"Scientific evidence really nails this man to the wall," the Harris County, Texas prosecutor told the jurors in closing statements. At trial, George Rodriguez claimed he was innocent and that he had been working a factory the day of the crime. The prosecutor emphasized, however, that the blood type of swabs taken from the victim showed that Rodriguez did commit the crime and that a hair from the crime scene matched him. But seventeen years later, the same hair was tested again, this time using DNA analysis, and the evidence cleared Rodriguez and ultimately led to the crime crime lab …

This paper considers the role that litigation might play in ending the human rights crisis of solitary confinement in Canada while also examining the relationship of prisoner rights litigation to broader, anti-carceral social movements. The paper proceeds in four parts. The first section provides a brief overview of the widespread use of solitary confinement in Canada’s federal prisons and in provincial and territorial jails. Next, current litigation seeking an end to solitary confinement in the federal prisons system is located in the context of a long history of prisoner rights litigation in both the US and Canada. Despite studies by legal and social-justice organizations pointing to connections between school-based police referrals and arrests that lead youth (particularly of color) into the juvenile-justice courts and criminal courts and are funneling students of color into the school-to-prison pipeline, schools increasing use school resource officers (SROs) in programs on K-12 campuses. Much of the academic literature about SROs in schools highlight the rationale for placing programs in urban schools from the perspectives of policymakers, legislators, members of the juvenile- and criminal-justice systems, and school district officials. Student conduct processes in higher education have been studied and theorized extensively from a structural perspective, yielding a wealth of guidance for practitioners on how they can best design and administer disciplinary interventions (e.g., Lancaster & Waryold, 2008b). However, very little published research has focused on students' perceptions of and experiences with student conduct processes, and to what extent these are congruent with the espoused learning goals of student conduct practitioners (Dannells, 1997; Karp & Sacks, 2014; Stimpson & Stimpson, 2008). Lesbian, gay, bisexual, and transgender (LGBT) identities within the workplace have recently gained greater attention as significant demographic categories. A key question that emerges from the limited scholarship on LGBT employment in the federal government is whether there is a distinction between the experiences of employees within federal security agencies, defined here as the five major agencies that provide civilian support to the defense and military structures of the United States, and employees of other federal agencies. Crime analysts play a pivotal role in evidence-based policing by readily diagnosing the nature of crime and disorder problems. Such analysis products are key in the design of evidence-based strategies. The role of analysts in the subsequent process of evidence-based policing, the evaluation of programs to determine what works, is less known. The current study seeks to fill this gap in the literature through a survey of the International Association of Crime Analyst Membership. In the 1960s and 1970s, New York City was in decline. Crime was rising, jobs were leaving, and the population was falling. At the same time, much of the historic city was being lost and replaced by less distinctive architecture. But the declining city offered an opening for recovery and re-imagining. New residents moved into old, declining neighborhoods. Gentrification stabilized sections of the Bronx, Manhattan, and Brooklyn. Between 1965 and 1989 the city designated more than fifty historic districts, and those areas prevented further decay and anchored the recovery. Unlike other older cities, New York continues to grow. Research identifies various place features (e.g., bars, schools, public transportation stops) that generate or attract crime. What is less clear is how the spatial influence of these place features compares across relatively similar environments, even for the same crime. In this study, risk terrain modeling (RTM), a geospatial crime forecasting and diagnostic tool, is utilized to identify place features that increase the risk of robbery and their particular spatial influence in Chicago, Illinois; Newark, New Jersey; and Kansas City, Missouri. The results show that the risk factors for robbery are similar between environments, but not necessarily identical. Further, some factors …

Risk terrain modeling (RTM) is a geospatial crime analysis tool designed to diagnose environmental risk factors for crime and identify the places where their spatial influence is collocated to produce vulnerability for illegal behavior. However, the collocation of certain risk factors’ spatial influences may result in more crimes than the collocation of a different set of risk factors’ spatial influences. Absent from existing RTM outputs and methods is a straightforward method to compare these relative interactions and their effects on crime. Policing strategies that seek to simultaneously combat crime and vehicle crashes operate under the assumption that these two problems have a corollary relationship—an assumption that has received scant empirical attention and is the focus of the present study. Geocoded vehicle crash, violent crime, and property crime totals across were aggregated to Indianapolis census blocks over a 36-month period (2011-2013). Time series negative binomial regression and local indicators of spatial autocorrelation analyses were conducted. Results indicate that both violent and property crime are significantly related to vehicle crash counts, both overall and during the temporal confines of patrol tours. Relationship strength …

Canada’s immigration regulations and policy instructions, collectively known as ‘Protecting Workers from Abuse and Exploitation’ (PWAE), instruct visa officials not to process temporary work permits when there is suspicion that migrants may be at risk of sexual abuse or exploitation in industries related to sex work. The regulations are part of Canada’s temporary foreign worker program, located within an anti-trafficking initiative.

"Solid waste and leachate generation from solid waste landfills has a legacy of detrimental and toxic impacts on the environment. Disposal practices are expensive, failure prone and have not been able to keep up with the pace of disposal of toxic compounds. In general, a landfill acts as a "bathtub" with infiltration of water through the landfill cover into the landfill, reacting with the waste and transferring toxic components into the leachate. Irrigating the evapotranspiration (ET) covers with leachate collected from the landfill has been developed and applied. Such methods can keep the leached pollutants in a loop, which reduces …

Ground-penetrating radar (GPR) is increasingly being used in transportation projects to monitor the performance of roadways and bridges and to identify buried structures. The objective of this thesis was to evaluate the use of GPR for the identification of bridge scour and to estimate the depth of shallow rock for geotechnical site investigations. The ability to understand and predict scour at bridges is a requirement for safe, economical foundation design and is important for the development of feasible scour monitoring systems. Over the past few years, scholars, legislators, and politicians have come to recognize that our current state of“mass incarceration” is the result of serious dysfunction in our criminal justice system. As a consequence, there has been significant attention to the causes of mass incarceration. These include the war on drugs and political decisions based on a “law and order” perspective. Congressional and state legislative enactments increased the financing of the expansion of police powers and provided for severely punitive sentencing statutes, thereby giving prosecutors uniquely powerful weapons in securing guilty pleas. All of this occurred as crime rates dropped.

Reflecting concerns regarding the suitability of managing certain juvenile offenders within the juvenile justice system, the Court has embraced the transfer of juveniles to adult court as a necessary measure. Among the factors to be considered when deciding between retaining an offender in the juvenile system and transferring him to the adult court concerns his amenability to treatment. Little empirical research has been devoted to this topic, especially with regard to the circumstances that may influence these clinical decisions. Among other provisions of the Trans-Pacific Partnership (TPP) Agreement, a new clause on encryption technology (‘Encryption Clause’) is particularly noteworthy. By tracing the history of decades-long encryption control, this article underscores how this clause implicates international order. Modern encryption technology was conceived and developed during World Wars. Painted by such a war-time legacy, encryption has been treated as a ‘dual-use’ technology and has been subject to export control since the end of World War II via the Coordinating Committee for the Control of Multinational Trade (COCOM) and, later, the Wassenaar Arrangement. Central to the separation of powers and the rule of law, judicial review empowers the courts to examine the exercise of discretionary power. While there is no general doctrine of deference, judical review in Singapore emphasises the green-light approach in facilitating good governance, and is sensitive to the political, socio-cultural and economic context. However, the jurisprudence also indicates a nuanced and robust approach to better regulate the decision-makers' latitude. This article presents policy, practice and theory implications of a case study of a youth curfew. The original case study of the Northbridge Policy Project set out to document the purposes of the Northbridge Policy, how policy was implemented, and to evaluate the effectiveness of this approach as a generalised response to child welfare and youth crime. The study synthesised data from multiple sources. The original study concluded that although the project was well resourced, well managed and had improved greatly inter-agency collaboration for child protection, these benefits could have been achieved without the curfew, which undermined some preventative aspects …

The Supreme Court of Canada’s decision in Safarzadeh-Markhali holds great significance, beyond Criminal Law, in the area of Statutory Interpretation: in Markhali, the Court decisively endorses a new rigorous approach to construing legislative purpose. Previously, while legislation itself was long-interpreted utilizing rigorous approaches, legislative purpose was typically construed ad hoc while providing only summary justification. Off-road vehicles (hereafter, ORVs) rank high among public-land management challenges because they are popular, often impair environmental conditions, and may cause conflicts with other recreational users. Unit-level planning for federal lands increasingly translates broad, system-wide objectives, such as maintenance of ecological integrity, into place-based limitations on ORV use to minimize and mitigate adverse impacts on wildlife.
