Collateral Impact Of Maternal Incarceration: Burdens Placed On Child Caregivers, Daniel Anderson Mar 2016

Collateral Impact Of Maternal Incarceration: Burdens Placed On Child Caregivers, Daniel Anderson

Theses and Dissertations

Although parental incarceration is both a maternal and paternal issue, it is particularly detrimental to the family when the mother is incarcerated. The number of children with a mother in prison has more than doubled since 1991 (Glaze & Maruschak, 2008). Although there are more children of incarcerated fathers than mothers, it is particularly important to note that sixty-four percent of mothers were the primary caregivers to their children at their time of arrest (Glaze & Maruschak, 2008; Mumola, 2000). The incarceration of a mother is often more detrimental than that of the father as it typically results in displacement …

Beyond Recidivism: Learning With Formerly Incarcerated Men About Youth Incarceration, Scott Patrick Bastian Mar 2016

Beyond Recidivism: Learning With Formerly Incarcerated Men About Youth Incarceration, Scott Patrick Bastian

LMU Theses and Dissertations

Too often, the truth behind a phenomenon is not sought through the perspectives of the people who lived that phenomenon—“the masters of inquiry” into their own realities, as Paulo Freire (1982, p. 29) has explained. Voice is the most powerful, reliable medium for collecting data based on lived experiences, if we are to gain genuine insight into the phenomenon (Freire, 1982). Focusing on the lived experiences of four formerly incarcerated young men of color, this study gave each participant the space to not only recall specific events and times, but to critically reflect on their lives—becoming more critically aware of …

Dreams Deferred: A Critical Narrative Analysis Of African American Males In Pursuit Of Higher Education, Martinique Starnes Mar 2016

Dreams Deferred: A Critical Narrative Analysis Of African American Males In Pursuit Of Higher Education, Martinique Starnes

LMU Theses and Dissertations

Many studies have been conducted on the achievement gap between Caucasian and minority students (Bankston & Caldas, 1998; A. Brown & Donnor, 2011; Howard, 2008; O’Conner, Lewis, & Mueller, 2007; Osborne, 1999), as this gap has been a persistent problem for decades. However, despite more students of color gaining access to institutions of higher education, there is still a severe gap in college graduation rates (National Center for Education Statistics [NCES], 2011), with African American males being the least likely group to be found on college campuses (Dunn, 2012), and thus, possessing the lowest college graduation rate. St. Peter Claver …

Defining Defiance: African-American Middle School Students’ Perspective On The Impact Of Teachers’ Disciplinary Referrals, Patricia Ray Mar 2016

Defining Defiance: African-American Middle School Students’ Perspective On The Impact Of Teachers’ Disciplinary Referrals, Patricia Ray

LMU Theses and Dissertations

The purpose of this study is to understand how African-American males enrolled in middle school in Los Angeles County experienced and understood the application of the California educational code regarding discipline. Disproportionate numbers of African-American students are being suspended and expelled from public schools. This overreliance on exclusionary punishment has led to the School-to-Prison Pipeline, and the statistics related to suspension rates from school mirror that of the criminal justice system. This study captures the voices of students who are consistently referred to the office by classroom teachers in order to understand how they perceive and articulate their experiences with …

The Role Of Official Misconduct In Wrongful Convictions, Mia Gilliam Mar 2016

The Role Of Official Misconduct In Wrongful Convictions, Mia Gilliam

Theses and Dissertations

As the number of wrongful convictions and exonerations of individuals imprisoned for crimes they did not commit has increased dramatically, the study of wrongful conviction has become increasingly important. The majority of past research has focused on the various causes of wrongful convictions. However, very little attention is given in detail to the specific nature of each of these causes. This thesis examined the most current, inclusive database of exonerations in the United States that exists, the National Registry of Exonerations. Qualitative and Quantitative data was examined and refined, and statistical analyses were run including descriptives, frequencies, and correlations in …

A Fair Trial: When The Constitution Requires Attorneys To Investigate Their Clients' Brains, Ellen G. Koenig Mar 2016

A Fair Trial: When The Constitution Requires Attorneys To Investigate Their Clients' Brains, Ellen G. Koenig

Fordham Urban Law Journal

The U.S. Constitution guarantees every criminal defendant the right to a fair trial. This fundamental right includes the right to a defense counsel who provides effective assistance. To be effective, attorneys must sometimes develop specific types of evidence in crafting the best defense. In recent years, the U.S. Supreme Court has found that defense attorneys did not provide effective assistance when they failed to consider neuroscience. But when must defense attorneys develop neuroscience in order to provide effective assistance? This question is difficult because the standard for determining effective assistance is still evolving. There are two leading approaches. First, in …

Aggregation And Urban Misdemeanors, Alexandra Natapoff Mar 2016

Aggregation And Urban Misdemeanors, Alexandra Natapoff

Fordham Urban Law Journal

The urban misdemeanor process relies on a wide variety of informal groupings and aggregations. Order maintenance police arrest large numbers of people based on neighborhood, age, race, and other generalizations. Prosecutors and public defenders resolve entire classes of minor plea bargains based on standard local practices and pricing. Urban courts process hundreds of cases en masse. At each stage, the pressure to aggregate—to treat people and cases by group—weakens and sometimes eliminates individuated scrutiny of defendants and the evidence in their cases; people are largely evaluated, convicted, and punished by category and based on institutional habit. This wholesale process of …

Crime, Surveillance, And Communities, Bennett Capers Mar 2016

Crime, Surveillance, And Communities, Bennett Capers

Fordham Urban Law Journal

We have become a surveillance state. Cameras—both those controlled by the state, and those installed by private entities—watch our every move, at least in public. For the most part, courts have deemed this public surveillance to be beyond the purview of the Fourth Amendment, meaning that it goes largely unregulated—a cause for alarm for many civil libertarians. This Article challenges these views and suggests that we must listen to communities in thinking about cameras and other surveillance technologies. For many communities, public surveillance not only has the benefit of deterring crime and aiding in the apprehension of criminals. It can …
