The Business Of Fraud, Jessica Marie Berkshire
The Business Of Fraud, Jessica Marie Berkshire
Honors Program Theses
This paper will focus on fraud within companies in order to discover overarching themes of why, when, and where corporate fraud occurs. Fraud has significant financial, economic, and social implications that negatively impact a company’s business standing. Research will be based on recent frauds that have been tried through the United States Attorney’s office. Correlations will be drawn regarding the Committee of Sponsoring Organizations of the Treadway Commission’s (COSO) framework, which is a foundation for companies who want to improve their internal controls. Based on the comparisons between the COSO framework and recent fraud activity, individual COSO principles can be …
Accommodating Invisible Illnesses And Disabilities In The Workplace, Elizabeth Simmons
Accommodating Invisible Illnesses And Disabilities In The Workplace, Elizabeth Simmons
Honors Program Theses
As our society evolves and becomes more accepting of people impacted by disabilities, we need to work to understand how to best accommodate those disabilities in the workplace. If employees and supervisors were trained on the importance of accommodating disabilities and the potential legal risk associated with a lack of accommodation, I believe they would be more open to implementing those accommodations. This research has taught me the value of how you can never understand what every person is going through. Each individual may have different needs, but it is the duty of HR professionals to attempt to create a …

Top Tens In 2015: Patent, Trademark, Copyright And Trade Secret Cases, Stephen Mcjohn
Northwestern Journal of Technology and Intellectual Property
The Supreme Court significantly affected the dynamics of patent litigation, holding that patent claim interpretation was not always reviewed de novo and that good faith belief that a patent was invalid was not a defense to infringement. The Federal Circuit potentially changed the approach to patent claim interpretation, holding that claims could be interpreted in light of the written description of the invention, even where the claim was not ambiguous. The Federal Circuit also addressed inducement of patent infringement, holding that it was not inducement to suggest consulting a physician who would likely prescribe an infringing treatment. The Federal Circuit …
Got Bacon?: The Use Of A Bioethics Advisory Board In Assessing The Future Of Transgenic Animal Technology, Heath R. Ingram
Got Bacon?: The Use Of A Bioethics Advisory Board In Assessing The Future Of Transgenic Animal Technology, Heath R. Ingram
Northwestern Journal of Technology and Intellectual Property
This article assesses the current state of the transgenic modification of animals and the law. It provides an introduction to the science behind transgenics as well as examples of transgenic livestock. This article discusses past federal level Ethics Advisory Boards, how these boards have impacted the development of controversial sciences, and how a new board can advance the use of transgenics. Bioethical arguments for and against the use of transgenics are evaluated. Finally, the article demonstrates how, if properly executed, an Ethics Advisory Board can help shape the national discourse on transgenics and provide a reasoned way forward for this …
Student-Athlete Perception Of Coaching Leadership Behaviors’ Influence On Mental Health Symptoms Associated With Anxiety, Depression, Suicidality, And Substance Abuse, Joan E. Thurston
UNF Graduate Theses and Dissertations
Abstract
Student-athletes are viewed as the epitome of health due to their physical appearance and talent set; however, it is their psychological health that needs significant attention (Etzel, 2006). Psychosocial stressors such as the pressures and demands of being a student and athlete as well as the demands and expectations of the coach have significant impact on the student-athlete’s mental health and well-being (Beauchemin, 2014; Cleary et al., 2011; Lafrenière et al., 2011; Mageau & Vallerand, 2003; Watson, 2005). The purpose of this research is to investigate any correlation between student-athletes’ perceptions of coaching leadership behaviors and the symptoms associated …

Increasing Student Interactions With Learning Objectives, Emily Kaye Faulconer
Increasing Student Interactions With Learning Objectives, Emily Kaye Faulconer
Publications
As educators, we recognize the importance of strong student learning objectives. We also know that students benefit by being well informed of expectations. Existing literature offers little guidance in methods and teaching strategies to apply in exposing students to their learning objectives. In this article, we discuss the use of specific teaching strategies to increase student interactions with the learning objectives. Student opinions regarding learning objectives were measured using an end-of-course Likert survey. Although no statistically significant changes in student opinions were detected in this study, a future study will investigate the influence of these targeted strategies on content mastery. …

Characterization Of The Mechanism Of Drug-Drug Interactions From Pubmed Using Mesh Terms, Yin Lu, Bryan Figler, Hong Huang, Yi-Cheng Tu, Ju Wang, Feng Cheng
School of Information Faculty Publications
Identifying drug-drug interaction (DDI) is an important topic for the development of safe pharmaceutical drugs and for the optimization of multidrug regimens for complex diseases such as cancer and HIV. There have been about 150,000 publications on DDIs in PubMed, which is a great resource for DDI studies. In this paper, we introduced an automatic computational method for the systematic analysis of the mechanism of DDIs using MeSH (Medical Subject Headings) terms from PubMed literature. MeSH term is a controlled vocabulary thesaurus developed by the National Library of Medicine for indexing and annotating articles. Our method can effectively identify DDI-relevant …
Murder, Miscarriage, And Women’S Choice: Prudence In The Colorado Personhood Debate, Calvin Coker
Murder, Miscarriage, And Women’S Choice: Prudence In The Colorado Personhood Debate, Calvin Coker
Faculty and Staff Scholarship
This article analyzes texts circulated in the 2014 debate over Colorado’s Amendment 67, the so-called Personhood Amendment, to demonstrate that value claims within the abortion debate are subordinated in favor of discussing the potential legal and philosophical implications of granting fetuses personhood. Using prudence, Robert Hariman’s (1991) framework for understanding political action, as a theoretical lens, I argue the personhood debate offers scholars an opportunity to identify and evaluate competing value claims of and in relation to potential impacts of the amendment. Prudence offers a compelling area for political communication and rhetorical scholars to expand and develop in light of …
Information Technology Approaches To Forest Management, Mary Snow, Richard Snow
Information Technology Approaches To Forest Management, Mary Snow, Richard Snow
Publications
The majority of the world’s forests occur where there is a dry season long enough to affect a seasonal change in the forest community. The seasonal forest may include evergreen, semi-deciduous, deciduous trees, or some combination of these. Local differences in soil or other site characteristics often determine which community persists. Since the seasonal forests exist where there is seasonal precipitation, the character of the forest is closely associated with the length of the rainy season. As the length of the rainy season decreases, the density of the canopy decreases. If the global climate system warms and prolonged drought gives …

Inside Sales Force And Gender: Mediating Effects Of Intrinsic Motivation On Sales Controls And Performance, Anne Gottfried, Scott Ambrose, Richard Plank
Publications
Business-to-business sales organizations are experiencing inside sales growth as well as increased importance and utilization of their inside sales people. This dynamic role change towards inside sales is resulting in organizations re-thinking their sales control structure. To fill this gap, data was collected from 183 inside sales professionals representing a variety of industries. Utilizing Partial Least Square Analysis (PLS), this study analyzed the influences of gender on the relationship between sales controls and job performance to include measuring effects of intrinsic motivation, both challenge seeking and task enjoyment, on the model relationships. Findings suggest that differences do exist between males …

Discriminating Gender: Legal, Medical, And Social Presumptions About Transgender And Intersex People, Janet L. Dolgin
Discriminating Gender: Legal, Medical, And Social Presumptions About Transgender And Intersex People, Janet L. Dolgin
Hofstra Law Faculty Scholarship
"Discriminating Gender: Legal, Medical, and Social Presumptions About Intersex and Transgender People” analyzes the significance of the binary-gender presumption in legal responses to intersex people and to transgender people. Both intersex and transgender status challenge familiar understandings of gender, sex, bodies, and personhood. Intersexuality challenges the cultural belief that that everyone can be, and should be, categorized as female or as male. And transgender status challenges the belief that gender and sex are always coincident and that they are established at a person’s birth. More fundamentally, differences in social and legal responses to both transgender people and to intersex people …

How does one balance national security and civil liberties when they are essentially incommensurable values? This Article seeks to answer that question by looking at both as a function of individual choice. We like national security in principle because it stops terrorists from taking away our choices—the choice to live, the choice to retain the integrity of our health, and the choice to act in the manner that we prefer. We like civil liberties because we want to be free from government interference when choosing the speech in which to engage, the religion we practice, and many other fundamental aspects …

Transactional Clinics As Change Agents In The Trump Era: Lessons From Two Contexts, Priya Baskaran, Michael Haber
Hofstra Law Faculty Scholarship
The results of the 2016 presidential election and the efforts by the Trump administration to make sweeping changes to a wide range of federal policies have left communities across the country feeling overwhelmed and threatened. In its first year, the Trump administration has been working steadily to slash budgets for health care, housing, infrastructure, schools, and other public benefits that help low-income and middle-class Americans, while adopting policies and engaging in rhetoric that has made many immigrants, Muslims, people of color, and LGBTQ people feel increasingly vulnerable and marginalized.
The authors of this commentary run law clinics that provide pro …

Family Limited Partnerships And Section 2036: Not Such A Good Fit, Mitchell M. Gans, Jonathan G. Blattmachr
Hofstra Law Faculty Scholarship
The IRS has struggled to close down abusive family limited partnerships. At first unreceptive to IRS arguments, the courts eventually embraced section 2036 as an estate-tax tool for attacking such partnerships. Because the section was not designed to apply to partnerships, difficulties have arisen as the courts have struggled with the fit. In its most recent encounter, the Tax Court in Powell grappled with a fit-related issue that implicates the Supreme Court’s landmark decision in Byrum. The Powell court, it will be argued, misread Byrum, conflating the majority opinion with the dissent – and converting the rule-based approach adopted by …

In the United States, 2.5 million people experience a traumatic brain injury (TBI) every year and an estimated 5.3 million are living with a TBI-related disability. A TBI alters the function of the brain and the brain pathology often resulting in long-lasting cognitive impairment, motor function impairments, and emotional changes. In conjunction with the physical changes a victim of TBI experiences, the injury can take a financial toll. It is estimated that 76.3 billion dollars is attributed to the direct and indirect costs of sustaining a TBI every year in the United States. Despite improvements in managing TBI, there are …

The Role Of Rig-I And Mda5 In Alphavirus Replication, Ivan Viachaslavavich Akhrymuk
All ETDs from UAB
Evolution of vertebrates has resulted in the development of a wide range of cellular pattern recognition receptors (PRRs), which detect the presence of virus-specific molecules termed pathogen-associated molecular patterns (PAMPs). Sensing of the incoming viruses and/or their replication by PRRs activates the cascade of cellular pathways that ultimately result in activation of antiviral response. Such response is determined by hundreds of cellular genes, whose products either directly interfere with virus replication or are released from the cells and activate antiviral state in yet uninfected cells. Consequently, the latter cell signaling prevents development of the next rounds of infection both in …

African American Child And Adolescent Obesity: The Parents Perspective, Alice Marie Austin
All ETDs from UAB
Nearly 36% of African American children ages 2 to 19 are overweight or obese. Childhood obesity results in children with social and psychological disorders, chronic disease, and an increase in morbidity and mortality. Solutions have been offered but none have made a significant impact on African American children living in the Southern United States. Studies that implement life style change produce short-term reductions in African American children but few show life-long change. Parents are responsible for making lifestyle choices for children, it is imperative to understand parental perceptions of child and adolescent obesity and its relationship to lifestyle change. The …

The increase of data collected every second requires a high data transfer system. Every day, 2.5 quintillion bytes of data are created [1]. This huge amount of data is col-lected from different devices and sensors. We proposed a new and novel scheme for a huge data transfer system. Our system introduces a new modulation and demodulations scheme for Ultra Wideband (UWB) communications systems. The main motivation for our scheme is to increase the amount of data collected from biosensors and medical data collections. This novel scheme is based on the Modified Hermite Pulses (MHP). The modulated signal is composed of …

The Effect Of An Increase In Lead In The Water System On Fertility And Birth Outcomes: The Case Of Flint, Michigan, Daniel Grossman, David J.G. Slutsky
The Effect Of An Increase In Lead In The Water System On Fertility And Birth Outcomes: The Case Of Flint, Michigan, Daniel Grossman, David J.G. Slutsky
Economics Faculty Working Papers Series
Flint changed its public water source in April 2014, increasing lead exposure. The effects of lead in water on fertility and birth outcomes are not well established. Exploiting variation in the timing of births we find fertility rates decreased by 12%, fetal death rates increased by 58% (a selection effect from a culling of the least healthy fetuses), and overall health at birth decreased (from scarring), compared to other cities in Michigan. Given recent efforts to establish a registry of residents exposed, these results suggests women who miscarried, had a stillbirth or had a newborn with health complications should register.
Are Fair Weather Fans Affected By Weather? Rainfall, Habit Formation And Live Game Attendance, Qi Ge, Brad Humphreys, Kun Zhou
Are Fair Weather Fans Affected By Weather? Rainfall, Habit Formation And Live Game Attendance, Qi Ge, Brad Humphreys, Kun Zhou
Economics Faculty Working Papers Series
We analyze habit formation in sports attendance utilizing rainfall as an unexpected, transitory shock to attendance costs. Using attendance data from Major League Baseball (MLB) and NOAA weather data, we analyze the impact of variation in game day weather conditions on current and future MLB attendance. The empirical strategy permits identification of both the formation and persistence of habit from exogenous weather shocks. Past adverse weather shocks increase future attendance by about 200 fans per game. Our study contributes to the literature developing empirical evidence of habit formation in the field and provides policy implications for optimal ticket pricing strategies.
The Effect Of Superstar Players On Game Attendance: Evidence From The Nba, Brad Humphreys, Candon Johnson
The Effect Of Superstar Players On Game Attendance: Evidence From The Nba, Brad Humphreys, Candon Johnson
Economics Faculty Working Papers Series
Economic models predict that “superstar” players generate externalities that increase attendance and other revenue sources beyond their individual contributions to team success. We investigate the effect of superstar players on individual game attendance at National Basketball Association games from 1981/82 through 2013/14. Regression models control for censoring due to sellouts, quality of teams, unobservable team/season heterogeneity, and expected game out-comes. The results show higher home and away attendance associated with superstar players. Michael Jordan generated the largest superstar attendance externality, generating an additional 5,021/5,631 fans at home/away games.
