The Frame Game: An Examination Of How The Local Print Media Framed The Issue Of Pension And Health Care Costs In Detroit's Municipal Bankruptcy, Robin West Smith
Wayne State University Theses
Scholars suggest understanding media theory and media sociology are instrumental when discussing the question of media power. Most of the empirical work done in this area has centered on the “objective-functionalist paradigm” (McQuail, 1985). The purpose of this study is to explore how two urban local print media outlets framed a group of stakeholders, the pensioners, and the broken promise of the pension and healthcare benefits, during Detroit’s municipal bankruptcy. I conducted a content analysis of Detroit News and Detroit Free Press news articles for the period from August 2013 to July 2014, focusing primarily on thirty (30) key dates …
Completing Government Speech's Unfinished Business: Clipping Garcetti's Wings And Addressing Scholarship And Teaching, Edward J. Schoen
Completing Government Speech's Unfinished Business: Clipping Garcetti's Wings And Addressing Scholarship And Teaching, Edward J. Schoen
UC Law Constitutional Quarterly
This article examines two major developments stemming from the U.S. Supreme Court decision in Garcetti v. Ceballos, in which the Court ruled: Statements made by public employees pursuant to their official duties are not protected by the First Amendment. Furthermore, the Court disclaimed whether or not its ruling applied to scholarship of teaching. First, this decision has triggered an avalanche of circuit court decisions dismissing 42 U.S.C. § 1983 employment retaliation claims, because the courts usually determined the expression was derived from the government employee's actual duties. Second, the disclaimer has created inconsistency and doubt in assessing § 1983 public …
The American Bar Association's Criminal Justice Mental Health Standards: Revisions For The Twenty-First Century, Christopher Slobogin
The American Bar Association's Criminal Justice Mental Health Standards: Revisions For The Twenty-First Century, Christopher Slobogin
UC Law Constitutional Quarterly
The American Bar Association's revision of its Criminal Justice Mental Health Standards ("Standards"), promulgated in August 2016, tackles a wide range of issues concerning the involvement of people with mental disabilities in the criminal justice system. Consisting of over ninety black letter provisions, the Standards address diversion and specialized courts; the role of mental health professionals, the police, lawyers and correctional officials in cases involving people with mental disabilities; and the law and processes associated with competency, insanity, commitment, and capital and non-capital sentencing. This article describes the genesis of the Standards and explains their content, organized in terms of …

Students, Police, And The School-To-Prison Pipeline, Jason P. Nance
Students, Police, And The School-To-Prison Pipeline, Jason P. Nance
UF Law Faculty Publications
Since the terrible shootings at Sandy Hook Elementary School in Newtown, Connecticut, lawmakers and school officials continue to deliberate over new laws and policies to keep students safe, including putting more police officers in schools. Yet these decisionmakers have not given enough attention to the potential negative consequences that such laws and policies may have, such as creating a pathway from school to prison for many students. Traditionally, only educators, not law enforcement, handled certain lower-level offenses that students committed, such as fighting or making threats without using a weapon. Drawing on recent restricted data from the US Department of …

Civil Rights—From Negative Restriction To Affirmative Obligation: A Call For Massachusetts To Recognize A Right To Rehabilitation Beginning With Juvenile Offenders, Jennifer L. Weekley
Western New England Law Review
In Diatchenko v. District Attorney for Suffolk District, 1 N.E.3d 270 (Mass. 2013) the Massachusetts Supreme Judicial Court sparked significant juvenile sentencing reform in the state. Previously an outlier for its harsh treatment of juveniles, the Commonwealth now prohibits the imposition of life imprisonment without the possibility of parole for juvenile offenders. This crucial step forward in juvenile justice is dually rooted in neuroscience advancements and society’s ever-evolving standards of decency. The premise is simply that children are different. Children are categorically impulsive, more susceptible to negative environmental influences, and their malleable character is less persuasive evidence of irretrievable depravity …

Exploring Racial Differences In System Treatment And Criminal Justice Involvement : A Criminal Career Perspective, Jaeok Kim Kim
Legacy Theses & Dissertations (2009 - 2024)
The overrepresentation of racial minorities is one of the key issues of the contemporary U.S. criminal justice system, and has motivated many studies to explore the cause and extent of the resulting disparities in the system. My dissertation consists of three separate papers, which contribute to the understanding of such disparities through unique approaches. Additionally, using both self-reported and official administrative datasets, I identify the strengths and limitations inherent to each type of data source, and discuss ways to increase the accuracy of the estimates of interest.

Event Risk : Three Essays Exploring Nonprofit Organizations' Finances After The September 11 Attacks, Santiago Guerrero
Legacy Theses & Dissertations (2009 - 2024)
The three essays of this dissertation explore the experience of nonprofit organizations after the September 11 attacks to gain a better understanding of one specific type of risk nonprofit organizations face— “event risk” — which I broadly define as the risk of a negative impact on the operations of a nonprofit organization as a result of unexpected events. Essay One finds that overall nonprofit sector revenues were not reduced after the September 11 attacks and identifies characteristics of the revenue mix that make nonprofit organizations less susceptible to event risk. Essay Two identifies characteristics of nonprofit organizations’ financial conditions that …

Prisons And Power : Carceral Coloniality In Hybrid Post-Neoliberal Venezuela, Cory Fischer-Hoffman
Legacy Theses & Dissertations (2009 - 2024)
This dissertation examines contemporary Venezuela’s dual prison system--in which half of the prison population is incarcerated in internally controlled prisons run by armed inmates, and the other half are locked up in the Bolivarian Government’s restricted “New Regime” prisons. The Venezuelan state formation is conceptualized as ‘hybrid post-neoliberal,’ demonstrating how rationalities of a liberal rentier state and neoliberalism, combined with anti-neoliberal logics all act together in competing yet co-existing ways in the post-neoliberal era, which was initiated by the 1999 Bolivarian Revolution. The central question examines the “work” of the prison in the (re)production of power relations and how policies, …

Exploring The Association Between Perceived Safety Of Household Children In The Neigborhood And Levels Of Depressive Symptoms Among Spanish Speaking Latina Adults Living In A High Crime, Low Income Neigbhorhood, Randall Stetson
Legacy Theses & Dissertations (2009 - 2024)
Previous research has confirmed that neighborhood level social factors (e.g. crime, safety) present chronic stressors that increase risk for depression in residents of economically disadvantaged neighborhoods. U.S. Latinos experience higher levels of poverty and thus are more likely to live in poor neighborhoods. In this study it was hypothesized that adult Latina women who reported (1) higher levels of worry regarding the general safety of their household children in the neighborhood, (2) higher levels of worry regarding influence of bad friends on their household children, and (3) higher levels of worry regarding their household children being exposed to drugs and …

The Local American Voter: Mayoral Election Turnout In Midsized American Cities, Austin Aldag
The Local American Voter: Mayoral Election Turnout In Midsized American Cities, Austin Aldag
Honors Projects
While the determining factors leading to the dismally low levels of voter turnout in national and statewide elections have been well studied, nowhere is turnout lower than in local elections, a particular area that is significantly understudied. Of the limited literature on local and mayoral elections, few examine cities below 250,000 in population. Rather, many examine mega-city elections, which are comparable to congressional or statewide elections. Utilizing an original dataset of 356 midsized (50,000-250,000 in population) American cities from the Midwest, South, and Northeast, this study examines the drivers of mayoral election turnout: election day circumstances, stakes in the game …

To Loose The Bonds: The Deceptive Promise Of Freedom From Pretrial Immigration Detention, Denise L. Gilman
To Loose The Bonds: The Deceptive Promise Of Freedom From Pretrial Immigration Detention, Denise L. Gilman
Indiana Law Journal
Each year, the United States government detains more than 60,000 migrants who are eligible for release during immigration court proceedings that will determine their right to stay in the United States. Detention or release should be adjudicated through a custody determination process focused on the question of whether a mi-grant poses a flight risk or danger to the community. Yet, because the process skips the critical inquiry into the need for detention before setting monetary bond require-ments for release that are difficult to fulfill, freedom remains elusive.
The custody determination process is a cornerstone in the U.S. immigration de-tention edifice …

Barriers To Use Of Social Media By Emergency Managers, Linda Plotnick, Starr Roxanne Hiltz
Research, Publications & Creative Work
Social media (SM) are socio-technical systems that have the potential to provide real-time information during crises and thus to help protect lives and property. Yet, US emergency management (EM) agencies do not extensively use them. This mixed-methods study describes the ways SM is used by county-level US emergency managers, barriers to effective SM use, and recommendations to improve use. Exploratory interviews were conducted with US public sector emergency managers to elicit attitudes about SM. This was followed by a survey of over 200 US county level emergency managers. Results show that only about half of agencies use SM at all. …

State Of Mississippi Crisis Communications: Examining Mswin Preparedness, Michael Knox Graham
Electronic Theses and Dissertations
This research examines the Mississippi Wireless Information Network (MSWIN) and its level of preparedness to avert the communication problems for the State of Mississippi that were seen during Hurricane Katrina in 2005, in the event of a similar crisis. It explores the technical workings of the network and the makeup of the Mississippi Wireless Communication Commission (WCC) who oversees MSWIN. It also takes a look at similar networks in Louisiana and Arkansas to compare and contrast those to what is in Mississippi. Primary interviews with the WCC, State of Mississippi officials, and others on the Mississippi Gulf Coast paint a …
