Montana’s Lake Koocanusa sits at the end of a river system that drains Canada’s most productive coal country. Today, the waters of the massive lake contain a mineral called selenium, a poorly understood byproduct of mine waste. This summer, the U.S. federal government will be in a position to declare that the selenium in the lake puts Canada in violation of its international treaty with the U.S. The Montana government, however, is preparing to argue otherwise through its own water analysis. The “dumb jock” stereotype prevalence is being questioned, along with its validity throughout this thesis. More negative articles about student-athletes are known by the public, while the successes have been buried beneath them. This thesis will discuss what the “dumb jock” stereotype is, what previous research has been done with it while determining the prevalence of the “dumb jock” stereotype and challenging its accuracy. The private sector historically has driven the setting of technical standards in the United States, with the federal government only intervening in response to perceived violations of specific statutes, such as antitrust laws. This concern is reflected in case law and in advice proffered by US antitrust enforcers. Recently, however, US enforcers have turned their attention primarily to the alleged misuse of monopoly power over patents that cover technologies embodied in standards. This new focus threatens to undermine innovation and departs from sound antitrust enforcement policy. Public access to government-funded research is an issue of tremendous importance to researchers, librarians, and ordinary citizens around the world. Based on the notion that taxpayers finance research through their tax dollars, research data should be available to them. Rapid, unfettered access to research publications provides access to medical research to patients, encourages further exploration and inquiry by other researchers, informs citizens, and advances scientific research.
Scientists typically write articles that divulge the results of their government-funded research. Prior to the open access movement, these articles were published in commercially produced journals. Subscriptions to these journals are expensive, and cost …

The challenge of achieving socially optimal incentives for innovation in public goods faces twin market failures: a market failure to adequately promote public goods invention and a market failure to implement innovative public goods once developed. Though innovation in private goods sometimes faces the former hurdle, often ameliorated by intellectual property law, the interaction of both market failures for public goods innovation raises unique difficulties.
Environmentally beneficial technology presents an illustration of the innovation problem for public goods. Private actors lack sufficient incentives both to engage in environmentally beneficial innovation and to implement such innovation. While traditional intellectual property law …

It has long been discussed whether individuals should have a "right to be forgotten" online to suppress old information that could seriously interfere with their privacy and data protection rights. In the landmark case of Google Spain v. Agencia Espafiola de Proteccion de Datos, the Court of Justice of the European Union (CJEU) addressed the particular question of whether, under EU Data Protection Law, individuals have a right to have links delisted from the list of search results in searches made on the basis of their name. The objective of this dissertation is to develop a comprehensive Structural Identification (St-Id) framework with damage for bridge type structures by using cameras and computer vision technologies. The traditional St-Id frameworks rely on using conventional sensors. In this study, the collected input and output data employed in the St-Id system are acquired by series of vision-based measurements. The aim of this thesis is to examine, develop, and assess innovative best management practices (BMPs) in stormwater management for pollutant reduction, flood control, and environmental sustainability. Previous research has clearly shown that urban stormwater runoff quickly transports pathogens, metals, sediment, and chemical pollutants to receiving waterbodies, resulting in the degradation of receiving waters and disruption of ecological networks. In this cross sectional quantitative investigation, the relationships among mental health professionals' cognitive complexity, mindfulness, and reflection were explored. To determine if there was a correlation between mindfulness and cognitive complexity, a Pearson's correlation was conducted: There was a strong positive correlation between mindfulness and cognitive complexity. To determine whether observing and describing (two key variables of mindfulness) could predict counselor overall cognitive complexity, a simultaneous multiple regression was conducted. The observing subscale significantly predicted counselor cognitive complexity and the describing subscale did not significantly predict mindfulness. The purpose of the present study was to investigate the impact of organizational centralization in higher education technology support units on institutional innovativeness. The centralization tools used for the present study included measures developed by Hage & Aiken (1971), Kaluzny, et al. (1974), and Ferrell & Skinner (1988). This thesis examines the gendered impacts of the 2015 earthquake on women in Nepal. The purpose of this study is to identify factors contributing to vulnerability of women, and explore gender sensitivity of the relief materials provided post 2015 earthquake. Five major themes were identified that put women in vulnerable situations. These include, menstruation and pregnancy, which are unique experience of women; bathing and toilet needs, which are different than their male counterparts; care taking duties, which was found to be the primary role of women interviewed; age based vulnerabilities, which puts older women in unique conditions that affect their …

In recent years, unprecedented numbers of migrants have arrived in Italy due to political, religious, ethnic and economic instabilities in West and North Africa and the Middle East. Simultaneously, the Eurozone Crisis and neoliberal austerity measures left the Italian government struggling to administer healthcare and legal services to all migrants. This study investigates the provision of essential services by the Italian state and two non-governmental organizations (NGOs), Emergency and ARCI, respectively providing free medical and legal services, to incoming migrants in Siracusa, Italy. The purpose of the study was to identify the barriers and challenges to EdD completion. Respondents helped identify which retention resources or actions would be most effective in keeping them enrolled and on track to degree completion. The EdD program director, EdD faculty, and WKU will be able to use information from the study to develop retention resources, intervention strategies, and perhaps make even more sweeping changes to confront the obstacles to EdD persistence.

In 2014 Parliament enacted a number of amendments to the Food and Drugs Act, R.S.C. 1985, c. F-27 [hereinafter the “F&D Act”]. Known as “Vanessa’s Law,” these amendments were intended to enhance the regulation of pharmaceutical drugs and thereby protect Canadians from harm by giving the regulator, Health Canada, new powers to, inter alia, recall drugs, require active post-market surveillance, and improve the transparency of information around pharmaceutical drugs. Canada should implement national pharmacare consistent with the principles outlined in the Pharmacare 2020 report. (Morgan et al. 2015a) The best evidence we have shows that national pharmacare will save approximately $7 billion and — more importantly — hundreds of lives each year. (Morgan et al. 2015b)
The issue, then, is not whether to institute national pharmacare, but how. For, even though the need for national pharmacare has been plain since the 1964 Hall Commission, the landscape of medicine and pharmaceuticals has changed dramatically since then.

In 1886, the US Supreme Court wrote that, for Indian tribes,"the people of the states where they are found are often their deadliest enemies." Recently, state agencies and regulators have continued that tradition of hostility by improperly attempting to regulate electronic commerce businesses operated by tribal governments that are more properly subject to regulations established by tribal law and subject to federal oversight. This Article explores the nature and characteristics of health information that make it subject to federal and state laws and the existing legal framework that confers rights and responsibilities with respect to health information. There are numerous legal and policy considerations surrounding the question of who owns health information, including whether and how to confer specific ownership rights to health information. Ultimately, a legal framework is needed that reflects the rights of a broad group of stakeholders in the health information marketplace, from patients to providers to payers, as well as the public's interest in appropriate sharing of health information.
