The principal objective of this research is to develop a location-allocation model for vacant lots in the City of Detroit, MI, to analyze for the suitability of retention basin placement. The model will place the retention basins in areas that will effectively reduce the amount of stormwater runoff that reaches the surrounding storm drains. Detroit needs stormwater mitigation to relieve the burden that is currently on the outdated combined sewer system (CSS). The Detroit Future City strategic framework suggests the use of blue infrastructure controls to alleviate the sewer system and reduce the number of combined sewer overflows (CSOs). The …

The Economic Impact Of Changing Water Levels: A Regional Economic Analysis Of Lake Thurmond, Rob Carey, Lori A. Dickes, Elizabeth L. Crouch

This article examines the economic impact of declining lake levels on the local economy in six counties near the publically managed Thurmond Reservoir, located along the border of Georgia and South Carolina. A regression analysis of the relationship between lake level elevations and lake front real estate transactions is used in conjunction with an input-output model to estimate the median monthly economic impact of a one-foot increase in lake level in terms of employment, output, disposable income, and net local government revenue on the six counties bordering the lake. Modeling hurricane events with models such as the Florida Public Hurricane Loss Model (FPHLM) is essential for insurance and reinsurance companies to estimate projected losses. Additionally, the models can be used by public officials to estimate and mitigate damages while also developing public safety policies to reduce the amount of damage and loss of life during a catastrophic event. The FPHLM combines hurricane event simulation and building vulnerability models to predict insurance portfolios losses. Americans have received unwanted telemarketing calls for decades. In response to a rapid increase in pre-recorded calls made using autodialer devices, Congress enacted the Telephone Consumer Protection Act (TCPA) in 1992. The TCPA imposes restrictions on calls made to consumers’ residences and wireless phones using autodialer devices, even if they are not telemarketing calls. Congress appointed the Federal Communications Commission (FCC) to prescribe rules and regulations to enforce the TCPA. In 2015, the FCC released an order that defined autodialer more broadly under the statute. Consequently, devices that have the potential to become autodialers in the future, even if they …

Police agencies should be governed by the same administrative principles that govern other agencies. This simple precept would have significant implications for regulation of police work, in particular the type of suspicionless, group searches and seizures that have been the subject of the Supreme Court's special needs jurisprudence (practices that this Article calls "panvasive"). Under administrative law principles, when police agencies create statute-like policies that are aimed at largely innocent categories of actors-as they do when administering roadblocks, inspection regimes, drug testing programs, DNA sampling programs, and data collection-they should have to engage in notice-and-comment rulemaking or a similar democratically …

The Invisible Revolution In Plea Bargaining: Managerial Judging And Judicial Participation In Negotiations, Nancy J. King, Ronald F. Wright

This Article, the most comprehensive study ofjudicial participation in plea negotiations since the 1970s, reveals a stunning array of new procedures that involve judges routinely in the settlement of criminal cases. Interviewing nearly one hundred judges and attorneys in ten states, we found that what once were informal, disfavored interactions have quietly, without notice, transformed into highly structured best practices for docket management. We learned of grant-funded problem-solving sessions complete with risk assessments and real-time information on treatment options; multicase conferences where other lawyers chime in; settlement courts located at the jail; settlement dockets with retired judges; full-blown felony mediation …

Currently, there are both methodological and practical barriers that together preclude a substantial use of theoretically sound approaches, such as the ones recommended by the Highway Safety Manual (HSM), for traffic safety management. Although the state-of-the-art provides theoretically sound approaches such as the Empirical Bayes method, there are still various important capabilities missing. Methodological barriers include among others (i) lack of a theoretically sound approach for corridor-level network screening, (ii) lack of a comprehensive approach for estimation of Safety Performance Functions based on a simultaneous consideration of both crash patterns and associated explanatory variables, and (iii) lack of theoretically sound …

Not only has gang membership been expanding, but the formation of cooperative ties with Mexican drug trafficking organizations (MDTOs) has been increasing as well. Collaborative relationships with MDTOs appear to be the driving force behind the continuing gang expansion and its subsequent effects. Using social network analysis, this study examines the linkage between MDTOs and American-based gang activity and the potential influence that MDTOs may have in U.S. drug market through their associations with American street gangs. This dissertation presents a novel procedure to select explanatory variables, without the influence of human bias, for deterioration model development using National Bridge Inventory (NBI) data. Using NBI information, including geometric data and climate information, candidate explanatory variables can be converted into normalized numeric values and analyzed prior to the development of deterministic or stochastic deterioration models. The prevailing approach for explanatory variable selection is to use expert opinion solicited from experienced engineers. This may introduce human influenced biases into the deterioration modeling process. Illicit trade in tobacco is a substantial and growing problem in the U.S., causing loss of tax revenue, damage to public health, and threats to public safety. Decisions about enforcement against ITTP involve tradeoffs among competing objectives. Good policy design can improve the terms of those tradeoffs but cannot eliminate them. We examine questions about the allocation of enforcement resources against ITTP, and its distribution across activities, individuals, and organizations: in particular, whether and how to differentially target ITTP that involves violence or support for terrorism. This dissertation narrative attempts to illustrate everyday life on the home front in Memphis, Tennessee during the years of World War II, 1941 until 1945. This narrative demonstrates the evolution of the city concerning the growth of business and industry not only by those that transformed for the war, but also the many that moved into the city because of the war. The establishment of war industries caused a surge in population that spawned a housing shortage the likes of which the city had never experienced. While juvenile courts continue to balance and reevaluate the dual goals of community safety and rehabilitation of youth, juveniles who are not competent to stand trial have been left without sufficient procedural protections. This paper examines Massachusetts’ approach to juvenile competency, due process, and pretrial procedure, within a national context. The inadequacies of the Massachusetts juvenile competency laws are not unique. Currently there are nineteen states that either entirely lack juvenile-specific competency legislation or merely incorporate inapposite adult criminal statutes and standards into the juvenile context—making it difficult or impossible for those juvenile courts to dismiss or divert a delinquency …

An increase in targeted violence incidents (TVIs), primarily active shooter events, at institutions of higher education (IHEs) has exposed gaps in campus security plan preparation and exercises. The purpose of this qualitative collective case study was to discover barriers to and best practices of universities and colleges conducting security preparedness activities for TVIs. The theory that guided this study was vested interest theory which predicts how attitudes will influence behavior in a commitment to preparedness fundamentals. In August of 1814, a New York farmer named Jacob E. Mott refused to rendezvous with the militia pursuant to the orders of Governor Daniel D. Tompkins as commanded by President James Madison. In 1818, Mott was court martialed and fined ninety-six dollars. One year later, Mott brought an action in replevin in the New York state courts to recover chattel taken from him by a deputy marshal in lieu of the ninety-six dollars. Long-Term Evolution (LTE) communication systems feature advanced frequency reuse and interference coordination techniques providing faster and more secured mobile services. However, the network capacity in licensed spectrum is still behind market demands. Dynamic spectrum access or spectrum sharing in other frequently vacant or unlicensed frequency bands is considered an effective means to boost system throughput. Different from operations in licensed spectrum with exclusive access, LTE deployment needs to take into account the distinct regulations on channel access to each shared frequency band, in order to avoid interference to incumbent users, and to maintain fair play with peer operators in heterogeneous …
