Producing Democratic Vibrancy, K. Sabeel Rahman

Professor Rahman gives his thoughts and opinions on the impact of Citizens' United v. FEC and the growth of the First Amendment debate since. The comment analyzes the normative udnerstanding of democracy and the ongoing debate campaifgn finance have. Professor Rahman concludes by suggesting that the debate is wrongly focused on the indivudals being consumers of politcal speech rather than the producers of it.

Persistent Threats To Commercial Speech, Jonathan H. Adler

The current Supreme Court is very protective of speech, including commercial speech. Threats to commercial speech persist nonetheless. This article briefly examines two: the use of commercial speech restrictions as a form of rent-seeking, and compelled commercial speech. Regulation of commercial speech protect is sometimes used to protect established corporate interests from competitors who are less able to bear the costs of regulation, with consequences that extend beyond the economic marketplace. In the case of commercial speech, courts have been unduly deferential to claims of a consumer “right to know” as a basis for mandated labeling and disclosure. Greater protection …

No Drop Prosecution & Domestic Violence: Screening For Cooperation In The City That Never Speaks, Allessandra Decarlo

Throughout history, domestic violence has been infamously kept behind closed doors and outside of our legislature. It was not until the 1960s, due to the efforts of the battered women’s movement, that the U.S. government began to address domestic violence as a social ill and offered protection to victims through statutes and policies in both State and Federal capacities. This note elaborates on one such policy, known as a “No-Drop” policy, which has been implemented by prosecutor’s offices throughout New York City’s five boroughs, as a mechanism to aggressively combat domestic violence. “No- Drop” policies allow prosecutors to vigorously prosecute …

Legal scholars, educational administrators, journalists, and students have all witnessed a rise in students being disciplined by university officials for speech and conduct deemed inappropriate for college campuses. In endeavoring to explain this trend, some academics point to the disconnect between the Department of Education and university administrators regarding the legal standards for campus anti-harassment policies. The lack of clarity regarding what constitutes harassment on college campuses has resulted in the punishment of students by universities for speech and conduct that is normally considered to be protected speech under the First Amendment. As one surveys the vast and ever-changing landscape of law and litigation, few things stand out as so unanimously exalted and carefully guarded as the privilege protecting attorney-client communications. Yet there is today a surprising lack of uniformity and predictability in the reasoning by which New York courts determine whether a communication made by in-house counsel to its corporate client will – or will not – enjoy the protection of that privilege. Type III secretion systems (T3SS) are central virulence factors for many pathogenic Gram-negative bacteria, and secreted T3SS effectors can block key aspects of host cell signaling. To counter this, innate immune responses can also sense some T3SS components to initiate anti-bacterial mechanisms. The Yersinia pestis T3SS is particularly effective and sophisticated in manipulating the production of pro-inflammatory cytokines IL-1β and IL-18, which are typically processed into their mature forms by active caspase-1 following inflammasome formation. Some effectors, like Y. pestis YopM, may block inflammasome activation. Here we show that YopM prevents Y. pestis induced activation of the Pyrin inflammasome induced …

The estimation of demand for priced highway lanes is becoming increasingly important to agencies seeking to improve mobility and find alternative revenue sources for the provision of transportation infrastructure.
However, many modeling tools fall short of what is required for robust estimates of demand with respect to toll and managed lanes in two key areas:
- The value-of-time is often aggregate and not consistently defined throughout the model system, and
- The reliability of transport infrastructure is rarely taken into account.

In introducing this special issue of Social Work Research, we feel it is important to discuss why social work practice and research with men and fathers is of critical importance and deserving of specific attention. Social work researchers and practitioners need to focus on men and fathers, both as a special population and as subpopulations of other groups. Over the past 20 years, conservation efforts in New Zealand have moved from being concentrated in rural and isolated island locations, where exotic mammalian predators are often controlled, to begin to bring native fauna back to major cities. However, human–wildlife conflicts arise when conservation occurs in close proximity to cities. These are particularly intense when companion animals are involved either as potential predators or prey of high-value conservation animals. Within New Zealand, this conflict is particularly fraught around domestic cats (Felis catus) in the urban environment. Among other challenges, homeless children often struggle with internalizing and externalizing behavior problems that impair functioning and well-being (Bassuk, et al., 1997). Given the instability of service continuity often present in the lives of homeless families and their children, it is strikingly common for child mental and behavioral disorders to be caught at a later developmental stage among this group compared to both housed and other low-income peers (Grant, et al., 2007). Emergency shelters represent an untapped setting in which to deploy universal, evidence-based screeners for problem behaviors among this population. Where Was Canada? The Canadian Military Contribution To The British Commonwealth Second World War Campaign In North Africa, Andrew Stewart

The campaign fought by predominantly British Commonwealth forces in North Africa during the Second World War, in many respects, represented a final example of imperial solidarity and unity. Whilst the United States participated during the final stages prior to the surrender of Axis forces in May 1943, it was Britain and its Empire that provided most of the resources and manpower and contested most of the battles. Canada, however, played only a relatively minor part and this paper seeks to examine the associated decision-making process that took place in London and Ottawa and discuss the tensions that arose.

Destroying The Panthers: The Effect Of Allied Combat Action On I./Ss Panzer Regiment 12 In Normandy, 1944, Arthur Gullachsen

This article is an examination of the operational record of the World War Two German Panther tank during the Normandy Campaign of summer 1944. Challenging its perception as mechanically unreliable, this article argues Allied combat action was responsible for a large percentage of Panthers that were out of action. Secondly, the inferior resources of the German tank replacement and repair program were no match for superior Canadian Army practices during 1944. To support these arguments the author examines Canadian and German wartime primary documents as well as multiple secondary sources.
