Federal Treaty And Trust Obligations, And Ocean Acidification, Robert T. Anderson
Federal Treaty And Trust Obligations, And Ocean Acidification, Robert T. Anderson
Washington Journal of Environmental Law & Policy
Ocean acidification will have profound effects on the entire human population and natural resources that depend in any way upon Earth’s oceans and lakes. In turn, those effects will be even greater, and potentially catastrophic, for indigenous populations who rely on the seas for physical, cultural, and spiritual sustenance. While most research on carbon dioxide absorption from the atmosphere has focused on oceans and the resulting acidification, many believe that acidification levels also will also increase in the Great Lakes. Indian tribes in the Pacific Northwest and the Great Lakes regions share reliance on marine and freshwater resources, and many …

State Constitutional Law As A Basis For Federal Constitutional Interpretation: The Lessons Of The Second Amendment, D. Bruce Black, Kara L. Kapp
State Constitutional Law As A Basis For Federal Constitutional Interpretation: The Lessons Of The Second Amendment, D. Bruce Black, Kara L. Kapp
New Mexico Law Review
This Article advocates that courts should rely more heavily on an underappreciated method of constitutional interpretation: reference to parallel state constitutional text and jurisprudence. This article is novel insofar as it develops a normative argument for why courts should consult state constitutions in interpreting the meaning of the federal constitution. To illustrate the value of this method for jurists who ascribe to various judicial philosophies, the authors apply this method to the U.S. Supreme Court’s newly developed Second Amendment jurisprudence. While District of Columbia v. Heller provides some guidance in interpreting the Second Amendment under the Court’s new framework, many …

Medical Exams Policy
Human Resources Policies
Some University positions require that an applicant satisfactorily complete a pre-employment medical exam to determine whether the employee is capable of performing the essential functions of the position as a condition of the employment offer. Physical and/or psychological examinations are given by the University's designated provider at no cost to the applicant. However, if the provider finds it necessary to perform procedures other than those required by a routine exam or to refer the applicant to an outside specialist, those additional expenses will be the responsibility of the applicant. UHSP complies with all laws and regulations regarding medical exams including. …
Abating Neighborhood Blight With Collaborative Policy Networks—Where Have We Been? Where Are We Going?, Kermit J. Lind
Abating Neighborhood Blight With Collaborative Policy Networks—Where Have We Been? Where Are We Going?, Kermit J. Lind
Law Faculty Articles and Essays
Blight is a term with multiple meanings and a complex legal and policy history in the United States. Currently, blight and its community costs are frequently associated with vacant and often foreclosed homes, defective and abandoned buildings, litter, vacant lots, and graffiti. As a legal and policy term, blight has roots in the common law definitions of public nuisance. Researchers and scholars in other disciplines have cited blighted neighborhoods as both a cause and symptom of larger socioeconomic problems such as poverty, crime, poor public health, educational deficits, and other personal or systemic distress.
This Article traces the seeds of …

The Original Fourth Amendment, Laura K. Donohue
The Original Fourth Amendment, Laura K. Donohue
University of Chicago Law Review
The meaning of the rights enshrined in the Constitution provides a critical baseline for understanding the limits of government action—perhaps nowhere more so than in regard to the Fourth Amendment. At the time it was adopted, the Fourth Amendment prohibited the government from entering into any home, warehouse, or place of business against the owner's wishes to search for or to seize persons, papers, or effects, absent a specific warrant. Consistent with English common law, the notable exception was when law enforcement or citizens were pursuing a known felon. Outside of such circumstances, search and seizure required government officials to …

The Influence Of Charismatic Authority On Operational Strategies And Attack Outcomes Of Terrorist Groups, David C. Hofmann
The Influence Of Charismatic Authority On Operational Strategies And Attack Outcomes Of Terrorist Groups, David C. Hofmann
Journal of Strategic Security
Despite the historical and contemporary prevalence of charismatic terrorist leaders, there has been very little empirical examination of the relationship between charismatic forms of authority and the strategic operation of terrorist groups. In response to this gap in knowledge, this study seeks to investigate if charismatic authority has a real-world impact on strategic choices and attack outcomes of terrorist groups. Using a theoretical framework meant to help measure charisma in terrorist organizations, this study quantitatively examines how differing levels of the presence of charismatic authority contributes to the choice in operational tactics (e.g., weapon and target choices) and the results …
Big Data And Intelligence: Applications, Human Capital, And Education, Michael Landon-Murray
Big Data And Intelligence: Applications, Human Capital, And Education, Michael Landon-Murray
Journal of Strategic Security
The potential for big data to contribute to the US intelligence mission goes beyond bulk collection, social media and counterterrorism. Applications will speak to a range of issues of major concern to intelligence agencies, from military operations to climate change to cyber security. There are challenges too: procurement lags, data stovepiping, separating signal from noise, sources and methods, a range of normative issues, and central to managing these challenges, human capital. These potential applications and challenges are discussed and a closer look at what data scientists do in the Intelligence Community (IC) is offered. Effectively filling the ranks of the …

Free‐Indirect‐Discourse Reboot: Beijing Queer Independent Cinema As A Mediating Environment, Victor Fan
Reconstruction: Studies in Contemporary Culture
In this essay, I first introduce the background of queer independent filmmaking in Beijing—in theory and practice—and its uneasy, if not outright antagonistic, relationship with a state authority that has compelled filmmakers, festival curators, and critics to rethink and reconstruct queer cinema, as what Weihong Bao would call a mediating environment. By mediating environment, I mean that contemporary Chinese queer cinema is best understood not only as a collection of films, but also an interactive and intersubjective sociopolitical and critical discourse among the audience, political activists, filmmakers, critics, and scholars through film and video, critical writing, on-site and online discussion, …

A Phenomenological Study Of Justice-Involved Veteran Experiences Of Veterans Court, Tanya Watson
A Phenomenological Study Of Justice-Involved Veteran Experiences Of Veterans Court, Tanya Watson
Dissertations
As of 2015, over 300 veterans treatment courts have opened across the nation in the United States, providing an alternative to incarceration to eligible justice-involved veterans. Despite the proliferation of veterans courts around the country, research on veteran experiences in veterans court is minimal at best. This study sought to examine veteran experiences in veterans treatment court through interpretive phenomenological analysis. Eight veterans from five western U.S. veterans treatment courts were interviewed regarding the circumstances of their referral to court, the treatment they received, their interactions with their treatment team, and how veteran identity impacted their receipt of treatment. Four …

Prosecuting Threats In The Age Of Social Media, Enrique A. Monagas, Carlos E. Monagas
Northern Illinois University Law Review
Social media has opened new avenues for perpetrators to threaten and intimidate. No longer does someone need to physically stalk their prey to deliver a message; they can now threaten anyone, anywhere with just one click of their cell phone. And because the threatening communications are often prepared in private and can be delivered anonymously, they are not regulated by social norms that would harshly condemn such behavior. Thus, it should come as little surprise that threats are increasing every year and online threats are fueling that growth. This Article considers the challenges facing prosecutors in charging and prosecuting online …

Chipotle shut down all of its restaurants nationwide in response to the ongoing food poisoning outbreaks. The deadly pathogen e. coli sickened people from the East coast to the West, and cost taxpayers hundreds of thousands of dollars. This Comment explores how these pathogenic outbreaks continue to happen, despite having federal agencies that are tasked with outbreak prevention. The increase of pathogenic outbreaks like e. coli and salmonella correlates to looser enforcement of federal regulations by executive agencies like the FDA and USDA. These agencies are often staffed by former lobbyists of the meat and poultry industries, and some who …

New Land Use And Water Policy Geographies In Emerging Cannabis Markets: The Case Of Pueblo County, Colorado, Jason Adam Kikel
Architecture and Planning ETDs
Voters and legislatures throughout the country are winding down the War on Drugs and legalizing marijuana for medical and retail use. While many regulatory decisions are made at state capitals nationwide, the marijuana landscape is largely shaped by local authorities exercising influence through land use planning. Over a decade after passing a voter-initiated medical marijuana program, Colorado voters approved a State Constitutional Amendment fully legalizing marijuana for adult use. The "Regulate Marijuana like Alcohol Act of 2012" made Colorado the first state to legalize the sale, taxation, and possession of marijuana through a commercial market. Local governments were given the …
