Manipulative Emotional Behaviour And Delinquency: Sex Differences And Links To Emotional Intelligence., Alison M. Bacon, Lisa Regan Jan 2016

Manipulative Emotional Behaviour And Delinquency: Sex Differences And Links To Emotional Intelligence., Alison M. Bacon, Lisa Regan

School of Psychology

Trait emotional intelligence (EI) encompasses high levels of emotional understanding and is generally associated with positive outcomes. However research has suggested that high EI might predispose some young females to delinquency. The present study investigated whether this relationship can be accounted for by a tendency towards emotionally manipulative behaviours, facilitated by high EI. Two hundred and fifty two young adults (125 female) completed measures of EI, Machiavellianism, managing the emotions of others (MEOS) and self-reported delinquent behaviour. High EI females presented higher levels of delinquency, Machiavellian Tactics and morality, the supposedly prosocial MEOS behaviours enhancing and diverting and the non-prosocial …

By exploring the intertwined histories of the automobile, policing, criminal procedure, and the administrative state in the twentieth-century United States, this Essay argues that the growth of the police’s discretionary authority had its roots in the governance of an automotive society. To tell this history and the proliferation of procedural rights that developed as a solution to abuses of police discretion, this Essay examines the life and oeuvre of Charles Reich, an administrative-law expert in the 1960s who wrote about his own encounters with the police, particularly in his car. The Essay concludes that, in light of this regulatory history …

These individuals encounter unique challenges upon release, such as facing the difficult task of finding mental health services and other resources, housing, and health insurance. This study aimed to gather the perspectives of clinicians who worked for the Office of Mental Health in New York State regarding community reentry for inmates …

Smoke & Mirrors: Bankruptcy Relief Remains Elusive For Marijuana Businesses And Their Creditors, Todd Plummer Jan 2016

Smoke & Mirrors: Bankruptcy Relief Remains Elusive For Marijuana Businesses And Their Creditors, Todd Plummer

Bankruptcy Research Library

(Excerpt)

Today, twenty-three states and the District of Columbia allow marijuana for medical purposes, and four of those states and the District of Columbia have legalized the drug’s recreational use. Despite this tidal shift in state laws and public opinion, marijuana remains a Schedule I substance under the Controlled Substances Act (“CSA”), meaning the federal government does not recognize its use in medical treatment, classifies the drug as having a high potential for abuse, and that no prescriptions may be written for it. Moreover, the CSA specifically makes it illegal to “rent, lease, profit from or make available for use” …

Deserts Will Bloom: Atomic Agriculture And The Promise Of Radioactive Redemption, Chris Fite Jan 2016

Deserts Will Bloom: Atomic Agriculture And The Promise Of Radioactive Redemption, Chris Fite

Theses and Dissertations

This paper examines the rhetorical and visual strategies used in marketing atomic agriculture to the American public from the 1940s to the 1960s. The term “atomic agriculture” refers to various agricultural research programs that used radioactive materials, particularly radioisotope tracing and mutation breeding. In print and on screen, atomic boosters from government and industry offered the promise of a better world made possible by applying atomic energy to agriculture. I argue that the proponents of atomic agriculture combined futurism and nostalgia to create a techno-pastoral vision. They hearkened back to the nineteenth century while simultaneously imagining a bright postwar future. …

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan Jan 2016

Decriminalizing Violence: A Critique Of Restorative Justice And Proposal For Diversionary Mediation, M. Eve Hanan

All Faculty Scholarship

The movement to reduce over-prosecution and mass incarceration has focused almost exclusively on non-violent offenders despite data showing that over half of all prisoners incarcerated within the United States are sentenced for crimes of violence. As a consequence of the focus on nonviolent offenses, the majority of current and future defendants will not benefit from initiatives offering alternatives to criminal prosecution and incarceration.

A discussion of alternatives to the criminal justice system in cases of violent crime must begin by acknowledging that violent crime is not monolithic. Many incidents meet the statutory elements of a violent crime, that is, the …

The Right To Be Forgotten: Comparing U.S. And European Approaches, Samuel W. Royston

St. Mary's Law Journal

This Article compares the European and United States stances regarding the right to be forgotten. Within that context, this Article explores the implications of technological advances on constitutional rights, specifically the intersection of the right to free speech and the right to privacy, commonly referred to as the "right to be forgotten" paradox. In the United States, the trend is to favor free speech, while Europe places an emphasis on human rights. Each approach is analyzed based on supporting case law. The consequences of each approach on society, both long- and short-term, are also discussed. This Article argues that a …

Transforming The System, India Thusi, Robert L. Carter

Books & Book Chapters by Maurer Faculty

Our criminal justice system must keep all communities safe, foster prevention and rehabilitation, and ensure fair and equal justice. But in too many places, and in too many ways, our system is falling short of that mandate and with devastating consequences. The United States is saddled with an outdated, unfair, and bloated criminal justice system that drains resources and disrupts communities.

The U.S. prison population has swelled to unprecedented levels and unequal, unjustified treatment based on race and ethnicity is well documented. People of color, particularly Native American, African American, and Latino people, have felt the impact of discrimination within …

Local, State, And Federal Responses To Stalking: Are Anti-Stalking Laws Effective?, Tracey Carter

Statistics show that there are currently 7.5 million victims of stalking in the United States each year. The year 2014 commemorated the 20th Anniversary since passage of the federal Violence Against Women Act of 1994 (“VAWA”) that was signed by President Bill Clinton on September 13, 1994. Passage of this Act marked a key transformation in our nation’s response to the crimes of domestic violence, sexual assault, and stalking. The VAWA was established to promote “collaboration among law enforcement, health care providers, nonprofit service groups, community leaders, and the private sector” to combat these crimes. In fact, the VAWA was …

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley Jan 2016

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley

Cardozo Journal of Equal Rights & Social Justice

The United Kingdom's recently enacted anti-pornography laws, the Audiovisual Media Services Regulations 2014 and section 63 of the Criminal Justice and Immigration Act 2008, are inconsistent with the European Convention on Human Rights, United Kingdom case law, and United Kingdom public policy. The Audiovisual Media Services Regulations 2014, which bans the sale of a wide array of domestically produced pornography, and the Criminal Justice and Immigration Act 2008, which criminalizes the possession of "extreme pornography, " are among the most restrictive anti-pornography laws in the democratic world. These laws were passed in response to the rise of the Internet, which …

Transforming The “Thurmond Rule” In 2016, Carl W. Tobias Jan 2016

Transforming The “Thurmond Rule” In 2016, Carl W. Tobias

Law Faculty Publications

This piece first analyzes the Rule’s history. Part II explains the convention and its deleterious consequences. Finding that each party reinterprets the notion to stymie appointments—which perverts the selection process, deprives courts of judicial resources for delivering justice, and intensifies the “confirmation wars”—the final Part proffers solutions. Because the Rule has multiple detrimental effects, it warrants abolition.
