Courts As Institutional Reformers: Bankruptcy And Public Law Litigation, Kathleen G. Noonan, Jonathan C. Lipson, William H. Simon

This article compares two spheres in which courts induce and oversee the restructuring of organizations that fail systematically to comply with their legal obligations: bankruptcy reorganization and public law litigation (civil rights or regulatory suits seeking structural remedies). The analogies between bankruptcy and public law litigation (PLL) have grown stronger in recent years as structural decrees have evolved away from highly specific directives to “framework” decrees designed to induce engagement with stakeholders and make performance transparent. We use the comparison with bankruptcy, where the value and legitimacy of judicial intervention are better understood and more accepted, to address prominent criticisms …

Since the beginning of the 1600s, slavery was a known issue in the United States (U.S.). Although slavery was abolished in 1863 as a result of the Civil War, slavery persists in the present day. Modem day slavery is human trafficking. Although there is a misconception that human trafficking is only an international issue, victims need not cross international borders to be trafficked. Even though trafficking suggests movement or travel, there is no requirement that victims must be transported in order for trafficking to take place. Despite the importance of marine sediments as a carbon sink and many efforts to integrate microbiological with geochemical and geological data, the understanding of microbial organic carbon mineralization processes in marine sediments remains incomplete. There is growing evidence for the existence of an unrecognized oxidative sulfur cycling (cryptic sulfur cycling) above, within and below of the main sulfate reduction zone. For example, sulfate exists in supposedly sulfate-free methanogenic marine sediments from the Aarhus Bay and Black Sea. This implies that sulfur cycling is an ongoing process in the deep biosphere. Increases in UV radiation (UVR) reaching Earth's surface as a result of anthropogenic activities and changing climate patterns are having a variety of effects on ecosystems. Such effects have been observed in aquatic environments, although certain parameters such as dissolved organic carbon (DOC) concentrations can modulate the level of exposure. Bdelloid rotifers are aquatic micro-invertebrates that pose a remarkable variety of special abilities to survive adverse conditions, including a resistance to UVR. This analysis explores migration flows from Mexico to the United States at the state level. This study finds empirical evidence to support the idea that social and economic factors can help predict state-to-state migration flows. Using an alternative measure of migration flows, the Matricula Consular de Alta Seguridad (Consular Identification Card) data from 2011 to 2014, a panel data model is constructed from yearly data to analyze the effects of different determinants of migration flows. LMP-103S and AFM-315E are emerging propellants that are less toxic to the environment than the propellants currently being used in spacecraft propulsion. Both propellants are a blend of liquid fuel, oxidizer and a majority percent of water. The diluted solutions enable the capability to handle and store the propellants with fewer requirements; for this reason, it decreases the overall cost of the propellants since it needs less precautions. The Missile Defense Agency (MDA) awarded the University of Texas at El Paso (UTEP) a contract to further research green propellants and eventually replace Hydrazide.

Machiavellianism And Endorsement Of Appeal Type: An Examination Of Organization Recruitment, Steven M. Mueller

Machiavellianism is characterized by a cynical worldview, a relativistic ethical orientation, and a willingness to manipulate others. Because those higher in Machiavellianism are successful at obtaining positions of power, research is needed to better understand the ways these individuals influence others' attention and behavior. This study examined the effect of Machiavellianism and related personalities narcissism and psychopathy on appeal type preference (guilt-based, ego-promoted, or neutral). In this study, Machiavellianism was not associated with appeal type preference. Those higher in psychopathy, however, were more likely to endorse guilt-based persuasiveness. Further, those higher in narcissism reported positive attitudes toward the recruitment statement. …

The present study sought to investigate the applicability of the Compensatory Health Belief (CHB) model in relation to drinking by developing and validating the Drinking-Specific Compensatory Health Beliefs (CHBs) Scale in adults between the ages of 18 and 29 living in the United States. In phase 1, a pool of 41 items was administered to 293 undergraduate students. An Exploratory Factor Analysis (EFA) was used to construct the Drinking-Specific CHBs Scale, which consists of 13 items that encompass four different factors - physical activity, no consumption of other drugs, amount of alcohol consumed in future, and rest. In the practice of Motivational Interviewing, recognizing language is important for understanding where a persona stands in terms of readiness to change when considering a behavior change, such as risky alcohol use. The former El Paso ASARCO Smelting and Refining Co. operated between 1877 and 1999, the pyrometallurgic activity was estimated to have discharged excess of a 1,000 tons of lead (Pb) into the atmosphere from 1969-71. It was estimated 96 tons of (Pb) were emitted on an annual basis from the standing ore and fluid beds. The Environmental Protection Agency (EPA) determined that lead (Pb) is the heavy metal of the highest concentration within the vicinity of the smelter. This Thesis presents the results of an investigation of the concentration of radon in soil around a fault in the East Franklin Mountains in the El Paso area in West Texas. The connection between underground radon exhalations near active faults has been known for decades, but possible similar increases of underground radon levels around inactive faults have not been studied as thoroughly. Surface-enhanced Raman spectroscopy (SERS) was applied to investigate the feasibility in the detection and monitoring of the dopamine (DA) neurotransmitter adsorbed onto silver nanoparticles (Ag NPs) at 10-11 molar, a concentration far below physiological levels. In addition, density functional theory (DFT) calculations were obtained with the Gaussian-09 analytical suite software to generate the theoretical molecular configuration of DA in its neutral, cationic, anionic, and dopaminequinone states for the conversion of computer-simulated Raman spectra. Comparison of theoretical and experimental results show good agreement and imply the presence of dopamine in all of its molecular forms in the experimental setting. The dominant …

The purpose of this study is to estimate a coincident index for the Midland-Odessa region using the Stock and Watson (1988) methodology. The model assumes that the co-movements of indicators have a common element that can be summarized as a single underlying and unobservable variable, the “state of the economy” (Stock and Watson, 1988). The model utilizes the Kalman filter smoothing approach which smooths the index across time and across indicators and results in index movements that are less pronounced during expansions and recessions. Forty years ago, Mrs. Inez Moore, a widowed black mother and grandmother of little means, secured a victory that likely seemed improbable to many. Without any money, but with the assistance of a team of dedicated Legal Aid attorneys, she took her lawsuit challenging an East Cleveland, Ohio, zoning ordinance that made it a crime for her to live with her grandson all the way to the U.S. Supreme Court and won. This study was conducted to address language of intervention for the rapidly-growing bilingual population of children with Autism Spectrum Disorder (ASD) in the United States. The purpose of this study was to determine whether a monolingual English or bilingual Spanish/English condition would yield a greater number of request types in a 3-year-old bilingual participant with autism. A single-subject, rapid alternating treatments design with baseline and a final maintenance phase was used to alternate between monolingual English and bilingual Spanish/English interventions. â??Coloniasâ?? is a colloquial term used along the U.S.-Mexico border to simply mean informal housing practices. This Thesis uses critical discourse analysis theory to analyze the way the media, government, and law theorists perceive and legitimize the colonia phenomenon through discursive texts, leading to a discussion of hegemonic oppression and racism spelled out in a rhetoric of the colonias section. Background: Code-switching may be seen as a weakness in the eyes of many who do not truly

understand bilingualism. Several professionals consider code-switching to be a compensatory

strategy, however other professionals perceive code-switching as a functionally motivating behavior
