Contract Exposition And Formalism, Gregory Klass
Contract Exposition And Formalism, Gregory Klass
Georgetown Law Faculty Publications and Other Works
Formalism in contract law has had many defenders and many critics. What courts need, however, is an account of when formalist approaches work and when they do not. This article addresses that need by developing a general theory of the rules of contract interpretation and construction—contract “exposition.” The theory distinguishes inter alia two forms of formalism. Formalities effect legal change by virtue of their form alone, and thereby obviate interpretation. Examples from contract law include “as is”, the seal and boilerplate terms. Formalities work when parties intend their legal effects, that is, when they perform juristic acts. Plain meaning rules, …
The Displaced As Guest: A Case Study Of The Yezidis Of Iraq And Jacques Derrida’S Deconstruction Of Hospitality, Zachary Jackman
The Displaced As Guest: A Case Study Of The Yezidis Of Iraq And Jacques Derrida’S Deconstruction Of Hospitality, Zachary Jackman
Theses and Dissertations
This thesis examines the Yezidi forced migration crisis by applying Jacques Derrida’s deconstruction of the binary relationships of self and the other (ipseity) and host and guest (hospitality). This approach first uncovers how the application of these categories operates in the Yezidi dilemma. Further, deconstructing the classifications then creates a space for thinking of alternative means of considering identity, foreignness, the hospitality exchange, and competing discourses. With over half of the entire global Yezidi population still living as hosted, forcibly displaced guests after three years, these new windows may provide a better opportunity to critically engage with the emergency situation …
Creating A Strong Statistical Machine Translation System By Combining Different Decoders, Ayah Elmaghraby
Creating A Strong Statistical Machine Translation System By Combining Different Decoders, Ayah Elmaghraby
Theses and Dissertations
Machine translation is a very important field in Natural Language Processing. The need for machine translation arises due to the increasing amount of data available online. Most of our data now is digital and this is expected to increase over time. Since human manual translation takes a lot of time and effort, machine translation is needed to cover all of the languages available. A lot of research has been done to make machine translation faster and more reliable between different language pairs. Machine translation is now being coupled with deep learning and neural networks. New topics in machine translation are …
Code Choice In Egyptian Tv Advertisements, Mostafa Younes
Code Choice In Egyptian Tv Advertisements, Mostafa Younes
Theses and Dissertations
This study examines the code choice made by content producers in Egyptian television (TV) advertisements. We consider the emergence of new types of TV networks, advertised products, services and messages conveyed in TV advertisements. These TV channels have raised competition in marketing and advertising where it is possible to see content producers choosing their language carefully to specifically target people from different social backgrounds. This study employs a qualitative analysis design with some frequency count to demonstrate the language varieties that are used in TV advertisements. Badawi’s 1973 model is used as a framework of analysis, where he proposed a …
Selecting Authentic Audiovisual Materials And Designing Authentic Tasks In The Afl Classroom: Criteria And Challenges, Mohamed Hassan Hamed
Selecting Authentic Audiovisual Materials And Designing Authentic Tasks In The Afl Classroom: Criteria And Challenges, Mohamed Hassan Hamed

This study investigated the criteria of selecting authentic audiovisual materials (AAM) and designing authentic tasks (AT) as well as the challenges which teachers of Arabic as a Foreign Language (AFL) encounter when selecting AAM and designing AT in the AFL classroom. Data collection procedures included an online questionnaire, classroom observations, and teachers’ interviews. Data collection followed this order: 112 respondents from various teaching backgrounds were surveyed, five AFL classrooms were observed, and four AFL instructors in a private university in Egypt were interviewed. Data was quantitatively and qualitatively analyzed. The results indicated that AFL teachers frequently use news, songs, and …
Lexical Variation In News Headlines: A Comparative Study Of Egyptian, Lebanese And Moroccan Written Arabic, Moustafa Saleh
Lexical Variation In News Headlines: A Comparative Study Of Egyptian, Lebanese And Moroccan Written Arabic, Moustafa Saleh
Theses and Dissertations
Does the existence of different Arab communities formulate a challenge in understanding its Modern Standard Arabic (MSA) variations? The question remains open to analogy. This research attempts to answer this issue through the study of lexicon variation in Egypt, Lebanon & Morocco. Even though the lexical variation exists historically, researchers are still in contradiction whether the MSA is the one bridge of communication among the Arabs or does each and every community has its own lexicons? A concurrent design of mixed research methods, both qualitative and quantitative, is carried to investigate the extent of this lexical variation. So, upon running …
The Impact Of Politics On Lexical Coinage: A Study Of The Morphological Patterns In Egyptian Printed Media After January, 25th 2011, Hagar Lotfy
Theses and Dissertations
All living languages come across linguistic changes with time. It is important to mention that various linguistic phenomena that living languages encounter include sound change, phonological change, syntactic change, lexical change or semantic change. From 2011 to 2015, Egypt passed through a critical political situation; a result, media and press introduce new lexical items and revive lexical terminology from the past. During the Arab Spring media websites tried to offer the most accurate lexical terminologies that express people’s impatience for dignity, socio-political reforms, and human rights (Michel, 2013). This study aims to primarily investigate the impact of the political situation …

When She Rhetorically Swears In Arabic: A Sociolinguistic Approach To Women's Swearing In A University Speech Community, Mohamed Bayoumi
When She Rhetorically Swears In Arabic: A Sociolinguistic Approach To Women's Swearing In A University Speech Community, Mohamed Bayoumi
Theses and Dissertations
Swearing, a controversial linguistic phenomenon, has recently become more of a social norm in some segments of Egyptian mass media. Much of the blame for the growth of swearing as a linguistic phenomenon, meanwhile, has been directed at mass media itself. This study investigates swearing in the speech community of female college students affiliated with the upper class in Egyptian society. The study examined the commonly-held notion that women use weaker swear words than men. Also examined were the effect of gender constellations on swear words use, and the social and linguistic functions swear words accomplish in this speech community. …
Uses And Gratification Of Spiritual And Religious Music In Egypt: A Descriptive Analysis Study, Hend El-Taher
Uses And Gratification Of Spiritual And Religious Music In Egypt: A Descriptive Analysis Study, Hend El-Taher
Theses and Dissertations
Media is one important constituent of the culture in a society. Its importance is reflected in the contents it presents especially in religion and music. The way both religion and music are blended and used as a medium to gratify certain needs is the interest of this study. In that sense, the relation between religions and music is examined, how music was perceived by religious figures, what disputes the music provoked, and how spiritual music is used as an intrapersonal, interpersonal, or a mass communication tool to influence the audience cognitively, behaviorally, and attitudinally. Accordingly, a descriptive survey is conducted …
Accountability, Autonomy, And Governance Challenges Of Public University Hospitals In Egypt, Yasmine Badr
Accountability, Autonomy, And Governance Challenges Of Public University Hospitals In Egypt, Yasmine Badr
Theses and Dissertations
In Egypt, public university hospitals play a crucial role not only in education and research but also in the provision of healthcare services. What adds to the complexity of public university hospitals is their existence within two sectors; higher education and healthcare. This work highlights the inability of Egyptian public university hospitals to achieve their tripartite mission as a result of improper institutional governance arrangement that does not empower hospitals to cope with the requirements of both sectors. Despite the importance of institutional governance to university hospitals in Egypt, this topic remains under researched in the literature. This qualitative study …
Islamic Feminism: A Perfect Match Or A Contradiction In Terms?, Merna Aboul-Ezz
Islamic Feminism: A Perfect Match Or A Contradiction In Terms?, Merna Aboul-Ezz
Theses and Dissertations
Gender inequality is a global issue that limits women’s social, economic as well as political opportunities. Fortunately enough, there have been many feminist movements that fight for gender equality and women’s rights. The basis for male domination is sometimes justified by culture, or religion. The problem arises when the oppression of women is being justified on the basis of religion mainly Islam in the Arab countries, for it becomes harder to women to challenge the situation, because it conflicts with their inner faith. This thesis will tackle the issue of Islamic Feminism, a recent movement that calls for gender equality …
The Relationship Between Non-Traditional Instructional Strategies And The Multicultural Competence Of School Psychologists, Jacqueline Kluger
The Relationship Between Non-Traditional Instructional Strategies And The Multicultural Competence Of School Psychologists, Jacqueline Kluger
Dissertations, Theses, and Capstone Projects
School psychology training programs have taken on the great responsibility of preparing practitioners who are culturally competent and able to provide effective services to a diverse range of students, families, schools, and communities. Literature in the related fields of counseling psychology and teacher training show evidence of the effectiveness of multicultural training on trainees’ and practitioners’ cultural competence, with some evidence that the instructional methods used in courses and workshops play a role in outcome. There is to date a dearth of research available in the school psychology literature to provide guidance to trainers and program administrators as to the …
Solo Performance: An Extension Of Vocal Pedagogy, Monica J. Harte
Solo Performance: An Extension Of Vocal Pedagogy, Monica J. Harte
Dissertations, Theses, and Capstone Projects
In this study, I examine the significance of the solo performance opportunity in vocal pedagogy at the tertiary level. In order to discover tangible correlations between solo performing and applied lessons, I designed and implemented a case study that focused on fourteen subjects rehearsing, performing, and recording roles in the children’s opera, Mambo. The findings stem from my theoretical analysis of substantive data collected through forty-one interviews and three months of observations. The data collected disclosed that whether the participants advanced within a particular performance practice (such as presentation), or developed a specific vocal technique (such as coloratura), Mambo …
Who Am I To You? Using Function Words As A Measure Of Transference, Jon William P. Lentz
Who Am I To You? Using Function Words As A Measure Of Transference, Jon William P. Lentz
Dissertations, Theses, and Capstone Projects
There is a gap in our understanding of transference resolution as an aspect of therapeutic process and its relation to observable changes in language. My hypotheses can contribute to this area by identifying whether there are detectible changes in pronoun use in a psychoanalysis that are related to the resolution of transference. Data: The de-identified transcripts of a young agoraphobic housewife in a four time a week then two time a week psychoanalysis from the 1970s. Method: The Linguistic Inquiry and Word Count software will be used to measure structural changes in language that may reflect intrapsychic changes in the …
Local Immigration Enforcement Entrepreneurship In The Punishment Marketplace, Daniel L. Stageman
Local Immigration Enforcement Entrepreneurship In The Punishment Marketplace, Daniel L. Stageman
Dissertations, Theses, and Capstone Projects
The contemporary neoliberal economic order plays a significant role in American social organization and policy-making. Most importantly, neoliberal ideology drives the creation and imposition of markets in public goods and services and the valorization of free market ideology in cultural life. The neoliberal ‘project of inequality’ is in turn delimited and upheld by an authoritarian system of punishment built around mass incarceration, surveillance, and an unprecedented level of social control directed at the lowest strata of American society – a group that includes both the urban underclass, and unauthorized immigrants.
This study lays out the theory of the punishment marketplace …
El Significado De La Construcción Con Ser Focalizador En El Español De Colombia, Ana I. González Támara
El Significado De La Construcción Con Ser Focalizador En El Español De Colombia, Ana I. González Támara
Dissertations, Theses, and Capstone Projects
One of the syntactic features of Colombian Spanish is the usage of focalizing SER (“TO BE”) reported by Cuervo (1885); Curnow & Travis (2003); Mendez (2009), among others authors, in constructions such as pago es el arriendo (I pay is the rent), or vino fue hoy (he/she came was right now) in alternation with simple forms (pago el arriendo- I pay the rent, or vino ahora- he/she came right now) and pseudo-clefts (Lo que yo pago es el arriendo- What I pay is the rent, or when he/she came was right now) …
From Rochel To Rose And Mendel To Max: First Name Americanization Patterns Among Twentieth-Century Jewish Immigrants To The United States, Jason H. Greenberg
From Rochel To Rose And Mendel To Max: First Name Americanization Patterns Among Twentieth-Century Jewish Immigrants To The United States, Jason H. Greenberg
Dissertations, Theses, and Capstone Projects
There has been a dearth of investigation into the distribution of and the alterations among Jewish given names. Whereas Jewish surnames are a popular topic of study, first names receive far less analysis. Because Jewish immigrants to the United States frequently changed their names, this thesis can serve as a guide to genealogists and other scholars seeking to trace the paths of Jewish immigrants from Europe. Data was drawn from about 1500 naturalization records from Brooklyn in order to determine the correspondences between the given names featured on passenger lists and their Americanized counterparts. More than three-quarters of surveyed immigrants …
The Life And Death Of Urban Ethnic Enclaves: Gentrification And Ethnic Fragmentation In Brooklyn's 'Polish Town', Aneta Kostrzewa
The Life And Death Of Urban Ethnic Enclaves: Gentrification And Ethnic Fragmentation In Brooklyn's 'Polish Town', Aneta Kostrzewa
Dissertations, Theses, and Capstone Projects
This dissertation examines the intersection of immigration and market-led gentrification in a fragmenting ethnic neighborhood of Greenpoint, Brooklyn– once home to a vibrant Polish community, now at risk of losing its social character as a traditional ethnic enclave. Extending Albert O. Hirschman’s theory of action to the Polish community in Greenpoint, I examine the conditions under which immigrants “participate”, “adapt” or “exit” as a response to neighborhood change. Based on participant observation, in-depth interviews and quantitative data, I argue that displacement or loss need not be the primary experience of longtime residents in gentrifying ethnic neighborhoods. Instead of emphasizing ethnic …
The Effect Of A Single Bout Of Physical Exertion On Expressive Language And Word Finding In Individuals With Multiple Sclerosis, Marissa A. Barrera
The Effect Of A Single Bout Of Physical Exertion On Expressive Language And Word Finding In Individuals With Multiple Sclerosis, Marissa A. Barrera
Dissertations, Theses, and Capstone Projects
To date, little research has been conducted on the relationship between fatigue and expressive language among Multiple Sclerosis patients (MS). This study was a response to this knowledge gap. A nonrandom, matched- subject, mixed-factor design model was used with a purposive sample of 17 individuals with MS (five had primary-progressive (PP) MS, and 12 had relapsing-remitting (RR) MS). The research design was subjected to pretesting to ensure validity. Participants were assessed on a range of language tasks after undergoing one bout of cardiovascular exercise (NuStep T5 Recumbent Cross Trainer) and asked to provide a subjective fatigue score. The expressive language …

Dominance & Survivance: Urban Latino Communities And Education In Racial Neoliberal Urbanism, Edwin Mayorga
Dissertations, Theses, and Capstone Projects
U.S. Latino youth are as undereducated and underprepared today as they were in the 1960s, leading some to declare that there is a national “Latino education crisis” that is affecting the lives of millions. While this problem is national in scope there are multiple narratives that underpin this story. Of particular interest in this study is the intersection of urban Latino core communities and public schools. This dissertation is based on the Education in our Barrios Project, #BarrioEdProj, which is a digital, critical participatory action research study of urbanism and urban education in the Latino core community of East Harlem …

Culturas Emocionales: Narrativa Escrita Por Mujeres Cubanas Durante El Periodo Especial (1992–2005), Laura Sandez
Dissertations, Theses, and Capstone Projects
This dissertation studies the emotional repertories employed in the presentation of the female literary subject in the Cuban special period, a period of rapid ideological shift. It deals with the presentation of the self in a series of fictional autobiographic works whose portraits of history and society allow for the observation of diverse emotional repertories, looking for social and ethical value attributed to emotions such as happiness or nostalgia. The dissertation has two modes, a written one and a visual one I produce using digital media. The written part features a close textual analysis of emotional repertories found in literary …

One of the most widely used chemical warfare agent (CWA) is mustard gas, which is a highly toxic blistering agent. In this study we investigated the interactions of mustard gas surrogates’ vapors on zinc and zirconium hydroxides and their composites with graphite oxide (GO) and/or Au or Ag nanoparticles. Even though a small quantity of reports about the detoxification of CWAs on metal oxides is reported in the literature, almost all of these studies are performed in the liquid phase. Both herein reported Zn(OH)2 and Zr(OH)4 showed a good adsorption performance, with the former being photoactive under visible …
Subversion And Transcendence In The Latin American Modern Travel Novel (1928-1976), Andrea Babsky
Subversion And Transcendence In The Latin American Modern Travel Novel (1928-1976), Andrea Babsky
Dissertations, Theses, and Capstone Projects
The focus of this dissertation is the role that travel plays in Latin American novels that stem from 1928 to 1976, specifically, Macunaíma, Los pasos perdidos, El reino de este mundo, and Mascaró, el cazador americano. Departing from the fact that this period of time in history was marked by political and cultural change and upheaval, different aspects and interpretations of travel as manifested in the novels of the corpus are explored as a means of subversion and transcendence to hegemonic discourses. Travel is viewed as a means of disruption, particularly of limits and borders, be they geographical, …

Breastfeeding mothers, non-mothers at high estradiol point in menstrual cycle, non-mothers at low estradiol point in menstrual cycle, fathers, and non-fathers were included in the study. Participants wore Polar RS800 heart rate monitors, were video recorded for facial expression analysis, and filled out 11 point self-rating forms …
Es-Esa: An Information Retrieval Prototype Using Explicit Semantic Analysis And Elasticsearch, Brian D. Sloan
Es-Esa: An Information Retrieval Prototype Using Explicit Semantic Analysis And Elasticsearch, Brian D. Sloan
Dissertations, Theses, and Capstone Projects
Many modern information retrieval systems work by using keyword search to locate documents in an inverted index by matching those documents based on terms in a user’s query. While highly effective for many use-cases, one notable drawback to simple keyword-based searching is that the contextual knowledge surrounding the user’s underlying information need may be lost, particularly if the user’s query terms are ambiguous or have multiple meanings. Research in the field of semantic search aims to make progress towards resolving this. One methodology in particular, explicit semantic analysis, works by modeling a document not only as a set of …

Retelling An Old Wife’S Tale: Postpartum Care Of Taiwanese And Chinese Immigrant Women, Kuan-Yi Chen
Retelling An Old Wife’S Tale: Postpartum Care Of Taiwanese And Chinese Immigrant Women, Kuan-Yi Chen
Dissertations, Theses, and Capstone Projects
The focus of this dissertation is the Chinese postpartum tradition zuoyuezi, often translated into English as doing-the-month. Having its roots in ancient China, this set of practices has maintained its salience today in Taiwan, China, and among first generation immigrant women in the U.S. Women not only continue to perform zuoyuezi at home, many also rely on emerging forms of commodified care. While immigrant women’s postpartum wellbeing and care has been the focus of scholarly research in health related fields, studies in the social sciences addressing immigrant women’s postpartum practices and the care relations engendered remain scant.
In this …
