The Faces Of The Second Amendment Outside The Home, Take Two: How We Got Here And Why It Matters, Patrick J. Charles Jun 2016

The Faces Of The Second Amendment Outside The Home, Take Two: How We Got Here And Why It Matters, Patrick J. Charles

Cleveland State Law Review

Since the late twentieth century, the Second Amendment has been increasingly promoted as the unfettered right to carry firearms in the public concourse. This expansive meaning, however, lacks historical support. Historical evidence reveals a disparity between the Anglo-American origins of armed carriage laws and present-day interpretations of the Second Amendment. The historical backdrop also reveals the impact pro-gun organizations have had on the expansion of armed carriage. Differences in state armed carriage laws, analyzed from both historical and regional perspectives, will one day require the Supreme Court to determine which version of history should dictate the meaning of the Second …

The Freedom Of Speech In Public Forums On College Campuses: A Single-Site Case Study On Pushing The Boundaries Of The Freedom Of Speech, Alexander Davidson Jun 2016

The Freedom Of Speech In Public Forums On College Campuses: A Single-Site Case Study On Pushing The Boundaries Of The Freedom Of Speech, Alexander Davidson

Journalism

The purpose of this single-site study is to test how far speech can be pushed before it is no longer protected at the California Polytechnic State University. The purpose isn’t merely to push limitations for the sake of testing boundaries, but it is to see what types of speech truly add to the marketplace of ideas and what types simply do not. The main points of the study are to understand what speech is protected and what speech is not protected on California Polytechnic State University’s campus and to understand how the provocation that comes along with “negative speech” can …

Anonymization And Risk, Ira S. Rubinstein, Woodrow Hartzog Jun 2016

Anonymization And Risk, Ira S. Rubinstein, Woodrow Hartzog

Washington Law Review

Perfect anonymization of data sets that contain personal information has failed. But the process of protecting data subjects in shared information remains integral to privacy practice and policy. While the deidentification debate has been vigorous and productive, there is no clear direction for policy. As a result, the law has been slow to adapt a holistic approach to protecting data subjects when data sets are released to others. Currently, the law is focused on whether an individual can be identified within a given set. We argue that the best way to move data release policy past the alleged failures of …

A Dark Record: Criminal Discourse And The African American Literary Project, 1721-1864, Brian Baaki Jun 2016

A Dark Record: Criminal Discourse And The African American Literary Project, 1721-1864, Brian Baaki

Dissertations, Theses, and Capstone Projects

A Dark Record charts the emergence and traces the evolution of a central figure in American culture, the myth of the black criminal. It does so both to explore the ideological effects of print, and to present an alternative history of African American literature. Historians have long maintained that the association of African Americans with crime solidified in our national culture during the post-Reconstruction period, the nadir for African American civil rights, with a corresponding rise in the over-policing of black individuals and communities. For its part, my study looks back from the post-Reconstruction period, and examines the role earlier …

Lecciones De IngléS Para Un Hispanohablante Encarcelado: Caso PráCtico, Mckenzie Brown

World Languages and Cultures

This project attempts to outline my experience teaching English in the San Luis Obispo County Jail as part of a seven-week internship. It will outline various teaching methods that I found useful in one-on-one settings. I will discuss the flexibility required to work within the limitations imposed by the jail, as well as linguistic and cultural obstacles associated with teaching a native Spanish speaker. Lastly, I intend to advocate for the implementation of more jail programs that can be accessed by non-native English speakers.

Although this project's core is founded in seven weeks of ninety-minute instructional sessions, it will also …

To Promote Or Not To Promote: An Inquiry Into The Experiences Of Female Police Officers And Their Decisions To Pursue Promotion, Kristin Poleski Jun 2016

To Promote Or Not To Promote: An Inquiry Into The Experiences Of Female Police Officers And Their Decisions To Pursue Promotion, Kristin Poleski

Dissertations

Despite an increase in the number of female police officers in U.S. police agencies, female representation in supervisory (sergeant and lieutenant) and command (captain, assistant chief and chief) positions in most agencies is limited. This research study focuses on the promotional aspirations as an explanation of limited female representation with attention to the decision-making criteria female police officers use when deciding to participate in the promotional process. This study also examines the institutional, political, organizational structures, and/or personal factors which may impact the female police officers’ decisions to participate in the promotion process. And, this study examines a factor mentioned …

A Metaevaluation Of The Commission On Fire Accreditation International Accreditation Process, Stacy A. French Jun 2016

A Metaevaluation Of The Commission On Fire Accreditation International Accreditation Process, Stacy A. French

Dissertations

Fire and emergency services throughout the country are being required by local governmental authorities to provide efficient and effective services. In 1996, the International City-County Management Association (ICMA) and the International Association of Fire Chief (IAFC) executed a master trust agreement that established the Commission on Fire Accreditation International (CFAI) to award accreditation to those fire and emergency services that demonstrated efficiency and effectiveness in the services provided. As of this study, no documented research had been published that challenged the current CFAI Accreditation process to ensure the highest level of accountability and usefulness for both the public and fire …

Legislating Agency Use Of Unmanned Aerial Vehicles In Washington State, Ashleigh B. Rhodes Jun 2016

Legislating Agency Use Of Unmanned Aerial Vehicles In Washington State, Ashleigh B. Rhodes

Washington Law Review

After years of hearing about “drone strikes” in the Middle East meant to kill terrorists that also kill and maim innocent civilians, Americans have legitimate concerns about the government’s use of unmanned aerial vehicles (UAVs) domestically. The public’s anxiety over law enforcement agency use of domestic UAVs stems from worries that UAVs will significantly invade citizens’ privacy. In an effort to allay these privacy concerns, state legislators, including those in Washington State, have introduced statutes aimed at curbing law enforcement agency use of UAVs. However, state legislators should carefully draft legislation to ensure that agencies not acting in a law …

New Trends In Diversity Leadership And Inclusive Excellence, Seth N. Asumah, Mechthild Nagel, Lewis Rosengarten Jun 2016

New Trends In Diversity Leadership And Inclusive Excellence, Seth N. Asumah, Mechthild Nagel, Lewis Rosengarten

Wagadu: A Journal of Transnational Women's & Gender Studies

The process of reaching inclusive excellence, cultural competence and social justice in the academy has generated new questions for interlocutors of diversity studies and new meanings for diversity management. In recent years, more attention has been focused on one area in the academy that implements “diversity management”— Admissions offices. These units that serve as both diversity agents and gatekeepers for recruitment have come under scrutiny for failing to adopt a culturally competent or even “culturally intelligent” skill set for inclusive excellence. Furthermore, the complex approaches in reaching inclusive excellence in recruitment and retention that involve diversity management, which is ideally …

Do Prosecutors Really Matter?: A Proposal To Ban One-Sided Bail Hearings, Sandra Guerra Thompson Jun 2016

Do Prosecutors Really Matter?: A Proposal To Ban One-Sided Bail Hearings, Sandra Guerra Thompson

Hofstra Law Review

In about half of all local jurisdictions today, arrested individuals face a judge at a bail hearing without the assistance of counsel, and in many of those jurisdictions, prosecutors may appear on behalf of the state. This article questions whether prosecutors can function as “ministers of justice” within the context of a one-sided proceeding where defendants appear without counsel. The ABA Standards for Criminal Justice: Prosecution and Defense Function apparently took the position of preferring the presence of prosecutors in all cases, even those in which a party appears without counsel. The rules assign prosecutors in those cases to protect …

A Hedonic Analysis Of Community Supported Agriculture Share Prices In Midwestern United States, Binod Khanal Jun 2016

A Hedonic Analysis Of Community Supported Agriculture Share Prices In Midwestern United States, Binod Khanal

Department of Agricultural Economics: Dissertations, Theses, and Student Research

As concerns mount over the consequences of conventional food production for health, the environment, and animal welfare, consumers are increasingly demanding what they perceive as more nutritious, safer, and ethically produced food. Local food in general and community supported agriculture in particular have emerged as promising alternatives that could allay those concerns and, judging by recent growth, the share of local food in total food sales will most likely continue to grow. This represents an opportunity and a challenge for both incumbent farms serving the local food market as well entrants who are looking to capitalize on the growth in …

Sustainable Development, Natural Resource Extraction, And The Arctic: The Road Ahead, Edward Canuel Jun 2016

Sustainable Development, Natural Resource Extraction, And The Arctic: The Road Ahead, Edward Canuel

Alaska Law Review

Sustainable development has emerged as an integral nexus, linking together critically important global issues including environmental stewardship and economic growth. Understanding sustainable development demands a close analysis of evolving definitions, conceptual applications, and areas of convergence and divergence within international, regional, and domestic institutions. The import and impact of hard law and soft law must additionally be explored to understand the application of sustainable development to the Arctic. This Article suggests a three-tier framework to assist the multiplicity of stakeholders with diverse equities to navigate the socio-economic and legal hurdles and potential associated with Arctic development. First, a trend has …

The Cost Of Earmarks, Nicholis John Zappia Jun 2016

The Cost Of Earmarks, Nicholis John Zappia

Electronic Theses, Projects, and Dissertations

Finding revenue is a challenge that faces many municipalities in the United States. As the tax base continues to decline and demand for government services increases, local governments are forced to make hard choices. Low on the list of priorities for local governments is the maintenance, and construction of infrastructure. Traditionally there have been several ways for local governments to fund long-term infrastructure projects including, federal-aid through the process of earmarking. The practice of earmarking has been around since the first congress, but hit its peak between 2003 and 2007. The earmarking process is controversial for several reasons; earmarking bypasses …

The Effects Of Gender On Driving Under The Influence Of Alcohol Sentencing Disaprities In Pennsylvania, Dianna Hurst Jun 2016

The Effects Of Gender On Driving Under The Influence Of Alcohol Sentencing Disaprities In Pennsylvania, Dianna Hurst

Electronic Theses, Projects, and Dissertations

Differential sentencing has been a reoccurring issue in the judicial system for decades. Sentencing disparity occurs when similar offenders (similar in offense type, age, gender, ethnicity, and SES) receive different sentences or when different offenders receive the same sentence (Spohn, 2009). Prior studies find a sex effect, where women tend to be treated more leniently than men (e.g., Daly, 1987a). Sentencing discrepancies are evident in crimes that are considered to be gendered. Certain types of crimes are more likely to be committed by females and receive more lenient sanctions than if a male were to commit these types of crimes. These …

The Climate Of Opinion In Illinois 2008- 2016: Roots Of Gridlock, John Jackson, Charles W. Leonard, Shiloh L. Deitz

The Simon Review (Occasional Papers of the Paul Simon Public Policy Institute)

Since January 1, 2015, Illinois has been frozen in a governmental and political gridlock that has dominated the state’s political discourse, consumed the energies of all involved, and created chaos in governmental and non-profit agencies that normally deliver state services. It has also created untold hardship and suffering among those who are most dependent on state services. The conflict has especially threatened to drastically reduce the quality and missions of the institutions of public higher education in Illinois, a state system that was widely recognized as one of the best in the nation and the world.
