The Science Of Gatekeeping: Using The Structure Of Scientific Inference To Draw The Line Between Admissibility And Weight In Expert Testimony, Christopher Slobogin, David Faigman, John Monahan

Fundamental to all evidence rules is the division of responsibility between the judge, who determines the admissibility of evidence, and the jury, which gauges its weight. In most evidentiary contexts, such as those involving hearsay and character, threshold admissibility obligations are clear and relatively uncontroversial. The same is not true for scientific evidence. The complex nature of scientific inference, and in particular the challenges of reasoning from group data to individual cases, has bedeviled courts. As a result, courts vary considerably on how they define the judge's gatekeeping task under Federal Rule of Evidence 702 and its state equivalents.

Are College Presidents Like Football Coaches? Evidence From Their Employment Contracts, Randall Thomas, Lawrence R. Van Horn

College presidents and football coaches are frequently criticized for their high compensation. In this paper, we argue that these criticisms are unmerited, as the markets for both college presidents and football coaches exhibit properties consistent with a competitive labor market. Both parties compensation varies in sensible ways related to the size of the programs they manage, as well as their potential for value creation. Successful college presidents and football coaches can greatly increase the value of their schools well beyond the amount they receive in compensation. Stagnant outcomes for students with disabilities has resulted in an era where results-driven accountability is emerging as the driving force for special education leadership. Students who receive special education services significantly lag behind their non-disabled peers in their performance on required statewide, standardized assessments. One of the myriad consequences of war is displacement and refugee-ism. People become refugees when they no longer feel safe in their country of origin. Before, during, and after the journey towards safety, refugees and internally displaced persons (IDPs) endure several challenging circumstances which stretch their normal abilities to cope. In their efforts to cope, these people report several mental health challenges like sleeplessness, hypervigilance, anxiety, and depression. The reported mental health challenges are normal in this population; however, when they persist, they result in posttraumatic stress disorder. Surprisingly, some also report obtaining psychological growth due to their challenging circumstances. …

Prevention efforts targeted at children and adolescents are important because alcohol consumption contributes to the three leading causes of death in this among 12-20 year-olds: unintentional injury, homicide, and suicide. Research on the causes of alcohol misuse traditionally focused on pharmacological and genetic explanations, but models have expanded to include cognitive processes in the development of alcohol use patterns. Alcohol expectancies, or beliefs about the effects of alcohol, are an important influence on drinking behavior. The influences of certain social changes and social movements, such as the feminist movement, in society introduced a violence gendered stereotype model that promoted the social idea that males are more violent than females. From the limited research, it appears that domestic violence perpetration among women differs from male domestic violence perpetration; however, research has not clarified the extent of female domestic violence perpetration and the severity of their abusive behaviors. This thesis analyzes the formation of two National Basketball Association (NBA) franchises—the Miami Heat and the Orlando Magic—and the efforts of groups representing both cities to procure those franchises between 1982 and 1987. Drawing primarily from discourse found in local newspapers, this thesis serves as a case study of the dual nature of sport to both unite and divide communities. While proponents of the NBA in Miami and Orlando preached the social, cultural, and economic benefits of sport, they ignored the ways in which the pursuit of sport divided local governments and perpetuated historic hostility toward African-American residents in each …

Grazing animals in Florida deposit over 20 million metric tons of dung per year, making dung a significant non-point source of pollution (extrapolated from Fincher, 1981). Degradation of this dung occurs naturally, primarily due to a diverse group of beetles (Order Coleoptera) primarily in the families Scarabaeidae and Geotrupidae(hereafter dung beetles). Dung that is not degraded becomes a non-point source of pollutants and may be leached into water bodies. Additionally, dung provides an incubation site for the pests and parasites of both humans and livestock. Human behavior and decision-making depend largely on past experiences that generate specific action patterns (i.e., scripts, Gioia & Manz, 1985) for specific situations. In an ideal world, in which changes in the environment do not conflict with these action patterns, humans would be able to operate consistently, efficiently, and automatically. However, real-world environments are dynamic and fluid, thus altering behavior and forcing changes in scripts. Research suggests that to implement alternate solutions to changing situations, humans select from a "library" of learned scripts. Given the impact that parents' and young children's characteristics have on the potential for child maltreatment, the present study sought to examine how mothers' ratings of their own childhood maltreatment, their psychological symptoms, their regulation abilities (i.e., emotion regulation, reflective functioning, attributions, and coping with young children's negative emotions), and their perceptions of their young children's temperament were related to their narratives of their attachment relationships with their young children and their child maltreatment potential. Exposure therapy is theorized to reduce posttraumatic stress disorder (PTSD) symptomatology by promoting habituation/extinction of fear responses to trauma-related cues. Empirical evidence indicates that emotional memory, including habituation/extinction learning, is enhanced by sleep. However, service members with combat-related PTSD often report disturbed sleep. In this study, quality of sleep and indicators of extinction learning were examined in veterans of recent wars who had completed an exposure-based PTSD intervention. Fifty-five participants were categorized into two groups based on self-reported quality of sleep: low sleep disruption severity (LSDS; N = 29) and high sleep disruption severity (HSDS; N = 26). This thesis examines how participants of an eight-week nutrition education class utilize disseminated information to manage chronic disease, as well as explores the challenges a community based nutrition education resource center faces in the arena of chronic disease prevention. Per the World Health Organization's Global Report on Diabetes, 422 million adults currently live with a diagnosis of type 2 diabetes, a four-fold increase since the 1980s. Within the U.S., approximately nine percent of the adult population suffers from diabetes, and obesity, a major contributor to the disease, afflicts nearly thirty-five percent. The purpose of this qualitative research study was to explore the perceptions of female student services staff members' perceptions of safety on a state college campus. Through the lens of social construction theory, six staff members were interviewed about their views of safety both on and off campus. The goal of this study was to better understand how female staff members formed their perceptions of safety on campus, through social, political and cultural processes. The focus of this research was to gain an understanding of the levels of job satisfaction of full-time faculty members at a for-profit university. There has been a paucity in the study of job satisfaction for faculty working in this sector of higher education (Kinser, 2006). Job satisfaction was measured by using the Job Descriptive Index (Stanton, Sinar, Balzer & Smith, 2002a) within the conceptual framework of faculty job satisfaction developed by Hagedorn (2000). Ammunition is most often comprised of a lead-based priming mixture which contributes to the traditional characteristics of gunshot residue (GSR). Due to the health risks often associated with lead, lead-free primer alternatives are becoming increasingly more popular. Thus, it is becoming more difficult to determine the presence of GSR based on traditional means, i.e. the presence of lead (Pb), barium (Ba), and antimony (Sb). This study examines the implementation and effectiveness of the Seminole County Sheriff's Office Global Positioning System (GPS) when ordered by the court for "no contact" in Domestic Violence cases, specifically Intimate Partner Violence. The research evaluates violations, which occurred while arrestees were assigned to GPS in 2009 and 2013; the programs first year and the most recent with complete data available. The purpose of this evaluative study was to review the implementation of a Webcam Test-Proctoring Program (WTPP) implemented in a Kindergarten through 12th grade public virtual school. Results of the evaluative study will be used to determine if the secure Webcam proctoring method would be a viable solution to a problem of practice—requiring full-time virtual school students to participate in the multitude of required state and Florida school district assessments. Cognitive aging appears inconsistent across cognitive domains, indicating that domains may not all decline at the same rate across individuals. Individual trajectories of cognitive aging can vary widely and are affected by numerous lifestyle and health factors. Alcohol use among older adults is known to confer both health risks, typically related to excessive use, and protective effects, often associated with moderate consumption. Moderate alcohol use has been linked with better cognitive functioning as well as a decrease in cardiovascular mortality and systemic inflammation, as compared to heavy or abstinent users.
