In May 1861, President Abraham Lincoln's decision to suspend habeas corpus in Baltimore following an attack on Federal troops as they marched through Baltimore on April 19th to answer Lincoln’s call to defend the Capitol. To complicate matters further, Congress was still in recess, so they could not legislate a solution to the growing insurgency. In order to check these actions, Abraham Lincoln authorized General Scott to suspend Habeas Corpus between Baltimore and Philadelphia. When John Merryman was arrested, detained, and denied habeas corpus, Chief Justice Roger B. Taney issued an in-chambers decision, Ex Parte Merryman, to voice his …

This paper will explore the question: “in what ways does DACA status influence undocumented students’ ability to access higher education in San Francisco and Bay Area, California?” Even though DACA does not encompass any direct policies regarding access to education, there is a very strong correlation between having DACA status and accessing higher education for the undocumented students. In this research, I highlight the voices of undocumented students through the method of testimonio. Migrants have long turned to self-employment in host country labor markets due to not only racial and ethnic prejudices, but also issues of local language proficiency and lack of recognition of the academic degree from the sending country. The taxi industry, one particular occupational niche dominated by migrants, has long been studied by scholars. However, the industry has evolved into a newer and understudied form of transportation: ridesharing. This study argues that in the case of the ridesharing industry, drivers did indeed turn to the occupation because of factors such as insufficient English language level and foreign academic degrees, but …

Within the United States there is a long history of immigration and citizenship law and policy being shaped by the idea that certain immigrant populations are a threat to American society. Such ideas justified the Alien and Sedition Acts, the Chinese Exclusion Act, the enactment of new deportation grounds in 1917, and the adoption of national origin quotas in 1924. The repeal or revision of these laws has required discrediting the immigrant threat narratives justifying them. Immigrants have done this by demonstrating their respectability—their commitment and adherence to mainstream American values, norms, and practices. Scholars in the humanities and the …

Strictly Speaking: Courts Should Not Adopt Strict Scrutiny For Firearm Regulations, Andrew Kimball

A militia right or an individual right? In District of Columbia v. Heller, the Supreme Court of the United States declared that the Second Amendment protects an individual’s right to a firearm outside the context of a militia. While pronouncing the individual right to a gun as fundamental, the Court declined to define an appropriate standard of review to assess firearm regulations. Thus, the Heller decision opened the floodgates for legal challenges to firearm regulations across the nation. Absent direction from the Supreme Court, many lower courts reacted by applying intermediate scrutiny, but in Kolbe v. Hogan the Fourth Circuit …

The problem explored in this mixed-method action research is that challenges to sustainable economic development and basic community services increase, as populations in cities and towns increase. A city is a human settlement with well-defined demarcation points. The “Right” Right To Environmental Protection: What We Can Discern From The American And Indian Constitutional Experience, Deepa Badrinarayana

Should there be a constitutional right to environmental protection? Arguments for and against are aplenty, but there is no consensus on this issue. Drawing on the experience within the U.S. and Indian Constitutions, this article posits that the right to environmental protection has normative and practical significance, because a constitutional right attaches to an individual and, hence, can protect an individual from environmental harms, whereas environmental laws, that focus primarily on reducing adverse environmental impact on a general population, may not. As part of the U.K.’s electronic surveillance program, the Government Communications Headquarters (GCHQ), started in 1909 to combat German Spies, now collects metadata from both foreigners and its own citizens. Through the express statutory authority of the Regulation of Investigatory Powers Act of 2000 (RIPA), and a loophole in section 94 of the Telecommunications Act of 1984, the GCHQ collects metadata, which is all of the information that is extrinsic to the actual contents of a communication. The GCHQ can request an authorization from a public authority—a member of its own staff—to collect traffic data, service use information, or subscriber …

Motor Vehicle Theft Arrests Reported In Alaska, 1985–2016, Random Reamey

This fact sheet presents data on motor vehicle theft arrests reported in Alaska from 1985 to 2016 as reported in the Alaska Department of Public Safety publication Crime in Alaska. Overall, the motor vehicle arrest rate consistently declined between 1990 and 2014 when it reached the lowest level in the 1985–2016 period. The motor vehicle arrest rate rebounded in 2015 and 2016. Increases in Alaska motor vehicle arrest rates in 2015 and 2016 were particularly pronounced among adults and males, while motor vehicle arrest rates for juveniles and females remained minimal in comparison. On average, adults accounted for 62.6 percent …

In this dissertation, I explore the role of law in policing operations targeting cyber sex offenders in the United States. Specifically, I examine enforcement in this crime arena as part of an ongoing expansion within the carceral, surveillance, risk-based state. I argue that imprecision and lack of clarity within American law – particularly in the evolving world of online interactions – generate hazy, arbitrary applications in law enforcement. On this point, I submit that absence of legal clarity undermines law enforcement efforts to address crimes – both within and beyond the cyber world. Extensive analysis and interpretation have occurred concerning the Marquis de Lafayette and his contributions to the American War for Independence and the Revolutionary French era. However, the discourse on his wife, Adrienne de Noailles, the Marquise de La Fayette, has been confined to a chapter within her husband's larger narrative. Examining her agency over her circumstances, Adrienne proves to be more than an idealistic angel suffering from a tumultuous time period.
