Transparency, Leslie P. Francis
Transparency, Leslie P. Francis
Utah Law Faculty Scholarship
Transparency is one of the key concepts of privacy protection. Transparency means openness about data collection, use, and retention. Individuals need to know what information about them is being collected, how it is being collected, how it is to be used and shared, how it is protected, what has been learned from data use, how what has been learned might benefit them, and how they can seek correction or redress for security breaches or other unjustified uses or disclosures of data. This chapter begins with a highly salient recent example of transparency in action: the principled commitment to transparency in …

Comment: Maryland State Drone Law Puts Residents At Risk Of Privacy Intrusions From Drone Surveillance By Law Enforcement Agencies, Wayne Hicks
University of Baltimore Law Forum
As technology rapidly advances, society is becoming more efficient and interconnected than ever before. Unmanned Aircraft Systems ("UAS"), more frequently referred to as "drones," have taken on an increasingly involved role in the progression towards a more interconnected society. For example, drones are presently capable of improving our ability to monitor potentially devastating storms, improving wildlife conservation efforts, increasing efficiency in agriculture, transporting goods to underdeveloped countries, and providing several forms of vital assistance to law enforcement.
Although the potential for drones appears promising, the advancements of drone capabilities have been met with increasing concerns regarding the government's ability to …
Antecedents And Consequences Of Performance Information Use In Collaborative Networks, Manabu Nakashima
Antecedents And Consequences Of Performance Information Use In Collaborative Networks, Manabu Nakashima
Legacy Theses & Dissertations (2009 - 2024)
This study aims to explore antecedents and consequences of performance information use in collaborative networks, focusing on the effects of network members’ interaction patterns and relational characteristics on performance information use. Using a case of the Faraway County system of care wherein network participants engaged in collective decision making and service provisions to mentally-ill children and youth, this study addresses three research questions:
Targeting The "Absence" In A Desistance Framework : Balancing Risk And Rehabilitation In Mandated Criminal Background Check Employment Decisions, Megan Denver
Legacy Theses & Dissertations (2009 - 2024)
Recent research efforts have documented resistance from employers in hiring individuals with criminal records. In response, advocates and policymakers have implemented strategies ranging from grassroots movements that delay criminal record inquiries to federal guidance that directs decision makers to conduct “individualized assessments.” However, it is not clear precisely what information employers actually are (or should be) seeking when they conduct criminal background checks. Furthermore, there may be a catch-22: while employment might promote desistance, applicants may need to demonstrate that they do not pose an undue risk before being able to secure a job or license (Maruna 2009). Since desistance …

Protecting The "Worst Of The Worst": The Constitutional Rights Of Non-Citizen Enemies In World War Ii And The War On Terror, Lane Hannah Corrigan
Protecting The "Worst Of The Worst": The Constitutional Rights Of Non-Citizen Enemies In World War Ii And The War On Terror, Lane Hannah Corrigan
CMC Senior Theses
After the terrorist attacks of September 11, 2001, President Bush authorized the detention of certain non-citizens suspected of terrorism at the naval base in Guantanamo Bay, Cuba. Beginning in 2004, the Supreme Court considered whether these non-citizens were entitled to rights under the Constitution. In deciding that question, the Court compared the facts in the War on Terror cases with World War II cases that dealt with the rights of captured Nazis. Though the cases from World War II denied all protections to nonresident enemies, the Court in 2004 and 2008 determined that detentions in Guantanamo were unique. As such, …
The Flint Water Crisis And The Role Of Professional Emergency Managers In Risk Mitigation, Mark Paine, Jane A. Kushma
The Flint Water Crisis And The Role Of Professional Emergency Managers In Risk Mitigation, Mark Paine, Jane A. Kushma
Research, Publications & Creative Work
A federal emergency was declared in Flint, Michigan on January 16, 2016 because of elevated lead levels in the city drinking water system. Resulting from a number of technical mistakes and a lack of oversight by the Michigan Department of Environmental Quality, this crisis may have implications for the professional practice of emergency management. This paper explores the relationship between critical infrastructure and disaster theory, reviews the Flint crisis as a representative case study, and presents recommendations for emergency managers to begin to assess the drinking water systems within their own communities. As this is a still-evolving event, the discussion …
Toward A Multi-Stage Model Of Hurricane Evacuation Decision: An Empirical Study Of Hurricanes Katrina And Rita, Shih-Kai Huang, Michael K. Lindell, Carla S. Prater
Toward A Multi-Stage Model Of Hurricane Evacuation Decision: An Empirical Study Of Hurricanes Katrina And Rita, Shih-Kai Huang, Michael K. Lindell, Carla S. Prater
Research, Publications & Creative Work
This study extended previous research by testing the Protective Action Decision Model (PADM) on hurricane evacuation decisions during Hurricanes Katrina and Rita. An examination of this mediation model shows that a household’s evacuation decision, as predicted, is determined most directly by expected wind impacts and expected evacuation impediments. In turn, expected wind impacts and expected hydrological impacts are primarily determined by expected storm threat and expected rapid onset. Finally, expected storm threat, expected rapid onset, and expected evacuation impediments are determined by households’ personal characteristics, their reception of hurricane information, and their observations of social and environmental cues. These results …

Horizontal Directional Drilling Pilot Bore Simulation, Paulius Tervydis, Ruta Jankuniene
Horizontal Directional Drilling Pilot Bore Simulation, Paulius Tervydis, Ruta Jankuniene
Turkish Journal of Electrical Engineering and Computer Sciences
Various underground communications (water or gas supply systems, sewage, power lines) have been installed in recent years using trenchless technologies, i.e. horizontal directional drilling (HDD). This technique by its nature does not disturb the traffic and is environmentally friendly. One must be aware that, with HDD, pipeline building time is shortened. With respect to the above, HDD is especially effective in highly populated or industrial areas. However, it is necessary to ensure that HDD works, in order to prevent damage to installed underground facilities. The aim of this work is to propose a user-friendly and inexpensive simulation tool with required …

Designed To Fail: The President's Deference To The Department Of Justice In Advancing Criminal Justice Reform, Rachel E. Barkow, Mark Osler
Designed To Fail: The President's Deference To The Department Of Justice In Advancing Criminal Justice Reform, Rachel E. Barkow, Mark Osler
Faculty Articles
One puzzle of President Obama’s presidency is why his stated commitment to criminal justice reform was not matched by actual progress. We argue that the Obama Administration’s failure to accomplish more substantial reform, even in those areas that did not require congressional action, was largely rooted in an unfortunate deference to the Department of Justice. In this Article, we document numerous examples (in sentencing, clemency, compassionate release, and forensic science) of the Department resisting commonsense criminal justice reforms that would save taxpayer dollars, help reduce mass incarceration, and maintain public safety. These examples and basic institutional design theory both point …
Sex Offender Policies That Spin The Revolving Door: An Exploration Of The Relationships Between Residence Restrictions, Homelessness, And Recidivism, Deanna Cann
Theses and Dissertations
Within the past two decades, a variety of specialized sex offender legislation has been implemented across the United States. Typically brought about in attempt to ebb the societal disquiet after notorious sexual assault cases are sensationalized in the media, these policies appear to be based on faulty assumptions, and lack any evidence-based foundation. In fact, empirical research suggests that policies such as sex offender registration, community notification, and residence restrictions do little to prevent sexual offending, and may actually work to increase the risk of these events through a number of collateral consequences. The current study critically examines the rationale …
Inmate Time Utilization And Well-Being, Mateja Vuk
Inmate Time Utilization And Well-Being, Mateja Vuk
Theses and Dissertations
Qualitative studies about prison culture and examinations of correctional recreation and programming offer a comprehensive understanding of prisons’ social dynamics, including how individuals spend their free time while incarcerated. Theoretical models and the extant research suggest that involvement in structured and prosocial activities is associated with positive behavioral and emotional outcomes in offenders. However, the majority of studies that provide the empirical evidence for these conclusions do not examine all aspects of time utilization explicitly or do not provide statistical evidence of the strength and significance of the associations. Additionally, many of these investigations are dated.
To address these gaps, …
Causes Of Satisfaction And Disatisfaction For Diversity Resident Librarians – A Mixed Methods Study Using Herzberg’S Motivation-Hygiene Theory, Jason Kelly Alston
Causes Of Satisfaction And Disatisfaction For Diversity Resident Librarians – A Mixed Methods Study Using Herzberg’S Motivation-Hygiene Theory, Jason Kelly Alston
Theses and Dissertations
Diversity residency librarian programs are post-MLIS programs aimed at providing recently graduated professionals with real work experience, with the expressed goal of recruiting and retaining a more-diverse workforce in professional librarianship.
This mixed-method study is one of the first empirical studies examining diversity residencies, which – at the time of this writing – have existed for more than 30 years. The study identifies concerns raised in the mostly anecdotal literature about diversity residencies, and 102 individuals identified as current or former diversity resident librarians participated in the quantitative portion of the study. In the quantitative portion of this study, there …
Easy On The Salt: A Qualified Defense Of The Deduction For State And Local Taxes, Daniel J. Hemel
Easy On The Salt: A Qualified Defense Of The Deduction For State And Local Taxes, Daniel J. Hemel
Public Law and Legal Theory Working Papers
Congressional Republicans and Trump administration officials have said that they plan to repeal the deduction for nonbusiness state and local taxes (SALT) as part of a comprehensive tax reform package. This essay critically examines the major arguments for repealing the SALT deduction. Repealing the deduction and using the resulting revenues to reduce federal rates across the board would likely lead to greater tax-induced deadweight loss overall. Repealing the deduction also would distort decisions about the financing of education and health care, which together account for more than half of all state and local government spending. Repeal would further encourage a …
Trends In The Community Supervision Population Of The United States: An Analysis Of Race, Gender, And Region's Effect On Probation And Parole, Patricia Bynum
Trends In The Community Supervision Population Of The United States: An Analysis Of Race, Gender, And Region's Effect On Probation And Parole, Patricia Bynum
Wayne State University Theses
Past research noted that the community supervision population of the United States has grown at a rate comparable to the incarcerated population. The two-fold purpose of this study was to describe the trend of growth for the community supervision population of the United States at the state- and national-level from 1990-2010, and to quantitatively examine whether race, gender, or region influenced the ratio of individuals under community supervision over incarceration by state. Data were collected from the Bureau of Justice Statistics (BJS) database from four different publications for all 50 states and the District of Columbia. Data were prepared in …
