Structural Cooperative Federalism, Kate Glover Jan 2016

Structural Cooperative Federalism, Kate Glover

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This article considers the status of cooperative federalism as a legal principle in Canadian constitutionalism. It argues that our understanding of cooperative federalism – often called the “modern form” of federalism in Canada – is enriched by looking to constitutional contexts beyond the division of powers. This article focuses on just one of those contexts, that is, it explores the lessons to be learned about cooperative federalism from the text and structure of Part V of the Constitution Act, 1982.

Faculty Articles

This article takes a snapshot of some of the most controversial topics in American society today and the juridical response to these topics by individual states, the United States Congress, and the United States Supreme Court. Although there are numerous legal topics that deserve mention and analysis, this article is limited to the discussion of nine fairly new rights created by state and federal laws. The rights discussed in this article include the following: 1) The right to open carry a firearm; 2) The right to consume marijuana; 3) The right to marry or to civil unions between same-sex couples; …

A Comprehensive Empirical Study Of Data Privacy, Trust, And Consumer Autonomy, Jay P. Kesan, Carol M. Hayes, Masooda N. Bashir

Indiana Law Journal

Modern society is driven by data. Data storage is practically unlimited with today’s technology, and analytical tools make it easy to find patterns and make predictions in a way that is very useful for private businesses and governments. These uses of digital data can raise considerable privacy issues that are of great concern to consumers. In this Article, we present and analyze the results of an extensive survey that we conducted to explore what people know, what people do, and what people want when it comes to privacy online.

Our survey is the first comprehensive examination of the intersection of …

What Iron Pipefittings Can Teach Us About Public And Private Power In The Market, Sandeep Vaheesan Jan 2016

What Iron Pipefittings Can Teach Us About Public And Private Power In The Market, Sandeep Vaheesan

Indiana Law Journal

Government restrictions on competition, whether in the market for cars, hotel rooms, or taxicabs, have attracted a great deal of attention of late. As a basic matter, government is not exogenous to the market: a functioning state is, in reality, a precondition for modern markets. Because it establishes the rules necessary for markets to develop and potentially flourish, government unavoidably shapes the bounds and structures of the private economic sphere. And more specifically, public limitations on competition are not intrinsically hostile to the interests of ordinary Americans and can, in fact, advance vital social goals, such as full employment and …

Disability Rights And Labor: Is This Conflict Really Necessary?, Samuel R. Bagenstos Jan 2016

Disability Rights And Labor: Is This Conflict Really Necessary?, Samuel R. Bagenstos

Indiana Law Journal

In this Essay, I hope to do two things: First, I try to put the current labor-disability controversy into that broader context. Second, and perhaps more important, I take a position on how disability rights advocates should approach both the current contro-versy and labor-disability tensions more broadly. As to the narrow dispute over wage-and-hour protections for personal-assistance workers, I argue both that those workers have a compelling normative claim to full FLSA protection—a claim that disability rights advocates should recognize—and that supporting the claim of those workers is pragmatically in the best interests of the disability rights movement. As to …

Living With Owning, Matt Ampleman, Douglas A. Kysar

Indiana Law Journal

In October, 2011, Terry Thompson committed suicide by gunshot after cutting open the cages of fifty-six exotic animals on his farm in Zanesville, Ohio. Fearing for pub-lic safety, law enforcement officers systematically hunted down the escaped animals in an episode that garnered international attention and prompted renewed discus-sion of the propriety of exotic animal ownership. This Article retells and discusses the circumstances surrounding Terry Thompson’s unhinging, applying frameworks of legal theory, chiefly in the realm of property law, to assess the fabric that held Thompson’s delicate system together and the tensions that led to its unravelling. As an autopsy, the …

Show Me The Money: How Registered Sex Offenders Affect Property Tax Revenue And What Governments Can Do To Recover The Losses, Justin Simmons Jan 2016

Show Me The Money: How Registered Sex Offenders Affect Property Tax Revenue And What Governments Can Do To Recover The Losses, Justin Simmons

Texas A&M Journal of Property Law

Many people have written scholarly articles highlighting the pros and cons of SORs. Some have taken the analysis a step further by pointing out the impact SORs have on the values of homes in the vicinity of a registered sex offender (“RSO”). While these studies have pointed out the impact the presence of an RSO can have on the property value for an individual homeowner, research regarding the impact RSOs have on property tax revenue for taxing districts is nonexistent. This Article highlights the correlation between the depressive effect the presence of RSOs has on property values, the impact this …

Why We Need Reed: Unmasking Pretext In Anti-Panhandling Legislation, Joseph Mead Jan 2016

Why We Need Reed: Unmasking Pretext In Anti-Panhandling Legislation, Joseph Mead

Law Faculty Articles and Essays

Over the past decade, there has been a dramatic increase in the number of areas where asking for help is restricted or banned. Whether called begging, panhandling, or solicitation, cities were spurred on by concerns of business owners and residents to ban or highly restrict this type of speech from occurring in public areas. Yet laws such as these have been repeatedly struck down by courts in recent months, fueled in large part by the Supreme Court’s decision in Reed v. City of Gilbert.

In this essay I argue that, at least in the context of anti-panhandling legislation, Reed …

The Unintended Consequence To Legalizing Marijuana Use: The Banking Conondrum, Florence Shu-Acquaye Jan 2016

The Unintended Consequence To Legalizing Marijuana Use: The Banking Conondrum, Florence Shu-Acquaye

Cleveland State Law Review

Marijuana is legal for either medicinal or recreational use in many states. However, the cultivation, use, possession, and sale of marijuana is illegal under federal law. Thus, a State that has legalized the use of marijuana is in direct conflict with federal law. This Article analyzes the problem legitimate marijuana businesses and financial institutions face regarding revenue from the cultivation and sale of marijuana. Specifically, this Article examines the risks a financial institution faces when in business with a legitimate marijuana business. Further, this Article recommends that Congress should act to create federal consistency in regulations concerning financial institutions that …

Use And Evaluation Of Lidar For Mapping Sinkholes In Royal Spring Groundwater Basin, Fidele Nsonguh Tibouo Jan 2016

Use And Evaluation Of Lidar For Mapping Sinkholes In Royal Spring Groundwater Basin, Fidele Nsonguh Tibouo

Theses and Dissertations--Earth and Environmental Sciences

This study utilizes a digital elevation model of the surface derived from high-resolution LiDAR (Light Detection and Ranging) and aerial-image technologies to map sinkholes in the Royal Spring groundwater basin. Shade-relief maps, with vertical exaggeration, were very helpful in the initial characterization of depressions. Then, aerial-photography sets were likewise helpful in identifying man-made structures such as retention basins, swimming pools, and parking lots, and to identify new sinkholes.

Field checking was necessary to further define depressions into two categories: 1.) potential sinkholes and 2.) probable sinkholes. This study had a lower success rate (50 percent) for identifying sinkholes via LiDAR …

The New American Debtors' Prisons, Christopher D. Hampson Jan 2016

The New American Debtors' Prisons, Christopher D. Hampson

UF Law Faculty Publications

State by state, Americans abolished imprisonment for debt in the first half of the nineteenth century. In forty-one states, the abolition of debtors' prisons eventually took the form of constitutional bans. But debtors' prisons are back, in the form of imprisonment for nonpayment of criminal fines, fees, and costs. While the new debtors' prisons are not historically or doctrinally continuous with the old, some aspects of them offend the same pragmatic and moral principles that compelled the abolition of the old debtors' prisons. Indeed, the same constitutional texts that abolished the old debtors' prisons constitute checks on the new today. …

United States Media Law Update, Lyrissa Barnett Lidsky, Rachael Jones Jan 2016

United States Media Law Update, Lyrissa Barnett Lidsky, Rachael Jones

UF Law Faculty Publications

In June 2015 the United States Supreme Court completed what was hailed as its most ‘liberal term of the ages’, issuing major decisions on controversial issues, such as same-sex marriage, affirmative action and the Affordable Care Act. The Court’s free press jurisprudence, however, remained largely unchanged after its last term. The Court did not decide any significant press cases. Instead, the Court sidestepped the opportunity to resolve important questions about the constitutional limits on the prosecution of threats made via social media in one notable case, and set a new, more speech-protective standard for determining when a law is content-based …

An Economic Assessment Of Household Unwanted Medicine Disposal Programs, Sofia Katherina Vielma Delano Jan 2016

An Economic Assessment Of Household Unwanted Medicine Disposal Programs, Sofia Katherina Vielma Delano

Open Access Theses

There has been increasing concern about the environmental impact of pharmaceutical accumulations in surface and groundwater over the last two decades due to their improper disposal. Improper storage of these pharmaceuticals at home also poses a public health concern given its association with drug abuse and accidental poisoning. Several states in the U.S., including those bordering the Great Lakes, have implemented medicine take-back programs to help mitigate problems associated with unused and unwanted pharmaceuticals kept in households. Although positive benefits for society and the environment have been reported for these programs, the perceived monetary value has not been estimated. This …

Ohio Is Jonesing For Automatic License Plate Readers: Why This May Violate Your Fourth Amendment Rights And What The Ohio Legislature Should Do About It, Michael E. Fisher Jan 2016

Ohio Is Jonesing For Automatic License Plate Readers: Why This May Violate Your Fourth Amendment Rights And What The Ohio Legislature Should Do About It, Michael E. Fisher

Cleveland State Law Review

The City of Cleveland currently owns and operates several automatic license plate recognition cameras. With a quick scan, these cameras can provide law enforcement with locational and other personal data about an individual. The Supreme Court in United States v. Jones successfully avoided the issue of whether there is a privacy right in locational data; thus this Note addresses the need for Ohio legislation to balance the interests of law enforcement in using license plate data to apprehend criminals with citizens' Fourth Amendment right to be free from unreasonable searches and seizures. It also examines legislation in effect in other …

Trust(Ee) And Abandonment Issues: A Proposal For New Action Regarding Abandonment Of Environmentally Contaminated Property, Michael P. Arwood Jan 2016

Trust(Ee) And Abandonment Issues: A Proposal For New Action Regarding Abandonment Of Environmentally Contaminated Property, Michael P. Arwood

Emory Bankruptcy Developments Journal

For a Chapter 7 trustee to abandon property under § 554 of the Bankruptcy Code, the property must be deemed burdensome or of inconsequential value to the estate. While environmentally contamination is burdensome because of the resources required to clean the property, there is currently no decisive rule or law to assist bankruptcy courts in determining when to allow trustee abandonment. This Comment explores the possibility of a trustee in bankruptcy asserting the innocent landowner defense under CERCLA as well as proposes three other solutions that may clarify this issue: (1) amending CERCLA or the Bankruptcy Code to provide a …

"Lord Forgive Me, But He Tried To Kill Me": Proposing Solutions To The United States’ Most Vexing Racial Challenges, André Douglas Pond Cummings Jan 2016

"Lord Forgive Me, But He Tried To Kill Me": Proposing Solutions To The United States’ Most Vexing Racial Challenges, André Douglas Pond Cummings

Law Faculty Scholarship

While great progress has been made in the United States in the past fifty years in connection with race relations, three critical issues continue to vex our nation. The United States, despite its progress, continues to struggle mightily with (a) the police killing of unarmed black men; (b) racially disproportionate mass incarceration; and (c) violent homicides of black men and boys. Nightly newscasts detail seemingly weekly killings of unarmed African American men by law enforcement officers. Mass incarceration, while plateauing in the last several years, continues to see millions of United States citizens incarcerated at rates unmatched by any other …

Adaptive Sensor Node Sleep Scheduling For Quality-Of-Experience Enhancement, Mini Mathew, Ning Weng Jan 2016

Adaptive Sensor Node Sleep Scheduling For Quality-Of-Experience Enhancement, Mini Mathew, Ning Weng

Articles

Focusing on a user’s quality-of-experience (QoE) has become important, because of the growing space of sensor-dependent applications and low-cost sensor design. QoE is typically affected by two quantities: the quality-of-information (QoI) received and the lifetime-of-service. Therefore, QoE is defined as a sensor network’s ability to consistently offer assured QoI for an expected lifetime when operating on a limited energy resource, such as a battery. However, dynamic factors, such as varying user requirements, unpredictable sensor environment, unreliable network conditions, and limited energy resource, affecting both QoI and lifetime-of-service, make it challenging to achieve a good QoE. In our previous work, we …
