The Ethics Of Visual Legal Rhetoric, Michael D. Murray
The Ethics Of Visual Legal Rhetoric, Michael D. Murray
Law Faculty Scholarly Articles
This article discusses both visual rhetoric and visual narrativity. Visual rhetoric is the use of graphics, photographs, and other depictions for communication, for construction of knowledge and understanding, and ultimately for persuasion in the truth and rightness of the communication. Narrativity, which is sometimes described as narrative reasoning or storytelling," is the modern movement to focus our legal writing on the tools that best communicate our clients' stories-their situation, conditions, and circumstances-along with the "story" of the development, growth, and meaning of the law itself that provides the context for the clients' legal situation. Communicating the story of the development …

The Moral Price Of The Profit Motive In Medicine, John Sobieski
The Moral Price Of The Profit Motive In Medicine, John Sobieski
Honors Theses
The profit motive in medicine, which is the desire to maximize pecuniary profit as a primary motivation in patient care, is unethical. Regardless of whether the functional body outputting a medical profit motive is a physician, a group of physicians, or a large hospital, proper medical care should not be undermined by a desire for monetary gain. To say that medical care should not concern itself with money (i.e. costs, budgets) would be foolish; rather, I am asserting that treating medicine like any other business is disrespectful to the core values that predicate patient care. Human health is too important …

Interprofessional Simulation In Accredited Paramedic Programs, Kim D. Mckenna, Elliot Carhart, Daniel Bercher, Andrew E. Spain, John Todaro, Joann Freel
Internet Journal of Allied Health Sciences and Practice
Introduction: Healthcare leaders advocate for interprofessional education as a means to promote collaborative practice, enhance interdisciplinary communication, and improve patient safety in the health professions. There is little evidence specific to interprofessional simulation in paramedic education. Methods: The National Association of EMS Educators (NAEMSE) surveyed paramedic programs that were accredited or in the process of becoming accredited. Program respondents were asked to characterize their resources and their use of those resources, and then were asked about their perceptions pertaining to simulation in their program. Chi-square analysis was used to compare characteristics of programs that participated in interdisciplinary simulation with those …

No Ground To Stand Upon?: Exploring The Legal, Gender, And Racial Implications Of Stand Your Ground Laws In Cases Of Intimate Partner Violence., Denise Crisafi
Electronic Theses and Dissertations
Within the past decade, the use of self-defense as defined under Stand Your Ground laws has been the subject of political and legal scrutiny. According to the American Bar Association (2015), twenty-three states have passed Stand Your Ground laws that eliminate the duty to retreat prior to using force in any place that an individual has the right to be. In addition, ten states allow individuals to use or threaten to use force in public or private spaces where they have a right to be under case law (not formal statute) but maintain stricter requirements for how self-defense must be …
The Influence Of Perceived Organizational Support, Perceived Coworker Support & Debriefing On Work-Related Compassion Satisfaction, Burnout, And Secondary Traumatic Stress In Florida Public Safety Personnel, Anastasia Miller
Electronic Theses and Dissertations
The purpose of this study was to examine the relationships between perceived organizational support, perceived coworker support, and debriefing on the one hand, and compassion satisfaction, burnout, and secondary traumatic stress on the other hand in Florida law enforcement, fire, emergency medical services, and dispatch public safety workers. In order to explore the relationships between these constructs, the research questions examined the relationships of the work environment of Florida public safety by administering surveys gauging perceived organizational support, perceived coworker support, psychological resilience, and debriefing activities that the personnel participate in. The Professional Quality of Life: Compassion Satisfaction and Compassion …

Criminalizing Terrorism In Canada: Investigating The Sentencing Outcomes Of Terrorist Offenders From 1963 To 2010, Joanna Amirault, Martin Bouchard, Graham Farrell, Martin A. Andresen
Journal of Criminal Law and Criminology
Despite having endured significant terrorist incidents over the past 50 years, terrorism-specific offenses were not criminalized in Canada until the implementation of the Anti-Terrorism Act (ATA) in 2001. One of the primary goals of this legislation was to provide law enforcement with the tools necessary to proactively prevent terrorist incidents; however, the effectiveness of these new legal measures in preventing terrorist incidents, and the potential for the increased punishment of offenders sanctioned under them, remains unclear. Using a sample of convicted terrorist offenders (n = 153) from the Officially Adjudicated Terrorists in Canada (OATC) dataset, the current study investigates …

Jag Strategic Plan, Anne M. Hobbs, Ryan E. Spohn
Reports
In 2015, the University of Nebraska at Omaha (UNO) began working in conjunction with Nebraska Commission on Law Enforcement and Criminal Justice (Nebraska Crime Commission or NCC) to create a 3-year strategic plan for the Edward Byrne Memorial Justice Assistance Grant (JAG) funding. The JAG Program, (42 U.S.C. § 3751(a)) is the primary provider of federal criminal justice funding to state and local jurisdictions, providing critical funding necessary to support a range of program areas. JAG funding is awarded annually and the applicant must show how funds will be used to improve or enhance the criminal justice system.

Operation Youth Success (Douglas County Collective Impact) Developmental Evaluation Report, Jennifer L. Miller, Ryan E. Spohn
Reports
In the summer of 2014, a subset of leaders and stakeholders in Douglas County initiated a collective impact project to reform the county’s juvenile justice system. Since the first meeting of that group, a number of additional stakeholders have been incorporated into this initiative, which is now known as “Operation Youth Success.” Operation Youth Success, or OYS, has been engaged since that time in an effort to create system change producing a more effective, efficient, and compassionate justice system that better serves the families and youth who are the users of this system. This report will review the activities and …

Multifactoral Free Speech, Alexander Tsesis
Multifactoral Free Speech, Alexander Tsesis
Faculty Publications & Other Works
This Article presents a multifactoral approach to free speech analysis. Difficult cases present a variety of challenges that require judges to weigh concerns for the protection of robust dialogue, especially about public issues, against concerns that sound in common law (such as reputation), statutory law (such as repose against harassment), and in constitutional law (such as copyright). Even when speech is implicated, the Court should aim to resolve other relevant individual and social issues arising from litigation. Focusing only on free speech categories is likely to discount substantial, and sometimes compelling, social concerns warranting reflection, analysis, and application. Examining the …

The Declaration Of Independence And Constitutional Interpretation, Alexander Tsesis
Faculty Publications & Other Works
This Article argues that the Reconstruction Amendments incorporated the human dignity values of the Declaration of Independence. The original Constitution contained clauses, which protected the institution of slavery, that were irreconcilable with the normative commitments the nation had undertaken at independence. The Thirteenth, Fourteenth, and Fifteenth Amendments set the country aright by formally incorporating the Declaration of Independence's principles for representative governance into the Constitution.
The Declaration of Independence provides valuable insights into matters of human dignity, privacy, and self-government. Its statements about human rights, equality, and popular sovereignty establish a foundational rule of interpretation. While the Supreme Court has …

Balancing Free Speech, Alexander Tsesis
Faculty Publications & Other Works
This article develops a theory for balancing free speech against other express and implied constitutional, statutory, and doctrinal values. It posits that free speech considerations should be connected to the underlying purpose of constitutional governance. When deciding difficult cases involving competing rights, judges should examine (1) whether unencumbered expression is likely to cause constitutional, statutory, or common law harms; (2) whether the restricted expression has been historically or traditionally protected; (3) whether a government policy designed to benefit the general welfare weighs in favor of the regulation; (4) the fit between the disputed speech regulation and the public end; and …

Nineteenth-century American religious movements challenged many aspects of American society. Although their challenges to mainstream America's vision of sex and marriage remain the best-known aspects of many of these groups, their challenges to traditional American economics are just as important. Eschewing individual ownership of property, many of these new Christian movements followed the New Testament model of a body of believers that held all property in common.
In the early twentieth century, these religious communal groups had to contend with something new: an income tax. Communalism did not fit into the individualistic economic system envisioned b-y the drafters of the …
