Innocent Until Born: Why Prisons Should Stop Shackling Pregnant Women To Protect The Child, Melanie Kalmanson

Florida State University Law Review

The practice of American prisons to shackle and otherwise restrain incarcerated, preg-nant women is problematic for several reasons. Such practices include shackling, chaining, and handcuffing pregnant inmates during their third trimester, transportation to and from medical facilities, labor and delivery, and postpartum recovery. Current discourse on this topic focuses primarily on how these practices invade the woman’s civil liberties, particularly the Eighth Amendment right against cruel and unusual punishment, and international human rights. Recent case law vindicates policy rationales for such practices—safety of others, safety of the woman herself, and securing flight risks.

A diverse body of laws and regulations speaking to reproductive rights, healthcare, criminal punishment of drug use, termination of parental rights, and more creates the rules of maternity. These rules are guidance provided both obliquely and explicitly by the law's coercive power telling women both how to and who should mother. Rule 1 begins in pregnancy, with the message that "your body is your child's vessel." During pregnancy, women are counselled that doctor knows best. After the child's birth, the mother remains responsible for the people who enter a child's life, leading to rule 3: "mothers must always protect." Rule …

The body of 19-year-old Sinoxolo Mafevuka was found in a communal toilet in the Cape Town, South African urban township of Khayelitsha. Sinoxolo had been viciously raped, strangled to death, and her body discarded, with her head under the toilet seat and her genitals displayed openly. Since at least the 1970s a variety of scholars have redefined the U.S. social welfare state to include not only traditional benefit programs (for example Food Stamps and social security) but also a variety of tax benefits that are “hidden” or “submerged” forms of “welfare for the wealthy.” Including these benefits in the overall picture of U.S. social welfare provision reveals a system that is both larger in size than popularly believed and that, in addition to providing some support for the poor, distributes significant benefits regressively, to households with substantial wealth. Consumers and retailers are increasingly interested in purchasing local, sustainable, and humanely raised foods. Advocacy groups are spearheading that trend. Their efforts have gained traction at the state-level, with a broad-based, food conscious constituency directly fomenting policy change. And yet, adversely affected food producers typically succeed in nullifying state reforms by securing from Congress preemptive national standards.

That dynamic is likely to manifest again in the area of farmed animal treatment. In November 2016, Massachusetts approved the furthest reaching prohibition on the use of "intensive confinement" systems for farmed animals, and the sale of any food products thereby derived. Additional …

Type 2 diabetes (DM2) was virtually nonexistent among Native American, Alaska Native, and Canadian First Nations people prior to the 1950s. Due to historical, cultural, environmental, and psychosocial factors, Native people suffer disproportionately higher rates of DM2 than other populations. This literature review aims to examine the influence of these factors and investigate whether insight and knowledge into them, as well as culturally sensitive approaches to disease education, prevention, and self-management can be beneficial to providers working among Native communities. Homeless young women become pregnant at exceptionally high rates, and such pregnancies often pose serious emotional, social, and physical health concerns. Perhaps surprisingly, many homeless youth intentionally seek to become pregnant or involved in pregnancy, as pregnancy and parenthood are viewed as conduits toward accessing social services and meaningful social connections to others that this group often lacks. However, most prevention efforts focus solely on young females' pregnancy attitudes and behaviors at the individual level. Normative studies misunderstand a crucial aspect of cannabis legalization: they have not critically analyzed how the pharmaceutical industry might react when synthetic cannabinoid compounds could be incorporated into new products. I argue that when marijuana is federally legal, there will be two independent market developments in: i) the cannabis market, which includes botanic cannabis and herbal supplements sold in retail nutrition stores; and ii) the FDA-approved ethical drug market. How does the drug industry's monopolistic pricing structure lend itself to strategic pricing for these new synthetic cannabinoids? Research demonstrates the presence of maternal mental health disparities as well as barriers to quality behavioral health care among women with low socioeconomic status. Warm Connections represents an innovative, interdisciplinary intervention designed to improve access to timely behavioral health support for women with low socioeconomic status. Among the current trends in suicidology that hold promise for suicide prevention are a focus on new areas for empirical exploration and the employment of creative methodologies to ascertain these phenomena. One such area is religion, along with its more enigmatic counterpart, spirituality. Suicidological research has long demonstrated that people who are religiously involved tend to be more protected from suicide than those who are not, yet it has been less attentive to the conditions under which religion or spirituality fails to inhibit suicidality. Studies examining microaggressions and individuals in the correctional system are limited. Previous studies have found experiences of perceived microaggressions have a negative impact on an individuals psychological well-being (Nadal, Griffin, Wong, Hamit, and Rasmus, 2014). The current study looked at the effects of microggressions on probationers' psychological well-being. The current study aimed to examine among probationers: hypothesis 1A, the level of microaggressions is significantly negatively associated with self-esteem; 1B, self-esteem will negatively be associated with probationers' psychological well-being; 2A, the experience of microaggressions would significantly predict levels of psychological distress; and hypothesis 2B, self-esteem would be negatively predicted probationers' psychological …

The intent of the Think:Kids Collaborative Problem Solving (CPS) Parent Group Therapy curriculum is to help parents recognize the underlying skill deficits contributing to their child's challenging behavior, identify pathways leading to the behavior, and make environmental changes to prevent problem behavior. This quasi-experimental study assessed the effects of implementing a 6-week, 12-hour Think:Kids CPS parent curriculum in a public school setting with an intervention group compared to a non-random waitlist group. This study is an assessment of the vulnerability of households to food insecurity under an extreme weather event. A subjective-qualitative technique primarily based on the perceived food security status of the households and their food insecurity coping strategies was used to examine household food vulnerability. Key findings reveal that households living in the vulnerable areas of Sta. Cruz subwatershed were generally resilient to extreme weather events and only suffered from slight to moderate form of food security problems. The social impact of All Across Africa (AAA) is as deep as it is wide. With access to global markets, women artisans dramatically increase their incomes. In Rwanda, an artisan’s livelihood significantly improves the wellbeing of her family, and benefits spill over into her community and local economy.

The genius of AAA is found in its efforts to recruit, support, and create livelihoods for artisans in their own communities, which transforms them into catalysts for economic development within their communities. The goal of this research project was to investigate the perspectives and practices of self-care among Pentecostal-Apostolic (P-A) clergy, and create a set of principles to assist the P-A clergy in conducting a God-honoring self-care. This was done through use of a convergent-parallel mixed method research design, with a case study approach. Literature reviews were conducted in biblical, theological and psychological research areas, while a survey containing both qualitative open-ended questions and quantitative Likert-scale items was developed and distributed via email to P-A clergy from the United Pentecostal Church International, Worldwide Pentecostal Fellowship, and Independent organizations. Seed production by moist-soil plant species often varies within and among managed wetlands and on larger landscapes. Quantifying seed production of moist-soil plants can be used to evaluate wetland management strategies and estimate wetland energetic carrying capacity, specifically for waterfowl. In the past, direct estimation techniques were used, but due to excessive personnel and time costs, other indirect methods have been developed. Because indirect seed yield models do not exist for moist-soil plant species in east-central or coastal Texas, we developed direct and indirect methods to model seed production on regional managed wetlands. Anaerobic capacity is an important performance variable for soccer athletes to compete at higher levels of competition. The purpose of this study was to develop a sports-specific anaerobic capacity test for soccer players that could be administered on commercial treadmills found in most exercise facilities. The Wingate Anaerobic test (WAnT) is the most common test for anaerobic capacity, however it is a cycle ergometer test, which is not sports-specific to running type athletes. There is a current lack of reintegration services in rural Humboldt County, California. In an effort to understand the services available, and develop recommendations for future reentry services, I conducted focus groups and interviews with the currently incarcerated, service providers, and the formerly incarcerated. Some of the formerly incarcerated participants live in Humboldt County currently, and some have moved to other communities in the state of California.
