The Foreword reviews Professor Cross' legacy of work as a tribal attorney on behalf of the Three Affiliated Tribes (Mandan, Hidatsa, and Arikara) of the Fort Berthold Reservation and discusses the important contributions his scholarly work continue to make to the field of Federal Indian Law. As noted at the conclusion of the Foreword, "[i]t is a true honor to introduce and present some of his important …
A Practitioner's Guide To Urban Trip Generation, Kristina Marie Currans
A Practitioner's Guide To Urban Trip Generation, Kristina Marie Currans
TREC Project Briefs
In 1976, the Institute of Transportation Engineers (ITE) compiled their first Handbook of guidelines for evaluating development-level transportation impacts. Decades later, these methods are still ubiquitously used across the US and Canada. Only recently, with the third edition of the ITE Trip Generation Handbook, have new data and approaches been adopted. In this study NITC researcher Kristina Currans takes aim at understanding issues inherent in the collection and application of ITE’s data and methods in various urban contexts. This technology transfer guide touches on the main findings from this work.
Assessing State Efforts To Integrate Transportation, Land Use And Climate, Rebecca Lewis, Robert Zako
Assessing State Efforts To Integrate Transportation, Land Use And Climate, Rebecca Lewis, Robert Zako
TREC Final Reports
Climate change is increasingly recognized as a threat to life on earth. “Continued emission of greenhouse gases will cause further warming and long-lasting changes in all components of the climate system, increasing the likelihood of severe, pervasive and irreversible impacts for people and ecosystems. Limiting climate change would require substantial and sustained reductions in greenhouse gas emissions” (International Panel on Climate Change, 2014, 8).
The transportation sector accounts for almost one-third of all greenhouse gas emissions (GHG) in the United States. Reducing GHG from transportation rests on the “three-legged stool” of improving vehicle efficiency, reducing the carbon content of fuels …
Do People’S Perceptions Of Neighborhood Bikeability Match “Reality”?, Liang Ma, Jennifer Dill
Do People’S Perceptions Of Neighborhood Bikeability Match “Reality”?, Liang Ma, Jennifer Dill
Urban Studies and Planning Faculty Publications and Presentations
Do people perceive the built environment the same as we objectively measure it? If not, what are the relative roles of the objective versus the perceived environment on bicycling behavior? This study, based on data from Portland, Oregon, explored the match or mismatch between the objective and perceived bicycling environment and how it affects people’s bicycling behavior. The descriptive analysis indicated a fair agreement between perceived and objective measures. Older adults, women having children, less-educated and lower-income persons, and those who bicycle less tended to perceive their high-bikeable environment (measured objectively) as being a low-bikeable environment. In addition to the …

The Impacts Of Lake-Effect Snow On Traffic Volume In Ohio And Indiana, 2011-2015, Daniel Allen Burow
The Impacts Of Lake-Effect Snow On Traffic Volume In Ohio And Indiana, 2011-2015, Daniel Allen Burow
Theses and Dissertations
Snowfall presents a hazard to drivers by reducing visibility and increasing safe stopping distances. As a result, some drivers cancel trips if snowfall is occurring or forecasted, and traffic volumes often decrease on snowy days. Lake-effect snow is very localized and is thus hypothesized to have a lesser influence on traffic volume than synoptic-scale snow, which usually covers a broader areal extent. Traffic volume in northeast Ohio and northern Indiana is studied using a matched-pair analysis to determine if volumes differ between lake-effect and synoptic-scale snowfall in these regions. While little statistical evidence is found to support this hypothesis, other …
Trailer Park Residents: Are They Worthy Of Society's Respect, Steve Anderson
Trailer Park Residents: Are They Worthy Of Society's Respect, Steve Anderson
Theses and Dissertations
Existing research is limited in explaining the existence of and reasons for stereotypes held against trailer park residents. This study uses an experimental design to measure attitudes towards trailer park residents, specifically in terms of being considered worthy of society’s respect. An Internet questionnaire was designed and administered to a sample of 559 introductory sociology students at a Midwestern university using semantic differentials to measure attitudes towards a fictitious couple. Participants were divided into a control and an experimental group. The groups were presented with two different vignettes, which were the same except for the experimental group where the vignette …

Theses and Dissertations
The purpose of this study was to test the effectiveness of the implementation of the Marzano Teacher Evaluation Framework (MTEF) in a Midwest school district. The study used quantitative methods to examine the process used to bring about change in the school district’s teacher evaluation model. The researcher examined teacher and administrator perceptions regarding change, professional development, instructional improvement, reliability, and overall satisfaction with ease of use of the MTEF model.
The researcher used data collected from one Midwest school district. The school district consisted of twelve elementary schools, four middle schools, and three high schools. A total of 682 …
Attitudes And Beliefs Of North Dakota Early Childhood Educators Toward Gender Constructs, Janelle Jean Ferderer
Attitudes And Beliefs Of North Dakota Early Childhood Educators Toward Gender Constructs, Janelle Jean Ferderer
Theses and Dissertations
The purpose of this qualitative study was to examine the attitudes and beliefs about gender and gender diversity held by certified practicing early childhood teachers in North Dakota Department of Public Instruction approved preschool programs. Selected children’s books were used to elicit qualitative responses that provided insight into teachers’ beliefs, attitudes, and practices regarding gender.
The theoretical framework for the study was based on Vygotsky’s theories on the Zones of Proximal Development (ZPD) and the More Knowledgeable Other (MKO), which focus on the importance of the role of educators’ influence in the social development of young children. The methodology for …
Variations In Video Game Play Habits And Beliefs Over Time, John Adam Campbell
Variations In Video Game Play Habits And Beliefs Over Time, John Adam Campbell
Theses and Dissertations
Psychological research about the consequences of playing video games has grown exponentially, correlating to the exponential growth of the video game industry. In the past decade, a major impetus has related to the concept of video game addiction, pathological gaming, or Internet Gaming Disorder. While the presence of this problem is widely accepted and there is growing knowledge about the factors contributing to its development and perpetuation, there is minimal research speaking to intervention. The primary purpose of the present study was to identify a potential pathway to educate members of the gaming community about pathological gaming, with the hope …
Using The Expectancy-Value Theory To Understand Why Women Persist Or Leave Collegiate Stem Programs: A Mixed Methods Study, Joseph Appianing
Using The Expectancy-Value Theory To Understand Why Women Persist Or Leave Collegiate Stem Programs: A Mixed Methods Study, Joseph Appianing
Theses and Dissertations
Concerns have been raised about the ability of the U.S. to maintain its global technological competitive advantage in the future because of American college students’ attitudes—particularly women—toward STEM programs and careers (Chen, 2013; Ehrenberg, 2010; Palmer & Wood, 2013). Many female students graduate from high school academically well-prepared to pursue STEM majors, and many choose to pursue STEM majors in college, yet many also leave those majors (Chen, 2015; Hill, Corbett, & Rose, 2010). Theories such as perceived value and expectations for success (Eccles et al., 1983), self-efficacy (Bandura, 1977, 1986), and self-determination (Deci & Ryan, 1985) have been advanced …
Determining Glacier Drift Ages Using Multispectral Remote Sensing Data, Paula Crock
Determining Glacier Drift Ages Using Multispectral Remote Sensing Data, Paula Crock
Theses and Dissertations
Determining the ages of glacier drifts in Antarctica can help paleoclimatologists determine
the changes Earth’s climate has gone through and thereby inform models for future climate
change prediction. However, many of these drifts are difficult to reach for sample collection
necessary to determine their ages. This research attempts to use multispectral remote sensing
data to expand the mapping of drift ages from known point measurements regionally. This
research is based on existing drift ages from Ong Valley, Transantarctic Mountains. Two
methods were used to determine a combination of the image band data that would sufficiently
distinguish the three age-distinct drift …

Effect Of Nanomaterials On Binder And Mix Performance, Bishal Karki
Theses and Dissertations
Nanotechnology has been increasingly used in asphalt modification for its remarkable effect in improving the binder and mix performance. Rheological properties of binder play major roles in rutting, fatigue cracking and low-temperature cracking resistance of Hot Mix Asphalt (HMA) pavement. This study was conducted to investigate the effect of Nanomaterials (NMs) on the rheological characteristics of asphalt binders and rutting and cracking resistance of HMA mixes. NMs, Nanoclay and Nanoalumina, were mixed separately into Performance Grade (PG) 58-28 and 64-28 asphalt binder at control (0% NM), 1, 5 and 7% by binder weight. Rolling Thin Film Oven (RTFO) and Pressure …
Parkinson's Symptoms Quantification Using Wearable Sensors, Md Nafiul Alam
Parkinson's Symptoms Quantification Using Wearable Sensors, Md Nafiul Alam
Theses and Dissertations
Parkinson’s disease (PD) is a common neurodegenerative disorder affecting more than one million people in the United States and seven million people worldwide. Motor symptoms such as tremor, slowness of movements, rigidity, postural instability, and gait impairment are commonly observed in PD patients. Currently, Parkinsonian symptoms are usually assessed in clinical settings, where a patient has to complete some predefined motor tasks. Then a physician assigns a score based on the United Parkinson’s Disease Rating Scale (UPDRS) after observing the motor task. However, this procedure suffers from inter subject variability. Also, patients tend to show fewer symptoms during clinical visit, …
Importance Of Macroeconomic Stability To Developed Nations, Jeffrey Brian Leeson
Importance Of Macroeconomic Stability To Developed Nations, Jeffrey Brian Leeson
Theses and Dissertations
This research investigates the importance of macroeconomic stability to economic growth of developed nations. For over a decade, many developed nations have experienced slower gross domestic product growth as well as slower gross domestic product per capita growth. Meanwhile, recently developed economies, such as the high-performing East Asian economies, have experienced far higher per capita growth rates. Although this is in line with Solow’s (1956) growth model predicting conditional convergence and other researchers attributing the slowdown to sectoral shifts, this offers little solace to the citizens of those developed nations witnessing slower growth. The purpose of this research is to …
Easy Credit And The Erosion Of Dischargeable Debt In Bankruptcy: Advocating For A Broad Interpretation Of 11 U.S.C. § 523(A)(2)(A) & (B)'S "Statement Respecting.. . Financial Condition", Tyler Sandifer
Georgia Law Review
The Bankruptcy Code largely exists to provide a
"fresh start" to debtors. But not everyone gets a free
pass. If a debtor has intentionally lied in order to
obtain money, property, services, or an extension,
renewal, or refinancing of credit, he receives no
protection. However, there is an exception built into the
code to protect debtors from predatory lenders intent on
gaming the system in an effort to eliminate insolvency
risk. The size of this exception has become a matter of
judicial debate over the past thirty-eight years as a
circuit split has slowly developed over the
interpretation of 11 …

"G" Is More Than "Pc" For Georgia: Why Prospective Adoption Of Aba Model Rule 8.4(G) Is A Viable Measure To Combat Discrimination And Harassment, Katie M. Wroten
Georgia Law Review
In August 2016, the American Bar Association
passed Model Rule 8.4(g) into its Model Rules of
Professional Conduct. The rule declares it misconduct
for a lawyer to harass or discriminate based on race,
sex, religion, national origin, ethnicity, disability, age,
sexual orientation, gender identity, marital status or
socioeconomic status. The scope of the rule extends to
lawyers' conduct outside of the courtroom, including
conduct related to the practice of law. The rule aims to
eliminate bias in the profession and justice system.
The Supreme Court of Georgia has yet to adopt any
version of Model Rule 8.4(g) in its comment …

Focusing on recently-permitted units provides a perspective on how the newest housing is and will be different from existing housing. The type of housing that will be built, where it is built, its characteristics, and its price will shape the Portland region in the years to come.
Better Outcomes: Improving Accountability & Transparency In Transportation Decision-Making, Robert Zako, Rebecca Lewis
Better Outcomes: Improving Accountability & Transparency In Transportation Decision-Making, Robert Zako, Rebecca Lewis
TREC Final Reports
This report aims to help policymakers and staff at all levels of government make transportation investments that serve the public better.
Amazingly, we simply don’t know how effective government spending is at achieving the outcomes the public expects and has been promised! Clearly, taxpayer dollars buy roads, bus service, airports, ferry service, and other transportation facilities and services. But it is unclear how well such investments help get people where they want to go, create jobs, improve public health, support community development, and provide other benefits. In other words, it is uncertain how cost-effectively the means (transportation investments) achieve the …

The object of investigation of this work are phenocrysts of quartz and plagioclase from dacite pumice of the Isthmus of the Isthmus, which is located on the island of Iturup. The purpose of this work is to determine the water content in the melts that participated in the caldera eruption of the Vetrovoy Isthmus and the patterns of their changes during the crystallization of magma. In the course of the work, the following were …
Cohabiting With Property In Washington: Washington's Committed Intimate Relationship Doctrine, Tom Andrews
Cohabiting With Property In Washington: Washington's Committed Intimate Relationship Doctrine, Tom Andrews
Articles
Washington has followed a community property system since at least 1869—twenty years prior to statehood. However, Washington rejected the doctrine of common law marriage quite early in 1892. For over one hundred years, in order to receive the advantages of the community property laws, a Washington couple has needed to have their relationship blessed with a ceremonial marriage or have a valid common law marriage in another state.
Accompanying these requirements for the formal establishment of a community property regime was the so-called "Creasman Presumption," which provided that "property acquired by a man and a woman not married to each …
The Taking Economy: Uber, Information, And Power, Ryan Calo, Alex Rosenblat
The Taking Economy: Uber, Information, And Power, Ryan Calo, Alex Rosenblat
Articles
Sharing economy firms such as Uber and Airbnb facilitate trusted transactions between strangers on digital platforms. This creates economic and other value but raises concerns around racial bias, safety, and fairness to competitors and workers that legal scholarship has begun to address. Missing from the literature, however, is a fundamental critique of the sharing economy grounded in asymmetries of information and power.
This Essay, coauthored by a law professor and a technology ethnographer who studies work, labor, and technology, furnishes such a critique and proposes a meaningful response through updates to consumer protection law. Commercial firms have long used what …
Industry Lobbying And "Interest Blind" Access Norms At International Organizations, Melissa J. Durkee
Industry Lobbying And "Interest Blind" Access Norms At International Organizations, Melissa J. Durkee
Articles
The standard approach of international organizations (IOs) makes no formal distinctions between nonprofit private sector associations, known as trade or industry groups, and public interest groups like Amnesty International or Greenpeace. After all, these groups are all organized as nonprofits; they may all be characterized as nongovernmental organizations representing the interests of their memberships; and the groups all seek to advance the agendas of members by offering ideas and expertise to international officials or bodies—classic lobbying activity. Thus, most IOs offer accreditation and access to both private sector and public interest groups on equal terms, without differentiating between them. I …

Hacking Qualified Immunity: Camera Power And Civil Rights Settlements, Mary D. Fan

Excessive force cases are intensely fact-specific. Did the suspect resist, necessitating the use offorce? What threat did the suspect pose, if any? Was the use of force excessive in light of the situation? These are judgment calls based on myriad facts that differ from case to case. Establishing what really happened forces courts and juries to wade into a fact-bound morass filled with fiercely conflicting defendant-said, police-said battles.
Now an evidentiary transformation is underway. We are in an era where the probability of a police encounter being recorded has never been higher. With the rise of recording—by the public as …
Justice Visualized: Courts And The Body Camera Revolution, Mary D. Fan
Justice Visualized: Courts And The Body Camera Revolution, Mary D. Fan
Articles
What really happened? For centuries, courts have been magisterially blind, cloistered far away from the contested events that they adjudicate, relying primarily on testimony to get the story—or competing stories. Whether oral or written, this testimony is profoundly human, with all the passions, partisanship and imperfections of human perception.
Now a revolution is coming. Across the nation, police departments are deploying body cameras. Analyzing body camera policies from police departments across the nation, the article reveals an unfolding future where much of the main staple events of criminal procedure law will be recorded. Much of the current focus is on …

The Vested Rights Doctrine: How A Shield Against Injustice Became A Sword For Opportunistic Developers, Steve P. Calandrillo, Chryssa Deliganis, Christina Elles
Articles
In an era of pioneering environmental and land use laws, savvy developers are using the “vested rights” doctrine to circumvent and undermine critical public health, safety, and environmental regulations. This controversy pits two legitimate interests against each other: On the one hand, local governments must have the power to pass land use laws and regulations in the public interest to protect their community’s health, safety, welfare, and environment. On the other, developers who rely on the laws in existence at the time their project is approved should be protected from subsequent changes to the law that could increase transactional costs …
