An Exposition Of The Effectiveness Of And The Challenges Plaguing Maine's Juvenile Drug Treatment Court Program, Jason E. Rayne

Since 1989, trial courts across the United States have been developing and implementing the drug court model. Drug courts are treatment-based programs that are considered less adversarial than traditional methods of adjudication. By early in the new millennium, drug courts had “achieved considerable local support and [had] provided intensive, long-term treatment services to offenders with long histories of drug use and criminal justice contacts, previous treatment failures, and high rates of health and social problems.” Drug courts were developed in part to quell the trend of prison overcrowding associated with America’s increased “war on drugs” during the 1980s. In 1996, Eric Letalien pleaded guilty to the gross sexual assault of a thirteen year-old girl, an offense he committed when he was nineteen years old. At the time of his sentencing in August of 1996, Letalien was subject to Maine’s Sex Offender Registration and Notification Act of 1995 (SORNA of 1995). Pursuant to SORNA of 1995, Letalien was required to register his address with the State Bureau of Identification (SBI) and update his address in the event he moved. This registration requirement was to be in effect for fifteen years from the time he was released from incarceration. After …

"The Wrong Approach At The Wrong Time?": Maine Adopts Strict Liability For Abnormally Dangerous Activities In Dyer V. Maine Drilling And Blasting, Inc., Matthew M. Cobb

In 2009, the Maine Supreme Judicial Court, sitting as the Law Court, held in Dyer v. Maine Drilling and Blasting, Inc. that strict liability should be applied to abnormally dangerous activities in accordance with the Restatement (Second) of Torts §§ 519-20. In doing so, the court expressly overruled its decision in Reynolds v. W.H. Hinman Co., which had rejected a strict liability approach to blasting cases in favor of a negligence-based standard. In Dyer, a majority of the Law Court vacated the trial court’s grant of summary judgment for Maine Drilling and Blasting, Inc. (Maine Drilling) and held that strict …

President Obama has made clear that the United States must grapple with questions of how to detain and try potentially dangerous terrorism suspects in a manner that maximizes national security while adhering to the rule of law. Yet the United States faces a serious quandary in terms of how to prosecute suspects who have been detained at Guantanamo Bay, Cuba, that puts at risk the reputation of the United States justice system and its adherence to rule of law. According to The Institute for Civility in Government, civility is “about more than just polite- ness, although politeness is a necessary first step. It is about disagreeing without disrespect, seeking com- mon ground as a starting point for dialogue about differences, listening past one’s preconceptions, and teaching others to do the same.”

This Note addresses the flaws in the current intelligible principle standard and proposes a new three-part standard that would better revitalize the intelligible principle as it was first articulated almost a century ago. This Note concedes that while legislative delegation in any form is a violation of the original meaning of the nondelegation doctrine, our society and the growth of administrative agencies removed any chance of having our laws created solely by Congress. What can happen, and what this Note proposes, is for the Supreme Court to adopt a new intelligible principle standard that scales back the amount of …

In Estate of Fortier v. City of Lewiston, the Maine Supreme Judicial Court, sitting as the Law Court, was asked to decide if the City of Lewiston was “using” an aircraft under the Maine Tort Claims Act (MTCA) when it chartered a plane from Twin Cities Air Services (Twin Cities) as part of an Air Force Junior Reserve Officer Training Corp (AFJROTC) exercise. Tragically, the pilot and three AFJROTC cadets from Lewiston High School lost their lives when the plane crashed into Barker Mountain shortly after take-off. The families of the students brought suit against Lewiston, in part, alleging negligence …

Chronic insomnia can lead to depression, anxiety, cognitive difficulties, workplace absenteeism, underperformance, and high employee turnover as well as medical issues such as Alzheimer’s, hypertension, myocardial infarction, obesity, and diabetes. Researchers have argued that healthful sleep is the most important factor in predicting longevity over diet, exercise, and heredity. Previous studies consider insomnia but do not address the specific issue of the levels of insomnia experienced by school principals and superintendents in Missouri. For several decades time studies have been used as a decision-making tool in criminal justice settings to assist in staffing allocation decisions. Despite their prevalence, these studies have rarely been documented in empirical journals or subjected to peer-review. Publication bias is a likely issue, with only those providing favorable results reaching a public audience. This study reviews the literature and documents a time study of probation and parole officer workloads conducted in a rural Western state. Results reveal probation and parole rely heavily on office-based interactions with probationers and parolees. An over-reliance on compliance enforcement, substantiated by other research in …

How Law Enforcement Unmanned Aircraft Systems (Uas) Could Improve Tactical Response To Active Shooter Situations: The Case Of The 2017 Las Vegas Shooting, Ryan J. Wallace, Jon M. Loffi
International Journal of Aviation, Aeronautics, and Aerospace
Using a case study methodology, this paper assesses the unique tactical challenges faced by law enforcement officers responding to the October 1, 2017, Las Vegas active shooter incident. The authors assessed the tactical strengths of the assailant, Stephen Paddock, and challenges faced by law enforcement personnel. The authors present several proposed applications of unmanned aircraft systems that could have potentially mitigated the active shooter’s tactical advantages.

Dam removal in the United States has continued to increase in pace and scope, transitioning from a dam-safety engineering practice to an integral component of many large-scale river restoration programmes. At the same time, knowledge around dam removals remains fragmented by disciplinary silos and a lack of knowledge transfer between communities of practice around dam removal and academia. Here we argue that dam removal science, as a study of large restoration-oriented infrastructure interventions, requires the construction of an interdisciplinary framework to integrate knowledge relevant to decision-making on dam removal. Take Me Out To The Ball Game? The Effect Of Crime On Major League Baseball Game Attendance, Allison Jakubek

Major League Baseball attendance has been examined since the league’s establishment in 1869. Winning percentage, opponent quality, and stadium quality have all been deemed significant determinants of increasing attendance, but deterring factors have yet to be closely examined. Since a majority of professional sports stadiums are constructed in economically poor, crime ridden areas, it seems natural to assume that crime could have an impact on people’s desire to attend Major League Baseball games. Panel data collected on twenty-eight teams over the course of ten years was used to determine whether or not crime rates have a significant effect on attendance.
