Measuring The Creative Plea Bargin, Thea Johnson
Measuring The Creative Plea Bargin, Thea Johnson
Indiana Law Journal
A great deal of criminal law scholarship and practice turns on whether a defendant gets a good deal through plea bargaining. But what is a good deal? And how do defense attorneys secure such deals? Much scholarship measures plea bargains by one metric: how many years the defendant receives at sentencing. In the era of collateral consequences, however, this is no longer an adequate metric as it misses a world of bargaining that happens outside of the sentence. Through empirical re-search, this Article examines the measure of a good plea and the work that goes into negotiating such a plea. …

Objective: This study examined patterns of violence victimization and aggression in both intimate partner and non-partner relationships among veterans, and used latent profile analysis to identify subtypes of violence involvement.
Methods: Participants were 841 substance use treatment-seeking veterans (94% male) from a large VA Medical Center who completed screening measures for a randomized controlled trial. Self-report measures were: substance use, legal problems, depression, and violence involvement.
Results: Past year violence involvement, including both intimate partner (IPV) and non-partner (NPV) were common in the sample; although NPV occurred at somewhat higher rates. When including either IPV or NPV aggression or victimization, …

Teacher Perceptions Of Response To Intervention And Its Core Components, And Its Implementation In Reading In The Primary Grades, Kelsey Hillard Davis
Teacher Perceptions Of Response To Intervention And Its Core Components, And Its Implementation In Reading In The Primary Grades, Kelsey Hillard Davis
Theses and Dissertations
Since the reauthorization of the Individuals with Disabilities Education Act (IDEA 2004), Response to Intervention (RTI) had been implemented in varied degrees due to lack of a national definition and framework. RTI was a general education initiative, however few studies focused on general education teachers and their perceptions of RTI. This was a qualitative descriptive study that utilized individual interviews and a focus group. First, individual interviews were conducted using a semi-structured interview protocol. Interview data was coded for prominent themes using NVivo. The individual interview data was then used to write a semi-structured interview protocol for a focus group. …
Philosophical Legal Ethics: An Affectionate History, David Luban, W. Bradley Wendel
Philosophical Legal Ethics: An Affectionate History, David Luban, W. Bradley Wendel
Cornell Law Faculty Publications
The modern subject of theoretical legal ethics began in the 1970s. This brief history distinguishes two waves of theoretical writing on legal ethics. The "First Wave" connects the subject to moral philosophy and focuses on conflicts between ordinary morality and lawyers' role morality, while the "Second Wave" focuses instead on the role legal representation plays in maintaining and fostering a pluralist democracy. We trace the emergence of the First Wave to the larger social movements of the 1960s and 1970s; in the Conclusion, we speculate about possible directions for a Third Wave of theoretical legal ethics, based in behavioral ethics, …
Job Characteristics And Perceived Organizational Support Among Police Officers, Paul Reynolds, Richard Helfers
Job Characteristics And Perceived Organizational Support Among Police Officers, Paul Reynolds, Richard Helfers
Criminal Justice Faculty Publications and Presentations
Research supports that treatment of employees, in terms of organizational policies, practices, and resources, are associated with employees’ perception of organizational support. Furthermore, research supports that there is often disparate treatment between employees’ work related factors. For this reason, it is reasonable to speculate that variances in police officers’ perception that their organization cares about them and values their work contributions may exist. The purpose of this exploratory research was to describe how police officers’ job characteristics (duty assignment, rank, tenure, and department size) might be associated with perceptions of organizational support. Utilizing OLS regression, the findings revealed that perceived …

The state of Tennessee arrested a woman two days after she gave birth and charged her with assault of her newborn child based on her use of narcotics during her pregnancy. Tennessee's 2014 assault statute was the first to explicitly criminalize the use of drugs by a pregnant woman. But this law, along with others like it being considered by legislatures across the country, is only the most recent manifestation of a long history of using criminal law to punish poor mothers and mothers of color for their behavior while pregnant. The purported motivation for such laws is the harm …

Removal Of Women And African-Americans In Jury Selection In South Carolina Capital Cases, 1997- 2012, Ann M. Eisenberg

The Supreme Court’s May 2016 decision in Foster v. Chatman involved smoking-gun evidence that the State of Georgia discriminated against African-Americans in jury selection during Foster’s 1987 capital trial. Foster was decided on the thirtieth anniversary of Batson v. Kentucky, the first in the line of cases to prohibit striking prospective jurors on the basis of their race or gender. But the evidence of discrimination for Batson challenges is rarely so obvious and available as it was in Foster.
Where litigants have struggled to produce evidence of discrimination in individual cases, empirical studies have been able to assess jury selection …

Third-Person Perceptions, Hostile Media Effects, And Policing: Developing A Theoretical Framework For Assessing The Ferguson Effect, Justin Nix, Justin T. Pickett
Criminology and Criminal Justice Faculty Publications
Objectives
Policing in the United States has come under intense scrutiny following numerous deadly force incidents involving unarmed black citizens, which dominated the news media. Some have argued that consequently, a “chill wind” has blown through law enforcement, such that officers have become more distrustful of civilians, fearful of scandal, and are de-policing. To date, however, scholars have given insufficient theoretical and empirical attention to why and how media coverage of policing may lead to such outcomes.
Methods
We addressed this literature gap using data from a survey of officers in a metropolitan police department in the southeast.

Nebraska Alternative To Detention Programs 2015 To 2016, Sara E. Moore, Lindsey Wylie, Anne M. Hobbs, Juvenile Justice Institute, University Of Nebraska At Omaha
Reports
The overarching goal of an alternative to detention (ATD) program is to ensure that youth released to the community are adequately supervised instead of being detained. JJI set out to evaluate whether youth would have in fact been detained (that is, are we using the program as an alternative to detention?). Secondarily, we planned to evaluate whether the program ensured that the youth showed up for the scheduled court date and refrained from any new law violations while placed in the community. The research questions that JJI hoped to answer were as follows: 1. How many youth are served in …

Protecting Victims Of Human Trafficking: Creating Better Residency Visas, Efthimia Barbagiannis
Protecting Victims Of Human Trafficking: Creating Better Residency Visas, Efthimia Barbagiannis
Cardozo Journal of International and Comparative Law
The note critiques the international approach to combating human trafficking, arguing that efforts prioritize prosecution over victim protection, leading to inadequate support for victims and increased risks of re-trafficking. It advocates for residency visas tailored to victims' needs as a more effective protection strategy.

Prosecuting Islamic State Members For Sexual And Gender-Based Crimes Committed Against Yazidi Women And Girls, Samantha Hechler
Cardozo Journal of International and Comparative Law
The note examines the systematic sexual enslavement and gender-based violence perpetrated by ISIS against Yazidi women and girls, emphasizing the legal and jurisdictional challenges in prosecuting these crimes under international law. It argues that while the International Criminal Court (ICC) lacks jurisdiction over Iraq and Syria, alternative mechanisms such as ad hoc tribunals, hybrid courts, or prosecutions in foreign national courts offer feasible pathways to justice for the victims

The Duty To Charge In Police Use Of Excessive Force Cases, Rebecca Roiphe
The Duty To Charge In Police Use Of Excessive Force Cases, Rebecca Roiphe
Cleveland State Law Review
Responding to the problems of mass incarceration, racial disparities in justice, and wrongful convictions, scholars have focused on prosecutorial overcharging. They have, however, neglected to address undercharging—the failure to charge in entire classes of cases. Undercharging can similarly undermine the efficacy and legitimacy of the criminal justice system. While few have focused on this question in the domestic criminal law context, international law scholars have long recognized the social and structural cost for nascent democratic states when they fail to charge those responsible for the prior regime’s human rights abuses. This sort of impunity threatens the rule of law and …

Nearsighted And Colorblind: The Perspective Problems Of Police Deadly Force Cases, Jelani Jefferson Exum
Cleveland State Law Review
In dealing with the recently publicized instances of police officers’ use of deadly force, some reform efforts have been focused on the entities that are central to the successful prosecutions of police—the prosecutor and the grand jury. Some have suggested special, independent prosecutors for these cases so that the process of deciding whether to seek charges against police officers remains untainted by the necessary cooperative relationship between the police department and the prosecutor’s office. Others have urged more transparency in the grand jury process so that the public can scrutinize a prosecutor’s efforts in presenting evidence for an indictment. Still …
Restoring Independence To The Grand Jury: A Victim Advocate For The Police Use Of Force Cases, Jonathan Witmer-Rich
Restoring Independence To The Grand Jury: A Victim Advocate For The Police Use Of Force Cases, Jonathan Witmer-Rich
Cleveland State Law Review
This Article proposes a grand jury victim advocate to represent the interests of the complainant before the grand jury in investigations into police use of excessive force. Currently, the prosecutor has near-exclusive access to the grand jury, and as a result, grand juries have become almost entirely dependent on prosecutors. Historically, however, grand juries exhibited much greater independence. In particular, grand juries have a long history in America of providing oversight over government officials, bringing criminal charges for official misconduct even when local prosecutors proved reluctant. Permitting the alleged victim of police excessive force to be represented before the grand …
