Anthropology: Faculty Scholarship

Pediatric patients with Chronic Kidney Disease face several barriers to medication adherence that, if addressed, may improve clinical care outcomes. A cross sectional questionnaire was administered in the Foundation for Children with Kidney Disease (FUNDANIER, Guatemala City) from September of 2015 to April of 2016 to identify the predisposing factors, enabling factors and need factors related to medication adherence. Sample size was calculated using simple random sampling with a confidence level of 95%, confidence interval of 0.05 and a proportion of 87%. A total of 103 participants responded to the questionnaire (calculated sample size was 96). Independent variables were defined …

Striding Out Of Babel: Originalism, Its Critics, And The Promise Of Our American Constitution, André Leduc

William & Mary Bill of Rights Journal

This Article pursues a therapeutic approach to end the debate over constitutional originalism. For almost fifty years that debate has wrestled with the question whether constitutional interpretations and decisions should look to the original intentions, expectations, and understandings with respect to the constitutional text, and if not, what. Building on a series of prior articles exploring the jurisprudential foundations of the debate, this Article characterizes the debate over originalism as pathological. The Article begins by describing what a constitutional therapy is.

The debate about originalism has been and remains sterile and unproductive, and the lack of progress argues powerfully for …

The Qualitative Report

The study described in this paper examined the national identity tension that often occurs between Chinese international students and Western host country members. Research questions guiding the study were: How does the experience of studying in New Zealand provide challenges for Chinese international identity, and how do Chinese students reflect their cognitions of national identity in everyday life. Case study was used as a method to collect data from 20 Chinese international students. Cross-national discussions of China from the participants’ life experiences reveal a complex, sometimes contradictory, relationship between the individual and state, which is deeply rooted in Chinese culture …

Re-Thinking Apprenticeship In Art Education, Kelly Nicole Denisson Oct 2017

Re-Thinking Apprenticeship In Art Education, Kelly Nicole Denisson

Teacher Education, Educational Leadership & Policy ETDs

Many students face isolation and meaningless experiences in their day-to-day routine in schools. The increasing focus on standardized tests and academic performance reinforces competition and extrinsic rewards for learning. This diminishes opportunities for creative thought, development of communities, and genuine meaningful connection to content, leaving students feeling disconnected to learning and their peers. Art education has long been an outlet in which to collaborate, embrace diversity, and transform throughout the learning process. This study uses the Arita Tradition of Porcelain, its instructional practices, community of practice, and studio classroom environment as a model for apprenticeship in art education. Participant experiences …

Let’S Talk About Sexual Assault: Survivor Stories And The Law In The Jian Ghomeshi Media Discourse, Dana Phillips Oct 2017

Let’S Talk About Sexual Assault: Survivor Stories And The Law In The Jian Ghomeshi Media Discourse, Dana Phillips

Osgoode Hall Law Journal

The recent allegations against former Canadian radio host Jian Ghomeshi catalyzed an exceptional moment of public discourse on sexual assault in Canada. Following public revelations from several women who described being attacked by Ghomeshi, many others came forward with accounts of sexual violence in their own lives. Affirming feminist critiques of sexual assault law reform, many survivors drew on their experiences to expose the criminal justice system’s ongoing flaws in processing sexual assault cases. While some held out hope for the criminal law’s role in addressing sexual violence, most rejected its individualizing and retributive aspects. Instead, survivors emphasized the need …

All In - And More! Gambling In The James Bond Films, Pauliina Raento Oct 2017

All In - And More! Gambling In The James Bond Films, Pauliina Raento

UNLV Gaming Research & Review Journal

Scholarly analysis of gambling in the James Bond films is rare, despite the multitude of topics in Bondology and the fictional agent’s global fame. The odd commentary in gambling scholarship criticizes the franchise from the perspective of harm prevention. This article counters both groups of scholars with a qualitative interpretation of Bond’s gambling habits and the role of gambling and risk taking in the film series. A basic toolkit of visual methodologies is applied to the 24 EON-produced Bond films released in 1962–2015. The examination shows the critical importance of gambling to character identity, power hierarchies and communication, atmosphere, and …

Maine's Overdue Judicial Reforms, Peter L. Murray Oct 2017

Maine's Overdue Judicial Reforms, Peter L. Murray

Maine Law Review

The recent mandate to all organs of Maine state government to make major budget cuts in a time of international economic distress has focused attention on the fiscal and operational condition of Maine’s Judicial Branch. A symposium on March 30, 2009 at the University of Southern Maine presented various perspectives on the role of Maine’s judiciary as the twenty-first century unfolds, and the need for adequate resources to maintain the Judicial Branch as a vital and functioning branch of our tripartite system of government. It is clear that much of the challenge faced by our Judicial Branch is that of …
