Did Orson Welles co-author the infamous War of the Worlds broadcast? The Ninth Circuit Court of Appeals has told us no, primarily because he only contributed the idea behind the broadcast, and ideas alone can’t be copyrighted. “An Idea of Authorship” challenges this premise—that ideas, no matter how significant, cannot qualify for joint authorship in collaborative works—and argues that we as a society should, under certain circumstances, recognize idea-contributors like Welles as joint authors. We should do so to further our society’s interest in encouraging future creations, as well as out of a sense of equity and fairness to idea-contributors, …

Due to students not meeting minimum proficiency levels in reading, a central Florida middle school that was rated an A school for 4 years consecutively dropped to a B rating during the 2012-2013 school year and was 10 points away from dropping to a C rating in the 2013-2014 school year. The purpose of this phenomenological study was to describe classroom implementation of Internet technology in a middle school classroom in an attempt to address the steady decline in reading scores. Humane education (HE) is a specialized niche in higher education and adult learning. HE provides a curricular framework positioning environmental ethics, animal protection, human rights, media literacy, culture, and change processes as the nexus for understanding and inspiring social change. Research-derived experiences illuminating how educators conceptualize and implement HE in U.S. schools are absent from the scholarly literature. Facing this gap, practitioners and administrators of HE programs cannot access nor apply research-derived practices to inform instruction. This thesis provides an analysis of the cartoons produced by Victor Ekpuk for The Daily Times newspaper of Nigeria from 1989 through 1998 and the artist’s use of ancient nsibidi script to “hide in plain sight” his social commentaries on sociopolitical and economic issues in Nigeria. Victor Ekpuk’s original cartoons within the permanent collection of the Smithsonian Institution’s National Museum of African Art are examined in the context of indigenous masking practices and other indirect methods employed by indigenous comedians to protect themselves. The Eleanor Burts Collection consists of children themed books, artifacts, artwork, posters, puzzles, and other miscellaneous items that were collected by Eleanor Norris Burts (1916-1998) throughout her life. Eleanor Burts was a 1937 graduate of Winthrop College and lifelong educator. She was an avid collector of artifacts, artwork, and mainly books related to children and amassed a very large collection of materials that date back to the 1700s.

Silence is both overpriced and underrated. This Article assesses the status of silence in light of renewed attention to reliability in criminal procedure. First, it considers the meaning of silence, both outside of the criminal justice process and within it. The Article then describes how silence can safeguard the context of confessions by making space for suspects to choose or reject engagement while shielding the content of statements from government manipulation. This account seeks to advance the discussion about protecting silence beyond the debate as to whether it advantages the innocent or the guilty. Even while we widely recognize legal liability for physical injury, we frequently discount mental, emotional, and psychological injury. We disfavor tort liability for emotional distress; we prohibit prisoners from suing for purely psychological injuries; and we tax the damages victims of emotional injury receive even while leaving damages for physical injury untaxed. This Article argues that neuroscientific, psychological, and technological advances challenge our traditional ideas about the set of injuries that are possible and that merit legal redress. The Article goes on to contend that, while these advances challenge our traditional ideas, they do not inevitably overturn traditional distinctions within …

In the 1920s, family law jurisprudence saw the development of a fundamental right to direct the upbringing and education of children by parents. However, in the aftermath of Roe v. Wade, the Supreme Court began a trajectory that culminated in what would amount to a total deprivation of a father's prenatal rights despite an absence of judicial review of these matters. In its post-2002 copyright jurisprudence, the Supreme Court of Canada has clarified that the Copyright Act grants a significant degree of latitude to non-copyright owning parties to express themselves using copyrighted works. This outcome is attributable neither to the SCC having interpreted provisions of the Copyright Act according to Charter values nor to the SCC having weighed provisions of the Copyright Act against the section 2(b) right to freedom of expression. Abstract This thesis studies the attitudes of healthcare provider and consumer groups in Qatar towards health literacy via health promotion. Using Q methodology, data from healthcare providers and consumers was analysed to determine relative attitudes towards previous and future health campaign strategies in Qatar. Consumer data was also collected to determine attitudes towards current health promotion campaigns and the perceived effectiveness of campaigns in encouraging behaviour change. The research also investigates the obstacles that prevent healthcare consumers from adopting the healthier lifestyle choices advocated by some of these campaigns. Participants were residents of Qatar.

This memoir-in-essays tells the story of four generations of a family living in one place, Pittsburgh, as they navigate the rise, peak, collapse, and disappearance of the steel industry. In terms of the manuscript’s “situation,” the family must navigate the complex economic, ethnic, environmental, and social struggles that are inherit when living in a place for over one hundred years. The manuscript argues that family and place are so intimately connected that the two entities cannot be separated. In this dissertation I will argue that familial betrayal is a central element in sixteenth-century British tragedy and seventeenth-century French tragedy. Family relationships help to define who the characters are and provide a point of identification between the audience and the play. This identification, as Aristotle argues, is necessary for the arousal of pity and fear and thus creates the possibility of catharsis. Fear is a key component of psychological trauma. This is the main link between Aristotle’s theories and modern trauma theory but there are other overlapping ideas that form a basis as to why old tragedies still resonate …

Purpose -- The purpose of this study was to conduct a content analysis of humor styles used in an original British television show and its adapted U.S. version.;Methodology -- A total of 28 episodes from the UK and U.S. version of the television sitcom The Office were classified under the four humor styles described by Martin et al. (2003).;Findings -- Humor styles used in television sitcoms significantly differ between the two countries. This dissertation examines how economic and technological changes shaped the sounds of Canadian cinema, from the modern industry’s founding in the late 1960s to the widespread adoption of digital editing software in the early 2000s. By focusing on the labour and craft practices that coalesced in Toronto’s postproduction companies, I argue that such practices engendered a critical shift in the sonic style of Canadian film sound. Whereas fiction films initially featured a sonic style developed by the National Film Board of Canada for documentary production, filmmakers eventually adopted a style strongly identified with Hollywood cinema. With 430,000 inhabitants in 1800, Naples had become the third most populous European city after London and Paris. The excavation of the site of Pompeii in the eighteenth century gave a special prestige to the city. Its newly unearthed antiquities and frescoes led to a vogue of neoclassicism across the arts. Images of ancient Greek and Roman lyres inspired the creation of the lyre-guitar, an instrument on which Mauro Giuliani performed on various occasions in Naples--probably more for its visual effect than for audibility's sake.

This thesis offers theatre practitioners a method for approaching Christopher Marlowe’s performance texts. Doctor Faustus is offered as a case study. Within it I provide a brief account of Marlowe’s education, identifying the key influencing factors that led to his resultant compositions. A discussion of the variant texts of Doctor Faustus follows, which provides the reader with an understanding of the text and its context. Various approaches to the text are explored and reviewed in their degree of success. This study investigated the role of both arts-integrated instruction (art activities as part of math instruction) and teacher immediacy (teacher caring behaviors) levels on students' math achievement. Although students from low socio-economic culturally diverse school districts have shown improvement in academic test scores, their scores are still significantly lower than scores of students from other school districts. Research has shown that when there is an increase in teacher immediacy, students' academic success increases. Background: Breastfeeding is strongly associated with health benefits for children and their mothers. Despite this knowledge, breastfeeding rates in the United States have increased only slightly. Current research examines the relationship between nurse characteristics and patient outcomes in adult intensive care and acute care settings. To date there is very limited research examining nurse variables and outcomes in women and children, and very little knowledge regarding the characteristics of the nurse in relation to patient’s breastfeeding success.

Patrice Rankine’s “The Body and Invisible Man: Ralph Ellison’s Novel in Twenty-First-Century Performance and Public Spaces,” contrasts the artistic uses of physicality in Invisible Man the novel with its 2012 play adaptation. Rankine argues that the stage version’s “focus on the corporeal reality of race” complements what the novel can do to facilitate social or political progress: in short, “there is therapeutic value in ‘staging’ or reliving such experiences.” Staging Invisible Man extends Ellison’s relevance in an age where, though the United States had a black president, the very novelty of the black body illustrates how infrequently that body …

The note argues that adult entertainment film contracts should be enforceable, as the consideration—whether in the form of performance, waiver of privacy, or sexual intercourse—meets legal standards. It posits that evolving social norms and legal precedents, such as the legalization of adult entertainment and the enforceability of cohabitation agreements, support the validity of these contracts, despite historical opposition due to public policy concerns.
