Emerging Environmental Justice Issues In Nuclear Power And Radioactive Contamination, Dean Kyne, Bob Bolin Jul 2016

Emerging Environmental Justice Issues In Nuclear Power And Radioactive Contamination, Dean Kyne, Bob Bolin

Sociology Faculty Publications

Nuclear hazards, linked to both U.S. weapons programs and civilian nuclear power, pose substantial environment justice issues. Nuclear power plant (NPP) reactors produce low-level ionizing radiation, high level nuclear waste, and are subject to catastrophic contamination events. Justice concerns include plant locations and the large potentially exposed populations, as well as issues in siting, nuclear safety, and barriers to public participation. Other justice issues relate to extensive contamination in the U.S. nuclear weapons complex, and the mining and processing industries that have supported it. To approach the topic, first we discuss distributional justice issues of NPP sites in the U.S. …

Affirmative Action In Higher Ed Sustained With Caveats., Aldemaro Romero Jr. Jul 2016

Affirmative Action In Higher Ed Sustained With Caveats., Aldemaro Romero Jr.

Publications and Research

The term affirmative action was first used in an executive order by President John F. Kennedy in 1961. The motivation was to favor members of a disadvantaged group that historically suffered from discrimination due to oppression of any kind. This concept has been employed in many spheres and one of those has been to promote diversity in higher education on the basis that many universities have effectively discriminated against admitting and/or promoting minorities. Two weeks ago the U.S. Supreme Court announced a decision on affirmative action that originated in higher education. The 4-to-3 decision reaffirmed the University of Texas’s admission …

Masking Your Rights: Facemask Requirements Under Mandatory Influenza-Vaccination Policies Violate Privacy Rights Of Health Care Workers, Janet S. Kim Jul 2016

Masking Your Rights: Facemask Requirements Under Mandatory Influenza-Vaccination Policies Violate Privacy Rights Of Health Care Workers, Janet S. Kim

San Diego Law Review

Hospitals should abandon the facemask requirements in their mandatory influenza-vaccination programs because the facemasks can infringe on the privacy rights of health care workers, and hospitals can still achieve their vaccination goals through less restrictive practices. Part II introduces the recent rise of mandatory influenza-vaccination policies for health care workers, how hospitals exempt certain employees, and the consequences for those exempted. Part III discusses the legal implications of requiring exempted employees to wear facemasks and other identifying material under federal and state privacy law. Part IV recommends that health care employers abandon facemask requirements in their mandatory-vaccination programs in order …

Sealing And Destruction Of Criminal Records For The Factually Innocent: A “Second Chance” For California Penal Code Section 851.8, Irina Fox Jul 2016

Sealing And Destruction Of Criminal Records For The Factually Innocent: A “Second Chance” For California Penal Code Section 851.8, Irina Fox

San Diego Law Review

This Article provides a comprehensive review of section 851.8 and proposes amendments to fairly balance the societal interests in preserving criminal records with the interests of factually innocent individuals in clearing their names. Part I reviews California law governing criminal record retention and dissemination and outlines the contemporary society’s main policy considerations for preserving arrest records and for their expungement. Part II scrutinizes Penal Code section 851.8, offers a synopsis of the most significant California case law interpreting the statute, and outlines the procedure for filing a petition under the statute—including a discussion of the statutory standards for establishing factual …

Assessing Self-Authorship Among Athletic Training Students, Jeffrey G. Williams Jul 2016

Assessing Self-Authorship Among Athletic Training Students, Jeffrey G. Williams

Theses and Dissertations

The purpose of this study was to examine the nature and development of self-authorship among athletic training students. A cross-sectional, survey design was used and students enrolled in Commission on Accreditation of Athletic Training Education (CAATE) accredited professional athletic training degree programs were included as participants. Systematic sampling was used to recruit participants from the target population. Participants were recruited through batch email addresses of non-certified student members of the National Athletic Trainers’ Association (NATA) membership database.

The quantitative measure of self-authorship described by Creamer, Baxter Magolda, and Yue (2010), referred to as the Career Decision Making Survey-Self Authorship (CDMS-SA), …

Role Of A Military Restricted Area In Protection Of Fish And Invertebrate Communities At San Clemente Island, California, Michael Esgro Jul 2016

Role Of A Military Restricted Area In Protection Of Fish And Invertebrate Communities At San Clemente Island, California, Michael Esgro

SNS Master's Theses

"De facto" marine protected areas (DFMPAs) are regions of the ocean that are not formal marine protected areas (MPAs), but experience limited human impact nonetheless. Although DFMPAs are widespread globally, their potential contributions to marine conservation have not been well studied. In 2012 and 2013, we conducted remotely operated vehicle (ROV) surveys of deepwater (40—200 m) marine communities at a military DFMPA and a fished control site at San Clemente Island, the southernmost of the Channel Islands in the Southern California Bight. We used data extracted from ROV imagery to compare density and biomass of ecologically and economically important focal …

Black And Blue Bloods: Protecting Police Officer Families From Domestic Violence, Rafaqat Cheema Jul 2016

Black And Blue Bloods: Protecting Police Officer Families From Domestic Violence, Rafaqat Cheema

Hofstra Law Student Works

Officer-involved domestic violence (OIDV) is a national problem, with police officer families having higher rates of domestic violence than non–police officer families. OIDV is also an underresearched problem with few studies or proposed solutions. Many victims of OIDV do not report their abuse precisely because their abuser is a police officer, whom they fear is in a unique position to protect him/herself from any legal consequences. Often, OIDV complaints are not investigated properly in a nonbiased manner. While a handful of police agencies around the country have developed specific policies and procedures to deal with OIDV, Washington State has enacted …
