Evolving Standards Of Reasonableness: The Aba Standards And The Right To Counsel In Plea Negotiations, Margaret Colgate Love
Evolving Standards Of Reasonableness: The Aba Standards And The Right To Counsel In Plea Negotiations, Margaret Colgate Love
Fordham Urban Law Journal
The ABA Criminal Justice Standards have been recognized by the Supreme Court as one of the most important sources for determining lawyer competence in right to counsel cases. Because the constitutional test under the Sixth Amendment is whether defense counsel’s performance was “reasonable” under “prevailing professional norms,” the standard of competence is necessarily an evolving one. The Supreme Court's decision in Padilla v. Kentucky underscores the defense bar’s stake in participating in the ABA standard-setting process to guide the development of defense counsel's obligations in plea negotiations. In addition, to the extent the courts give the ABA Standards credence in …

There is, newfound interest in obtaining accurate information about police use of force in this country. This means, among other things, that we need reliable statistics about police violence. We cannot address the problem of unlawful police violence unless we possess adequate statistical information about all police violence, lawful as well as unlawful.
This article explores the violence of police tasering and the statistics of this practice.
Honest Abe Or Doc Holliday? Bluffing In Bargaining, Gregory Deangelo, Bryan C. Mccannon
Honest Abe Or Doc Holliday? Bluffing In Bargaining, Gregory Deangelo, Bryan C. Mccannon
Economics Faculty Working Papers Series
We consider a bargaining environment where there is asymmetric information regarding whether the two players have common preferences or conflicting preferences. If the cost of strategic communication is independent of the state, then signaling is not expected to be effective. If the uninformed agent believes, though, a (cheap‐talk) signal has been sent, then the informed agents are incentivized to engage in deceptive bluffing. Alternatively, if bluffing is not too prevalent, honest communication can be worthwhile. We explore this theoretically and experimentally. We present a bargaining model where state‐dependent mixed strategies arise as equilibria. Thus, bluffing occurs in equilibrium. In the …

Charging The Poor: Criminal Justice Debt & Modern-Day Debtors' Prisons, Neil L. Sobol
Charging The Poor: Criminal Justice Debt & Modern-Day Debtors' Prisons, Neil L. Sobol
Faculty Scholarship
Debtors’ prisons should no longer exist. While imprisonment for debt was common in colonial times in the United States, subsequent constitutional provisions, legislation, and court rulings all called for the abolition of incarcerating individuals to collect debt. Despite these prohibitions, individuals who are unable to pay debts are now regularly incarcerated, and the vast majority of them are indigent. In 2015, at least ten lawsuits were filed against municipalities for incarcerating individuals in modern-day debtors’ prisons. Criminal justice debt is the primary source for this imprisonment.
Criminal justice debt includes fines, restitution charges, court costs, and fees. Monetary charges exist …

Publications and Research
Reclaiming Futures is an organizational change initiative that supports coordinated and individualized responses for justice-involved youth with problematic substance use issues. The Research and Evaluation Center at John Jay College of Criminal Justice compared people's perceptions currently working in Reclaiming Futures communities with similar colleagues from nearly ten years ago. The study suggested that communities with the strongest engagement in Reclaiming Futures tended to have more positive perceptions of their youth justice and substance abuse treatment systems, including key facets of administration, collaboration, and overall system quality.

Welch V. United States: Brief Of Scholars Of Federal Courts And Sentencing As Amici Curiae In Support Of Petitioner, Eve Brensike Primus
Appellate Briefs
Amici are scholars of federal courts, sentencing, and criminal law. They have a shared interest in the application of retroactivity principles to decisions regarding criminal sentencing and believe that the intellectual history of retroactivity doctrine is helpful to answering the question in this case.
If Teague's retroactivity bar applies to collateral challenges to federal sentences, then the rule announced in Johnson applies retroactively under Teague (either because it qualifies as an "exception" to Teague's retroactivity bar, or because it was not subject to the bar in the first place). If Teague's bar against retroactive application of new constitutional rules does …

The Impact Of Length Of Stay On Adjudicated Male Youths;' Language Use: Focusing On Linguistic Analysis Of Verbal Samples, Yousun Shin Ph.D., Terry P. Overton Ph.D., Ed.D., Zelica Espinoza M.Ed.
Journal of Human Services: Training, Research, and Practice
The primary purpose of the study was to examine the impact of the length of juvenile offenders’ stay in a residential facility on attitudinal changes, measured by language use of 22 participants’ interviews analyzed by using a computerized text tool called Linguistic Inquiry and Word Count (LIWC) to obtain a measure of language use. A series of one-way ANOVA (SPSS 18.0 version) were used to examine the differences between the groups identified by the length of stay and interview interval. The results indicate that the length of stay significantly impacts language use regarding the language categories of affective process words …
