Montana Standard Interviews Barbara Creel On The Violence Against Women Act And Double Standards, Barbara L. Creel

Faculty Scholarship

Barbara Creel, Southwest Indian Law Clinic Director Professor at the University of New Mexico, agreed with Babcock that the case was not about tribal sovereignty.

Yet she said the case reveals inequities in the criminal justice system of tribes created when Congress told them how to structure their governments under the Indian Reorganization Act but did not provide sufficient funding or additional legal protections to make those systems function as intended.

Additionally, in a brief she and colleagues filed to the court, Creel argues that the Violence Against Women Act creates a discriminatory double standard.

Police Academy Recruits’ Academic Performance Predicted By Initial Education Obtainment Level, Donald Doutt

GS4 Student Scholars Symposium

This study made a statistical analysis of test scores, on three select written knowledge based tests given in the six Georgia Regional Police Academies, to detect significant influence from the prior formal educational obtainment levels of the police recruits. Two 10 week training cycles, provided 20 Graduating Classes with =22.4 recruits. Up in the Air: A Global Estimate of Non-Violent Drone Use 2009-2015

The use of unmanned aerial vehicles (UAVs), or drones, has increased dramatically in recent years. While most attention has gone to military drone use, commercial drones have gained widespread popularity, with uses ranging from leisure activities by hobbyists to humanitarian aid and disaster relief support by non-governmental organizations (NGOs) and activist groups. This use has been hard to quantify and regulate.

In an effort to better understand the rapid growth of non-weaponized drone, this report analyzes cases of worldwide drone use reported during a six-year period (2009-2015). Utilizing a combination of qualitative and quantitative methods, we engage two distinct research …

Pay-For-Performance In Prison: Using Healthcare Economics To Improve Criminal Justice, W. David Ball Apr 2016

Pay-For-Performance In Prison: Using Healthcare Economics To Improve Criminal Justice, W. David Ball

Faculty Publications

For much of the last seventy-plus years, healthcare providers in the United States have been paid under the fee-for-service system, where providers are reimbursed for procedures performed, not outcomes obtained. Providers, insurers, and consumers are motivated by different individual and organizational incentives; costs and burdens of patient care are shifted from one part of the system to another. The result has been a system that combines exploding costs without concomitant increases in quality. Healthcare economists and policymakers have reacted by proposing a number of policies designed to reign in costs without sacrificing quality. One approach is to focus on the …

Hamad V. Gates And The Continuing Interpretation Of Boumediene: A Note On 732 F.3d 990 (9th Cir. 2013), Paul Blenz Apr 2016

Hamad V. Gates And The Continuing Interpretation Of Boumediene: A Note On 732 F.3d 990 (9th Cir. 2013), Paul Blenz

Journal of the National Association of Administrative Law Judiciary

A particularly prevalent type of claims in post-Boumediene cases are Bivens claims by detainees. One such case is Hamad v. Gates. Hamad represents a typical claim made by such detainees, and is the focus of this note. In Hamad, the Ninth Circuit held that a statute that had previously thought to be entirely overruled by Boumediene actually survived. This statute, 28 U.S.C. § 2241(e), stemmed from years of back-and-forth debate between the Supreme Court and Congress. The result of this conflict is still unsettled. The main issue is whether the Court’s primary concern in overruling the jurisdiction-stripping statutes of Congress …

A Proposal To Allow The Presentation Of Mitigation In Juvenile Court So That Juvenile Charges May Be Expunged In Appropriate Cases, Katherine I. Puzone Apr 2016

A Proposal To Allow The Presentation Of Mitigation In Juvenile Court So That Juvenile Charges May Be Expunged In Appropriate Cases, Katherine I. Puzone

Pace Law Review

Many people believe that juvenile adjudications of delinquency are automatically expunged upon the youth reaching the age of majority. In reality, a juvenile adjudication of delinquency—especially for a felony—can significantly limit a teenager’s future ability to obtain student loans and scholarships, join the military, participate in athletics, become a firefighter or a law enforcement officer or obtain one of many jobs. As discussed herein, the majority of youth facing charges in delinquency court are suffering from severe socio-economic deprivation, are victims of emotional, physical or sexual abuse, or have serious mental health issues. Many youth caught up in the delinquency …
