Disaggregating "Immigration Law", Mathew J. Lindsay
Florida Law Review
Courts and scholars have long noted the constitutional exceptionalism of the federal immigration power, decried the injustice it produces, and appealed for greater constitutional protection for noncitizens. This Article builds on this robust literature while focusing on a particularly critical conceptual and doctrinal obstacle to legal reform—the notion that laws governing the rights of noncitizens to enter and remain within the United States comprise a distinct body of “immigration laws” presumed to be part and parcel of foreign affairs and national security.
This Article argues that the U.S. Supreme Court’s recent immigration jurisprudence suggests a willingness to temper, and perhaps …
Content-Neutral And Content-Based Regulations Of Speech: A Distinction That Is No Longer Worth The Fuss, R. George Wright
Content-Neutral And Content-Based Regulations Of Speech: A Distinction That Is No Longer Worth The Fuss, R. George Wright
Florida Law Review
This Essay establishes that content-based restrictions on speech are no longer uniformly subjected to unequivocally more demanding judicial scrutiny than content-neutral restrictions by examining several recent jurisprudential trends and their effects. The five relevant trends are (1) the compounding complications and failed attempts in seeking to distinguish between content-neutral and content-based regulations of speech in the first place; (2) the crucial judicial option, distinctively available in content-neutral regulation cases, to insist on the realistic availability of ample valued alternative channels through which speakers can continue to convey their message; (3) in partial offset thereof, the rise of the judicial option, …

Safe, Free And Lgbt: Legal Issues Facing Lgbt West Virginian’S, Jennifer Meinig, Delegate Stephen Skinner, Jill Rice
ASA Annual Conference
It has been less than a year since the United States Supreme Court’s ruling in Obergefell v. Hodges ushered in marriage equality nationwide. However, this victory has not stopped continued efforts to discriminate against LGBT people throughout our region. Even with the freedom to marry secured many LGBT people may find themselves in situations where they can be married on Sunday, fired on Monday, and evicted on Tuesday. In this session we will be exploring the legal challenges facing LGBT West Virginians and LGBT people living in our region. The goal of this presentation is to give participants the language …

An Examination Of The Impact Of Drug Court Clients’ Perceptions Of Procedural Justice On Graduation Rates And Recidivism, Cassandra A. Atkin-Plunk, Gaylene Armstrong
An Examination Of The Impact Of Drug Court Clients’ Perceptions Of Procedural Justice On Graduation Rates And Recidivism, Cassandra A. Atkin-Plunk, Gaylene Armstrong
Criminology and Criminal Justice Faculty Publications
Over the years, researchers have found drug courts reduce recidivism for participants. Scholars have hypothesized that drug courts are effective at producing positive outcomes for participants due in part to a case management approach that implements concepts of procedural justice. Using a convenience sample of participants involved in one drug court, this study adds to the limited body of research on procedural justice and drug courts by examining whether variation in drug court clients’ perceptions of procedural justice is related to their likelihood of graduation from drug court and recidivism. Results, policy implications, and recommendations for future research are discussed.

Conclusion
By many different measures, rural Nebraskans are positive about their community. Many rural Nebraskans rate their community favorably on its social dimensions: as friendly, trusting and supportive. Most rural Nebraskans say it would be difficult to leave their community. And, most rural Nebraskans disagree that their community is powerless to control its future.
Across all years of this study, rural Nebraskans’ views about the change in their community have generally been positive. The proportion believing their community has changed for the better during the past year has usually been greater than the proportion believing it has changed for the …

Incognito: Nighttime In The Student Neighborhood, Eric F. Spina
President's Blog: From the Heart
What is the student neighborhood like on a Friday night? While it was hardly 21 Jump Street ? I wore jeans, a Pittsburgh Pirates T-shirt and a University of Dayton baseball cap ? I felt like a college student again as I climbed into officer Michael Sipes' unmarked car for a 10 p.m. to 2 a.m. patrol.
