Study: Students Often Perceived Differently By Race., Aldemaro Romero Jr. Apr 2017

Study: Students Often Perceived Differently By Race., Aldemaro Romero Jr.

Publications and Research

In past columns, I have reported on more than one study that shows that expectations for “brilliance” for women in higher education were much higher than that for males. For example, when a research paper is co-authored by a male and a female the assumption by many is that the male did “the real work.”

Now comes a study showing that there is a similar bias when it comes to students – only this time the differences are based on race.

Fighting Fines & Fees: Borrowing From Consumer Law To Combat Criminal Justice Debt Abuses, Neil L. Sobol Apr 2017

Fighting Fines & Fees: Borrowing From Consumer Law To Combat Criminal Justice Debt Abuses, Neil L. Sobol

Faculty Scholarship

Although media and academic sources often describe mass incarceration as the primary challenge facing the American criminal justice system, the imposition of criminal justice debt may be a more pervasive problem. On March 14, 2016, the Department of Justice (DOJ) requested that state chief justices forward a letter to all judges in their jurisdictions describing the constitutional violations associated with the illegal assessment and enforcement of fines and fees. The DOJ’s concerns include the incarceration of indigent individuals without determining whether the failure to pay is willful and the use of bail practices that result in impoverished defendants remaining in …

The Global Positioning System, Brendon Baker

Physics Capstone Projects

This research study explores the Global Positioning System (GPS), its history, and the process of discovery needed to create the most accurate GPS possible, as well as the contemporary applications of GPS technology. Starting with the first satellite in space, GPS has been a work in progress. Originally pursued by the military for improvements to military tactics, GPS has become integrated into the everyday lives of millions of people around the world. How GPS determines location is a dichotomy, with simplistic theory and complex application. Many factors go into GPS to provide a consistent, accurate location. The orbital planes the …

Defining Freight-Centric Neighborhoods And Implications For Livability Evaluation, Shepherd Kenworthy Tate Apr 2017

Defining Freight-Centric Neighborhoods And Implications For Livability Evaluation, Shepherd Kenworthy Tate

Electronic Theses and Dissertations Archive

The transportation of goods over land, water and through the air plays an important role in the economies of cities but also imparts significant impacts on surrounding neighborhood livability. The neighborhoods that form around and support these freight hubs and thoroughfares are studied in the areas of health, safety, air quality and livability. Based on the current literature, a robust definition of what qualifies as a freight-centric neighborhood remains tenuous and a framework for delineating a freight-centric neighborhood does not exist. Without a standard way of defining the physical boundaries of these neighborhoods, quantitatively assessing the range of potential effects …

State V. Mcpartland: Applying The Reasonable Articulable Suspicion Standard To Secondary Screening Referrals At Sobriety Checkpoints In Maine And The Proper Role Of The Law Court In Reviewing A Trial Court's Application Of This Standard, Holly L. Doherty Apr 2017

State V. Mcpartland: Applying The Reasonable Articulable Suspicion Standard To Secondary Screening Referrals At Sobriety Checkpoints In Maine And The Proper Role Of The Law Court In Reviewing A Trial Court's Application Of This Standard, Holly L. Doherty

Maine Law Review

In State v. McPartland, Mallory McPartland challenged her conviction for operating under the influence, arguing that the trial court erred when it denied her motion to suppress evidence obtained in a sobriety checkpoint that led to her arrest. In a 4-3 decision, the Supreme Judicial Court of Maine, sitting as the Law Court, affirmed the judgment against McPartland. This case centered on a matter of first impression in Maine—what constitutional standard should a law enforcement officer apply when determining whether a motorist, lawfully stopped at a sobriety checkpoint, may be kept for secondary screening? The majority concluded, and the dissent …

Fishing, Fowling, And Dockominiums: Maine's Need For A New Approach To Public And Private Intertidal Rights, Agnieszka A. Pinette Apr 2017

Fishing, Fowling, And Dockominiums: Maine's Need For A New Approach To Public And Private Intertidal Rights, Agnieszka A. Pinette

Maine Law Review

In the sixteenth century, Queen Elizabeth recognized the public’s inalienable right to the sea. Despite the intuitive concept embodied in the Queen’s pronouncement, a centuries-old debate over the public’s right to the seashore continues to occupy the attention of Maine’s bar and bench. In 2011, for example, the Supreme Judicial Court of Maine, sitting as the Law Court, handed down a decision that maintains Maine’s prevailing judicial analytical framework for resolving property disputes in the intertidal zone. In McGarvey v. Whittredge, the plaintiffs, claiming ownership of the intertidal zone, brought an action in trespass and sought a declaratory judgment that …

Domestic Violence And Enforcement Of Protection From Abuse Orders: Simple Fixes To Help Prevent Intra-Family Homicide, Nicole R. Bissonnette Apr 2017

Domestic Violence And Enforcement Of Protection From Abuse Orders: Simple Fixes To Help Prevent Intra-Family Homicide, Nicole R. Bissonnette

Maine Law Review

Domestic violence has long been recognized as a pressing law enforcement and societal concern, and both federal and state governments have continued to pursue strategies to address the issue. Beyond the criminal threatening, assaults, batteries, and other physical atrocities that victims face, domestic violence provides an added horror—“obliterating personhood, suspending identity and nullifying any notion of personal autonomy.” To address these concerns, legislatures created Protection from Abuse Orders (hereinafter PFAs), to protect those that have been subject to abuse from trusted family members or dating partners. Unfortunately, victims then place their trust in the system, which often fails to deter …

Modeling Channel Response To Dam Removal In Lansing, Michigan, Using Swat, Ryan Filbin Apr 2017

Modeling Channel Response To Dam Removal In Lansing, Michigan, Using Swat, Ryan Filbin

Research and Creative Activities Poster Day

The removal of dams has increased in recent decades in the United States, largely resulting from decaying infrastructure and greater efforts to restore rivers to a more natural, free-flowing state. Dam removal presents the opportunity for increased public safety, improved environmental prosperity, and improved economic prosperity in conjunction with riverfront revitalization projects. The City of Lansing, Michigan, contains two moderate-to high-risk dams along the Grand River that pose a significant risk to the surrounding area in the event of structural failure.

The Soil and Water Assessment Tool (SWAT) is applied to model the impacts of the Moores Park Dam and …

Nebraska Department Of Correctional Services Reentry Initiative Vocational & Life Skills Program Grant Announcement - Application For Funding, Uno Nebraska Center For Justice Research

Reports

Reentry requires a systemic approach for incarcerated individuals to return to their communities. It is not a “program;” rather, it is an intentional mind-set or method of facilitating used to prepare individuals to be contributing members of a community.

Successful reentry:

• Provides increased public safety by reducing the number of future victims

o This is achieved by reducing the likelihood of continued criminal behavior, essentially lowering the recidivism rate

• Provides a plan for assessing and addressing risks and needs

o This plan involves a reentry-focused case management system from first contact to release and community reintegration

• Provides …
