Extracurricular International Criminal Law, Mark A. Drumbl Jan 2016

Extracurricular International Criminal Law, Mark A. Drumbl

Scholarly Articles

This article unpacks the jurisprudential footprints of international criminal courts and tribunals in domestic civil litigation in the United States conducted under the Alien Tort Statute (ats). The ats allows victims of human rights abuses to file tort-based lawsuits for violations of the laws of nations. While diverse, citations to international cases and materials in ats adjudication cluster around three areas: (1) aiding and abetting as a mode of liability; (2) substantive legal elements of genocide and crimes against humanity; and (3) the availability of corporate liability. The limited capacity of international criminal courts and tribunals portends that domestic tort …

The Shibboleth Of Discretion: The Discretion, Identity, And Persecution Paradigm In American And Australian Lgbt Asylum Claims, Heather Kolinsky Jan 2016

The Shibboleth Of Discretion: The Discretion, Identity, And Persecution Paradigm In American And Australian Lgbt Asylum Claims, Heather Kolinsky

Scholarly Articles

While the High Court in Australia has made it clear that discretion is not to be considered when determining if an applicant may avoid persecution upon returning home, there are concerns that discretion persists in the decision-making process with respect to discrediting identity claims. In addition, the Supreme Court of the United Kingdom handed down a retooled formulation of discretion, which once again created subcategories of applicants and suggested discretion is an appropriate consideration so long as it is not exercised out of a fear of persecution. This discussion will focus on a comparison of the evolution of LGBT asylum …

Truthiness And The Marble Palace, Chad M. Oldfather, Todd C. Peppers Jan 2016

Truthiness And The Marble Palace, Chad M. Oldfather, Todd C. Peppers

Scholarly Articles

Tucked inside the title page of David Lat’s Supreme Ambitions, just after a note giving credit for the cover design and before the copyright notice, sits a standard disclaimer of the sort that appears in all novels: “This is a work of fiction. Names, characters, places, and events either are the products of the author’s imagination or are used fictitiously. Any resemblance to actual persons, living or dead, events or locales is entirely coincidental.” These may be the most truly fictional words in the entire book. Its judicial characters are recognizable as versions of real judges, including, among others, …

A Comment On “Measuring Economic Freedom: A Comparison Of Two Major Sources”, Ryan Murphy Jan 2016

A Comment On “Measuring Economic Freedom: A Comparison Of Two Major Sources”, Ryan Murphy

Bridwell Institute for Economic Freedom Research

Do social scientists have the tools to measure the effects of free economic institutions? Ram (2014) raises concerns regarding the reliability of the two major sources that measure economic freedom. This comment shows that there is little reason to be any more alarmed about our ability to measure economic freedom than about our ability to measure other aspects of institutional quality, such as democracy.

The Origin And Development Of Tigrinya Language Publications (1886 - 1991) Volume One, Abraham Negash

Staff publications, research, and presentations

Tigrinya is a Semitic language spoken in Eritrea and in the Tigray Region of Northern Ethiopia. Tigrinya is one of the nine languages in Eritrea. It was one of Eritrea's official languages (along with Arabic) during the short-lived federation with Ethiopia (1952-1962). When Ethiopia officially annexed Eritrea in 1962, Amharic also formally replaced Tigrinya and Arabic; and was established as an official language by the imperial government of Ethiopia. In 1993, when Eritrea officially declared its independence through referendum. Tigrinya regained its status as a working language.

Tigrinya has its own alphabet of 32 letters adopted from Ge'ez, a language …

Social Media In The Sexual Lives Of African American And Latino Youth: Challenges And Opportunities In The Digital Neighborhood, Robin Stevens, Jamie Dunaev, Ellen Malven, Amy Bleakley, Shawnika J. Hull Jan 2016

Social Media In The Sexual Lives Of African American And Latino Youth: Challenges And Opportunities In The Digital Neighborhood, Robin Stevens, Jamie Dunaev, Ellen Malven, Amy Bleakley, Shawnika J. Hull

Prevention and Community Health Faculty Publications

There has been significant interest in the role of social media in the lives of adolescents, particularly as it relates to sexual risk. Researchers have focused on understanding usage behaviors, quantifying effects of social media exposure and activity, and using social media to intervene. Much of this work has focused on college students and non-minority youth. In this paper, we examine the growing body of literature around social media use among US minority youth and its intersection with sexual risk behavior. We introduce the concept of the “digital neighborhood” and examine the intersection of social media and sexual health in …

Monograph Selections from the Archives

Nicholas Tillinghast (1804-1856) was the founding principal of the State Normal School at Bridgewater, Massachusetts. While his accomplishments as an educator and administrator are well-known, his earlier U.S. Army career is less-well documented. This article examines both Tillinghast’s experiences at West Point as a student and instructor and his career as an Army officer serving at Fort Gibson in the Indian Territory.

The Global Agriculture And Food Security Program: An Evaluation Of The Public Private Partnership In Malawi, Madhavi Venkatesan Jan 2016

The Global Agriculture And Food Security Program: An Evaluation Of The Public Private Partnership In Malawi, Madhavi Venkatesan

Economics Faculty Publications

Chronic food security issues in Africa have recently spurred an increase in public–private partnerships (PPPs), as governments across the continent look to stimulate agricultural productivity. Through multiple international channels, PPPs are implementing various programs within the agricultural sector as a means to promote both nutrition and food security. However, there are some constraints that may impede the success of PPP in the near-term such as inadequate legal and regulatory framework for PPPs; lack of technical skills to manage PPP programs and projects; unfavorable investor perception of country risk, small market size, limited infrastructure and limited financial markets. Additionally, the success …

The Interactive Role Of Emotional Intelligence, Attachment Style, And Resilience In The Prediction Of Time Perception In Doctoral Students, Pat J. Precin Jan 2016

The Interactive Role Of Emotional Intelligence, Attachment Style, And Resilience In The Prediction Of Time Perception In Doctoral Students, Pat J. Precin

The School of Health Sciences Publications and Research

The perception of time (the use of temporal categories to conceptualize experiences) affects human behavior. Students’ time perspective predicts academic outcomes: those with future orientations tend to have better academic outcomes than those with past or present, according to Zimbardo and Boyd’s psychology of time model, and may contribute to the 80% attrition rate of emergent online distance learning programs. However, their model is limited because of the exclusion of certain variables that may influence the development and maintenance of time perspective. Zimbardo and Boyd’s model claims that time perspective continually develops and changes but does not explain which variables …

Petrogenesis And Provenance Of Distal Volcanic Tuffs From The Permian–Triassic Karoo Basin, South Africa: A Window Into A Dissected Magmatic Province, Matthew P. Mckay, Matthew A. Coble, Angela M. Hessler, Amy L. Weislogel, Andrea Fildani Jan 2016

Weislogel, Andrea Fildani

College of Natural and Applied Sciences

We present zircon rare earth element (REE) compositions integrated with U-Pb ages of zircon and whole-rock geochemistry from 29 volcanic tuffs preserved in the Karoo Supergroup, South Africa, to investigate the history of magmatism in southern Gondwana. Whole-rock compositions suggest a subduction-driven magmatic arc source for early (before 270 Ma) to middle Permian (270-260 Ma) Karoo tuffs. After ca. 265 Ma, the magmatic source of the volcanic deposits transitioned toward intraplate shallow-sourced magmatism. Zircon U-Pb ages and REE chemistry suggest that early to middle Permian magmas were oxidizing, U- and heavy (H) REE-enriched, melts; middle Permian to Triassic zircons record …

Increasing Middle School Students' Energy Literacy, Justin St. Onge, Karla Eitel

Research in Outdoor Education

The aim of this research was to examine the effectiveness of outdoor education on middle school students' energy literacy. An energy literacy curriculum was developed and taught in both outdoor and traditional, indoor classroom settings. Energy literacy constructs of knowledge, attitude, and behavior were evaluated and measured using a survey distributed pre, post, and 1–month after the curriculum was taught. The population (n=130) of this study was 6th grade students attending a five-day residential education program at an outdoor science school. Results showed greater increases in middle school students' energy literacy knowledge, attitude, and behavior when taught in …

Reaching The Water's Edge: Assessing Riverfront Accessibility In The Quad Cities Area, Lorraine Stamberger Jan 2016

Reaching The Water's Edge: Assessing Riverfront Accessibility In The Quad Cities Area, Lorraine Stamberger

Geography: Student Scholarship & Creative Works

In river towns across the United States, a slow transformation is taking place as aging and abandoned industrial infrastructure is being replaced by new riverfront uses. Consequently, the urban American riverfront has become a battleground, with municipalities, developers, and large corporations fighting over this contested land. Although riverfronts offer a wealth of benefits for the public such as therapeutic river views and abundant recreational opportunities, studies have shown that public interests and access are often overlooked in the waterfront development process. The purpose of this research is to understand the level of access people in the Quad Cities community have …

Improving African Internet Traffic Through Maximization Of Node Centrality, Gloire Rubambiza Jan 2016

Improving African Internet Traffic Through Maximization Of Node Centrality, Gloire Rubambiza

McNair Scholars Journal

For most African nations, the cost of an Internet subscription is more than the average yearly per capita income – which inherently makes Internet access a quixotic amenity for the majority of Africans. This disproportionate connectivity creates a disadvantage for Africa’s academic potential because most of its Internet traffic is routed through international fiber optic links – which is costlier than direct connections within Africa [1]. One of the causes for slower Internet traffic is the lack of cooperation between the Internet Service Providers (ISPs) across Africa. This study will explore whether we can increase the average closeness of a …

The Gasoline Tree, Brianne Manning Jan 2016

The Gasoline Tree, Brianne Manning

Electronic Theses and Dissertations

In exploration of Millennial anxieties and the power of dreaming, The Gasoline Tree imagines a soundtrack for the revelations, defeats, and curiosities of leaving childhood behind. This is a collection of 40 poems that examines eating disorders, gender roles, physical abuse, sex, infidelity, loneliness, and the fear of losing one's parents. This collection also contemplates the brutalities and muted delights of what drives us all: love, in all of its forms. "The Gasoline Tree," "Wolf of Chocorua," and many other poems construct New England landscapes that pay homage to the pastoral uniqueness of Maxine Kumin and Galway Kinnell, while poems …

Geomechanical Response Of Overburden Caused By Co2 Injection Into A Depleted Oil Reservoir, Hema J. Siriwardane, Raj K. Gondle, Sai B. Varre, Grant S. Bromhal, Thomas H. Wilson

Faculty & Staff Scholarship

This study investigates the hydro-mechanical aspects of carbon dioxide (CO2) injection into a depleted oil reservoir through the use of coupled multiphase fluid flow and geomechanical modeling. Both single-phase and multiphase fluid flow analyses coupled with geomechanics were carried out at the West Pearl Queen depleted oil reservoir site, and modeling results were compared with available measured data. The site geology and the material properties determined on the basis of available geophysical data were used in the analyses. Modeling results from the coupled multiphase fluid flow and geomechanical analyses show that computed fluid pressures match well with available measured data. …
