The Coming Federalism Battle In The War Over The Death Penalty, Michael J. Zydney Mannheimer Oct 2017

The Coming Federalism Battle In The War Over The Death Penalty, Michael J. Zydney Mannheimer

Arkansas Law Review

From the founding of the Republic until 2002, it appears that only a single person was ever sentenced to death by the federal government for criminal conduct occurring in a state that did not authorize the death penalty for the same conduct. However, in the last twenty-three years, the federal government has sought the death penalty dozens of times in non-death penalty states. Such cases virtually always involve offenses historically thought of as being best dealt with at the state level. And since 2002, eleven people have been sentenced to death by the federal government for criminal conduct occurring in …

Should Death Be So Different?: Sentencing Purposes And Capital Jury Decisions In An Era Of Smart On Crime Sentencing Reform, Jelani Jefferson Exum Oct 2017

Should Death Be So Different?: Sentencing Purposes And Capital Jury Decisions In An Era Of Smart On Crime Sentencing Reform, Jelani Jefferson Exum

Arkansas Law Review

We are in an era of “Smart on Crime” sentencing reform. Several states and the federal government have made major changes to their sentencing policies—from reducing the incarceration of low-level, nonviolent drug offenders to the use of evidence-based sentencing to focus the most severe punishments on those who are at the greatest risk of recidivism. Often, today’s reform efforts are spoken about in terms of being fiscally responsible while still controlling crime. Though such reform efforts do not explicitly acknowledge purposes of punishment—such as retribution, incapacitation, rehabilitation, or deterrence—an undercurrent running through all of these reforms is an effort for …

Updating New York’S Constitutional Environmental Rights, Nicholas A. Robinson Oct 2017

Updating New York’S Constitutional Environmental Rights, Nicholas A. Robinson

Pace Law Review

The stakes are high as New York State considers whether to amend the constitution. The electorate contemplates the gathering crises of sea level rise, disruption of weather patterns, intensified summer heat waves, and other climate change impacts. New York also faces escalating environmental problems, which the newly perceived climate impacts in turn exacerbate. It is timely to debate whether or not New York should recognize the right to the environment to its constitution. In 2016, the House of Delegates of the New York State Bar Association adopted the report of its committee on the constitution, regarding the environmental conservation article …

Suburban Sustainability

As the United States and other nations strive to cope with the obesity epidemic (NCHS, 2015), progressive communities are developing sidewalk infrastructure to promote physical activity and health. The Center for Disease Control (CDC) recommends that community-based interventions like neighborhood walk, bike programs etc. have shown to be effective in promoting physical activity and health. Smart cities are embracing the development of community trails and promoting their use to increase physical activity among youth and adults. System implementation, data collection, and analysis were performed from January 2015 through July 2015. To promote these objectives, communities and cities need accurate information …

More Faculty of Science and Engineering Research

© 2017 Elsevier Ltd. We review and evaluate human adaptations during the last glacial-interglacial climatic transition in southwest Asia. Stable isotope data imply that climatic change was synchronous across the region within the limits of dating uncertainty. Changes in vegetation, as indicated from pollen and charcoal, mirror step-wise shifts between cold-dry and warm-wet climatic conditions, but with lag effects for woody vegetation in some upland and interior areas. Palaeoenvironmental data can be set against regional archaeological evidence for human occupancy and economy from the later Epipalaeolithic to the aceramic Neolithic. Demographic change is evaluated from summed radiocarbon date probability distributions, …

Wildland Recreation Disturbance: Broad‐Scale Spatial Analysis And Management, Kevin J. Gutzwiller, Ashley D'Antonio, Christopher Monz

Environment and Society Faculty Publications

Wildland recreation that does not involve animal harvests (non‐consumptive recreation) often influences various components of natural systems, including soils, water, air, soundscapes, vegetation, and wildlife. The effects of non‐consumptive recreation on wildlife have typically been assessed at spatial scales that are not only much smaller than the overall distributions of this disturbance but also much smaller than the areas that species use during a season or year. This disparity in scales has prevented effective assessment and management of broad‐scale recreation disturbance for many species, especially wildlife. We applied three software systems (ArcGIS, FRAGSTATS, and Conefor) to demonstrate how metrics commonly …

The Importance Of Transportation, Broadband, And Intellectual Infrastructure For Entrepreneurship, James E. Prieger, Heng Lu, Habi Zhang Oct 2017

The Importance Of Transportation, Broadband, And Intellectual Infrastructure For Entrepreneurship, James E. Prieger, Heng Lu, Habi Zhang

School of Public Policy Working Papers

This empirical study uses a unique panel dataset to investigate the link between regional entrepreneurship and infrastructure. This topic is vital for understanding the factors that facilitate entrepreneurship, yet it receives scant scholarly attention. It is of particular value to policy makers because entrepreneurship is crucial for economic growth. We therefore examine how broadband infrastructure (internet connectivity), intellectual infrastructure (human capital), and transportation infrastructure (roads, bridges, and intermodal facilities) affect the establishment of new businesses in the United States. We primarily focus on broadband infrastructure, which is the least explored of these factors in the literature. We find that all …

The Punishment Marketplace: Competing For Capitalized Power In Locally Controlled Immigration Enforcement, Daniel L. Stageman Oct 2017

The Punishment Marketplace: Competing For Capitalized Power In Locally Controlled Immigration Enforcement, Daniel L. Stageman

Publications and Research

Neoliberal economics play a significant role in US social organization, imposing market logics on public services and driving the cultural valorization of free market ideology. The neoliberal ‘project of inequality’ is upheld by an authoritarian system of punishment built around the social control of the underclass—among them unauthorized immigrants. This work lays out the theory of the punishment marketplace: a conceptualization of how US systems of punishment both enable the neoliberal project of inequality, and are themselves subject to market colonization. The theory describes the rescaling of federal authority to local centers of political power. Criminal justice policy activism by …

The Utility Of Bioenergetics Modelling In Quantifying Predation Rates Of Marine Apex Predators: Ecological And Fisheries Implications, A. Barnett, M. Braccini, C. L. Dudgeon, N. L. Payne, K. G. Abrantes, M. Sheaves, E. P. Snelling

Fisheries Research Articles

Predators play a crucial role in the structure and function of ecosystems. However, the magnitude of this role is often unclear, particularly for large marine predators, as predation rates are difficult to measure directly. If relevant biotic and abiotic parameters can be obtained, then bioenergetics modelling offers an alternative approach to estimating predation rates, and can provide new insights into ecological processes. We integrate demographic and ecological data for a marine apex predator, the broadnose sevengill shark Notorynchus cepedianus, with energetics data from the literature, to construct a bioenergetics model to quantify predation rates on key fisheries species in …

A Systematic Review Of Urban Sustainability Assessment Literature, Matthew Cohen

Earth and Environmental Sciences Publications

As the world rapidly urbanizes, there is much focus on achieving sustainability outcomes within cities. Accomplishing this goal requires not only envisioning sustainable cities and implementing strategies, but it also demands assessing progress towards sustainable urban development. Despite a growing literature on sustainability assessment, there is room to further understand the application of sustainability assessment in urban contexts. This paper presents a systematic review of urban sustainability assessment literature to (1) identify the most common methods used for urban sustainability assessment, (2) identify the most common framings for urban sustainability assessment, and (3) identify the most common categories for organizing …
