The Stokes Brothers: The Advent Of Black Political Power In America, Ma'taya Hammond Jan 2017

The Stokes Brothers: The Advent Of Black Political Power In America, Ma'taya Hammond

Undergraduate Research Posters 2017

Beginning in January of 2017, I conducted research alongside my mentor, Dr. Ronnie Dunn, commemorating the 50-year anniversary of Carl Stokes election as the first African-American mayor of a major US city, and his brother Louis, as the first African-American congressman from the state of Ohio. Our research and the commemoration focused on the political, civil rights, and public policy initiatives and contributions of the Stokes brothers. Our research concentrated specifically on policing during the late 1960's, a period in which many social commentators suggest mirror the racial tensions of today. Mayor Stokes's principal economic development and community revitalization plan, …

Mandation Of Two Police Officers Per Patrol Unit And The Impact Of Diversity, Jolito Rivera Jan 2017

Mandation Of Two Police Officers Per Patrol Unit And The Impact Of Diversity, Jolito Rivera

Bridges: A Journal of Student Research

The purpose of this research is to explore the operation of police patrol units. Many police patrol units currently lack diversity as well as accountability on police officers. The first phase of correcting the deficits of the patrol units is identifying pros and cons of the current police patrolling methods. The second phase involves alternative solutions that could be put in place to create safer and more efficient police patrolling units. I analyze these solutions to determine why they would be positive and what restrictions prevent them from being feasible. In the final phase of the paper, I present a …

Social Network Usage In The Hiring Process, Melissa L. Carpenter Jan 2017

Social Network Usage In The Hiring Process, Melissa L. Carpenter

WRIT: Journal of First-Year Writing

Social Network usage in hiring practice is a valuable tool for employers to learn more about an applicant than what can be found on a resume or application. Social Network usage is controversial as it can provide a variety of information to an employer that could impact the hiring process. The responsibility falls on the employer to implement a Social Network screening policy to ensure proper usage of this hiring tool. In combination with current legislation and HR professional recommendations, employers have the resources they need to develop a successful Social Network screening policy.

The Effect Of Contact Type On Perceptions Of Sex Offender Recidivism Risk, Donald Walker Jr. Jan 2017

The Effect Of Contact Type On Perceptions Of Sex Offender Recidivism Risk, Donald Walker Jr.

ETD Archive

Prior research has found that the general public perceives sex offenders negatively as a whole (Edwards & Hensley, 2001). These perceptions have enabled sex offender management policies that create ironic conditions for sex offender rehabilitation and reintegration (Hanson, & Harris, 2000). More recent research has found that when sex offenders are presented as subcategories the public has more varied, though still negative attitudes toward sex offenders (King & Roberts, 2015). Furthermore, a burgeoning area of research has developed around the differentiation of child sex offenders based on the contact that they have had with their victims: non-contact, contact-only, and mixed-contact. …

St. Thomas Law Review

This Comment brings reconciliation between the majority and minority opinions in Strieff by proposing a solution that will uphold Fourth Amendment rights and public safety. Part III discusses the Court's trend of weakening Fourth Amendment rights and provides an in-depth analysis of the impact its most recent Fourth Amendment ruling, Strieff will have on Blacks and lower socioeconomic citizens. Part IV provides a comprehensive solution, suggesting a warrant hierarchy system that …

Prisoners Of The Zip Code: How Single Zip Code Rate-Making Hurts The Public Interest, Ansell Fernandez Jan 2017

Prisoners Of The Zip Code: How Single Zip Code Rate-Making Hurts The Public Interest, Ansell Fernandez

St. Thomas Law Review

This comment argues that using socioeconomic data to calculate auto insurance premiums within the boundaries of a single ZIP Code disproportionally increase premiums on low-income households, leading to higher rates of uninsured drivers in these communities. Furthermore, this comment discusses how this rate scheme provides a possible avenue to illegally discriminate based on race, as a direct result of historical racial segregation and recent advances in big data. Part II.A of this comment discusses the recent amendment to the insurance laws of Florida that now allows the use of a single ZIP Code to calculate auto insurance rates. Part II.B …

First Zipcar, Now Uber: Legal And Policy Issues Facing The Expanding “Shared Mobility” Sector In U.S. Cities, Joseph P. Schwieterman, Mollie Pelon

Belmont Law Review

Innovations and technological disruptions in the “sharing economy” are shifting the contours of urban travel in the United States. Carsharing organizations such as car2go and Zipcar have grown exponentially over the past decade, expanding their memberships from 52,347 in 2004 to 1,181,087 in 2015. Ridesourcing companies like Lyft and Uber, which were entirely absent from most U.S. cities as recently as 2010, are now global powerhouses, each reportedly worth billions of dollars. Private investors, after avoiding investments in urban transit services for more than half a century, are now offering venture capital for Bridj, Chariot, and other companies. This Article …

Law In The Time Of Cholera, Rhett B. Larson Jan 2017

Law In The Time Of Cholera, Rhett B. Larson

Notre Dame Law Review

Thousands die each day from infections related to water, as evidenced in the ongoing crises of cholera in Haiti, Zika in the Western Hemisphere, and Legionnaires’ Disease in Flint, Michigan. Yet water law focuses primarily on two agendas. First, the “Blue Agenda” aims to provide an equitable allocation of water to individuals and communities while encouraging sustainable water management. Second, the “Green Agenda” aims to efficiently protect water in the natural environment from pollution. These two agendas often ignore, and can be inconsistent with, the “Red Agenda.” The Red Agenda addresses prevention of waterborne infections, like cholera, and the habitat …

The Membership Decisions Of Religious Organisations: Equality, Religious Liberty And Freedom Of Association, G Walsh Jan 2017

The Membership Decisions Of Religious Organisations: Equality, Religious Liberty And Freedom Of Association, G Walsh

Law Papers and Journal Articles

The merit of a provision that regulates the membership decisions of religious organisations is typically assessed according to the right to equality and religious liberty. Although such rights are of central importance in assessing such a provision, it is necessary to also consider other relevant considerations in order to reach an informed conclusion on the appropriateness of the provision. Freedom of association is a right that is often neglected in this context. This article argues that any assessment of the merits of a provision that impacts on the membership decisions of religious organisations should have a strong focus on freedom …

Maintaining Religious Identity In Hiring In Faith-Based Schools: A Comparative Analysis Of Australia And The United States, Keith Thompson, Charles J. Russo

Law Papers and Journal Articles

Even as Australia and the United States (US) are becoming increasingly secularised, they retain a significant number of faith-based primary and secondary schools. Aware of the tension between changing societal norms and the freedoms associated with religious institutions, the main part of this paper is divided into two sections. The first part surveys the relevant constitutional and anti-discrimination laws in Australia and the US along with exemplary litigation on how these statutes are applied. The second section offers six suggestions for school administrators who are wrestling with the challenge of preserving the faith-based ethos in their schools in the face …
