A Proposal To Allow The Presentation Of Mitigation In Juvenile Court So That Juvenile Charges May Be Expunged In Appropriate Cases, Katherine I. Puzone
A Proposal To Allow The Presentation Of Mitigation In Juvenile Court So That Juvenile Charges May Be Expunged In Appropriate Cases, Katherine I. Puzone
Pace Law Review
Many people believe that juvenile adjudications of delinquency are automatically expunged upon the youth reaching the age of majority. In reality, a juvenile adjudication of delinquency—especially for a felony—can significantly limit a teenager’s future ability to obtain student loans and scholarships, join the military, participate in athletics, become a firefighter or a law enforcement officer or obtain one of many jobs. As discussed herein, the majority of youth facing charges in delinquency court are suffering from severe socio-economic deprivation, are victims of emotional, physical or sexual abuse, or have serious mental health issues. Many youth caught up in the delinquency …
Circuit Splits And Empiricism In The Supreme Court, Karen M. Gebbia
Circuit Splits And Empiricism In The Supreme Court, Karen M. Gebbia
Pace Law Review
This Article demonstrates, empirically rather than merely in theory, how a failure to do so leads to unreliable conclusions concerning the relationship between the Supreme Court and the circuit courts of appeal. Specifically, commentators routinely misapply facially accurate raw data regarding the rate at which the Court reverses circuit court decisions to support unreliable conclusions regarding the comparative degree of accord between the Court and individual circuits. Commentators and the popular press then employ these unreliable conclusions to draw unsupported inferences regarding the reasons for supposed discord between the Court and the circuits, and to urge fundamental institutional reforms ranging …

An Intersectional Approach To Race/Ethnicity, Sex, And Age Disparity In Federal Sentencing Outcomes: An Examination Of Policy Across Time Periods, Jeffrey Nowacki
Articles
Approaches to intersectionality stress the importance of recognizing multiple, intersecting inequalities. As such, recent sentencing research has examined the changing role of extra-legal characteristics on United States federal sentencing outcomes in the aftermath of recent policy changes (e.g., United States v. Booker), but scholarship has less often examined these characteristics at the intersections of race/ethnicity, gender, and, especially age. This article uses an intersectional approach to examine the influence of these characteristics net of legally-relevant characteristics. Using ordinary-least squares regression procedures, the author examines the role of the joint effects of extra-legal variables on sentence length decisions across four distinct …

On most job applications, there are any one or more questions that could trigger further inquiry into an applicant’s background “Have you ever been convicted of a felony?”; “Have you ever been arrested?”; “Have you ever pled no contest to any criminal or civil offense?”. A great majority of U.S. citizens are profoundly affected by these questions as one in four U.S. citizens currently have a criminal record (D'Alessio, Flexon, & Stolzenberg, 2014). D’Alessio, Flexon, and Stolzenberg (2014) indicated in their research that 92% of employers conduct background checks on prospective employees which based on the amount of U.S. citizens …

Purpose of this work, from Erin Bock, Sherwood Foundation: Our community has come a long way over the last year in strategically partnering to reform the Juvenile Justice system in Douglas County. The strengthened relationships across the system are now enabling us to ask more assertive questions and gather catalytic evidence towards change. We are also in a position to foster mutual accountability for that change. It’s up to all of us! In that light, the OYS/JDAI Data Committee has commissioned an evaluation of the Alternatives to Detention (ATD) in Douglas County and will partner with Dr. Ryan Spohn in …

Terrorism Versus The Right To Privacy: Apple Takes On The Doj, Anastasia Dolph
Cardozo Arts & Entertainment Law Journal (AELJ) Blog
The long-simmering struggle between two essential American interests came to a dramatic head this week when Apple indicated its intent to appeal a court order directing the company to unlock an iPhone used by Syed Rizwan Farook, one of the San Bernardino terrorists. The case brought to light the enduring and intense battle between privacy rights and national security. For over a decade, Americans have grappled with how to prevent acts of terrorism on American soil without contravening our highly valued right to privacy.

St. Thomas More And His Utopia In Antebellum American Lawyer's Thought, Michael H. Hoeflich
UTOPIA500
The fifth UTOPIA500 presentation was April 7, 2016 about St. Thomas More and his Utopia in Antebellum American Lawyers' Thought. A former dean at Kansas Law and a renowned historian of colonial and pre-Civil War America, Professor Michael H. Hoeflich is also a fellow of the Royal Historical Society. He explored the publication history of More's UTOPIA, and the extent to which editions of the book were available in antebellum America. Professor Hoeflich noted that the novel, as a work of "politics," was well known by the likes of Jefferson, Madison, and John Adams, but its influence thereafter ebbed and …

Disrupt, Deny, Dismantle: A Special Operations Forces (Sof) Model For Combatting New Terrorism, Will Gunzelman
Faculty Publications and Presentations
Terrorism in the new millennium has morphed drastically since the 1970s. The terrorist organizations of today are a hybrid between the insurgent group models of the 1960s and modern terrorist organizations such as Al Qaeda. This hybrid model has created what has become a transnational insurgency recruited, trained, and led by major terrorist networks such as the Islamic State of Iraq and the Levant (ISIL). Even smaller regional groups such as Boko Haram have surpassed merely conducting terrorist attacks. These smaller groups are also focused on controlling territory. Tan (2008) refers to this change as “New Terrorism”. To combat New …
