Student Resistance And Standardization In Schools, Frank Pignatelli Oct 2017

Student Resistance And Standardization In Schools, Frank Pignatelli

Occasional Paper Series

A criticism of the current climate of public schools where standardization is key, compliance is rewarded, and resistance is met with lowered status and increased scrutiny. This article asserts that acts of resistance can be crucial opportunities to promote a student’s moral, political, and intellectual development. Civic education, student agency, conflict management, and communities of inquiry are areas that require attention and application in the classroom.

Mapping The World: Facts And Meaning In Adjudication And Mediation, Robert Rubinson Oct 2017

Mapping The World: Facts And Meaning In Adjudication And Mediation, Robert Rubinson

Maine Law Review

This Article explores what is and what is not in adjudication and mediation, thus illuminating the profound differences between these two processes. The Article does this work in four parts. First, it offers an analysis of cognitive mapmaking and its inevitability in constructing meaning. It then explores how adjudication defines meaning in a particular way. This Article then conducts a comparable analysis of mediation. Finally, it focuses on the bridging function attorneys play between the worlds of mediation and adjudication in light of the Author’s analysis and the practical implications of this function.

Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin Oct 2017

Stories Told And Untold: Confidentiality Laws And The Master Narrative Of Child Welfare, Matthew I. Fraidin

Maine Law Review

In most states, child welfare hearings and records are sealed or confidential. This means that by law, court hearings and records may not be observed. The same laws and court rules also preclude those who are authorized to enter and watch from discussing anything learned or observed in a closed courtroom or from a sealed court record with anyone not involved in the case. It is the restriction on speech—on telling stories about child welfare—with which this Article is concerned. I will argue in this Article that the insights of narrative theory and agenda-setting studies help us understand the damaging …

The Long-Arm's Inappropriate Embrace, Lynda Wray Black Oct 2017

The Long-Arm's Inappropriate Embrace, Lynda Wray Black

St. John's Law Review

(Excerpt)

Arguably, the heart balm torts have outlived their relevance in a society where marriage is no longer a necessary imprimatur for intimate relations, and where broken hearts and failed marriages are the statistical norm. A state’s resolute rejection of the heart balm torts in principle as well as applied to modern domestic relations mores need be checked neither by Constitutional protections of marriage nor by the need for uniformity among sister states. Therefore, one state need not and must not transport its domestic relations public policy across state lines. Mississippi’s expansive jurisdictional embrace of nonresidents, John Daly and Anna …

Treatment And Moderator Effects In A Randomized Controlled Trial Of Culturally Informed And Flexible Family Treatment For Adolescents (Ciffta): An Investigation Of The Relationships Between Stress, Acculturation, And Parenting Practices, Marc Puccinelli

Open Access Dissertations

The present study investigated how acculturation, acculturative stress, and change in acculturative stress impact parenting practices among 141 Hispanic families randomly assigned to either Culturally Informed and Flexible Family Treatment for Adolescents (CIFFTA) or Individual Treatment As Usual (ITAU). Data were obtained from a parent study investigating the efficacy of CIFFTA vs. ITAU in addressing internalizing and externalizing disorders, and preventing future drug use and risky sexual behavior among 200 at-risk adolescents 11-14 years of age. A series of mixed model ANOVAs were conducted to investigate how Hispanic stress and parenting practices change pre to post-treatment (four months post-baseline), and …

Engage With Your Cultural Side: Cultural Intelligence, Michele Villagran Oct 2017

Engage With Your Cultural Side: Cultural Intelligence, Michele Villagran

Faculty Publications

It is not enough to simply be ‘aware’ anymore. As our workforces become more diverse, we face a greater challenge and problem; that of how to successfully manage increasingly diverse interactions. To address this concern, organizations are applying the framework of cultural intelligence (CQ). Cultural intelligence is a person’s capability for successful adaptation to new cultural settings. This session’s learning goals include: what is cultural intelligence; how is CQ used as a practical tool for embracing differences and increasing work performance; how do you improve your own CQ capabilities including the four factors; and how do you apply CQ within …

A Case Study Investigation Of Differentiation In Middle Grade English And Math Classrooms, Yvonne-Nicole Maisel De St. Croix

CUP Ed.D. Dissertations

The research questions investigated in this study were designed to explore (a) what strategies of differentiation teachers used in their practice of teaching and learning, and (b) what challenges teachers faced in implementing differentiated strategies. Efforts to answer these questions were supported by existing related research and theories in the field of education and were examined using an explanatory case study methodology. The intent of this study was to add to the body of literature regarding the ways in which middle grade teachers used differentiated strategies and the challenges teachers faced in implementing differentiated strategies. The findings of this study …

Dialogic Interactions That Support Learning And Motivation: A Phenomenological Study Of High School Teachers’ Experiences During Reflective Dialogue, Sandra Metzger Oct 2017

Dialogic Interactions That Support Learning And Motivation: A Phenomenological Study Of High School Teachers’ Experiences During Reflective Dialogue, Sandra Metzger

CUP Ed.D. Dissertations

When teachers skillfully interact in reflective dialogue, they experience professional learning and motivation. However, teachers’ interactional skills are often not data-informed. The purpose of this hermeneutic phenomenological study is to provide descriptive data on (a) how high school teachers experience the dialogic interaction within reflective dialogue, (b) what evidence of learning is present in the interaction, and (c) how self-directed motivation is supported in the interaction. The conceptual framework for this study consists of learning theories from Dewey and Mezirow and the Self-Determination theory of motivation from Deci and Ryan. Three sessions were conducted with two teams of two teachers …

The Disproportionate Representation Of Minorities In Special Education, Rasuwl Medina Oct 2017

The Disproportionate Representation Of Minorities In Special Education, Rasuwl Medina

Theses and Dissertations

Students throughout the United States are promised that individuals who enter the U.S. educational system are placed on an even playing field and that each student will be given equitable treatment within the school they attend. Furthermore, students are assured that studying and learning class material will determine not only their placement within school but the success they will have in life. Despite this long held belief, research and demographic breakdowns of special education placement within the U.S. suggests minorities are disproportionately placed into special education (de Valenzuela, Copeland, & Qi, 2006). This finding is in concert with the already …

Purpose: The purpose of this study was to examine factors that might influence the treatment effectiveness of motor learning guided (MLG) treatment approach for apraxia of speech (AOS). Specifically, this study examined the effects home practice and the stimuli selection on speech production.

Method: This is a case study across two treatment cycles involving a 52 year-old male five months post left CVA (due to a carotid artery dissection). Each treatment cycle used three conditions of practice to investigate the influence of practice frequency on treatment outcomes. The personal relevance of stimuli within and across treatment conditions differed in the …

Discourse As Virtue Ethics: Muslim Women In The American Southwest, Maisa C. Taha Oct 2017

Discourse As Virtue Ethics: Muslim Women In The American Southwest, Maisa C. Taha

Department of Anthropology Faculty Scholarship and Creative Works

This article examines naturally occurring speech among participants in a young women’s halaqa, or study circle, at a mosque in the southwest United States to detail how “tactics of linguistic objectification” provide anchor points for ethical negotiations of difference. By focusing on linguistic micro-practices, including codeswitching and mock “foreign” accents, this paper brings a linguistic anthropological approach to bear upon this inquiry into discourse as a mode of phronesis. It is argued that, during informal conversation, core members of this group of largely second-generation immigrant women highlighted features of non-native English speech to monitor, examine, and mediate their own and …

When Two Roads Diverge: How Language Barriers Undermine Immigrant Parental Authority Oct 2017

When Two Roads Diverge: How Language Barriers Undermine Immigrant Parental Authority

Intuition: The BYU Undergraduate Journal of Psychology

In the United States, immigrant families are one of the fastest growing and most diverse segments of the population (Zhou,1997). Researchers have studied many facets of the immigration process that these families go through, such as acculturation gaps (Weisskirch & Alva, 2002), ethnic identity (Hurtado & Gurin, 1987), youth violence (Boutakidis, Guerra, & Soriano, 2006), and parenting styles (Nguyen, 2008). One construct that surfaces often in these studies is immigrant parental authority; some researchers hypothesize that the immigration experience could shift the authority structure in immigrant homes. The purpose of this literature review is to examine language barriers between immigrant …

Controversies In Batterer Intervention Programs: Doing Good, Well, Yeliani R. Valdez Oct 2017

Controversies In Batterer Intervention Programs: Doing Good, Well, Yeliani R. Valdez

McNair Scholars Research Journal

One in four women has been a victim of domestic violence perpetrated by an intimate partner. Instead of holding the abusers accountable, many victims will be questioned and ostracized for not leaving an unhealthy relationship, which shifts the blame from the abuser to the victim. A variety of Batterer Intervention Programs are available to abusers, including anger management, therapy, and counseling. One such program is the Duluth Model, which focuses on the transformation of batterers through a social change framework. This research will examine the Duluth Model as it is being implemented in Ann Arbor, Michigan.

Distributive Residuated Frames And Generalized Bunched Implication Algebras, Nikolaos Galatos, Peter Jipsen Oct 2017

Distributive Residuated Frames And Generalized Bunched Implication Algebras, Nikolaos Galatos, Peter Jipsen

Mathematics, Physics, and Computer Science Faculty Articles and Research

We show that all extensions of the (non-associative) Gentzen system for distributive full Lambek calculus by simple structural rules have the cut elimination property. Also, extensions by such rules that do not increase complexity have the finite model property, hence many subvarieties of the variety of distributive residuated lattices have decidable equational theories. For some other extensions, we prove the finite embeddability property, which implies the decidability of the universal theory, and we show that our results also apply to generalized bunched implication algebras. Our analysis is conducted in the general setting of residuated frames.

Cultural Re-Presentation And Translation : Chinese And English Anthologies Of Tang Poetry, Chi Man, Cecilia Chan Oct 2017

Cultural Re-Presentation And Translation : Chinese And English Anthologies Of Tang Poetry, Chi Man, Cecilia Chan

Lingnan Theses

Due to its unique prestige, classical Chinese poetry written during the Tang dynasty is often anthologised. These anthologies serve various purposes (e.g. recreational, educational, or both), but they are generally expected to feature works high in aesthetic value, and represent the culture wherein they are produced. While the functions of anthologies are seldom contested, representations of Tang poetry in anthologies have many different manifestations.

Using China’s most famous anthology, Tangshi sanbaishou 唐詩三百首, as an opening case study, research shows that within its home culture, the anthologising of Tang poetry has a long history by itself, and anthologists negotiate between ideological …

A Metaphorical Analysis Of Employment Barriers And Support Needs In Psychosis, Margaret E. Hampson Dr., Richard E. Hicks Dr, Bruce D. Watt Dr

The Qualitative Report

This study uses metaphor analysis to explore the employment-related experiences of people living with psychosis and those around them such as family, community members, professionals and employers. Data was derived from transcripts of 14 focus groups and 31 interviews conducted during a qualitative study of the employment barriers and support needs of people living with psychosis. The sample comprised participants drawn from six key stakeholder groups, namely people diagnosed with a persisting psychotic disorder, care-givers, health professionals, employers, employment providers and local community members. Transcripts from focus groups and interviews were imported into NVivo 10 and explored through the lens …
