Feeling Unsafe At School: Southeast Asian American Adolescents’ Perceptions And Experiences Of School Safety, Cara S. Maffini
Feeling Unsafe At School: Southeast Asian American Adolescents’ Perceptions And Experiences Of School Safety, Cara S. Maffini
Journal of Southeast Asian American Education and Advancement
School safety impacts mental health and educational attainment particularly among vulnerable populations such as refugee youth. Using data from the Children of Immigrants Longitudinal Study (CILS), this study examined the mental health impact of perceptions and experiences that compromise school safety among Southeast Asian American adolescents (N = 645). Higher rates of perceptions and experiences that violated students’ feelings of safety at school were associated with decreased self-esteem and increased levels of depressive symptoms. Hierarchical regressions indicate that in light of perceptions and experiences of feeling unsafe at school, bicultural orientation, importance of identity, and family cohesion have an additive …

Intent and mitigating circumstances play a central role in moral and legal assessments in large-scale industrialized societies. Although these features of moral assessment are widely assumed to be universal, to date, they have only been studied in a narrow range of societies. We show that there is substantial cross-cultural variation among eight traditional small-scale societies (ranging from hunter-gatherer to pastoralist to horticulturalist) and two Western societies (one urban, one rural) in the extent to which intent and mitigating circumstances influence moral judgments. Although participants in all societies took such factors into account to some degree, they did so to very …

Wiki-Based Collaborative Writing Activities In Esl Contexts, Abdurrazzag Abdullah Alghammas
Electronic Theses and Dissertations Archive
Driven by Vygotsky's sociocultural theory and the notion of the zone of proximal development (ZPD), and Long's interaction hypothesis, the study investigated how intermediate-level international students at an urban U.S. Mid-South university interacted in wiki-based collaborative writing. students' perspectives toward the integration of wikis in writing assignments and why they hold such perspectives were also objectives of the study. Eighteen students in small groups of three were asked to collaboratively write three different paragraphs, namely, summary, compare/contrast, and classification.Using a triangulation mixed-methods approach, the data were collected over 8 weeks. Pre-and post-survey questionnaires were adminstered using an online survey website …
Scholarly Ecotones In The Information Landscape, Drew Hubbell, John Ryan
Scholarly Ecotones In The Information Landscape, Drew Hubbell, John Ryan
Landscapes: the Journal of the International Centre for Landscape and Language
For this issue of Landscapes, we invited contributors to reflect on the concept of ecotone as a method of interrogating intersections between literature, culture, art and landscapes. We wanted to encourage the ecocritical and creative arts communities (including poets, writers, photographers, painters and graphic artists) to engage with this term in the hopes that ecotone would do for the environmental humanities what Mary Louise Pratt’s contact zone did for cultural and post-colonialist studies (see, for example, Pickles and Rutherdale). Taking our cue from Donna Haraway’s provocative study of interspecies contact zones in When Species Meet, we proposed the …

Patent Attorney Malpractice: Case-Within-A-Case-Within-A-Case, A. Samuel Oddi
Patent Attorney Malpractice: Case-Within-A-Case-Within-A-Case, A. Samuel Oddi
Akron Intellectual Property Journal
This article will first provide a brief history of the jurisdictional controversy between federal courts and between federal courts and state courts. Then, the question will be examined of how the subject matter jurisdictional question has been resolved with respect to patent attorney malpractice cases to the extent it has been to date in the federal and state courts. The manner in which the case-within-a-case doctrine or methodology has been used in deciding the jurisdictional question will also be investigated. In addition, the relevance of the use of the judgment or non-judgment model to determine patent attorney malpractice will be …
Trademarks In 2010 (And 2011): Dilution Takes Center Stage, David S. Welkowitz
Trademarks In 2010 (And 2011): Dilution Takes Center Stage, David S. Welkowitz
Akron Intellectual Property Journal
From the hundreds of trademark cases decided in any year, it is often difficult to discern any particular theme. There are cases from many different areas raising very disparate issues. In 2010, however, trademark dilution stands out as the area with the most prominent doctrinal opinions. In addition to three court of appeals decisions, there were five significant Trademark Trial and Appeal Board (“TTAB”) decisions from an entity whose prior involvement in dilution had been very much the exception. These dilution opinions form the centerpiece of this discussion.
There were, of course, other notable decisions involving contributory infringement and the …
Legal Interpretation By Computer: A Survey Of Interpretive Rules, Eric Engle
Legal Interpretation By Computer: A Survey Of Interpretive Rules, Eric Engle
Akron Intellectual Property Journal
This article presents a survey of legal interpretive rules. The rules presented in this survey are used as the rule base in the computer program accompanying this article, an expert system. The computer program models legal decision-making and uses the rules presented to make legal decisions, generating a report to justify the decision reached. Legal interpretation is chosen as a model for computation representation because understanding interpretive methods is useful for any jurist seeking creative arguments. This survey of legal interpretive rules is of both a theoretical and practical interest.
Intersection Between The Patent System And Antitrust Laws: Patents Speeding, Antitrust Yielding, Innovation Bleeding!, Stijepko Tokic
Intersection Between The Patent System And Antitrust Laws: Patents Speeding, Antitrust Yielding, Innovation Bleeding!, Stijepko Tokic
Akron Intellectual Property Journal
In this article, I explain the interaction between the two laws and describe the ways in which these two extremely important areas of government regulation are and are not in tension. I argue that the conflict between the two laws is overstated, but the proper balance is far from being found. The reason for that is a notion that the current state of the patent system is more of a hindrance than a spur to innovation and competition due to overprotection and broadening of patent rights, lowering of standards to grant patents, chronic inefficiency of the Patent and Trademark Office …
If Hip-Hop Were Classified And The Pentagon Papers Had Been Copyrighted: An Analysis Of Whether The Fair Use Defense In Copyright Law Is Broad Enough To Protect First Amendment Concerns, Sean Buchanan
Akron Intellectual Property Journal
This paper will show that copyright law conflicts with the First Amendment in that the fair use doctrine is insufficient to protect the fundamental rights and interests that underlie the First Amendment's protection of speech. To do this, the paper will examine three primary justifications of the First Amendment: individual liberty, the marketplace of ideas, and political participation. The paper will also analyze multiple situations, in which parties bring copyright suits and the defendants claim fair use, to determine whether the fair use doctrine protects the First Amendment. This paper will show that if one accepts either a marketplace of …
Memories That Won't Desert. Transnational Legacies Of Francoism And The Spanish Civil War In 21st Century Novel, Comic And Film., Julie Samit
Open Access Dissertations
This dissertation examines contemporary representations of Francoism and the Spanish Civil War and emphasizes the Republican legacy in three different media: novel, comics, and film. Its main focus is Spain, but my corpus also includes the experience of French and Mexican exiles. These works, produced for the most part by descendants of Republicans in diverse sociocultural and sociopolitical contexts, establish a memorial network that goes beyond national boundaries, and that travels from generation to generation. I define the production of second and third generations who recuperate individual stories that have been repressed politically as “legacy narratives.” I argue that because …
Quantifying The Association Between Active Tuberculosis Incidence And Migrant Farm Worker Populations Among Florida Counties, 2009-2013: An Ecological Study, Ryan Nicolas Ortega
Quantifying The Association Between Active Tuberculosis Incidence And Migrant Farm Worker Populations Among Florida Counties, 2009-2013: An Ecological Study, Ryan Nicolas Ortega
USF Tampa Graduate Theses and Dissertations
Nearly 20 studies conducted in the last 40 years indicate that tuberculosis (TB) represents a major health concern among migrant farm worker (MFW) populations, but their role in the transmission of TB within the broader community is poorly understood. To this end an ecological study was undertaken which examined 67 Florida counties between years 2009 through 2013. Its aims were as follows: (1) to describe the demographic, geographic, and temporal distribution of the incidence of active TB, (2) to examine the effect of agriculturally relevant seasonal periods on the incidence of active TB, and (3) to quantify the strength and …
"The Afro That Ate Kentucky": Appalachian Racial Formation, Lived Experience, And Intersectional Feminist Interventions, Sandra Louise Carpenter
"The Afro That Ate Kentucky": Appalachian Racial Formation, Lived Experience, And Intersectional Feminist Interventions, Sandra Louise Carpenter
USF Tampa Graduate Theses and Dissertations
This thesis examines selections of Appalachian women’s personal narrative as well as Affrilachian Poetry written by Kentuckians Bianca Spriggs and Nikki Finney. This project’s goal lies in resisting oppression and erasure of Appalachian culture’s heterogeneity. Contrary to constructions of Appalachians as lazy, complacent, and white, many Appalachians organize communities of resistance from within the region itself. Challenging these representations, I argue that Appalachian feminists as well as Affrilachian poets create countercultures that disrupt monolithic, colonialist, and unquestioned constructions of Appalachia.

A Qualitative Study On How Washington State Mayors Transform Conflict, Darin Hand
Dissertations
The purpose of this phenomenological study was to discover and describe how exemplary Washington State mayors establish common ground and produce breakthrough results by utilizing the six domains of conflict transformation behaviors: collaboration, communication, emotional intelligence, ethics, processes, and problem solving. This study was conducted in collaboration with peer researchers studying other exemplary leaders representing a variety of industries. For this study, three methods of data collection (interviews, observations, and artifacts) were used to study the lived experiences of exemplary Washington State mayors and to present shared practices and patterns that demonstrate finding common ground and producing breakthrough results. The …

From Wilde to Obergefell:
Gay Legal Theatre, 1895-2015
Todd Barry, PhD
University of Connecticut, 2016
This dissertation examines how theatre and law have worked together to produce and regulate gay male lives since the 1895 Oscar Wilde trials. I use the term “gay legal theatre” to label an interdisciplinary body of texts and performances that include legal trials and theatrical productions. Since the Wilde trials, gay legal theatre has entrenched conceptions of gay men in transatlantic culture and influenced the laws governing gay lives and same-sex activity. I explore crucial moments in the history of this unique genre: the Wilde …

To Utopianize The Mundane: Sound And Image In Country Musicals, Siyuan Ma
To Utopianize The Mundane: Sound And Image In Country Musicals, Siyuan Ma
USF Tampa Graduate Theses and Dissertations
Many consider music, songs, and dance performance as utopian signifiers for cinema, but few has entered the utopian discourse of country musicals, a small genre of cinema usually known as country music films. By closely scrutinizing Pure Country (1992), this thesis aims to reveal how country music—as music numbers and as background cues— integrate and connect the fragmented on-screen world for the country musicals so as to offer audiences a fullness of utopian experience, and how this utopian effect are culturally significant for American audiences due to country music’s unique mechanism of constructing utopia and nostalgia in its past-orientations, sentimentalities, …
The Experiences Of Community College Trustees During Their First Year Of Service: A Phenomenological Study, Jacob Farbman
The Experiences Of Community College Trustees During Their First Year Of Service: A Phenomenological Study, Jacob Farbman
Theses and Dissertations
The global economy has created a demand for skills and talent, and while the rest of the world has responded to the global demand for post-secondary skills by increasing attainment, the United States has not. Community colleges are more important today than ever before as they work to produce qualified, skilled workers as well as an educated citizenry so that the United States can remain competitive in a global economy. Boards of trustees govern these community colleges. The boards of trustees have the final authority over the affairs of higher education institutions in the United States, yet very little research …

Language Use And Identity In The Cuban Community In Russia, Maria Yakushkina, Daniel J. Olson
School of Languages and Cultures Faculty Publications
A significant body of research has begun to explore the association between language and identity, a relationship that becomes more complex when considering multilingual communities. Important for this field, a number of studies have examined the interrelation between language and identity in the Cuban population in the USA, a case in which dominant (English) and minority language (Spanish) interaction has largely resulted in language maintenance and a positive correlation between language use and ethnic identity. While the Cuban population in Russia shares cultural and historical background with the well-studied US Cuban community, key differences allow for the examination of the …
Racial Stereotype Threat: A Critical Race Perspective, Daniel Mccloud
Racial Stereotype Threat: A Critical Race Perspective, Daniel Mccloud
Theses and Dissertations
America is currently at a crossroads regarding race relations. Social and racial inequities have led to disparities in the educational outcomes among Blacks and other groups in this country. These educational disparities, incorrectly defined as an achievement gap, are part of a larger deficit based construct, which continues to deflect attention away from a system of hegemony that has been used to maintain a hierarchy of power and dominance over African Americans. Central to the continuance of this structure is the use of deficit based rhetoric, ideology, and research that continues to perpetuate stereotypes of African American intellectual inferiority.

Session presented on Monday, November 9, 2015:
More than 200 million children under five fail to reach their cognitive potential due to poverty, poor health, poor nutrition and lack of care. Providing increased cognitive stimulation or learning opportunities to young children significantly increases cognitive and social-emotional competence later in life. An interdisciplinary team of students from the United States worked with the University of Venda and the Vhembe Health District in Limpopo to determine the acceptability and feasibility of a pediatric assessment tool and program to track child development in a rural health district in Limpopo, South Africa. Biennial Convention (CONV)
Session presented on Monday, November 9, 2015 and Tuesday, November 10, 2015: Schools of nursing and nursing faculty are struggling with high attrition rates and low NCLEX-RN first time pass rates. At the same time students are struggling with progressing and completing nursing programs while maintaining their own sense of self-worth. There is limited research addressing the association of positive factors that sustain nursing students in stressful situations, i.e., preparing for success on NCLEX. Student nurses who manage stress as a component of maturity and development become nurses who are able to monitor and moderate stress in their careers. Salutogenesis …
