Bathroom Laws As Status Crimes, Stephen Rushin, Jenny Carroll
Bathroom Laws As Status Crimes, Stephen Rushin, Jenny Carroll
Faculty Publications & Other Works
A growing number of American jurisdictions have considered laws that prohibit trans individuals from using bathroom facilities consistent with their gender identities. Several scholars have criticized these so-called “bathroom laws” as a form of discrimination in violation of federal law. Few scholars, though, have considered the criminal justice implications of these proposals. By analyzing dozens of proposed bathroom laws, this Article explores how many laws do more than stigmatize the trans community—they effectively criminalize it. Some of these proposed laws would establish new categories of criminal offenses for trans individuals who use bathrooms consistent with their gender identity. Others would …

A Review Of State Standards For Batterer Intervention Treatment Programs And The Colorado Model, Angela Gover, Tara Richards
Criminology and Criminal Justice Faculty Publications
Many states aiming to improve domestic-violence-offender treatment have passed legislative standards for Batterer Intervention Treatment (BIT). This article reviews existing literature in relation to state standards for BIT in general and Colorado’s unique model for BIT specifically. In addition, existing research focused on the Colorado model’s adherence to evidence-based practices and principles is discussed, and ongoing research that examines the relationship between the novel elements of the Colorado model and BIT completion and recidivism is explained.

Infrastructure Financing: A Guide For Local Government Managers, Can Chen, John R. Bartle
Public Administration Faculty Publications
U.S. local governments play a key role in funding, operating, and maintaining local roads, bridges, airports, transit facilities, drinking water and sewer systems, and other types of infrastructure. However, as is widely publicized, local governments across the United States are facing a serious infrastructure deficit and are exploring new ways to finance needed expansions, upgrades, and repairs. More than half of U.S. city mayors highlighted infrastructure issues during their State of the City speeches in 2015 (National League of Cities 2015). According to a new survey sponsored by the U.S. Conference of Mayors (2016), aging and underfunded infrastructure is the …

Contemplated Amendments To Japan's 1947 Constitution: A Return To Iye, Kokutai And The Meiji State, Carl F. Goodman
Contemplated Amendments To Japan's 1947 Constitution: A Return To Iye, Kokutai And The Meiji State, Carl F. Goodman
Washington International Law Journal
The post World War II American Occupation of Japan was a huge programmatic success. Its disarmament, repatriation, land reform, and health programs put a defeated Japan on the road to recuperation, while providing a military shield that enabled Japan to focus on recovery from the War and rebuilding the country and economy. Perhaps its most enduring legacy was its Enlightenment-based, American-drafted, rights-oriented Constitution of 1947 [hereinafter “the Constitution”]. Drafted in English, the Constitution was promulgated in Japanese, resulting in some substantive changes. Among the most important of these were changing the English word “people” into the Japanese “kokumin” …
The Impact Of Owner Practices And Procedures On Construction Project Safety Performance, Huang Liu
The Impact Of Owner Practices And Procedures On Construction Project Safety Performance, Huang Liu
Theses and Dissertations--Civil Engineering
Construction sites are dangerous work environments. One traditional assumption prevails in the construction industry that construction safety should be the sole responsibility of the contractor. However, some safety researchers gradually begin to challenge this assumption. The elementary research in this field try to validate the existence of relationship of the owner’s practices and safety performance, which indicates that the involvements of the owner have a positive impact on improvement of safety performance. Therefore, the owner can and should take a responsibility of the project safety. Some subsequent research focus on collecting and summarizing the best safety practices and procedures of …
Data-Driven Adaptive Reynolds-Averaged Navier-Stokes K - Ω Models For Turbulent Flow-Field Simulations, Zhiyong Li
Data-Driven Adaptive Reynolds-Averaged Navier-Stokes K - Ω Models For Turbulent Flow-Field Simulations, Zhiyong Li
Theses and Dissertations--Mechanical and Aerospace Engineering
The data-driven adaptive algorithms are explored as a means of increasing the accuracy of Reynolds-averaged turbulence models. This dissertation presents two new data-driven adaptive computational models for simulating turbulent flow, where partial-but-incomplete measurement data is available. These models automatically adjust (i.e., adapts) the closure coefficients of the Reynolds-averaged Navier-Stokes (RANS) k-ω turbulence equations to improve agreement between the simulated flow and a set of prescribed measurement data.
The first approach is the data-driven adaptive RANS k-ω (D-DARK) model. It is validated with three canonical flow geometries: pipe flow, the backward-facing step, and flow around an airfoil. For all 3 test …

Investigating The Impact Of Levels Of Experience On Workload During Nuclear Power Plant Operations, Jonathan Harris
Investigating The Impact Of Levels Of Experience On Workload During Nuclear Power Plant Operations, Jonathan Harris
Electronic Theses and Dissertations
The human-machine interface (HMI) of a Nuclear Power Plant (NPP) Main Control Room (MCR) is complex. Understanding HMI factors that influence Reactor Operator (RO) performance and workload when controlling an NPP is important. The Nuclear Regulatory Commission (NRC) began a program of research known as the Human Performance Test Facility (HPTF) with the goal of collecting human performance data to better understand cognitive and physical elements that support safe control room operation. The HPTF team developed an experimental methodology to evaluate workload using perceived ratings, performance measures, and physiological correlates. This methodology focuses on tasks commonly performed during operations in …
Developing An Insider Threat Experimental Environment, Eric Ortiz
Developing An Insider Threat Experimental Environment, Eric Ortiz
Electronic Theses and Dissertations
Simulated, 3D gaming environments have been used for a wide-range of applications including training, entertainment, and experimentation in an assortment of domains for some time. This can be attributed to their unique ability to emulate multifaceted situations that may be difficult to control, while affording participants the opportunity to operate in a relatively safe environment. In cybersecurity research, investigation of insider threat behavior is an endeavor that has received little attention in terms of available environments and resources for experimental manipulation. This research effort aimed to close this gap. A simulated, 3D gaming environment and accompanying scenarios were developed for …

You Speak An "Infinite Deal Of Nothing": Prioritizing Free Speech Over Other Fundamental Rights, Jacqueline Ahearn
Journal of Civil Rights and Economic Development
(Excerpt)
This Comment will assert that the Court has likely caused a future increase in violence against women and other people who utilize, work for, or support abortion clinics, weakened the fundamental right to abortion, and prioritized free speech over equally important rights and interests. Part II will provide background on abortion and demonstrate the change in attitudes toward and increasing restrictions of abortion. Part III will discuss the history of buffer zones and McCullen and will look at how McCullen departs from free speech precedent. It will argue that the Court has incorrectly prioritized free speech as a result …
Colorado's About Face: Mechanics, Progress, And Challenges Facing Veterans Trauma Courts In Colorado, Karthik A. Venkatraj
Colorado's About Face: Mechanics, Progress, And Challenges Facing Veterans Trauma Courts In Colorado, Karthik A. Venkatraj
University of Colorado Law Review
The nature of asymmetrical warfare-defined by improvised explosive devices, indirect fire attacks, and suicide attackshas significantly altered the patterns of post-service challenges faced by veterans. Dealing with the unseen wounds of post-traumatic stress disorder (PTSD) and traumatic brain injury (TBI) that result from this type of combat has been one of the most difficult leadership challenges of my career as a young officer.
Although our nation's medical response to PTSD and TBI is well documented, the judicial challenges are not as apparent. Most recently, our nation has responded to this challenge with an alternative court, the Veterans Trauma Court (VTC), …

Pride And Prejudice And Administrative Zombies: How Economic Woes, Outdated Environmental Regulations, And State Exceptionalism Failed Flint, Michigan, Brie D. Sherwin
University of Colorado Law Review
It was just over forty years ago, shortly before the Safe Drinking Water Act was passed, that a group of mothers in the small, sleepy town of Woburn, Massachusetts realized there just may have been a connection between their children's leukemia and the town's water supply. They withstood the terrible smell and masked the water's rancid flavor with orange juice. For months they inquired, complained, and assembled in hopes that someone in a position of authority would notice what was so obvious to them. And for months they were dismissed and even ridiculed. Turns out they were right. It took …
Fighting Fines & Fees: Borrowing From Consumer Law To Combat Criminal Justice Debt Abuses, Neil L. Sobol
Fighting Fines & Fees: Borrowing From Consumer Law To Combat Criminal Justice Debt Abuses, Neil L. Sobol
University of Colorado Law Review
Although media and academic sources often describe mass incarceration as the primary challenge facing the American criminal justice system, the imposition of criminal justice debt may be a more pervasive problem. On March 14, 2016, the Department of Justice (DOJ) requested that state chief justices forward a letter to all judges in their jurisdictions describing the constitutional violations associated with the illegal assessment and enforcement of fines and fees. The DOJ's concerns include the incarceration of indigent individuals without determining whether the failure to pay is willful and the use of bail practices that result in impoverished defendants remaining in …
Understanding The Radicalization Process Of U.S. Homegrown Terrorists, Jose Manuel Vargas
Understanding The Radicalization Process Of U.S. Homegrown Terrorists, Jose Manuel Vargas
Walden Dissertations and Doctoral Studies
Radicalization is an aspect in the development of homegrown terrorists; however, researchers have been unable to establish a path to radicalization, uncover how individual and social factors influence radicalization, and identify how the Internet and social media mediate this process. The purpose of this case study was to explore individual and environmental factors that contribute to the radicalization of U.S. homegrown terrorists and identify interventions. Conversion theory was used to develop an understanding of the radicalization of U.S. homegrown terrorists. Data were derived from interviews of local and state law enforcement, military antiterrorism officers (AT), and security personnel from military …

The Impacts Of Recreational Marijuana Legalization On Colorado Policy Analysis On Amendment 64, Santhi Chilukuri
Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)
This report is a policy analysis on the impacts of Colorado’s Amendment 64. Marijuana is the most commonly used illicit drug in the U.S, and a Schedule 1 Drug under the federal government. Despite this, twenty-nine states and territories in the U.S. have legalized it for medicinal purposes; (Hanson NCSL, 2017) four of which legalized it for recreational purposes. (Hall & Lynskey, 2016) Medical Marijuana has been legal in Colorado since 2009; however, Amendment 64 was passed in 2012 which legalized the possession, retail sale, and purchase of marijuana to Colorado state residents 21 and over. Commercialization in retail stores …
