Life's Hurried Tangled Road: A Therapeutic Jurisprudence Analysis Of Why Dedicated Counsel Must Be Assigned To Represent Persons With Mental Disabilities In Community Settings, Alison Lynch, Michael L. Perlin
Articles & Chapters
This paper will be published as part of a symposium issue of Behavioral Sciences and Law.
Although counsel is now assigned in all jurisdictions to provide legal representation to persons facing involuntary civil commitment, such counsel is rarely available to persons with mental disabilities in other settings outside the hospital. In this paper, we strongly urge that such representation also be made available to this population in community settings. The scope of this representation must include any involvement with the criminal justice system that currently does not fall within the scope of indigent counsel assignment decisions such as Gideon v. …

Alternatives To Immigration Detention, Fatma E. Marouf
Alternatives To Immigration Detention, Fatma E. Marouf
Faculty Scholarship
The United States places over 440,000 people each year in immigration detention, far more than any other country in the world. This Article argues that there are compelling humanitarian and financial reasons to utilize more alternatives to detention. It examines the strengths and limitations of existing alternatives, including the need to develop more community-based case management programs and to rely less on electronic monitoring. The Article then sets forth several legal arguments under the Constitution, Rehabilitation Act, and international human rights law for requiring greater consideration of alternatives to detention.

Experiences Of Students Utilizing A Campus Food Pantry, Jamie Daugherty
Experiences Of Students Utilizing A Campus Food Pantry, Jamie Daugherty
Dissertations
Food insecurity is a phenomenon with far-reaching impacts on the social, economic, health, and well-being of college students’ lives impacting how they procure food, food choices, and food experiences. A qualitative narrative inquiry explored experiences of three students facing food insecurity and using a campus food pantry. Data collection methods included in-depth semi-structured interviews, journaling, and photo elicitation. Data analysis illustrated five themes: a) financial challenge identification; b) strategizing budget priorities; c) prioritizing health; d) food pantry uses and strategies; and e) having enough. Students’ experiences were impacted by social and physical implications due to their financial challenges. The food …

This interim report on legal barriers to doing business in ASEAN coincides with the 50th Anniversary of ASEAN’s founding and the first year of the ASEAN Economic Community (AEC). The team is privileged to be supported by, among others, the Canada-ASEAN Business Council (CABC), given that it is also the 40th anniversary of dialogue relations between Canada and ASEAN.
Despite occasional misgivings about the “ASEAN Way”, ASEAN economic integration has come a very long way. The number of member States has grown over the 50 years since ASEAN’s founding, and the joint efforts among these States driving economic growth and …

Closing The Legal Aid Gap One Research Question At A Time, Kathleen Elliott Vinson, Samantha A. Moppett
Suffolk University Law School Faculty Works
Currently, two of the hot topics in legal academia are “access to justice” and experiential learning. The justice system’s failure to adequately serve all people irrespective of wealth and position has brought access to justice to the forefront. Experiential learning has made the headlines due to the recent changes in the American Bar Association standards regarding the incorporation of experiential learning into the law school curriculum. Despite being hot topics, these issues are often neglected or given short shrift in the law school curriculum, particularly in the first year. Law schools grapple with how to work towards closing the legal …

Researching Cuban law poses numerous challenges for U.S. researchers. These challenges run the gamut from an inadequate understanding of Cuban sources of law, to unwieldy government websites. This guide addresses those challenges head on by providing a snapshot of Cuban law and an assessment of Cuban legal resources. The guide served as a handout to accompany the program, “Cuban Law and Legal Research: A Snapshot During the Deshielo,” presented at the American Association of Law Libraries’ Annual Meeting & Conference on July 17, 2017, in Austin, Texas.

Distinctive Factors Affecting The Legal Context Of End-Of-Life Medical Care For Older Persons, Marshall B. Kapp
Distinctive Factors Affecting The Legal Context Of End-Of-Life Medical Care For Older Persons, Marshall B. Kapp
Georgia State University Law Review
Current legal regulation of medical care for individuals approaching the end of life in the United States is predicated essentially on a factual model emanating from a series of high-profile judicial opinions concerning the rights of adults who become either permanently unconscious or are clearly going to die soon with or without aggressive attempts of curative therapy.
The need for a flexible, adaptable approach to medically treating people approaching the end of their lives, and a similar openness to possible modification of the legal framework within which treatment choices are made and implemented, are particularly important when older individuals are …

Contingent Compensation Of Post-Conviction Counsel: A Modest Proposal To Identify Meritorious Claims And Reduce Wasteful Government Spending, Christopher T. Robertson
Contingent Compensation Of Post-Conviction Counsel: A Modest Proposal To Identify Meritorious Claims And Reduce Wasteful Government Spending, Christopher T. Robertson
Maine Law Review
It costs about $25,000 a year to pay for the housing, food, medical care, and security for each of the 2.3 million residents of America’s prisons. In a world of limited public budgets, each of these expenditures represents an opportunity cost—a teacher’s aide not hired, a section of road not widened. Local, state, and federal governments pay such incarceration costs, which amount to $75 bullion in the aggregate, while slashing budgets for essential services for the rest of the citizenry including medical care, biomedical research, infrastructure, and educational funding—investments which arguably provide greater returns to taxpayers.

Yikes! Was I Wrong? A Second Look At The Viability Of Monitoring Capital Post-Conviction Counsel, Celestine Richards Mcconville
Maine Law Review
When Albert Holland’s capital post-conviction counsel filed his state post-conviction motion in September 2002, twelve days remained in the one-year statute of limitations for filing a federal habeas petition. While Holland might not have known exactly how much time was left in the federal limitations period, he knew he wanted to preserve his right to federal review, that the limitations period was tolled during non-discretionary state post-conviction review, and that he would be under the gun to get the federal petition filed once the Florida Supreme Court issued its decisions. And he made no ones about his desire to file …

Maine Law Review
Post-conviction review, often considered a tangential area of criminal law, is progressing to the forefront in our criminal justice system. The growth in our nation’s prison population, the expansion of collateral consequences flowing from criminal convictions, and advances in forensic science, among other factors, make the law of post-conviction review increasingly relevant and compelling. For these reasons, this Symposium issue of the Maine Law Review, “Balancing Fairness with Finality: An Examination of Post-Conviction Review,” is both timely and important.

The Five Stages Of Lgbtq Discrimination And Its Effects On Mass Incarceration, Michael D. Braunstein
The Five Stages Of Lgbtq Discrimination And Its Effects On Mass Incarceration, Michael D. Braunstein
University of Miami Race & Social Justice Law Review
Although the Supreme Court’s recent decision in Obergefell v. Hodges provided some indication of equality for members of the LBGTQ community, the sad truth is that discrimination against those who do not identify as “heterosexual” reaches far deeper than the right to marry. This discrimination is especially present with regards to biased treatment by law enforcement officers and a lack of accommodations or protections within the court and prison systems. In a nation that has seen various groups of people fight for and earn their equality over and over again, it is truly concerning that the LGBTQ community is still …

The More? Uniform Code Of Military Justice (And A Practical Way To Make It Better), Sean Patrick Flynn
Notre Dame Law Review
This Note offers suggestions for the successful transition of the military sentencing system, in light of the responses to the federal sentencing system. It goes on to argue that ,because sentencing guidelines are detrimental to the defendant, the military sentencing process should offer a guaranteed, but waivable, two days of preparation to the defendant post-conviction and presentencing.
