Jersey: Vocabularies Of Coûtume And Code, Steven Pallot

Journal of Civil Law Studies

The Channel Islands were an integral part of the Duchy of Normandy until 1204 when King John lost Continental Normandy to the French King, Philip Augustus. Jersey and Guernsey did not submit to the jurisdiction of the French King but retained allegiance to the King in England as Duke of Normandy. The customary laws of the Islands retain their Norman root to this day in spite of strong legal and cultural influences from England in the 19thand 20Centuries. A rich legal vocabulary in both French and English has evolved in these mixed legal jurisdictions.

Brazil: The Difficult Path Toward Democratization Of Civil Law, Lucas Abreu Barroso, Pablo Malheiros Da Cunha Frota, Brígida Roldi Passamani, Lúcio Moreira Andrade

Journal of Civil Law Studies

The Federal Constitution of 1988 reinstated the democratic rule of law in Brazil. Based on fundamental rights, the “Citizen’s Constitution” shaped the model of a welfare State, which objectives consist in the construction of a free, just and solidary society, the eradication of poverty and substandard living conditions and the promotion of the well-being of all, without prejudice as to origin, race, sex, color, age and any other forms of discrimination. From this context, the constitutional idealization of family democracy emerges, specifically represented in this paper by the recognition of civil union be-tween people of the same sex as family …

Methods: The guideline was created through the following processes: defining the topic and generating clinical questions by using the PICO process, conducting a systematic literature reviewarticle and evidence appraisal, drafting the clinical guideline for Preventing Lower Limb Lymphedema in Patients with Gynecological Cancer (CGP-3L-in-GC), performing two rounds of Delphi consensus, and …

The Other Eighty Percent: Private Investment Funds, International Tax Avoidance, And Tax-Exempt Investors, Omri Marian Dec 2016

The Other Eighty Percent: Private Investment Funds, International Tax Avoidance, And Tax-Exempt Investors, Omri Marian

BYU Law Review

The taxation of private equity managers’ share of funds’ profits—the twenty percent “carried interest”—received much attention in academic literature and popular discourse. Much has been said and written about the fact that fund managers’ profits are taxed at preferred rates. But what about the other eighty percent of funds’ profits? This Article theorizes that the bulk of such profits are never taxed. This is a result of a combination of three factors: First, private equity, venture capital, and hedge funds (collectively, Private Investment Funds, or “PIFs”) are major actors in cross-border investment activity. This enables PIFs to take advantage of …

Contracts And Automation: Exploring The Normativity Of Automation In The Context Of U.S. Contract Law And E.U. Consumer Protection Directives, Daniel Barnhizer Dec 2016

Contracts And Automation: Exploring The Normativity Of Automation In The Context Of U.S. Contract Law And E.U. Consumer Protection Directives, Daniel Barnhizer

Yearbook of Antitrust and Regulatory Studies

Given a choice between two systems of contract rules, a court or legislature may have a normative obligation to adopt the rule that is more susceptible to coding and automation. This paper explores the ramifications of that normative proposition through the lens of multiple contract doctrines that traditionally involve “messy” judgments or multiple interacting judgments regarding which human beings are – arguably – capable of making finely nuanced analyses. Using the common law doctrine of unconscionability and Polish Civil Code Article 385 on unfair terms in consumer contracts, this paper explores the differences between contract rules that require human analysis …

Occupational Skin Cancer And Precancerous Lesions, Fifinela Raissa, Githa Rahmayunita, Sri Linuwih Menaldi, Dewi Soemarko

Journal of General - Procedural Dermatology and Venereology Indonesia

Occupational skin cancer and precancerous lesions are skin disorders caused by exposure to chemical carcinogens such as polycyclic hydrocarbons and arsenic, or radiation, such as ultraviolet light and ionizing light in the workplace. Annual increase in skin cancer incidence is believed to be related to various factors such as frequent intense sunlight exposure (i.e. at work, recreational activities, and sun-tanning habit), ozone depletion, an increase in number of geriatric population, and an increase of public awareness in skin cancer. The most common occupational skin cancers are basal cell carcinoma, squamous cell carcinoma, and melanoma. Examples of occupational precancerous lesion of …

Vaginal Microbiota In Menopause, Martinus Martinus, Larisa Paramitha Wibawa, Evita Halim Effendi, Shannaz Nadia Yusharyahya, Hanny Nilasari, Wresti Indriatmi

Journal of General - Procedural Dermatology and Venereology Indonesia

The human vagina together with its resident, microbiota, comprise a dynamic ecosystem. Normal microbiota is dominated by Lactobacillus species, and pathogen microbiota such as Gardnerella species and Bacteroides species can occur due to decrease in Lactobacillus domination. Lactobacillus plays an essential role in keeping normal vaginal microbiota in balance. Vaginal microbiota adapts to pH change and hormonal value. Changes in the vaginal microbiota over a woman’s lifespan will influence the colonization of pathogenic microbes. They include changes in child, puberty, reproductive state, menopause, and postmenopause. Estrogen levels change will affect the colonization of pathogenic microbium, leading to genitourinary syndrome of …

Journal of General - Procedural Dermatology and Venereology Indonesia

Neural leprosy is characterized by neurological deficit without skin lesions, with a prevalence ranging from 1% to 17.7%. Diagnosis might be difficult and need a multidisciplinary approach. This is a case of axonal type motor and sensory polyradiculoneuropathy of the peripheral facial nerve. A 26-year-old woman was referred from the neurology clinic with facial paralysis, suspected as leprosy. Physical examinations were as follows: no skin lesions, left eye lagophthalmos, thickening of right lateral peroneal and bilateral posterior tibial nerves, sensory impairment, peripheral bilateral facial palsy, and wasting of bilateral distal small muscles of the hands, with normal autonomic function. Consequences Of The New Reimbursement Act For Patients And The Public Payer, Józef Haczyński, Zofia Skrzypczak

internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)

The Act on the Reimbursement of Medicines, Foodstuffs Intended for Particular Nutritional Uses and Medical Devices came into force on 1 January 2012. Its purpose was to transform the Polish medicine reimbursement so that the available public funds corresponded as closely as possible to the current social needs in the supply of refunded products. The consequence of the new reimbursement act – experienced painfully by patients - was a decrease in the share of reimbursement (and thus increase in patients’ contribution) in the value of the purchased medicine on prescription (Rx).

How Burroughs Plays With The Brain, Or Ritornellos As A Means To Produce Déjà-Vu, Antonio José Bonome

CLCWeb: Comparative Literature and Culture

In his article "How Burroughs Plays with the Brain, or Ritornellos as a Means to Produce Déjà-Vu" Antonio José Bonome discusses how the recurrence and significance of one of William S. Burroughs's most potent refrains, "dim jerky faraway," was inspired by its source text, Paul Bowles's second novel Let It Come Down (1952), where Tangiers-Interzone fuels the unwholesome descent of a US-American expatriate not unlike Bowles or Burroughs himself. "Dim jerky faraway" was used by Burroughs during more than two decades in different contexts, and its textual variations have sparked a mélange of colors, sounds, smells, and feelings oscillating in …

Remembering Time, Jonathan Carey

Capstones

My parents were dressed in their Sunday best, heading to a church revival. I was 12 and still the baby of the family, so staying home alone was out of the question. My grandmother Lillian, who preferred to be called Nana, came to babysit me. She relished a little time away from the doldrums and senior citizen gossip that engulfed the high-rise building where she lived, five minutes from my house in Petersburg, Virginia. That evening, as the sounds of “The Young and the Restless” echoed through the house, I tiptoed downstairs to give Nana a playful scare.

Determinants Of Integrated Soil Fertility Management Technologies Adoption By Smallholder Farmers In The Chinyanja Triangle Of Southern Africa, Powell Mponela, Lulseged Tamene, Gift Ndengu, Ruth Magreta, Job Kihara, Nelson Mango

All Peer-Reviewed Publications

Integrated Soil Fertility Management (ISFM) technologies have proven to be viable options for improving land productivity and increasing yield. However, adoption of the set of complementary technologies that are required in ISFM is quite variable and studies tend to focus on single technologies. In this study we used cluster analysis to group technologies and ordered probit to determine the probability of multiple technology adoption. The result show that usage of ISFM in the Chinyanja Triangle (Southern Africa) is grouped into 3 technological sets based on complementarities. The set of nutrient dense technologies of inorganic fertiliser, compost and animal manure (ISFMset3) …

Comparison Of Clinical And Electromyographic Characteristics Between Surgery-Related And Tumor-Related Unilateral Vocal Fold Paralysis, Chenglun Chen, Wanni Lin, Shuchun Huang, Alice M. K. Wong, Tuanjen Fang, Yucheng Pei

Rehabilitation Practice and Science

Background: The etiologies of unilateral vocal fold paralysis (UVFP) could be highly varied. It could be idiopathic or related to surgery, infection, radiation, and tumor. Among these causes of UVFP, surgery-related and idiopathic UVFP were the most well studied. However, the clinical characteristics of tumor-related UVFP have been discussed in only a few studies. Therefore, we evaluated the clinical and electromyographic characteristics of tumor-related UVFP and compared them with those of surgery-related UVFP. Methods: Laryngeal electromyography (LEMG) was performed in the thyroarytenoid-lateral cricoarytenoid muscle complexes and the cricothyroid muscles. The Short Form-36 quality-of-life questionnaire (SF-36) was applied to evaluate the …

Rehabilitation Practice and Science

Purpose: Osteoarthritis (OA) is the most common musculoskeletal disease worldwide. Knee OA is the most common type of OA and is the main cause of disability in elderly people. Intra-articular (IA) injection of hyaluronic acid (HA) has been widely proven to improve pain, physical function, and quality of life among patients with knee OA. However, most of the previous studies have used low-to-moderate molecular weight (MW) HA and have evaluated the clinical benefits by using subjective self-reported measures. In this study, we evaluated the efficacy of a single IA injection of a novel cross-linked HA (HYAJOINT Plus) through objective ultrasonographic …

Cervical Disc Herniation With Myelopathy Following Cervical Tuina Manipulation, Valeria Jia-Yi Chiu, Shu-Yuan Chou, Yu-Ting Hsieh, Yi-Shiung Horng

Rehabilitation Practice and Science

Complications following cervical manipulation can be classified as cerebrovascular or noncerebrovascular complications. The former complications occur more frequently, and they are usually due to vertebral artery occlusion, damage or thrombus formation. The latter include spinal cord or nerve root injuries and have seldom been reported. Herniation of the cervical disc with myelopathy following manipulation is rare. However, we have encountered two patients who developed cervical disc herniation with myelopathy secondary to cervical tuina manipulation for nuchalgia at the bone setting facilities. One of the patients suffered from shooting pain during manipulation and developed tetraparesis two days later. An MRI examination …
