A while back, in November 2007, some students came down after class and asked me why I never told any personal stories during class. I gave them my standard reply that class time was too valuable for the telling of "war stories." "Well," they countered, "would you be willing to tell your 'back story' after class?" I had no objection to that, as long as they would set it up. I half-expected nothing further to come of it, but the students did set it up, publicizing it to the whole law school community. Gaming regulators are uniquely positioned state agents, who must consider contradictory goals in their day-to-day actions. They must protect the public (and maintain the legitimacy of government) but are also responsible for ensuring that the gaming industry provides needed revenue to the state. To that end, regulators are not only responsible for promoting the legitimacy of the government but also, to some extent, must consider how they can encourage the legitimization of a previously illegal behavior. Prior research has examined regulators’ attempts to balance such “structural contradictions” through their licensing process, but little research has been done on regulatory responses …

In 2008, thirty-one people were the victims of homicide in the state of Maine. Even more startling: nineteen of these homicides stemmed from domestic violence, possibly the largest number of domestic-violence-related killings in the state's history. This means that nearly 70 percent of Maine's homicides in 2008 were the result of domestic violence. Amendments made in 2007 (and implemented in February 2008) to Maine's Criminal Code have criminalized particular instances of domestic violence as “enhanced” crimes of violence. This allows prosecutors to consider “prior acts” of domestic abuse when deciding how to charge a criminal defendant accused of a domestic-violence-related …

Is the rate of property crime increasing in Alaska? Data from six Alaska jurisdictions show it’s a complex question. Dr. Brad Myrstol, interim Justice Center director developed a series of graphs to show how the rate of property crime in Alaska is impacted by factors including time, place of crime and type of crime. This presentation focuses on the property crimes of larceny-theft, shoplifting (which is a subcategory of larceny), burglary, and motor vehicle theft. The time period is from 1985 to 2016. The jurisdictions reviewed are: Anchorage, Fairbanks, Juneau, Kenai, North Slope Borough and Palmer. Each use the Uniform …

Studies have shown that changing the number of police officers has no effect on crime rates. This article explains why and describes alternative measures. An accompanying chart compares rates of violent crime in Alaska for 1986–2015 with the number of police officers per 1,000 residents for the same period.

Definitive conclusions about the impact of Senate Bill 91 on the rate of property crimes in Alaska are not possible for a number of reasons, including that the most current data cover less than six months following implementation of the first phase of the law. Accompanying figures show rates of incidents of shoplifting, motor vehicle theft, burglary, and larceny theft reported to police in 1985–2016.

The Crisis Intervention Team (CIT) is a police-based, first responders’ pre-arrest jail diversion model for individuals with mental illness and/or substance abuse disorder. After decades of a culture of social isolationism, we see how colleges and universities have gradu- ally become the battlegrounds of national issues such as race, religion, sexual assault, gun control and free speech. Over the last 50 years more than 120 cases related in one way or another to higher education have been heard by the U.S. Supreme Court. Hundreds of other cases have been filed, only for the justices to deny hearing them.
However, most colleges and universities are not well prepared to deal with litigation. For one thing institutions of higher education have had for decades a …

Ramblin’ Round Raton (RRR) coordinated a walkability workshop for members of the community to come together at the Center for Sustainable Community and assess different parts of the city for pedestrian friendliness. The group modeled the event after a similar workshop in the Village of Cuba in 2009. Prior to the workshop, RRR identified six areas of focus. They chose the locations because they are popular pedestrian thoroughfares, close to schools, or thought to be confusing areas for pedestrians.

This paper presents a framework involving the use of remote sensing imagery and image processing techniques to analyze a 2014 super typhoon, Typhoon Nuri, and the cold occlusion that occurred in the northwestern Pacific Ocean. The purpose of this study was to predict the tracks and profiles of Typhoon Nuri and the corresponding association with the induction of cold front occlusion. Three-dimensional typhoon profiles were implemented to investigate the in-depth distribution of the cloud top from surface cloud images. The results showed that cold fronts and southwesterly airflow accompanied by warm air masses occurred at the front ends of the …

A growing body of evidence links differing managerial practices, specifically ones addressing environmental sustainability and the management of people, to variations in performance observed across firms and countries. Firms (and by extension jurisdictions) that invest in better environmental policies (sustainability) and that empower workers (inclusivity) tend to outperform, over the long run, those that do not. Despite the gains associated with these inclusive and sustainable management techniques, large differences in the adoption of even the most basic management practices persist. This article is intended to provide a practical lens into how Home Rule issues unfold in complex matters involving the City, and to suggest how a much-needed Home Rule constitutional amendment could re-shape or, at the very least, clarify Home Rule standards. Section II will provide some historical and legal background on Home Rule; Section III will analyze some of the more well-known Home Rule cases that the Law Department litigated during the Bloomberg Administration; and Section IV will discuss insights gleaned with respect to, and will offer several recommendations for, the future of Home Rule in New York.

The budget for the administration of justice in the State of Maine is a study in contrasts. During the last two decades, the lack of sufficient dollars appropriated to Maine Judicial Branch and the impact that this underfunding has had on people seeking access to justice have created consistent concerns for leaders in the Judicial Branch as well as for those in the Executive and Legislative Branches. Despite these challenges, however, the administrative structure of the Maine Judicial Branch stands as a model for states across the country. Understanding the genesis of this contrast will be critical to planning for …
