Domestic Violence And The Politics Of Self-Help, Elizabeth L. Macdowell Feb 2016

Domestic Violence And The Politics Of Self-Help, Elizabeth L. Macdowell

William & Mary Journal of Race, Gender, and Social Justice

Self-help programs are conceptualized as alternatives to attorney representation that can help both courts and unrepresented litigants. The rhetoric of self-help also typically includes empowering unrepresented individuals to help themselves. But how do self-help programs respond to litigants’ efforts at self-advocacy? This Article reports findings from a study of courthouse self-help programs assisting unrepresented litigants applying for protection orders. The central finding is that self-help staff members were not neutral in the provision of services despite a professed ethic of neutrality. Using the sociological concept of demeanor, this Article shows that staff members rewarded protection order applicants who conformed to …

Charging On The Margin, Paul T. Crane Feb 2016

Charging On The Margin, Paul T. Crane

William & Mary Law Review

The American criminal justice system has experienced a significant expansion in the number and severity of penalties triggered by misdemeanor convictions. In particular, legislatures have increasingly attached severe collateral consequences to misdemeanor offenses — penalties such as requirements to register as a sex offender, prohibitions on owning or possessing a firearm, and deportation. Although there is a wealth of scholarship studying the effect this development has on defendants and their attorneys, little attention has been paid to the impact collateral consequences have on prosecutorial incentives. This Article starts to remedy that gap by exploring the influence that collateral consequences exert …

Deprivation Of Freedom Research Paper And Critical Analysis Of The Utilization Of Privately Operated Correctional Institutions, Richard Louis

Student Articles

According to Merriam-Webster’s dictionary, one of the definitions of deprivation is the state of being deprived of something. In addition, Merriam-Webster has one of its definitions of freedom as the liberation from slavery or restraint or from the power of another.

According to Meiners (2011), the United States of America has the unfortunate distinction of having the most incarcerated individuals than any other nation. A Pilot Test Of A Mobile App For Drug Court Participants, Kimberly Johnson, Stephanie Richards, Ming-Yuan Chih, Tae Joon Moon, Hilary Curtis, David H. Gustafson

Health and Clinical Sciences Faculty Publications

The U.S. criminal justice system refers more people to substance abuse treatment than any other system. Low treatment completion rates and high relapse rates among addicted offenders highlight the need for better substance use disorder treatment and recovery tools. Mobile health applications (apps) may fill that need by providing continuous support. In this pilot test, 30 participants in a Massachusetts drug court program used A-CHESS, a mobile app for recovery support and relapse prevention, over a four-month period. Over the course of the study period, participants opened A-CHESS on average of 62% of the days that they had the app. …
