“The Biggest Problem With You…”: Racial Profiling And Canada’S Program Of Extra-Territorial Migrant Interdiction, Simon Wallace, Benjamin Perryman, Gábor Lukács, Sean Rehaag
Osgoode Hall Law Journal
In 2019, two Roma-Hungarian travellers were prevented from boarding their flight to Canada. Even though their documents were in order and their travel was legitimate, they were singled out for examination and extra scrutiny. This article—relying on new evidence produced in a series of legal proceedings—shows how Canada has implemented a de facto system of racial profiling in airports overseas. This program was not built overnight, but produced by a series of historical accretions, all organized around the idea that potential refugees can be detected by their race. This article shows how Canada, to deter asylum seekers, has conscripted private …
Sentencing Vulnerability: Conceptualizing The Incorporation Of Personal Characteristics And Experiences At Sentencing, Adelina Iftene
Sentencing Vulnerability: Conceptualizing The Incorporation Of Personal Characteristics And Experiences At Sentencing, Adelina Iftene
Osgoode Hall Law Journal
Social inequalities that lead to criminal conduct are often not considered in sentencing; individuals subject to structural inequities receive the same formal sentence as those convicted of like crimes irrespective of the latter’s social advantage. Individual characteristics may also affect how a sentence will be experienced by an individual. While Characteristics and Experience-Sensitive Sentencing (CESS) already exists in various forms and to various degrees in sentencing theory and praxis, a more cohesive, comprehensive, and principled CESS remains wanting. Building on existing approaches, this article locates CESS as a necessary response to equality-based concerns arising from current mainstream sentencing practice. Thus, …
Studying Religious Symbols And Bias In Court Proceedings, Nicholas A.R. Fraser, Colton Fehr
Studying Religious Symbols And Bias In Court Proceedings, Nicholas A.R. Fraser, Colton Fehr
Osgoode Hall Law Journal
MOCK JURY STUDIES INVESTIGATING the impact of religious symbols on jurors have produced conflicting findings, raising questions about how religious bias should be studied in judicial settings. Our study adds to the literature in three ways. First, we develop a clear theoretical framework which identifies dispositional and situational triggers allowing researchers to more precisely define and measure religiously motivated bias. Second, we show that mock jury experiments with video-based treatments simulating audio-visual cues are more likely to produce reliable findings relative to text-based studies. Third, we present the first empirical evidence of how mock jurors react to courtroom oaths. Our …
Does Lady Justice Need A Sword? Indictment: The Criminal Justice System On Trial By Benjamin Perrin, Noel Semple
Does Lady Justice Need A Sword? Indictment: The Criminal Justice System On Trial By Benjamin Perrin, Noel Semple
Osgoode Hall Law Journal
LADY JUSTICE CAN OFTEN BE FOUND, in statue form, in or near courthouses. This symbol of the Western justice system is blindfolded to show neutrality. She carries a scale to weigh facts and arguments fairly. Sometimes, she also holds an olive leaf to symbolize mercy and healing. A sword is the other accessory that Lady Justice invariably carries. The sword is a ubiquitous part of this symbol because most people believe that justice in general, and criminal justice in particular, necessarily involves inflicting pain upon wrongdoers.
Development And Validation Of The Informal Safety Leadership Measure, Ashley L. Gill
Development And Validation Of The Informal Safety Leadership Measure, Ashley L. Gill
Dissertations
This research develops and validates a measure of the emerging concept of informal safety leadership (ISL), which integrates elements of safety leadership and informal leadership to address a significant gap in organizational safety literature. Despite extensive research on formal safety leadership, there remains limited understanding of how non-managerial employees influence safety practices and culture within organizations. This dissertation develops and validates a comprehensive measure of informal safety leadership through a sequential mixed-methods approach incorporating a pilot study and two additional studies. First, a pilot study employed focus groups with health, safety, and environmental professionals to identify key dimensions of ISL. …

This paper addresses key issues related to the admissibility of digital evidence—a pivotal concern in modern legal proceedings. The use of such evidence is fraught with challenges, particularly due to the rapid technological changes and heightened concerns surrounding electronic data privacy. In the criminal justice system, these challenges can impact the admissibility of evidence, its presentation in trial, and the charging and resolution of cases.
This study examines the difficulties of admitting digital proof before the UAE judiciary. Considering the trend towards the digital world as an alternative to the tangible world, interest is increasing in the extent of the …

Machine Learning Crime Prediction Models And The Gap Between Research And Implementation: A Systematic Review, Ricardo Huamantingo, Miguel Cano-Lengua, Ciro Rodriguez
Karbala International Journal of Modern Science
A crime is an illegal or violent act committed by one individual against another. The increasing crime rate has become a major concern as it negatively affects people's quality of life and generates significant social and economic costs. This study aims to identify the most widely used machine learning (ML) models for crime prediction, determine evaluation metrics for assessing model performance, and analyze key data characteristics to enhance real-world implementation. The study follows the Preferred Reporting Items for Systematic Reviews and Meta-Analyses (PRISMA) methodology. A search string was formulated using the population, intervention, comparison, and outcomes (PICO) framework and applied …

Public Safety In Smart Cities: An Experimental Study To Monitor And Record Vehicles’ Movements, Ali A. Albar, Mirza A. Baig
Yanbu Journal of Engineering and Science
This research addresses the critical issue of enhancing public safety in smart cities, with a particular focus on industrial cities in Saudi Arabia. Despite the advanced infrastructure and high safety standards in industrial cities, there are safety challenges, particularly the vulnerability of residential properties to burglaries during holidays and extended breaks. To mitigate these risks, the research proposes leveraging existing infrastructure to implement surveillance systems that monitor vehicle movements using RFID technology and smart sensors, thereby enhancing safety, supporting law enforcement in crime detection, and protecting local communities. The study also acknowledges the reduced social interaction often associated with the …

A Chat Room In A City Of Missouri's Public Safety Answering Point, Rochele Wynee' Young
Walden Dissertations and Doctoral Studies
Despite new and emerging communications technologies to improve access to 911 emergency services for people with speech, hearing, and cognitive disabilities, there continue to be access barriers for those who may require silent communications due to the nature of the emergency. Chat rooms in 911 communications present a promising solution to this challenge. However, the current literature has inadequately examined the use of chat rooms in 911 communications, mainly due to the nascent nature of this technology. This study aimed to fill that gap by providing valuable insights to enhance access to 911 emergency services for individuals who may require …
Mental Health Services Utilization And Health Insurance Status Among Firefighters, Yvette Evans
Mental Health Services Utilization And Health Insurance Status Among Firefighters, Yvette Evans
Walden Dissertations and Doctoral Studies
Firefighting exposes individuals to significant psychological dangers, leading to mental health issues like anxiety, depression, and posttraumatic stress disorder. This study investigated the underuse of mental health services among firefighters, focusing on the relationship between health insurance status and service utilization while considering age, gender, race, and ethnicity. Data from the National Health Interview Survey within the Integrated Public Use Microdata Series were analyzed using a quantitative approach. The study employed logistic regression to examine the likelihood of mental health service utilization based on health insurance status, adjusting for demographic factors. The sample included 1,526 firefighters, predominantly male (78.9%) and …

Correctional Psychology And Training Implications: A Mixed Analysis Of Trainee Knowledge And Application Of Ethical Dilemmas In Corrections, And A Closer Look At The Experience Of Support From Generalist Training, Alyssa A. Hoyt
Electronic Theses and Dissertations Archive
Correctional psychology, a subfield of psychology, has long been comprised of its own distinct purpose, focus, and competencies. Yet correctional psychology remains unrecognized today as a formal American Psychology Association (APA) specialization. Unlike forensic psychology, without an APA specialization, and subsequent structured training standards, scholars have argued that correctional mental health professionals may be ill-prepared to navigate unique ethical dilemmas inherent to the correctional environment. The present mixed analysis study aimed to contribute to this discussion by assessing psychology trainees’ ability to respond to hypothetical ethical dilemmas in a manner consistent with correctional environments, and whether prior correctional experience/ exposure …
Evicted From The Outside, Colleen Cosgriff
Evicted From The Outside, Colleen Cosgriff
Maine Law Review
In recent years, Maine has seen an increase in the number of people experiencing homelessness who are living outdoors. People living in these circumstances often shelter together in groups of tents or other temporary structures commonly referred to as “encampments.”As municipalities across Maine struggled with how best to respond to the increase in encampments across the state, the United States Supreme Court decided City of Grants Pass v. Johnson, a case originating in Grants Pass, Oregon. Grants Pass wanted to issue civil and criminal fines to people for sleeping outdoors, even when no alternative shelter was available. The city ultimately …

A System For Predictive Crowd Management Using Coupled Analysis Of Crowd State And Environmental Information, Mithun Kumar S R
Defensive Publications Series
Some crowd management systems analyze crowd dynamics, such as density and flow, in isolation from the physical environment. The disclosed system can couple a Dynamic Crowd State Vector, which may quantify real-time crowd metrics, with a Hyper-Local Condition Vector, which may quantify environmental factors such as surface integrity, passage width, and lighting. A machine learning model can process the real-time interaction between these two vectors to generate a unified, predictive risk score for a specific geographic zone. The resulting coupled analysis may facilitate the proactive identification of context-specific hazards, such as moderate crowds in some conditions, which may aid in …

Unfinished Business: An Analysis Of The Permanent Forum On People Of African Descent, Satang Nabaneh
Journal of African Policy Studies
Communities of African descent worldwide experience persistent structural discrimination, manifested in poverty, underdevelopment, marginalization, social exclusion, and economic disparities. The historical crimes of enslavement, the transatlantic trade of enslaved Africans, apartheid, and colonialism, recognized as crimes against humanity and potentially constituting genocide, have left enduring trauma and systemic repercussions. These atrocities are demonstrably linked to current disparities in health, welfare, and the fulfillment of human rights for people of African descent. The International Decade for People of African Descent (2015 to 2024), proclaimed by the United Nations General Assembly in 2015 under the theme “People of African Descent: Recognition, Justice …

Community Perspectives On Engaging Stakeholders For Human-Sumatran Tiger Coexistence In The Bukit Barisan Selatan Landscape, Rinekso Soekmadi, Novriyanti Novriyanti, Burhanuddin Masy’Ud, Damayanti Buchori, Christine Wulandari, Ismanto Ismanto
Forest and Society
The Bukit Barisan Selatan (BBS) landscape, a vital habitat for the Sumatran tiger (Panthera tigris sumatrae), is increasingly degraded and fragmented by plantation and agricultural expansion, driving tigers into human-dominated areas and creating conflict zones beyond conservation boundaries. However, despite global frameworks like the Kunming-Montreal 2050 Biodiversity Framework and IUCN advocating coexistence by integrating ecological and socio-economic priorities, the practical implementation at the site level remains uncertain, particularly regarding local perspectives on coexistence and their alignment with competing stakeholder interests. This study analyzes the alignment of parties in the context of the potential coexistence of human-tiger conflicts in …

Missing Information: A Content Analysis Of U.S. Missing Persons Alerts Using The Missing And Endangered Persons Message Framework, Lauren Cain, Jeannette Sutton, Hugh Walpole, Micki Olson
Emergency Preparedness, Homeland Security, and Cybersecurity Faculty Scholarship
Missing and endangered person (MEP) alerts are a prominent messaging strategy used by law enforcement agencies in the United States to recover missing persons, with over 1,800 AMBER Alerts issued via the Wireless Emergency Alert (WEA) system and nearly 40 similar alerts introduced by state legislatures for other groups of missing people. Despite their prevalent use, the contents of MEP alerts have not yet been empirically examined. Drawing from warning message design and AMBER Alert best practices, we propose a new MEP Message Framework and use it to evaluate the contents of 4,053 MEP WEAs sent from 2013 to 2023. …

The Enduring Relevance Of The Right To Strike: Arguments For Further Legal Protection And Regulatory Reform, Tonia Novitz, Katherine Fitzpatrick, Jeffrey Vogt
Comparative Labor Law & Policy Journal
In this thematic issue, the contributors demonstrate the past and contemporary relevance of a right to strike. Some authors do so with reference to the long-standing role that such an entitlement plays in protecting dignity, democracy, and other vital public interests. Attention is also paid to emerging contemporary issues, whereby the right to strike offers important leverage that would otherwise be absent, for example countering abusive treatment of those at work in global supply chain practices and the environmental degradation of the planet. They all conclude that, while it is possible to utilise existing legal protections of a right to …

Balancing The Right To Strike And Other Public Interests: The Importance Of The Status Of The Right To Strike, Petra Herzfeld Olsson, Shae Mccrystal
Comparative Labor Law & Policy Journal
The regulation of strike action involves the balancing of competing public interests – the benefits derived from collective bargaining and the right to strike and others including public safety, health, welfare, and industrial peace. We explore how this balancing act plays out in the legal systems of two national jurisdictions, Australia and Sweden, and through the ILO principles on freedom of association as developed by the ILO’s supervisory bodies. We seek to understand how different regulatory approaches to these competing public interests produces different outcomes and the potential consequences where protecting other public interests is prioritised over the right to …

Youth violence—the deliberate use of physical force or harm by young people between the ages of 10 and 24 to intimidate or cause harm to others, both online and offline—is a critical public health issue in the United States. Yet, successfully predicting future violent offenders is a complex and challenging task, as the question of why some youths resort to extreme violence while others refrain from it—despite facing similar risk factors—remains widely debated. This article highlights both risk and protective factors of youth violence through a socio-ecological lens to offer a comprehensive understanding of the multifaceted factors driving youth violence …

Residential development within the wildland-urban interface (WUI) has greatly expanded in the United States since the 1990s, amplifying wildfire risk by placing people and structures in greater proximity to flammable vegetation. Household wildfire mitigation actions can vary substantially by cost, knowledge required, and perceived effectiveness, but few studies have examined them separately and how their adoption varies by housing tenure in the context of wildfires. To address this gap, we surveyed residents living in WUI areas within Southern California near recent burn scars in the Santa Ana and San Bernardino Mountain ranges. Drawing on the Protection Motivation Theory and the …
