The Intersection Of Exploitation And Coercion In Cases Of Canadian Labour Trafficking, Jesse Beatson, Jill Hanley, Alexandra Ricard-Guay

Journal of Law and Social Policy

Internationally, human trafficking intervention, research, and policy-making has leaned towards sex trafficking rather than labour trafficking. Aiming to understand the characteristics of labour trafficking within Canada, a country considered by many to have strong labour protections and clear pathways for labour migration, this article reports on a review of documented cases over the past fifteen years in Canada where labour exploitation intersected with coercion. Our analysis is centred on the notion that this is the crux of what constitutes labour trafficking—coercion being used to facilitate labour exploitation. In the aftermath of the 2016 elections there is ample data to examine trends in voter turnout across the states. This election cycle also provided the first national election in fifty years without the full protections of the Voting Rights Act (VRA). Previously covered states and jurisdictions were no longer required to obtain preclearance in the enactment of voting legislation. This thesis will seek to answer which interest was being served by the new voting laws in several states and whether the gutting of the Voting Rights Act by the U.S. Supreme Court had an impact on voter turnout. California’s black bear (Ursus americanus) population has tripled over the last 3 decades, causing an increased incidence of human–bear conflicts, many of which now occur in urban areas. Consequently, it is imperative that bear managers have the ability to monitor population parameters in both wildland and urban environments to help manage bears. Capture-mark-recapture (CMR) methods using uniquely typed genetic samples (DNA) collected via hair-snares have been widely used to monitor bears in wildland areas. Wildlife–vehicle collisions (WVCs) are a major research focus because of increasing human health and safety concerns and the potential for biological impacts on wildlife. A key component of both understanding the causes of WVCs and designing mitigation measures is the collection and analysis of environmental and roadway data at WVC sites. However, collecting these site data can be logistically challenging and potentially dangerous to researchers. We studied the feasibility and accuracy of using public geospatial datasets, particularly Google Earth and Street View, as an alternative approach to assessing WVC onsite covariates. Following presidential declarations of “war” on drugs and terror, domestic law enforcement agencies were saddled with difficult and dangerous new duties. They responded to the danger by becoming more dangerous themselves; increasingly adopting the training, tactics, and equipment of the United States military. This “militarization” of domestic police officers has, predictably, led to a breakdown in community policing, almost one thousand fatal shootings by police officers per year, and growing rifts between law enforcement agencies and the communities they are sworn to protect. The U.S. Supreme Court’s landmark case of Miranda v. Arizona created a culture in which police officers regularly warn arrestees that they have a right to remain silent, that anything they say can and will be used against them in a court of law, that they have the right to an attorney, and that if they cannot afford one, an attorney will be appointed to them. These Miranda warnings have a number of possible effects. Social impact bonds (SIBs) have recently generated a lot of excitement nationwide as an innovative way to finance social projects. A SIB is a financing mechanism that uses private capital to fund social services, with the government only repaying investors their capital plus a potential return on investment if improved social outcomes are achieved. As such, it brings together the private, public, and non-profit sectors in a manner that unlocks an additional source of capital to fund social service providers, promotes innovation, encourages interagency cooperation, and creates more accountability. An exciting new way to fund social services has recently emerged. This new financing mechanism, called a social impact bond (SIB), has the potential to help us tackle some of our nation’s most challenging social problems. Broadly speaking, a SIB is a type of “pay for success” contract where private investors provide the upfront capital to finance a social program, but only recoup their investment and realize returns if the program is successful. Like any new financing instrument, SIBs create numerous regulatory challenges that have not yet been addressed. One unresolved issue is the tax implications of a SIB investment. …

Broadly speaking, privacy doctrine suggests that the right to privacy is non-existent once one enters the public realm. Although some scholars contend that privacy ought to exist in public, “public privacy” has been defended largely with reference to other, ancillary values privacy may serve. For instance, public privacy may be necessary to make the freedom of association meaningful in practice.

This Article identifies a new dimension of public privacy, supplementing extant justifications for the right, by arguing that many efforts to maintain privacy while in “public” are properly conceptualized as forms of performative, expressive resistance against an ever-pervasive surveillance society. …

Too many lives are lost to injury in the United States and in Nevada. Nearly 200,000 people in our country die each year from injuries, which is equivalent to one death every three minutes (CDC 2017b). Over the last several decades, law and social science scholars have documented persistent racial inequality in the United States. This review focuses on mechanisms to explain this persistent pattern. We begin with policy making, a mechanism fundamental to all the others. We then examine one particularly important policy, the carceral state, which can be described as the most important policy response to the civil rights era. A significant body of scholarship on employment discrimination presents a site for explaining the transformation of law on the books into the law in action. The combination of increasing cougar populations and the rising human population in Wildland-Urban Interface (WUI) areas suggests that the number of human-cougar encounters will rise as well. The increase in human-cougar encounters creates potential issues in regard to public safety, public policy, and management of predators. For the purposes of this research, I employ a housing dataset for eleven counties in western Washington in order to quantify the impacts of a confirmed cougar sighting on the sale value of a home. Bridges throughout the nation are continuously deteriorating, and current improvement efforts have not been sufficient for closing the investment gap. Without investing in bridge condition today, the structural integrity of the bridges, as well as the comfort, cost, and most importantly safety of motorists is compromised. One of the centerpieces of the United States’ effort to combat climate change is the Environmental Protection Agency’s (EPA) controversial Clean Power Plan, which consists of the first-ever federal regulations requiring states to achieve massive carbon dioxide emissions reductions from existing fossil fuel-fired power plants. The regulations operate by setting interim and final emissions target dates for states to ultimately reach an aggregate 32% reduction in carbon emissions by the year 2030. In recent years, a particular strain of argument has arisen in response to decisions by courts or the government to extend certain rights to others. Grounded in religious freedom, these arguments suggest that individuals have a right to operate businesses or conduct their professional roles in a manner that conforms to their religious identity. For example, as courts and legislatures have extended the right to marry to same-sex couples, court clerks have refused to issue marriage certificates to such couples, claiming that to do so would violate their religious beliefs. In 2011 the National Crime Victimization Survey (NCVS) reported that of people who are employed and aged 16 and older, 24% of nonfatal violent incidents happened at work. To understand the magnitude of the problem, from 2005 to 2009, 572,000 nonfatal workplace crimes occurred against people aged 16 or older. Annually, the rate of workplace violence was about 5 victimizations per 1,000 employed persons aged 16 and older (Harrell 2011). The purpose of this study was to examine the relationship between school district spending on Internet access and student achievement, defined by graduation rates, in the state of Florida. Internet funding received for Internet access from E-rate funding administered by the Universal Service Administration Company (USAC) and graduation rates of the 67 school districts in the state of Florida were compared. Further, the data were adjusted for socio-economic status (SES) to determine the relationship between school districts' SES and spending on Internet access. With mass shootings occurring with frightening regularity, research into gun ownership behavior is becoming increasingly important for public policy creation and public safety. While extant research tells us that firearm ownership is woven deep into the historical fabric of American culture, scholarship has yet to fully explore predictors for gun ownership. Employing 2015 Pew Research Center political survey data, this study examines the predictive effects of birth cohort, political ideology, and attitudes towards gun control legislation on gun ownership, with and without controls, using hierarchical binary logistic regression models. The U.S. Department of Education and Title IX Educational Act of 1972 shaped the way institutions of higher education address and prevent student victimizations. The law originally sought to eliminate sex-based discrimination in education but has evolved to include sexual misconduct. Since the Dear Colleague Letter of 2011, the position of institutions has changed significantly in the way they address student victimization as it relates to dating violence, sexual assault, and stalking (Rosenthal, 2017). In 2010, Public Act 205 was passed and signed into law, revising Michigan School Code section 1250. This revision required compensation for teachers to be based on job performance and job accomplishments. Compensation based on performance or merit is a significant departure from existing practice wherein teachers are paid a step scale salary based on years of service and educational qualifications. The purpose of this phenomenological study was to investigate the lived experience of nine superintendents as it relates to the implementation of section 1250 of PA 205 in their respective districts.
