students' academic adjustment. Undergraduate students from a northeast public university completed an online survey that comprised of demographic information and two Likert type scales that measured psychological distress and academic adjustment. The purpose of our study was to better understand the role of gender performance for aspiring school leaders through a reflection of their journey through the administrative pipeline. The transformation of professional aspirations throughout and following the certification process and during employment was also analyzed. Also, the appealing factors of a nontraditional administrative preparation program were evaluated. Using heuristic qualitative methods, women graduates of and expedited certification for educational leadership program participated in focus groups and a select group returned for individual interviews. Each year in the United States, thousands of individuals are released from prisons and must reintegrate into society. Ensuring these individuals obtain adequate employment upon release is key to keeping them from returning to the penal system. This paper examines different social work programs that attempt to secure employment for ex-offenders. This paper reviews the obstacles these programs face and considers how social workers can improve the effectiveness of these programs at preventing recidivism. This Independent Practitioner Inquiry Capstone (IPIC) aims to provide relevant information, from a Peace Corps (PC) Volunteer (PCV) standpoint, on a renovation project that was implemented in the village of Vorniceni, Republic of Moldova. At its core, this was a community development project that involved the active participation of the community of Vorniceni, providing local resources and knowledge towards the goal of building a healthier sanitation facility on the second floor of the local kindergarten.

Journal of Marketing and Consumer Behaviour in Emerging Markets

The purpose of this study is to test whether the influence of satisfaction and reputation on repurchase intention varies among analytic and holistic thinkers. We employed an individual level approach to measure cross-cultural differences regarding thinking style and other variables. We made a cross-cultural comparison via analyzing the effects of satisfaction and firm reputation on repurchase intention, using data from the USA and Turkey that reflect analytic and holistic thinking cultures, respectively. Also, we conducted intra-cultural analyses in which the USA data and Turkish data were analyzed separately. Findings from these analyses revealed that holistic and analytic thinking styles create …

A common need for students is scheduling events efficiently. Students using various methods for scheduling events. Some prefer a physical paper calendar, while others prefer to use a mobile device. Several problems can occur when students schedule events. For example, it may not be clear when a student’s free time periods are, especially when trying to meet with a team or group members. Also, user’s preferences are different on how they schedule events.

Fundations: A Systematic, Research-Based Program To Support Students With Dyslexia Through Tier 1 Instruction, Clarie C. Innocenti

This study explored whether students with dyslexia can be supported through Tier 1 intervention in the general education setting. The school researched in this study chose to purchase a research-based program, FUNdations, which can be implemented at Tier 1, 2, or 3, to support students with language-based disabilities, including dyslexia. Students identified with dyslexia require explicit instruction in phonics and decoding skills. As the Dyslexia Center for Utah (2014) reports, dyslexia is a common language-based disability, affecting one in five learners.
