Secret Jurisdiction, Irina D. Manta Jan 2016

Secret Jurisdiction, Irina D. Manta

Emory Law Journal

So-called ¿confidentiality creep¿ after the events of 9/11 has given rise to travel restrictions that lack constitutionality and do nothing to improve airline security. The Executive Branch¿s procedures for imposing such restrictions rely on several layers of secrecy: a secret standard for inclusion on the no-fly list, secret procedures for nominating individuals to the list, and secret evidence to support that decision. This combination results in an overall system we call ¿secret jurisdiction,¿ in which individuals wanting to challenge their inclusion on the list are unable to learn the specific evidence against them, the substantive standard for their inclusion on …

Keynote Remarks, Vanita Gupta Jan 2016

Keynote Remarks, Vanita Gupta

Michigan Journal of Race and Law

In communities across America today, from Ferguson, Missouri, to Flint, Michigan, too many people—especially young people and people of color—live trapped by the weight of poverty and injustice. They suffer the disparate impact of policies driven by, at best, benign neglect, and at worst, deliberate indifference. And they see how discrimination stacks the deck against them. So today, as we discuss the inequality that pervades our criminal justice system—a defining civil rights challenge of the 21st century—we must also acknowledge the broader inequalities we face in other segments of society. Because discrimination in so many areas—from the classroom, to the …

Police Impunity In Mexico: Creating Openings For Justice In A New Democracy, Emily Boyce Jan 2016

Police Impunity In Mexico: Creating Openings For Justice In A New Democracy, Emily Boyce

Honors Theses

In this project, I investigate why police impunity has persisted in Mexico, and why the application of justice, when it does occur, happens unequally. Mexico has undergone a democratic transition with a specific focus on increasing accountability in the judiciary. These persistent trends of police impunity and unequal application of justice are especially puzzling in the face of these recent shifts. Existing literature argues that the institutional changes that occur as a result of democratization should yield changes that further the individual rights of citizens. A majority of the scholarly work regarding police impunity and justice in Mexico focuses on …

The Historical Ecology Of Queensland’S Australian Saltwater Crocodile (Crocodylus Porosus), Emily M. Walker Jan 2016

The Historical Ecology Of Queensland’S Australian Saltwater Crocodile (Crocodylus Porosus), Emily M. Walker

Honors Theses

Human wildlife conflict is a critical aspect of many societies, as it often plays a large role in government decisions. The iconic saltwater Australian crocodile (Crocodylus porosus) is one example of a species that has become the subject of human-wildlife conflict in Queensland, Australia. Decades of intensive hunting in Queensland, beginning at the time of the Second World War, drastically depleted crocodile populations, leading to a federal embargo on crocodile exports in 1972 and their protection in Queensland in 1974. Since protection, populations appear to be recovering with increasing densities in the north and increased sightings along the …

Collective Corporate Knowledge, The Federal False Claims Act, And The Future Of Federal Health Programs, Sam F. Halabi Jan 2016

Collective Corporate Knowledge, The Federal False Claims Act, And The Future Of Federal Health Programs, Sam F. Halabi

Faculty Publications

While recent U.S. Supreme Court decisions have drawn focus to whether what corporations “say” is protected by the First Amendment or what they “believe” is protected by the federal Religious Freedom Restoration Act, the more relevant inquiry for a wide range of statutory and regulatory regimes is what corporations “know.” At the core of that question is what guides information relevant for legal compliance (including product safety, employee welfare, and material risks considered by investors) from its source to any given point in the firm, including decision-makers. This Article analyzes the federal False Claims Act as an underexploited resource in …

Inventing Legal Combat: Pro-Poor 'Struggles' In The Human Rights Jurisprudence Of The Nigerian Appellate Courts, 1999-2011, Obiora Chinedu Okafor, Basil E. Ugochukwu Jan 2016

Inventing Legal Combat: Pro-Poor 'Struggles' In The Human Rights Jurisprudence Of The Nigerian Appellate Courts, 1999-2011, Obiora Chinedu Okafor, Basil E. Ugochukwu

Osgoode Legal Studies Research Paper Series

This article deals with the question whether the jurisprudence of Nigeria’s appellate courts has helped advance or impede the struggles of the poor to assert their human rights in the country. The article begins by defining, delimiting, and situating the concepts “struggle” and “human rights as struggle.” It then moves on to identify and discuss the factors that make the struggles that the poor and the subaltern must wage to realize their human rights a tough one. Following this discussion, the article turns its attention to its main focus, i.e., an analytical examination of the ways in which the corpus …

Vilifying The Vigilante: A Narrowed Scope Of Citizen's Arrest, Ira P. Robbins Jan 2016

Vilifying The Vigilante: A Narrowed Scope Of Citizen's Arrest, Ira P. Robbins

Scholarly Articles in Law Reviews & Journals

Ira P. Robbins* The doctrine of citizen’s arrest in the United States has been ignored for far too long. In every jurisdiction in the United States, a private person may lawfully detain another and often may even use physical force to do so. Placing such power in the hands of ordinary, untrained individuals creates the possibility that citizens will misuse or abuse the privilege, sometimes with serious consequences for both the arrestor and the arrestee. This risk is compounded by the disparate treatment of the citizen’s arrest doctrine in different jurisdictions and the ambiguities inherent in many of the doctrine’s …

The Idea Model: Designing Earthquake Early Warning Messages Using Instructional Risk Communication, Nigel D. Haarstad Jan 2016

The Idea Model: Designing Earthquake Early Warning Messages Using Instructional Risk Communication, Nigel D. Haarstad

Theses and Dissertations--Communication

The goal of risk communication is to inform people about the risks they face and to encourage them to take appropriate action in response to that threat. To achieve this goal, risk communication scholars continuously examine the messages surrounding crises and disasters, and engage in message-testing to evaluate theory-driven message designs. Recent communication scholarship recommends that messages should including instructing information (Coombs, 2012), and should take into consideration established pedagogy based on instructional communication research (Sellnow & Sellnow, 2010). This dissertation continues to build on research which applies instructional communication scholarship to risk communication messaging. Using message-testing, this dissertation examined …

Access For Adolescents: Multisystemic Therapy In The Juvenile Justice System, Meagan Pilar

Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)

In this application for funding, DC YouthLink, a non-profit organization that connects adolescents in the juvenile justice system to community resources, proposes to implement an evidence-based mental health intervention into the juvenile justice system in Washington D.C. The Director of DC YouthLink will serve as the Principal Investigator for this pilot program; she, along with five trained staff members, will be responsible for implementing multisystemic therapy (MST), an intensive form of therapy designed specifically for at-risk youth and their families. We propose to intervene at three main stages of the juvenile justice system— intake, correctional placement/probation supervision, and reentry. The …
