A Paper Shield? Whether State Privilege Protections Apply To Student Journalists, Jonathan Peters, Genelle Belmas, Piotr Bobkowski
A Paper Shield? Whether State Privilege Protections Apply To Student Journalists, Jonathan Peters, Genelle Belmas, Piotr Bobkowski
Fordham Intellectual Property, Media and Entertainment Law Journal
Most states recognize a privilege for journalists to protect confidential sources from compelled disclosure. The privilege varies from state to state, and a major difference is how they define a journalist—i.e., a person qualified to claim the privilege. Some schemes are narrow and limit their coverage to employees of professional news organizations. Others are broad and cover freelancers, filmmakers, bloggers, and others who gather information for publication. But what about student journalists? Are they covered? In recent years, as traditional media have adapted to changing circumstances, student journalists have played a vital role in meeting their communities’ needs for news. …

Space Weapons And The Law, Bill Boothby
Space Weapons And The Law, Bill Boothby
International Law Studies
Outer space is of vital importance for numerous civilian and military functions in the modern world. The idea of a space weapon involves something used, intended or designed for employment in, to or from outer space to cause injury or damage to the enemy during an armed conflict. Non-injurious, non-damaging space activities that adversely affect enemy military operations or capacity, though not involving the use of weapons, will nevertheless be methods of warfare. Article III of the Outer Space Treaty makes it clear that international law, including weapons law, applies in outer space. Accordingly, the superfluous injury/unnecessary suffering and indiscriminate …

Law Firm Cybersecurity: The State Of Preventative And Remedial Regulation Governing Data Breaches In The Legal Profession, Madelyn Tarr
Law Firm Cybersecurity: The State Of Preventative And Remedial Regulation Governing Data Breaches In The Legal Profession, Madelyn Tarr
Duke Law & Technology Review
With the looming threat of the next hacking scandal, data protection efforts in law firms are becoming increasingly crucial in maintaining client confidentiality. This paper addresses ethical and legal issues arising with data storage and privacy in law firms. The American Bar Association’s Model Rules present an ethical standard for cybersecurity measures, which many states have adopted and interpreted. Other than state legislation mandating timely disclosure after a data breach, few legal standards govern law firm data breaches. As technology advances rapidly, the law must address preventative and remedial measures more effectively to protect clients from data breaches caused by …

Reflections On The Future Of Legal Services, Andrew M. Perlman
Suffolk University Law School Faculty Works
The following reflections on the future of legal services were part of an online symposium on Prawfsblawg. The symposium focused on two books: Richard Susskind & Daniel Susskind, The Future of the Professions: How Technology Will Transform the Work of Human Experts and Gillian Hadfield, Rules for a Flat World: Why Humans Invented Law and How to Reinvent it for a Complex Global Economy. The reflections contain three parts. The first part describes the Susskinds’ prediction that technology will drive dramatic changes to the delivery of legal services and concludes that, although the Susskinds’ predictions are probably close to the …

Erisa Remedies: Rethinking Indemnification And Contribution For Co-Fiduciaries, Nicholas L. Debruyne
Erisa Remedies: Rethinking Indemnification And Contribution For Co-Fiduciaries, Nicholas L. Debruyne
Seventh Circuit Review
The Employee Retirement Income Security Act ("ERISA") is a federal law that protects participants of employee benefit plans. Congress attempted to achieve this by assigning duties to co-fiduciaries that are responsible for managing plan assets. Despite allocating a variety of obligations among co-fiduciaries, ERISA does not specify whether co-fiduciaries can seek contribution or indemnification as an equitable remedy. To date, the circuit courts are split as to whether such equitable remedies should be implied under ERISA.
In Chesemore v. Fenkell, the Seventh Circuit incorrectly held that ERISA authorized the district court to provide contribution or indemnification to co-fiduciaries. The …

A Congregational & Legal Study In The Practice Of Hospitality At Faith Community Center, Lacey, Washington, Matthew Henry
Doctor of Ministry Major Applied Project
Henry, Matthew R. “A Congregational and Legal Study in the Practice of Faith Community Center.” Doctor of Ministry. Major Applied Project, Concordia Seminary, 2017. 171 pages.
Churches that practice hospitality by operating community centers must remain faithful in their confession and abide by anti-discrimination laws. This project provides the necessary theological and legal guidance for community center ministry in morally diverse settings. Surveys conducted before and after a congregational presentation at Faith Lutheran Church, Lacey, WA, reveal opinions of both limits and freedoms as to what activities and groups may be permitted or disallowed. As an expression of love for …

From Teaching Professionalism To Supporting Professional Identity Formation: Lessons From Medicine, Sylvia R. Cruess, Richard L. Cruess
Mercer Law Review
Profession, professional, and professionalism are generic terms that apply to a limited number of knowledge-based occupations charged with providing essential services to society. While the terms have existed for over 2000 years, until the middle of the nineteenth century the professions served only the upper socioeconomic strata and thus had a limited impact on society. The reasons were not complex. Wealth was limited and only a few could afford the services of the professional until the industrial revolution provided sufficient resources to support their use. The growth in both size and influence of the medical and legal professions occurred at …

The European Union's Response To The Syrian Refugee Crisis: National Factors That Affect Compliance In France And Spain, Sarah Cockcroft, Nicole Provax
The European Union's Response To The Syrian Refugee Crisis: National Factors That Affect Compliance In France And Spain, Sarah Cockcroft, Nicole Provax
Senior Theses
Beginning in 2011, the Syrian Refugee Crisis refers to refugees that come to Europe in an effort to escape the civil war in Syria. The influx of refugees from Non-European Union Member States, specifically those from Syria, threatens the stability and the status quo of the European Union. This population is particularly relevant because their status as refugees and their large numbers indicates a level of uncertainty about short term and long term assistance expectations. In order to understand the European Union’s response to the Syrian refugee crisis, it is necessary to determine the ways in which the national implementation …

Leaving Experiences Of Survivors Of Intimate Partner Violence In Emergency Shelter And Transitional Housing, Alicia Christine Hawley-Bernardez
Social Work Dissertations - Archive
Intimate partner violence (IPV) is a pervasive public health problem across the United States disproportionately affecting women and children. IPV has four primary categories of violence: physical, sexual, stalking, and psychological aggression. This dissertation utilized an interpretative phenomenological as well as a directed content analysis approaches to better understand leaving experiences of survivors of IPV. The study consisted of semi-structured interviews with 19 survivors of IPV who had left an abusive relationship and were living in either an emergency shelter or transitional housing. Participants were recruited from several domestic violence agencies. Interpretative phenomenology served as the framework for understanding the …
Achieving Justice Through Adr: An Analysis Of The Korean Mediation System, Yonghwan Choung
Achieving Justice Through Adr: An Analysis Of The Korean Mediation System, Yonghwan Choung
Maurer Theses and Dissertations
The purpose of this research is to reconsider Korean judicial mediation as a part of alternative dispute resolution (“ADR”) and to discuss the possible legal transition of Korean judicial mediation into private sector mediation.
Similar to other states’ judicial problems, Korea has also faced overloaded case dockets, congestion of the civil process, an expensive legal process, and emotional stress on parties during the procedures. The Korean judicial authority continuously developed the Korean mediation programs, which can be categorized as court-related mediation, including court-annexed and court-connected mediations. Based on enactment of the Judicial Conciliation of Civil Disputes Act of 1990 (“JCCDA”) …

Factors In Fairness And Emotion In Online Case Resolution Systems, Youyang Hou, Cliff Lampe, Maximilian Bulinski, J. J. Prescott
Articles
Courts are increasingly adopting online information and communication technology, creating a need to consider the potential consequences of these tools for the justice system. Using survey responses from 209 litigants who had recently used an online case resolution system, we investigate factors that influenced litigants’ experiences of fairness and emotional feelings toward court officials. Our results show that ease of using the online case resolution system, the outcome of the case, and a litigant’s perceptions of procedural justice are positively associated both with whether the litigant views the process as fair and whether the litigant ultimately feels positive emotions toward …
