The Role Of The Prosecutor And The Grand Jury In Police Use Of Deadly Force Cases: Restoring The Grand Jury To Its Original Purpose, Ric Simmons Jul 2017

The Role Of The Prosecutor And The Grand Jury In Police Use Of Deadly Force Cases: Restoring The Grand Jury To Its Original Purpose, Ric Simmons

Cleveland State Law Review

In deciding whether and what to charge in a criminal case, the prosecutor looks to three different factors. The first is legal: is there probable cause that the defendant committed this crime? The second is practical: if the case goes to trial, will there be sufficient evidence to convict the defendant beyond a reasonable doubt of this crime? And the third is equitable: should the defendant be charged with this crime? The prosecutor is uniquely qualified to answer the first and second question, but the third is a bit trickier. If it is used properly, the grand jury could provide …

Supporting Freshmen Through Their First Year Of High School: A Program Review, Rosa Costain

School of Education and Leadership Student Capstone Theses and Dissertations

The research question this project explored was, do students and teachers perceive the PREP program to be effective in meeting the goals of a high school transition program? It documents one teacher’s mixed methods evaluation of the ninth grade transition support program she teaches based on student and teacher perceptual data gathered from surveys and interviews. It identifies the need for transition support programs in high schools, recommended structural changes for implementing transition programs, curricular recommendations for transition support courses and current transition support models in use around the country. The author then documents the results of her survey about …

Focal Point, Volume 31, Portland State University. Regional Research Institute

Research and Training Center - Focal Point

Research demonstrates that the prevalence of mental health conditions among justice system involved youth is alarmingly high, coupled with a strong likelihood of multiple traumatic exposures. Unfortunately, while the need for appropriate and timely treatment is acute, the juvenile justice system seems challenged in meeting it. The authors of this issue of Focal Point identify and propose solutions to these challenges with new research findings.

Remotivating The Black Vote: The Effect Of Low-Quality Information On Black Voters In The 2016 Presidential Election And How Librarians Can Intervene, Andrew P. Jackson, Denyvetta Davis, James Kelly Alston Jul 2017

Remotivating The Black Vote: The Effect Of Low-Quality Information On Black Voters In The 2016 Presidential Election And How Librarians Can Intervene, Andrew P. Jackson, Denyvetta Davis, James Kelly Alston

Publications and Research

In a phenomenon that was surprising to many, given the racially charged nature of the 2016 presidential election, black voter turnout was significantly lower than the previous two elections. Donald Trump’s victory is attributable to many factors, one of which was the lower participation of black voters in several swing states. To a lesser extent, black support for third-party candidates also aided Trump’s victory. The lower black turnout itself is attributable to several factors, but one factor specifically in the LIS realm was the prevalence of low-quality information and rhetoric and a susceptibility that some black voters had to this …

Articles, Abstracts, and Reports

Although several lung cancer susceptibility loci have been identified, much of the heritability for lung cancer remains unexplained. Here 14,803 cases and 12,262 controls of European descent were genotyped on the OncoArray and combined with existing data for an aggregated genome-wide association study (GWAS) analysis of lung cancer in 29,266 cases and 56,450 controls. We identified 18 susceptibility loci achieving genome-wide significance, including 10 new loci. The new loci highlight the striking heterogeneity in genetic susceptibility across the histological subtypes of lung cancer, with four loci associated with lung cancer overall and six loci associated with lung adenocarcinoma. Gene expression …

The United States Benefit Deficit For Veterans, Leslie-Dawn Quick Jul 2017

The United States Benefit Deficit For Veterans, Leslie-Dawn Quick

Sociology & Criminal Justice Theses & Dissertations

Over the last few years the Department of Veterans Affairs has faced an increase of public scrutiny for its handling of veteran health care claims. Allegations that mismanagement created extensive waiting times and appointment scheduling manipulations resulted in veterans dying were made against the VA. This research examined data from the VA Monday Morning Workload Reports, the National Survey of Veterans, the VA Office of Inspector General, and media reports of whistleblowers accusing the VA of mismanagement to determine whether the VA was guilty of a state crime of omission and commission resulting in a social harm to its veterans. …

Beyond The War: The Evolving Nature Of The U.S. Approach To Drugs, Don Stemen Jul 2017

Beyond The War: The Evolving Nature Of The U.S. Approach To Drugs, Don Stemen

Criminal Justice & Criminology: Faculty Publications & Other Works

Over the last forty years, perhaps no issue has affected the United States’s criminal justice system as profoundly as has drug policy. Since President Nixon declared drug abuse “America’s public enemy number one,”1 concerns about the manufacture, distribution, and possession of drugs have remained at the fore of criminal justice policy discussions.2 President Reagan’s subsequent pronouncement of drugs as “an especially vicious virus of crime” set a course for national drug policy that emphasized enforcement and punishment over treatment to “win the war on drugs.”3 Throughout the 1980s, increasing public concern about the effects of drug abuse4 further pressured policymakers …

Child Labor Trafficking In The United States: A Hidden Crime, Katherine Kaufka Walts Jd Jul 2017

Child Labor Trafficking In The United States: A Hidden Crime, Katherine Kaufka Walts Jd

Center for the Human Rights of Children

Emerging research brings more attention to labor trafficking in the United States. However, very few efforts have been made to better understand or respond to labor trafficking of minors. Cases of children forced to work as domestic servants, in factories, restaurants, peddling candy or other goods, or on farms may not automatically elicit suspicion from an outside observer as compared to a child providing sexual services for money. In contrast to sex trafficking, labor trafficking is often tied to formal economies and industries, which often makes it more difficult to distinguish from ”legitimate” work, including among adolescents. This article seeks …

The Devil Is In The Details: Representations Of The Rural Appalachian Deviant, Stephen T. Young Jul 2017

The Devil Is In The Details: Representations Of The Rural Appalachian Deviant, Stephen T. Young

Sociology & Criminal Justice Theses & Dissertations

Every year, it seems, a new film makes its way through theaters across America demonstrating a new variant of the rural Appalachian deviant. These films play a major role in continuing to shape societal perceptions of rural white populations in Appalachia. Drawing on theoretical insights of Cohen, Hunt, Simon, and Lupton this dissertation examines how film depictions of the rural white Appalachians supports the continued construction of the rural Appalachian deviant. This study finds that films support said construction by demonstrating this population through themes about tainted blood, intimate partner violence, and drug addiction. Moreover, these films camouflage the facts …

The 2016 ‘Lone Wolf’ Tsunami - Is Rapoport’S ‘Religious Wave’ Ending?, Martin J. Gallagher

Journal of Strategic Security

This article considers recent developments across the western world in the lethality of lone wolf terrorists during 2016 against the contextual framework of Rapoport’s theory regarding the existence of waves of terrorism, mirroring current extreme political and social situations. It highlights the similarities in terms of world conditions coupled to modus operandi that existed during the first wave of terrorism, the Anarchist wave, and currently, while highlighting recent increased lethality. The paper illustrates that current lone wolf behaviours, and the decreasing ‘Religiosity’ of fourth wave participants indicate that the wave’s breakwater may have been reached. A discussion of the role …

Changing The Message: Battered Women's Advocates And Their Fight Against Domestic Violence At The Local, State, And Federal Level, 1970s-1990s, Clara Amy Van Eck

History Theses & Dissertations

This thesis analyzes congressional hearings, reports to Congress, government statistics, acts of Congress, Supreme Court rulings, and newspaper articles to examine how, in the 1970s, 1980s, and 1990s, battered women's advocates altered their rhetoric when dealing with local, state, and federal governments in order to change policies, laws, and to obtain funding for domestic abuse shelters. In the 1970s, battered women's advocates used anti-patriarchal language to help survivors of sexual assault and of domestic violence understand the pervasive and systemic nature of violence against women to liberate survivors from the belief that the violence was their fault. In the 1980s, …

When It Is Troublesome To Do Right: A Narrative Analysis Of The Continual Censorship And “Sivilizing” Of Huckleberry Finn, Angela P. Branyon

Teaching & Learning Theses & Dissertations

This qualitative dissertation is a part of a broader program of research that investigates intellectual freedom. The study focuses on developing understanding in three distinct, but related, research areas – the American historical and cultural narrative of race, the historical discourse of intellectual freedom, and the role The Adventures of Huckleberry Finn can play in adding to and perhaps changing these historic stories. By using historical narrative inquiry, data was examined from each story to find correlations among the discourses Where previous research centers on and develops the reasons why Huck Finn has been challenged, this research focuses on how …

The Grand Jury's Role In The Prosecution Of Unjustified Police Killings - Challenges And Solutions, Roger Fairfax Jul 2017

The Grand Jury's Role In The Prosecution Of Unjustified Police Killings - Challenges And Solutions, Roger Fairfax

Scholarly Articles in Law Reviews & Journals

One of the most profound tests of trust in a society is when the state must be relied upon to hold itself accountable for violating the rights of the governed. Nowhere is this more true than in the context of the prosecution of law enforcement officers for unjustified violence against civilians. The reasons for this are twofold. First, it should go without saying that police perform a vital - and extremely difficult and dangerous - function, and bravely serve as the prophylactic between civil society and complete chaos. As President Obama recently wrote, "[p]olice officers are the heroic backbone of …

School Resource Officers And The School-To-Prison Pipeline: A Mixed Methods Application Of The Behavior Of Law In Schools, Caitlin Grace Lynch Jul 2017

School Resource Officers And The School-To-Prison Pipeline: A Mixed Methods Application Of The Behavior Of Law In Schools, Caitlin Grace Lynch

Sociology & Criminal Justice Theses & Dissertations

The implementation of school resource officer programs has been a popular response to school-based violence in the United States. Parents, school officials, and policy makers believe that police presence makes students and staff feel safer on campus, deters school-based crime and violence, and creates positive relationships between youth and the police. However, there is a growing concern that school resource officers hypercriminalize trivial student misbehavior, contribute to a culture of youth punishment and control, and are instrumental in facilitating a link between schools and the juvenile justice system. Despite the rapid rate at which school resource officer programs have expanded …

Philosophical Legal Ethics: An Affectionate History, David Luban, W. Bradley Wendel Jul 2017

Philosophical Legal Ethics: An Affectionate History, David Luban, W. Bradley Wendel

Georgetown Law Faculty Publications and Other Works

The modern subject of theoretical legal ethics began in the 1970s. This brief history distinguishes two waves of theoretical writing on legal ethics. The “First Wave” connects the subject to moral philosophy and focuses on conflicts between ordinary morality and lawyers’ role morality, while the “Second Wave” focuses instead on the role legal representation plays in maintaining and fostering a pluralist democracy. We trace the emergence of the First Wave to the larger social movements of the 1960s and 1970s; in the conclusion, we speculate about possible directions for a Third Wave of theoretical legal ethics, based in behavioral ethics, …

It analyses the dilemmas raised by the exercise of justice in conditions of political flux by looking at the distinct role played by public philosophers, in particular, Ronald Dworkin.

Rehabilitation And Reintegration Of Genocide Ex-Prisoners: Understanding The Correctional Role Of Prisons In Rwanda, Lulu Abdun Jul 2017

Rehabilitation And Reintegration Of Genocide Ex-Prisoners: Understanding The Correctional Role Of Prisons In Rwanda, Lulu Abdun

Independent Study Project (ISP) Collection

After the Genocide Against the Tutsi in 1994, over 120,000 people were imprisoned in Rwanda for the perpetration of genocide. Twenty-three years after the Genocide, numerous genocide ex-prisoners have been released. Throughout their prison time and after their release, rehabilitation and reintegration programming has been available. This paper looks at the rehabilitation and reintegration programming available to genocide ex-prisoners, the success and challenges they currently face or have previously faced, and recommendations for reforms for the future prison/rehabilitation/reintegration process. This paper also examines the correctional role of prisons in Rwanda and how that contributes to successful reintegration. From interviewing genocide …
