State And Local Determinants Of Employment Outcomes Among Individuals With Disabilities, Purvi Sevak, John O'Neill, Andrew J. Houtenville, Debra L. Brucker
State And Local Determinants Of Employment Outcomes Among Individuals With Disabilities, Purvi Sevak, John O'Neill, Andrew J. Houtenville, Debra L. Brucker
Institute on Disability
In the United States, employment rates among individuals with disabilities are persistently low but vary substantially. In this study, we examine the relationship between employment outcomes and features of the state and county physical, economic, and policy environment among a national sample of individuals with disabilities. To do so, we merge a set of state- and countylevel environmental variables with data from the 2009–2011 American Community Survey accessed in a U.S. Census Research Data Center. We estimate regression models of employment, work hours, and earnings as a function of health conditions, personal characteristics, and these environmental features. We find that …

Student Scholarship
This Article discusses the cemetery access easement and access agreements under the lens of an emerging modern theoretical approach—the Social Morality Theory of Property Law. Part II reviews the history of public and private memorials in Texas, preservation efforts of nineteenth-century cemeteries, and other significant Texas historical sites. Part III discusses the cemetery access easement under current Texas law and regulatory schemes. Part IV discusses the obstacles of awareness and access as the greatest threats to the current and future status of nineteenth-century Texas family cemeteries on rural private land. Finally, Part V proposes incentives, approaches, and recommendations to strengthen …

Remedial Actions To Prevent Suicides On Commuter And Metro Rail Systems, Patrick Sherry
Remedial Actions To Prevent Suicides On Commuter And Metro Rail Systems, Patrick Sherry
Mineta Transportation Institute
The present study reviewed current efforts of commuter railroads to reduce or prevent suicide on railways and discussed preventative activities affecting rail related suicides. Primary preventative methods have included erecting physical barriers, posting warning signs with telephone numbers for hotline crisis counseling, using video surveillance on platforms, and training key personnel to identify and intervene with at-risk individuals. However, little or no evidence has been reported to demonstrate the efficacy of these methods.
The present study also sought to provide information about community awareness and attitudes toward suicide on the railroads and survey data collected from 498 respondents demonstrate that …

Conclusion
Understanding why students behave aggressively and violently can be a challenge. Even more challenging is trying to prevent aggressive and violent student behavior. Although serious violent acts by students, such as a shooting, are rare, it is still vital to be able to assess, evaluate, and deter potential threats in schools. Researchers suggest that schools create policies and procedures to evaluate and assess threats and violent student behavior. Also, researchers recommend that schools utilize the threat assessment approach to help facilitate the process of evaluating and assessing threats (Cornell & Sheras, 2006). Even though there has not been extensive …
“A False Idea Of Economy”: Costs, Counties, And The Origins Of The California Correctional System, W. David Ball
“A False Idea Of Economy”: Costs, Counties, And The Origins Of The California Correctional System, W. David Ball
Faculty Publications
Realignment in California comes at a time when the state’s prison system is expensive and overcrowded; the response has been to reevaluate and reconfigure the way counties use state prisons. Based on an original historical analysis of state archival records from the late nineteenth and early twentieth centuries, as a well as a review of secondary historical accounts of California’s prison system, I show that similar problems and policies were present at the state’s founding: issues of expense, overcrowding, and the county-state relationship help to explain the origins, size, and shape of the California prison system. California’s lack of money …

Using A Coach Approach In Regulatory Practice: One Technique On The Enforcement Spectrum, Shelley Mcclure
All Theses And Dissertations
This qualitative action research explored the use of a coach approach in the field of human care licensing. The Community Care Facilities Licensing program (CCFL) in Island Health strategically employed a 6-year coach training program between 2009 and 2015. This study specifically looked at how licensing officers in Island Health, who adopted a coach approach, influenced licensees to be partners in compliance. Seventeen individuals participated, including six child care licensing officers, one licensing supervisor, five members of the CCFL management team, and seven licensees. Interviews, a focus group, and an electronic survey were utilized to obtain data on the phenomenon. …
Remarks At The Southern Illinois University School Of Law And School Of Medicine Symposium: The President’S Task Force On 21st Century Policing: Procedural Justice, Policing, And Public Health, Tracey Meares
Southern Illinois University Law Journal
Public trust in legal authority is intimately connected with compliance with the law and with citizen engagement and cooperation. Excessively aggressive policing can undermine public trust in legal authority. Members of the public want to have the opportunity to tell their side of the story and to participate in development of agency strategies and policies, they want to be treated with dignity and respect for their rights, they want to be able to assess the extent that decisions affecting them are fair and neutral, and they want to be able to expect to be treated benevolently in the future. These …

Contraceptive Coverage Falls, No More: Using Rfra To Limit The Scope Of Religious Challenges To The Aca's Contraceptive Mandate, M. Catherine Norman
Mercer Law Review
Contraceptive coverage is a required part of all new insurance plans under the Patient Protection and Affordable Care Act (ACA), but many employers' are exempt from this requirement. Other employers have challenged the contraceptive requirement on religious grounds. In East Texas Baptist University v. Burwell, the United States Court of Appeals for the Fifth Circuit held as follows: (1) the plaintiffs are either automatically exempt from the contraceptive-coverage mandate or eligible for accommodation upon application; (2) the challenged provisions do not violate rights to religious freedom under the Religious Freedom and Restoration Act (RFRA); (3) RFRA applies only to …
Keynote Address At The Southern Illinois University School Of Law And School Of Medicine Symposium: The President’S Task Force On 21st Century Policing: Procedural Justice, Policing, And Public Health, Ronald L. Davis
Southern Illinois University Law Journal
Policing has changed significantly during the last thirty years and, although the current period involves many challenges, many changes have been successful. Community policing has advanced considerably and has been accompanied by advances in police technology. The current period of crisis in policing also presents opportunities to create a new era of policing in the United States. This generation’s civil rights movement does not have to involve conflict between police and activists, who should be working together to reform American policing. The work of the President’s Task Force on 21st Century Policing provides a framework for building a new era …
Reflections On Judging In A Mental Health Court And Challenges Beyond The Courtroom Doors, Kathryn E. Zenoff, Carl Norberg
Reflections On Judging In A Mental Health Court And Challenges Beyond The Courtroom Doors, Kathryn E. Zenoff, Carl Norberg
Southern Illinois University Law Journal
Mental illness poses unique challenges to the justice system, which the traditional model of criminal justice is poorly suited to confront. In the last few decades, problem-solving courts specifically tailored to reflect this dilemma have emerged, and early research into the effectiveness of these courts has shown promising results. The Community Mental Health Act of 1963 began the process of deinstitutionalizing people with mental illnesses, but the legislation was underfunded and only half of the proposed community mental health centers contemplated by the legislation were ever built. In the absence of appropriate treatment, people with mental illnesses began to be …

This Is Just Not Working For Us: Why After Ten Years On The Job It Is Time To Fire Garcetti, Jason Zenor
This Is Just Not Working For Us: Why After Ten Years On The Job It Is Time To Fire Garcetti, Jason Zenor
Richmond Public Interest Law Review
In Lane v. Franks, the U.S. Supreme Court held that public employees who give truthful testimony in court are protected so long as it was outside their ordinary job duties. This issue arose after ten years of the Garcetti rule which does not protect employee speech pursuant to their job duties- a nebulous topic in the digital era. In applying Garcetti, lower courts have extended it to include any speech that is a product of job duties, even if it would serve the public interest. In Lane v. Franks, the Court amended the employee speech doctrine to protect …

Public Engagement: A Vital Leadership Skill, Ashley Trim
Public Engagement: A Vital Leadership Skill, Ashley Trim
eJournal of Public Affairs
From the earliest days of the American republic, local communities have been incubators of civic health in the United States. While national, state, and local assessments of civic health show a lack of public engagement in political and social activities that were once the foundation of healthy local democracy, these first decades of the 21st century have revealed both new challenges for local governments and new tools for engagement. As local leaders revisit the important role of engaged citizens in local programs and policies, the Davenport Institute for Public Engagement and Civic Leadership at the Pepperdine University School of Public …
