In Mapp v. Ohio, the U.S. Supreme Court extended the due process protections of the exclusionary rule to include all "constitutionally unreasonable searches" that were done without a basis of probable cause. In the seven years after Mapp, when homicide rates in the U.S. nearly doubled, riots broke out in at least forty-seven U.S. cities. During the same era, a heroin epidemic gripped the nation's urban centers, giving rise to street drug markets and associated violence and pressures on law enforcement to curb those markets. As violence increased, a turn in the nation's political culture questioned Mapp's restraints on …

Leveraging Resources And Relationships In Joint Corruption Investigations, Center For The Advancement Of Public Integrity
Center for the Advancement of Public Integrity (Inactive)
Prosecutors and investigators pursuing corruption cases need all the help they can get. Detecting and proving public integrity violations can require hours of work, specialized expertise, and sometimes expensive software or surveillance equipment. Collaboration across agency lines can be a force multiplier, bringing additional resources, expertise, and legal tools. Strong partnerships can also provide critical cover in politically sensitive cases, helping investigative agencies weather the storm and diffuse political risks.
This paper is intended to provide practical insights about the benefits and nuances of inter-agency cooperation on public integrity cases, as well as anticipated challenges. The paper ends with two …

Mexico City's Citizen Comptroller Program, Patricio Martinez Llompart
Center for the Advancement of Public Integrity (Inactive)
Since 1997, Mexico City has had an autonomous, elected government responsible for meeting the needs of nearly nine million metropolitan citizens. Controlling corruption has been a key public priority. In 2004, the city government passed the Citizen Participation Act (Ley de Participación Ciudadana), which established a landmark program to enlist citizen volunteers directly in the day-to-day work of procurement oversight.
These trained volunteers, called “citizen comptrollers,” act as ground-level watchdogs to observe and evaluate public contracting processes. The “bottom up” approach to municipal anti-corruption control pioneered by the Citizen Comptrollers program can serve as an innovative model for cities and …

Operation Youth Success: Developmental Evaluation Final Report, Jennifer Miller, Ryan E. Spohn
Reports
In the summer of 2014, a subset of leaders and stakeholders in Douglas County initiated a collective impact project to reform the county’s juvenile justice system. Since the first meeting of that group, a number of additional stakeholders have been incorporated into this initiative, which is now known as “Operation Youth Success.” Operation Youth Success, or OYS, has been engaged since that time in an effort to create system change producing a more effective, efficient, and compassionate justice system that better serves the families and youth who are the users of this system. This report will review the activities and …

Strengths And Challenges Of A Rural Ohio Public Health Department: Considerations For Effective Service Delivery And Emergency Preparedness, Cindy L. Harris Graessle
Master of Public Health Program Student Publications
The local public health department is the main entity in cities and counties established to ensure the safety, health, and well-being of its community members. In many cases, particularly in rural areas, the health department may be the community’s closest access to health care, providing not only clinical care, but preventive services as well. These rural health departments have additional challenges that may not be experienced in the larger, more populated metropolitan areas. These challenges include lack of resources and funding that impact daily operations, expanded registered sanitarian responsibilities, and emergency preparedness difficulties with resource allocation and communication. Despite these …

Fifty years after Miranda v. Arizona, significant numbers of innocent suspects are falsely confessing to crimes while subject to police custodial interrogation. Critics on the left and right have proposed reforms to Miranda, but few such proposals are appropriately targeted to the problem of false confessions. Using rigorous psychological evidence of the causes of false confessions, this Article analyzes the range of proposals and develops a realistic set of reforms — Miranda 2.0 — which is directed specifically at this foundational challenge to the justice system. Miranda 2.0 is long overdue; it should require: warning suspects how long they …

Sweeten The Deal: Transfer Of Federal Spectrum Through Overlay Licenses, Brent Skorup
Richmond Journal of Law & Technology
The explosion in consumer demand for wireless services that began in the 1990s caught policymakers off guard. Demand for wireless services has only accelerated, as new cellular wireless technologies-such as broadband Internet via 3G and 4G LTE-permit services such as web browsing, video streaming, the Internet of things, and gaming, necessitating a steady influx of spectrum as an input.

Honors College Theses
Southern Steam Prints, a steamroller printmaking festival for Georgia Southern University I directed and organized. The project helped create community involvement in printmaking as an art form, gained notoriety for the Betty Foy Sanders Department of Art and especially the Print, Paper, and Book Arts Program. The project taught valuable skill mastery in relief print techniques, commercialism, and leadership for the kinds of event that artists plan, jury, and participate in, in the professional world. The Southern Steam Prints festival took place on April 23, 2016. Artworks created at the event were exhibited at the Center of Art and Theater …
Charging On The Margin, Paul T. Crane

The American criminal justice system has experienced a significant expansion in the number and severity of penalties triggered by misdemeanor convictions. In particular, legislatures have increasingly attached severe collateral consequences to misdemeanor offenses- penalties such as requirements to register as a sex offender, prohibitions on owning or possessing a firearm, and deportation. Although there is a wealth of scholarship studying the effect this development has on defendants and their attorneys, little attention has been paid to the impact collateral consequences have on prosecutorial incentives. This Article starts to remedy that gap by exploring the influence that collateral consequences exert on …

#Sayhername Captured: Using Video To Challenge Law Enforcement Violence Against Women, Amber Baylor

Recorded encounters between women of color and police officers have been invaluable in bringing the reality of these interactions into the living rooms of otherwise unknowing Americans. The recordings are instrumental pieces of documentation and evidence, with the power to impact verdicts and galvanize the domestic struggle for human rights outside of the courtroom. They also are fraught with ethical issues that must be addressed by attorneys and activists hoping they effect change. Complexities such as implicit biases, editing and sourcing of videos, anonymity for those attacked and bystanders, and vicarious trauma on affected communities complicate use of violent police …
Chapter 11 Shapeshifters, Lindsey Simon
Chapter 11 Shapeshifters, Lindsey Simon

Logic and equity would seem to demand that when administrative agencies are creditors to a bankrupt debtor, they should have the same status as other creditors. But a creditor agency retains its regulatory authority over the debtor, permitting it to continue with agency business such as conducting enforcement proceedings and awarding licenses. As a result, though bankruptcy law and policy both strongly support equal distribution of the estate, administrative agencies have been able to circumvent these goals through the use of “shapeshifting” behaviors. This Article evaluates two dangerous shapeshifting scenarios:
(1) where the agency avoids the limitations of creditor status …

Neighborhoods By Assessment: An Analysis Of Non-Ad Valorem Financing In California, Mathew D. Mccubbins, Ellen C. Seljan

Non-ad valorem assessments on property are a fiscal innovation born from financial stress. Unable to raise property taxes due to limitations, many localities have turned to these charges as an alternative method to fund local services. In this paper, we seek to explain differential levels of non-ad valorem assessment financing through the analysis of property tax records of a large and diverse set of single family homes in California. We theorize that assessments, as opposed to other forms of taxation, will be used when residents hold anti-redistributive preferences. We show that assessment financing is most common in cities with high …

Recidivism And Time Served In Prison, Daniel P. Mears, Joshua C. Cochran, William D. Bales, Avinash S. Bhati
Journal of Criminal Law and Criminology
A justification for lengthier stays in prison stems from the belief that spending more time in prison reduces recidivism. Extant studies, however, have provided limited evidence for that belief and, indeed, suggest the effect of time served may be minimal. Few studies have employed rigorous methodological approaches, examined time spans of more than one to two years, or investigated the potential for the relationship between recidivism and time served to be curvilinear. Drawing on prior scholarship, this paper identifies three sets of hypotheses about the functional form of the time served and recidivism relationship. Using generalized propensity score analysis to …
Freedom Of Conscience In War Time: World War I And The Limits Of Civil Liberties, Laura M. Weinrib
Freedom Of Conscience In War Time: World War I And The Limits Of Civil Liberties, Laura M. Weinrib
Emory Law Journal
This Article examines the relationship between expressive freedom and freedom of conscience as the modern First Amendment took shape. It focuses on efforts by the American Union Against Militarism and National Civil Liberties Bureau¿the organizational precursors to the ACLU¿to secure exemptions from military service for conscientious objectors whose opposition to American involvement in the First World War stemmed from socialist or radical labor convictions rather than religious scruples. Although such men asserted secular, ethical objections to war, advocates strained to expand the First Amendment¿s Free Exercise Clause to encompass them. Concurrently, they sought to import a generalized theory of freedom …
