Rape And Sexual Violence: Questionable Inevitability And Moral Responsibility In Armed Conflict, Katherine W. Bogen
Rape And Sexual Violence: Questionable Inevitability And Moral Responsibility In Armed Conflict, Katherine W. Bogen
Scholarly Undergraduate Research Journal at Clark (SURJ)
Wartime sexual violence is a critical human rights issue that usurps the autonomy of its victims as well as their physical and psychological safety. It occurs in both ethnic and non-ethnic wars, across geographic regions, against both men and women, and regardless of the “official” position of commanders, states, and armed groups on the use of rape as tactic of war. This problem is current, pervasive, and global in spite of the status of wartime sexual violence perpetration as a crime against humanity and the capacity of the international criminal court to indict offenders. Though some scholars have argued that …
Pulling The Trigger: Dehumanization Of African Americans And Police Violence, Themal I. Ellawala
Pulling The Trigger: Dehumanization Of African Americans And Police Violence, Themal I. Ellawala
Scholarly Undergraduate Research Journal at Clark (SURJ)
Police shootings and killing of African American targets has reached epidemic proportions and has captured the attention of the entire country. Research in social psychology has studied many dimensions of this layered issue, and has generated disparate findings regarding the role of racial bias in police violence. The process of implicit dehumanization of African Americans, especially youth, has been proposed as particularly salient in making shoot/don’t shoot decisions. This paper suggests that the paradigm of dehumanization could complete the understanding of racialized police violence and reconcile contradictory research findings, while highlighting areas for future research.

A Restorative Approach To Student Discipline: Examining A Small School's Changed Response To Student Behavior, Regina M. Hopkins
Doctoral Dissertations
This study examines how restorative practice takes shape in a single, racially diverse interdistrict school in the Northeast. It focuses on two fundamental questions: what does restorative practice look like at this school; and to whom is restorative practice applied at this school?
Using critical race theory as a contextual and analytical framework, I explore the relationship between P-12 public schools’ race neutral policies, system-wide racially disparate student discipline outcomes, and the efficacy of restorative practice as a more equitable, socially just student discipline model. My study investigates the effect of restorative practice on one school’s student discipline outcomes; and …
College Student Development And Emerging Adulthood, Gina Cavanaugh
College Student Development And Emerging Adulthood, Gina Cavanaugh
Honors Theses
College student development theories focus on the experiences and growth that individuals and groups encounter throughout their time attending colleges and universities. During this time, many traditionally aged college students are in the period of emerging adulthood. In industrialized societies, this age range is characterized by a prolonged period of adolescence and a lack of taking on adult responsibilities. This exploration highlights the emerging adult college student population in the United States and the development these individuals may undergo.

This study attempts to address the dearth of information about child sexual abuse (CSA) and psychological functioning in Korean children by measuring the psychological impact of sexual abuse on children in South Korea. The original data were collected on 92 sexually abused children (age 13 or younger) who underwent medical forensic interviews and psychological evaluations prior to treatment. This study collected additional data reflecting specific psychological evaluations from a control group drawn from five randomly chosen elementary schools. The psychological impact on the group of sexually abused children was compared to the control group via the assessment of four major …

Atlanta, like the rest of the U.S., is experiencing a dramatic increase in its older adult population; by 2030, one in five residents will be over the age of 60. Recognized as a leading county-based senior service agency in metropolitan Atlanta, Cobb County Senior Services provides an array of aging services including multipurpose centers, volunteer and advocacy opportunities, resource development, and innovative partnerships. Due to the many challenges presented by the growth of the older adult population, Cobb County Senior Services is currently embarking on the development of a strategic plan to best meet the changing needs of older adults …

The Jjie Virtual World Journalism Project: Experimenting With Virtual Worlds As An Emerging Journalism Platform, Claire M. Bohrer
Symposium of Student Scholars
Although immersive journalism in the virtual world was pioneered by journalist and documentary filmmaker Nonny de la Peña years ago, traditional journalists are just now discovering its potential as an alternative platform to report the news. This study explores the singularities of immersive journalism in virtual worlds using the "Marginalized Youth Voices Amplified on Virtual Worlds" project, which a journalism professor at a southern public university received a grant to develop. The grant came from an Online News Association Challenge Fund for Innovation in Journalism Education, and has been involved in efforts to produce 3D-scenario machinimas (action videos inside virtual …

Police Contracting In St. Louis County: Focusing Events And Changes In Image And Venue In Five Case Studies, Alan W. Karr
Police Contracting In St. Louis County: Focusing Events And Changes In Image And Venue In Five Case Studies, Alan W. Karr
Dissertations
St. Louis County, Missouri is a fragmented suburban area, covering 505 square miles, with ninety separate municipalities. Fifty-six municipalities maintain in-house police departments, while thirty-four contract police services from other governments. Previous research concerning interjurisdictional collaboration efforts has been rooted in the rational choice theory. However, the rational choice theory alone does not explain why some municipalities do or do not enter into contracts for police services. The purpose of this work is to examine police contracting decisions in St. Louis County, specifically the drivers behind contracting discussions and decisions in five sample municipalities in St. Louis County. The five …

This article published on April 25, 2016 at the Huffington Post examines the case of McKinley Phipps. He was sentenced to thirty years of hard labor for a crime that, to this day, he insists he did not commit. During the trial prosecutors used Phipps’s rap persona and lyrics - remixed for special effect - to carefully construct a story of Phipps’s guilt. The article discusses how Phipps lyrics and persona contributed to his conviction and the progress of his appeals.
Qualified Immunity For Officers’ Reasonable Reliance On Lawyers’ Advice, Edward C. Dawson
Qualified Immunity For Officers’ Reasonable Reliance On Lawyers’ Advice, Edward C. Dawson
Northwestern University Law Review
An officer is entitled to qualified immunity when a reasonable officer would not have known that her conduct violated clearly established law. Courts disagree over whether and how an officer’s receipt of legal advice before acting supports the qualified immunity defense by showing that, based on the advice, a reasonable officer would have thought that her conduct would not violate clearly established law. This Article argues that legal advice should support the qualified immunity defense. It argues that when an officer asserts reliance on legal advice as supporting qualified immunity, a court should consider whether in the circumstances the officer …

Toxic Confinement: Can The Eighth Amendment Protect Prisoners From Human-Made Environmental Health Hazards?, Brenna Helppie-Schmieder
Northwestern University Law Review
What would you do if you realized a nearby factory or energy operation was making everyone in your town sick? You might try to rally your neighbors in protest, take legal action, or cut your losses and move away. But what if your options were more limited? What if you were forced to stay? This is the situation for prisoners across the country who live in prisons located near dangerous energy industry operations.
The increased reliance on incarceration in recent times has resulted in prisons being built on undesirable land, often the same land occupied by the energy industry. This …
Not All Plea Breaches Are Equal: Examining Heredia’S Extension Of Implicit Breach Analysis, Kevin Arns
Not All Plea Breaches Are Equal: Examining Heredia’S Extension Of Implicit Breach Analysis, Kevin Arns
Northwestern University Law Review
When the government enters into a plea agreement with a criminal defendant that stipulates that the government will give a specific sentence recommendation in exchange for the defendant’s guilty plea, it can implicitly breach that agreement by clearly distancing itself from the recommendation at the sentencing hearing. In most circuits, the implicit breach of a non-court-binding plea agreement—an agreement where the defendant is bound to the guilty plea even if the court rejects the sentence recommendation—entitles defendants to a remedy. However, in 2014, the Ninth Circuit was the first circuit to hold that a defendant is entitled to a remedy …

A Place To Call Home: The Acceptance And Denial Of Burmese Refugees, Alexandra Craig
A Place To Call Home: The Acceptance And Denial Of Burmese Refugees, Alexandra Craig
Creative Activity and Research Day - CARD
For more than 25 years Burma has been experiencing a refugee crisis due to the military government’s excessive human rights violations. The argument for not accepting refugees often prioritizes the economic troubles that a country can face when taking care of refugees. Meanwhile, those who prioritize humanitarianism often appeal to human morals and argue that refugees should be accepted wherever they need to in order to be safe. This project ultimately focuses on whether Burmese refugees should be accepted into the surrounding countries or if countries should be able to deny refuge within their borders.
Proactive Or Predetermined?: Contextualizing Color-Blind Policing Practices In New York City, Rachel E. Lautenschlager
Proactive Or Predetermined?: Contextualizing Color-Blind Policing Practices In New York City, Rachel E. Lautenschlager
Open Access Theses
Since the widespread growth of proactive policing strategies across the United States during the 1990s, community members and scholars alike have critiqued these law enforcement techniques for their injurious effects on minority communities. Prior research has established that suspect and neighborhood characteristics influence police decision making and stop outcomes, with Blacks and Latinos faring worse than their White counterparts. What remains largely unknown, however, are the underlying mechanisms driving these disparities. This study approaches the problem by conducting a neighborhood-level analysis of the reasons that police officers provided for making 4.5 million stops over a period of twelve years as …
