"This research explores immigration policies that have provided access to higher education to undocumented students through the lens of sociocultural identity theory and cultural identification theory. These theories are fundamental in understanding the construction of identity for undocumented students as a result of their interactions with policies and higher education institutions. Pertinent Washington State legislation includes House Bill 1079, which allows for undocumented students to pay in-state tuition, the Real Hope Act that provides financial aid for undocumented students. Federal policy includes the Executive Order Deferred Action for Childhood Arrivals, which allows undocumented students who meet certain requirements to apply …

This paper will examine the legal right to assemble in sub- Saharan Africa before turning to discuss historic and present protest movements. I will examine the tactics activists today employ in sub Saharan Africa, from flash mob protests to hunger strikes to mass mobilization as they continue to express their right to protest, often in very challenging environments. I will then detail the legal systems through which individuals can attempt to assert their right to assemble and how they have been utilized to this point. In May 2014, the Georgia General Assembly enacted legislation establishing the Alzheimer’s Disease Registry (“Registry”) in order to generate new data for research and policy planning. The Task Force bill followed similar federal legislation. This state action has not only drawn tremendous attention to the continued prevalence of Alzheimer’s disease among the population of Georgia but also raised a series of questions regarding the practicability, legality, and effectiveness of the Registry. The lessons learned in Georgia, as Registry implementation moves forward, will provide guidance for other states interested in collecting similar data. In Part I of this article we describe …

This article examines the adverse effects of federal case law and legislation on tribal courts and tribal courts’ ability to incorporate tribal customary law. Tribal customary law is the law given to tribes by holy deities which governs tribal ways of life. It is important to maintain tribal customary law because it strengthens tribal communities’ identities and cultural foundations. © 2016 IEEE. Mobile video surveillance applications are used widely nowadays. They offer real-time video monitoring for homes, offices, warehouses, airports, and so on with live and pre-recorded on-demand video streaming. Quality of service (QoS) remains a key challenge faced by most of these applications. In this article, we propose an architecture for mobile video surveillance applications with a guaranteed and differentiated QoS support. The architecture relies on the 3GPP 4G evolved packet core (EPC). The main components are the QoS enabler, media server, and machine-to-machine gateway and surveillance application. This essay undertakes a detailed frame analysis of print and electronic media coverage of three nationally publicized death penalty cases between the years of 2014 and 2015. Drawing specifically from the work of Kenneth Burke (1984), this research argues that tragically framed death penalty cases reify victim/perpetrator discourses and cause the actual act of execution to be a fitting resolution within a narrative. Burke’s (1984) grotesque-mystical frame and Bakhtin’s (1984) theory of the grotesque body are used to argue that the media’s portrayal of botched executions help highlight the incongruities with the system of capital punishment, and cause audiences to …

This article analyzes the international refugee law regime in order to analyze European Union policies towards asylum seekers in light of the Syrian refugee crisis. By comparing the 1951 Refugee Convention and regional legal instruments such as the European Convention on Human Rights policies such as the Dublin Regulation and border controls are analyzed to determine their legality. These policies on the surface appear to be violating basic principle of International Refugee Law such as non-refoulement, however on closer inspection have legal basis. In the last three plus decades, considerable attention has been given to certain common phases in the life cycle of gatherings, demonstrations, and riots in the United States. Much of the study focuses on theoretical origin and social psychology associated with each type of event. There is considerably less empirical work regarding police reaction to these events, particularly concerning celebratory behavior following a sporting event. Celebratory incidents are less organized than their protests counterpart. A variety of fans with collective zeal gather in a common location without leadership or mission. The context of the study was assessment of whether corrections officers in Appalachia are receiving adequate health and safety training who attended health and safety trainings sessions provided by the OSHA Training Institute and Education Center on the campus of Eastern Kentucky University. Participants included in the study were corrections officers who have been working in corrections for a minimum of two years. Participants were required to be working in Appalachian corrections during distribution of the questionnaire. Participants were selected by using convenience and snowball sampling procedures. This research is a descriptive study of the misuse of social media in law enforcement from 2011 to present. The research will use a content analysis of social media policies coupled with survey of 10 questions administered anonymously to students at the Department of Criminal Justice Training. Today’s tree wardens are continually called upon to strike a balance between preservation of public trees and protection of the public from hazardous tree conditions. The Commonwealth of Massachusetts has been a pioneer in tree protection legislation, including the enactment of the first state legislation requiring a municipal tree warden. As guardians of the municipal landscape, tree wardens decide whether and when to plant new public shade trees, or to permit those that already exist to be cut, trimmed, or removed. There is unequivocal evidence that the climate system is warming, caused mainly by the measurable increase in anthropogenic greenhouse gas emissions. When does a right to privacy become a right of censorship? Conversely when does freedom of speech become a carte blanche to violate the dignity and autonomy of others? Discussions of privacy throughout the world frequently boil down to these questions. Despite the parallel relationships between privacy and speech in the United Kingdom and America, and despite their shared legal heritage, the two legal systems have struck the balance in radically different ways. This article examines the utility of a new way of determining when increased punishment should be imposed pursuant to "three strikes" laws or other recidivist enhancements. In the past two years, Congress and the United States Sentencing Commission are each considering criminal justice reform measures that would use the length of time an offender spent incarcerated as a proxy for the seriousness of his earlier criminal conduct. While this reform seems sound at first glance, this article ultimately concludes that its incorporation into current state and federal sentencing laws must be done carefully, if at all, and that doing so …

Oregon Health and Science University is a microcosm of the 24-hour city, and it’s essential that patients, employees, students and others have safe and convenient 24-hour access to its medical campuses. Access to and from the main campus is always complicated, but even more so at night. The Night Access Plan lays out a strategy to make getting to and from OHSU at night and early in the morning safer, more convenient, and affordable.

Preventing Conflict Or Descending An Iron Curtain? Buffer-Zone Laws And Balancing Histories Of Disruption With Free Speech, Nate Nasrallah

This article proposes that courts and lawmakers look to two factors to help determine whether a given law is necessary. First, they should evaluate the extent of the law’s history of disruption. To do this, they should ask whether the history is pervasive, whether it is egregious, whether it calls for immediate action, and whether it is particular. Second, courts and lawmakers should examine the degree to which the disruption impedes upon the government’s interest. If logic dictates that the government cannot advance its interest so long as the prohibited conduct persists, then the government does not need to show …

Part I of this Article considers parallel developments in the law that contribute to what can be characterized as the emergence of nothing less than a Latina/o removal system. It first considers the Supreme Court’s implicit sanctioning of race-conscious law enforcement in the United States, with the centerpiece of this symposium, Whren v. United States, perhaps the most well-known example. Second, it summarizes the trend over the last twenty years toward greatly increased cooperation between state and local law enforcement agencies and federal immigration enforcement authorities. Part I gives background on AEDPA, points out what Section 2254(d)(1) does, explains why AEDPA’s standard of review is problematic, and introduces the Suspension Clause challenge. Part II describes the writ of habeas corpus at common law and observes that there are two versions of habeas’s history, a narrow version and a functionalist version. The functionalist approach is essential to a strong attack on AEDPA. Part III introduces the age-old debate over the writ’s constitutional scope. Whren v. United States clarified the Supreme Court’s support of the practice of pretextual stops—using minor traffic violations as a reason to stop a person in order to investigate suspicious activity. However, a tactic’s legality does not make it inherently ethical, just, or effective. The following essay considers the role of pretextual stops in relation to police departments’ relationship with minority communities, particularly black communities. I argue that pretextual stops are one part of a larger and deeply troubling mélange of legal fictions, intentional deception of the innocent, and perverse incentives that undermine the perceptions of legitimacy of law enforcement, …

The destructive public conflicts documented in this study caused dysfunction and harm to Massachusetts local governments and communities. The report documents how municipal officials are managing conflicts and the impact of current approaches to dealing with destructive public conflict. The oral health and hygiene of incarcerated populations, both in the United States and globally, is known to be poorer than that of the general population. This study examined the prevalence of dental caries and periodontal disease and the relationships between oral health status and the oral health knowledge, attitudes, and practices of jail inmates housed in a large metropolitan jail located in the midwestern United States. This cross-sectional study collected data from 100 inmates using a 21-item closed-ended questionnaire in addition to oral examinations conducted by the jail's dentist to determine the extent of dental caries and periodontal disease …

In 2007 South Carolina funded 15 regional coordinators to work with local law enforcement agencies and alcohol and drug commissions to create 16 community alcohol enforcement teams to improve enforcement of underage drinking laws. Previous researchers have suggested that collaborative leadership is needed for effective teams, yet little is known about the factors that serve as barriers to and facilitators of, collaborative leadership in alcohol enforcement teams. An increasing number of older adults must continue working, which requires that they maintain their competencies and work skills, including use of mobile technology (MT). However, little is known about older adult adoption of MT in relation to work. This study used Rogers's diffusion of innovation theory and Davis's technology acceptance model as a framework. Distraction while using mobile technology devices such as a cell phone or tablet computer is a common occurrence within the civilian population of the United States. Researchers have reported that corporations in the United States incur hundreds of billions of dollars of annual direct and indirect costs from workplace injuries. Employing a theoretical framework underpinned by the job characteristics theory, this correlational study examined the relationships between task identity, safety climate, and job satisfaction to assist transportation managers with information for improving workers' job satisfaction for increasing productivity and organizational performance. Three validated survey instruments (Safety Climate, Job Characteristics Inventory, and Job Satisfaction) and one demographic instrument were distributed to railroad workers in the eastern region of North Carolina (n = 80).
