Copyright In Pantomime, Brian L. Frye
Copyright In Pantomime, Brian L. Frye
Cardozo Arts & Entertainment Law Journal
Why does the Copyright Act specifically provide for the protection of "pantomimes"? This Article shows that the Copyright Act of 1976 amended the subject matter of copyright to include pantomimes simply in order to conform it to the Berne Convention for the Protection of Literary and Artistic Works. It further shows that the Berlin Act of 1909 amended the Berne Convention to provide for copyright protection of "les pantomimes" and "entertainments in dumb show" in order to ensure copyright protection of silent motion pictures. Unfortunately, the original purpose of providing copyright protection to '"pantomimes " was forgotten. This Article argues …
Access To Capital Or Just More Blues? Issuer Decision-Making Post Sec Crowdfunding Regulation, Patricia Hureston Lee
Access To Capital Or Just More Blues? Issuer Decision-Making Post Sec Crowdfunding Regulation, Patricia Hureston Lee
All Faculty Scholarship
Crowdfunding is an alternative for Issuers seeking funds for their businesses. On October 2015, the Securities Exchange Commission (SEC) released final crowdfunding regulations that became effective May 20162 as a charge of the Jobs Act, Title III (the “Crowdfund Act”). Issuers can now secure crowdfunded investments without a securities registration.
This article evaluates investment-based crowdfunding from the perspective of one group that has been neglected from the crowdfunding scholarship — Issuers that seek financing under this new framework. In Section I, the author summarizes the new crowdfund regulations, which create a new financing opportunity vastly different from previous types of …

The privileged Watters family, David, Winnie, and their 14-year-old daughter, Faye, struggle to adjust their suburban Charlotte lifestyle to fit a much-reduced income. Their fast failure leads them down separate paths: David after enlightenment through Transcendental Meditation, Faye after the power she feels in the company of her handsome Earth Science teacher, and Winnie in a romantic foray to Alaska after buried gold. Currency probes that moment when everything changes size, when initial annoyances shrink and reality resumes a new and disturbing sense of proportion.
Virginia Practice Series: Jury Instructions, Ronald J. Bacigal, Margaret Ivey Bacigal
Virginia Practice Series: Jury Instructions, Ronald J. Bacigal, Margaret Ivey Bacigal
Law Faculty Publications
Virginia Practice Series-Jury Instructions is a continuation and update of previous editions, which won widespread approval among the bench and bar for almost 40 years.
As in the past, this book is primarily confined to the most common areas of jury trial work, torts and criminal law. Where possible, the language of the instructions is taken directly from reported cases or case records. Where this is not possible, we have set out instructions that should meet both the general rules regarding the form of instructions and the specific substantive legal rules. In the latter cases, close attention has been paid …
Speech-Facilitating Conduct, Jud Campbell
Speech-Facilitating Conduct, Jud Campbell
Law Faculty Publications
Free speech doctrine generally protects only expression, leaving regulations of nonexpressive conduct beyond the First Amendment’s scope. Yet the Supreme Court has recognized that abridgments of the freedom of speech “may operate at different points in the speech process.” This notion of protection for nonexpressive conduct that facilitates speech touches on many of the most contentious issues in First Amendment law— restrictions on photography and audiovisual recording, limits on campaign contributions, putative newsgathering privileges for journalists, compelled subsidization of speech, and associational rights, to name just a few. Scholars, however, have generally approached these topics in isolation, typically focusing on …
A Patriot For Men: The Politics Of Masculinity In John Osborne's "A Patriot For Me", Joshua Kelly
A Patriot For Men: The Politics Of Masculinity In John Osborne's "A Patriot For Me", Joshua Kelly
All Master's Theses
By applying David Savran’s scholarship on the politics of masculinity to John Osborne’s play A Patriot for Me (1965), I demonstrate that Osborne exemplified contradictory sexual politics in the play, and was criticized as homophobic and praised as revolutionary in similarly contradictory original reviews. I argue that play very much typifies the heteronormative politics of masculinity by placing a dominant homosexual (Redl) as protagonist, and inverts the positions of the period woman and the staged effeminate man. Redl is historically represented as a heroic homosexual, but is actually a heteronormative object. I provide evidence for this interpretation by employing Savran …
In Search Of Heterotopia: Immersive Experiences In The Museum, Nicolas Crosby
In Search Of Heterotopia: Immersive Experiences In The Museum, Nicolas Crosby
All Master's Theses
Museums everywhere are waging battle to find ways to attract new audience members. In this thesis I draw upon participant observation, interviews, and event planning in order to examine how museums create heterotopic, interactive immersive experiences. I focus on the work of two Seattle-area museums, and a gallery and a museum in Ellensburg. The Entertainment, Music, and Popular Culture museum (EMP), the Nordic Heritage Museum (NHM), and the Museum of Culture and Environment (MCE) developed opportunities for visitors to engage with museum-created heterotopic events. I approach this analysis through a theoretical framework that emphasizes structure and agency. On one hand, …
Duchamp Meets Turing: Art, Modernism, Posthuman, Gabriela Galati
Duchamp Meets Turing: Art, Modernism, Posthuman, Gabriela Galati
Other Faculty of Arts, Humanities and Business Theses
In her book How We Became Posthuman (1999), Katherine Hayles analysed the process through which the conception of the liberal humanist subject led the way to the posthuman subject, a subject who lives in complete entwinement with the digital. This process, however, was not innocuous: it made the (fallacious) perception that information could do without material instantiation pervasive within many fields of knowledge, a process that Hayles contends originates in the Macy Conferences and the evolution of cybernetic theory. This research identifies an analogous process within the artistic realm: when Clement Greenberg delineated the concepts of opticality and colour field …
Choreographing Intimacy: The Making Of ‘[They] Slipped Briskly Into An Intimacy From Which They Never Recovered’ – A Dance Film, Antonio Rinaldi
Choreographing Intimacy: The Making Of ‘[They] Slipped Briskly Into An Intimacy From Which They Never Recovered’ – A Dance Film, Antonio Rinaldi
Theses : Honours
In this investigation, I have utilised a practice-led research methodology to capture ‘intimacy’ in film, specifically, the medium of dance film. The exegetical work is divided into the written research with an accompanied dance film component; however they should be viewed as an integrated thesis. The aim of my research was to develop my choreographic practice through a film that is a sensory and evocative exploration of intimacy. I argue that the film components of dance film (directing, cinematography, editing and the like) uniquely capture an intangability of dance and the complexities of human intimacy in a manner that is …
Physical And Moral Forces: An Analysis Of World War Ii’S 1944-1945 Ardennes Offensive Using Clausewitzian Theory, Rebecca Griffin
Physical And Moral Forces: An Analysis Of World War Ii’S 1944-1945 Ardennes Offensive Using Clausewitzian Theory, Rebecca Griffin
Theses : Honours
This thesis employs Carl von Clausewitz’s theory on moral forces to conduct an analysis of World War II’s 1944-1945 Ardennes Offensive. The literature largely focuses on presenting the physical components of the offensive, neglecting the moral. This thesis aims to fill this gap by presenting an analysis of the utilisation and effects of both physical and moral forces in the Ardennes Offensive and determining the importance of each to the outcome. Analysing the planning and execution of the offensive through this theoretical perspective reveals that moral forces played a significant part in Allied success in the Ardennes. The analysis exposed …

The Material Forms Of Memory: A Creative Arts Praxis Examining Family Archive Materiality And The Performance Of Memory Through Installation Art, Emily M. M. Hornum
Theses
This Master of Arts by Research investigates the role of new media in influencing familyarchive materiality and what effect this has on the performance of memory. The aim is to examine through creative arts praxis how installation art illuminates the participatory engagement of family archive materiality to mediate our mnemonic processes. The source materials for this project stem from my family archives dating from the early 1900s to 2013, and include photographs, 35mm slides, VHS tapes, audiotapes and personal items. The significance of this research lies in the creative outcomes that have occurred through the investigative and critical dialogues between …

The Influence Of Romantic Poetry On The Career And Music Of Nicolas Medtner, Denise Rudell
The Influence Of Romantic Poetry On The Career And Music Of Nicolas Medtner, Denise Rudell
Theses and Dissertations
Nicolas Medtner was a composer born out of his time. He was a true Romantic in the Russian Silver Age and his creative ideology owes much to the Romantic poetry that he was devoted to all his life. This poetry put a decisive stamp on his music and influenced his career decisions. Medtner was exposed to the most renowned literature from an early age. Influenced by his father, and his oldest brother Emil, he developed a lifelong love for literature and especially poetry. Literary connections are apparent throughout Medtner’s music, including (and not limited to) references to Goethe, Pushkin, Lermontov, …

Male Or Nurse What Comes First? Challenges Men Face On Their Journey To Nurse Registration, D Juliff, K Russell, C Bulsara
Male Or Nurse What Comes First? Challenges Men Face On Their Journey To Nurse Registration, D Juliff, K Russell, C Bulsara
Health Sciences Papers and Journal Articles
Objective: This paper aims to provide an account of the first phase of a qualitative longitudinal study that explored the initial challenges men in nursing face to become registered. What is known is that men, a minority group within nursing, face the usual challenges of all new nurses in their quest to register as nurses. In addition, they have added pressures that hinder their quest due to being male.
Primary Argument: An Australian nursing shortage is looming due to nurses retiring from this female-dominate profession. Hence, the retention of men in nursing is an area requiring attention in order to …
Development Of A Definition And Measure For The Study Of Violent Mass Victimization, Mindy Weller
Development Of A Definition And Measure For The Study Of Violent Mass Victimization, Mindy Weller
Electronic Theses and Dissertations
For decades there has been a growing body of literature and research on the topic of mass murder with no attention paid to incidents of mass violence whose death toll falls just short of the minimum three body requirement. The purpose of this study is to address this gap and develop a valid and reliable definitional measure for the future study of violent mass victimization events. A mixed methods approach was employed and consisted of assessing 1,118 news articles collected from 42 U.S. states for the years of 2009 through 2012. These articles were collapsed into a sample size of …

Matteo Garrone's Reality:The Big Brother Spectacle And Its Rupture, Anna Paparcone Bronner
Faculty Journal Articles
In Garrone’s film, Reality, the protagonist Luciano Ciotola becomes obsessed with his participation in the reality TV show Big Brother to the point that his whole life turns into a spectacle. In Italian cinema studies no other scholar had yet analyzed this film, despite its success and the very engaging and up-to-date topic. In my article, at the diegetic level, I show that the spectator experiences an overlap and a (con)fusion between Luciano’s everyday reality and his life as a member of the reality TV show. However, keeping in mind Guy Debord’s seminal work The Society of the Spectacle and …

Flow. Interactive Sonic Art: The Creation And Use Of Responsive Strategies To Re-Imagine The Performer/Spectator Relationship And Create Visitor Inclusive Sonic Environments., Peter Shepherd
Other Faculty of Arts, Humanities and Business Theses
FLOW operates on two levels, firstly as an engaging live performance environment and secondly as a vehicle to discuss a number of philosophical ideas relating to sound as art. As a performance piece FLOW exists to provide an inclusive interactive environment for musicians and casual visitors alike. A series of sensors allow those who enter the arena to make interventions in an immersive soundscape through their movements, opening up possibilities for the exploration of sound and gestural action within the space. The piece challenges the conventional roles of performer and spectator and offers interactive technology as a means of uniting …
Poems To The Sea And Painterly Poetics: Charles Olson, Robert Creeley, Cole Swensen, Peter Gillies
Poems To The Sea And Painterly Poetics: Charles Olson, Robert Creeley, Cole Swensen, Peter Gillies
Other Faculty of Arts, Humanities and Business Theses
Poems to the Sea: Rather than narrating or describing a work of visual art, the poems that form this collection show an accumulation, juxtaposition and realignment of material ranging from art historical detail and critique to a more personal, location specific response to works viewed in galleries and museums. Many of the poems engage with non-representational artworks and question how best to reflect, translate or expand upon their transformative effects. The first section, ‘Museum Notes’, explores Charles Olson’s open field poetics by giving artists and writers a conversational voice. ‘Sound Fields’, the second section, responds to individual works of art …
Food With Integrity: A Financial Analysis Of Chipotle Mexican Grill, Kaylie M. Rowell
Food With Integrity: A Financial Analysis Of Chipotle Mexican Grill, Kaylie M. Rowell
Honors Theses
For the accounting alternative thesis, we were to pick a publicly traded company domiciled in the U.S that we were interested in and research their financials, business, and industry. I chose Chipotle Mexican Grill due to their unique restaurant brand. Chipotle's Food with Integrity campaign makes up their main brand, but brings the issue of finding enough suppliers to meet their needs. If Chipotle has to use processed food to fulfill the lack of the natural, organic food then they will eventually lose their customer's trust. Chipotle has also expanded globally so there are always issues that appear when dealing …

A Case Study Of Factors Influencing Remote University Nursing Graduates And Their Decision To Work In A Remote Hospital, Sally Clark
Theses
The health of the rural population in Western Australia (WA) is predicated on equity and access to healthcare facilities with nurses being the main component of front line staff. There continues to be a nurse shortage particularly in remote regions of Australia where the poor health status of Australian Indigenous people, and an increasing ageing population are a perennial problem. The Kimberley, the setting for this study, is a remote region in the north of WA. It has a landmass of 423,517 square kilometres with a significantly low-density population compared to the total WA population. Nearly half of the Kimberley …

An Analysis Of Narong Prangcharoen's "Three Minds" For Solo Piano, Pawatchai Suwankangka
Graduate Theses, Dissertations, and Problem Reports (ETD)
This research paper studies the piano piece Three Minds composed by Narong Prangcharoen. The main focus is the analysis of its three movements: "Fierce," "Absent," and "Hesitant," of which only the first movement receives an in-depth analysis. In addition, the composer's biography, his musical style, a complete list of his composition, and historical background of Three Minds are included.;Prangcharoen, Thai native composer, became well known in the early 2000s. His music uniquely fuses Thai and Western elements. This is found in the first movement "Fierce" with the influence from ranad, a Thai wooden xylophone. As his music is bound within …
